Dear Sirs: This letter is to make clear this department's requirements for the swimming pool construction at the above address. 1. As indicated, two (2) skimmers approved by the National Sanitation Foundation will be provided. 2. As indicated, two (2) inlets of approved design for fresh and/or repurified water will be provided. 3. As indicated, a main drain of approved construction will be provided. 4. The filter and pump shall be approved by the N.S.F. and be of sufficient capacity to provide a minimum turnover of at least two (2) times in 24 hours. This department recommends a turnover rate of 6 - 8 hours. 5. A deck of at least three (3) feet wide, measured from the pool waters edge, shall be provided which extends completely around all private residential pools. Above ground private residential pools may be provided with decking of a minimum size of 4 feet by 4 feet at pool entry points and provided that such. decking has the approval of the City. 6. The diving area will be acceptable provided there is no overhead obstruction. 7. Fencing or other effective means including but not limited to walls or buildings, acceptable to the City, shall be provided to positively control all access to public and private residential swimming pools. Fencing shall meet the following criteria: (a). The fencing shall prevent the entrance of children and be without hand or foot holds that would enable a person to climb over it. (b) The fencing shall be at least 6 feet high and entrances shall be equipped with self-closing and self -latching gates capable of being locked. (c) Self-closing and self -latching devices shall be placed at the top of the gate or otherwise inaccessible to small children. (d) The opening between the bottom of the fence and the ground or other surface shall be not more than four inches. 8. An automatic chlorinator should be provided with a suitable test kit. 9. All overhead electrical lines must be a minimum of 10 feet horizontally from the pool surface, and 18 feet straight line distance from the waters edge. An alternative is to bury said lines. 11. The pool fill spout must be protected by a vacuum breaker or air -gapped. 12. Suitable safety equipment to include but not limited to a ring buoy and rope that is 1� times the pool diameter, and shepherds crook pole must be provided and maintained with the pool at all times. Furthermore, these and any other requirements must meet the provisions of the Fridley City Code, Section 115, Swimming'Pools. Flora, Public Works Director DATE: November 1, 1994 SUBJECT: Back Yard Flooding I met with the Schwartz's on Monday, October 31, 1994, regarding the flooding of their property at 1372 64th Avenue and their neighbor Dahlberg at 1384 64th Avenue. I attempted to explain to them the survey and contours that we have prepared for the back of their yards and the adjoining property to the south. I indicated that there was a high ridge on the property to the south which precluded water flowing from their property to the Harris Pond ditch or vice versa. I also indicated the depressions on their property which resulted in holding water from major rain events. They continued to disagree with the information we had available, indicating that the diversion of the storm water in the 64th Avenue storm sewer project caused increased flooding of their property. They completely disregarded the saturated ground conditions from last year and the heavy rains this spring as the cause for water on their property. They maintain that the contour information is not valid and that there are various depressions in the area which caused the water to backflow into their property. I attempted to explain that prior to any water backflowing into their property, the pond that we constructed would have to become flooded for the water to raise high enough to enter their property. At first they indicated that the pond did not flood but then indicated that the pond did flood for a very short time which caused the backup. They left the meeting consistent with their original beliefs and requested we provide them a copy of the contour information that we had prepared. This we will do. JGF:cz FACT SHEET 64TH AVENUE STORM SEWER MARK SCHWARTZ, 1372 64TH AVENUE September 13, 1993 - City Council Meeting: 9 Mr. Schwartz stated that the Rice Creek School area detention ponds do not work. Since the ditch has been filled on the south side of 64th Avenue, water has been backing up onto his property. Mr. Schwartz stated, while showing a video of floods in 1993, that water has been backing up onto his property since 1991. Summer, 1993 - Flooding Occurred: Flooding occurred in most areas of Minnesota and throughout the Midwest during the summer of 1993 (see WaterTalk issue, Summer, 1993). Fall, 1993 - Climate Update - Department of Natural Resources: Warning issued at this time of high soil moisture in Minnesota with possible flooding potential for spring of 1994 (see WaterTalk issue, Fall, 1993). April 24, 1994 - Local Flooding: Over three inches of rain fell between April 24, 1994 and April 26, 1994. Over one inch of rain fell on April 24. Also, 7.7 inches of snow fell on April 28 and 29 (Ramsey Soil and Water Conservation District, Ken Ackerman). October 17, 1994 - City Council Meeting: Mr. Schwartz stated that the water backed up into his yard on April 24 and into May, 1994. He showed a video taken in April and May of 1994 of the water in his back property. October 24, 1994 - Survey: SuGy and development of contour lines on the Schwartz (1372) and Dahlberg (1384) properties indicate their rear yards are in a designated wetland and they have depressions in the yards which cannot drain. 13 s The 64th Avenue Storm Water Project No. 260 involved the placement of concrete curb and gutter, street alignment and catch basins. The purpose for this project was to correct the flooding that was occurring in the front yards of 64th Avenue. The residents at 1372 and 1384 64th have raised the issue of storm water accumulation in their backyards. A contour survey of their properties was made. The land is within an identified wetland area and has depressions that do not have any outlets. In the 64th Avenue project, we also constructed a detention area south of the Harris Pond ditch. This detention pond was constructed below the north ditch embankment and is to serve as an overflow detention area. The petitioners claim the pond overflowed and contributed to the flooding on their property. During April, 1994, we experienced rainfall in excess of 7.7 inches. 4.25 inches alone fell on the 24, 25 and 26 of April. Staff inspected the pond during this period and found that the pond had not been flooded. It appears that the petitioners claim is not material to the improvement project completed as it deals with the front yard area of the properties. The torrential rains that Impacted nearly all of the Midwest left many locations In Minnesota with precipitation totals exceeding 200 percent of the mean, the equivalent of two summers worth of rain. Figure 1 shows that roughly one half of Minnesota ranked at, or above, the 99th percentile for May through August rainfall. A value above the 99th percentile means that those locations broke, or nearly broke, all-tlme May through August rainfall records. Four month totals exceeded 28 Inches over much of southern Minnesota, the normal annual rainfall for many of those areas. Record breaking rainfall over such a broad area for such an extended period of time Is unprecedented In Minnesota's 100 -year climate record. The same atmospheric conditions that led to the heavy rains also led to extraordinarily low evaporation rates. Cloudy and cool weather, In tandem with persistently high relative humidity, combined to dramatically reduce the atmosphere's ability to evaporate water from the surface. For the first time since such records have been kept, precipitation totals exceeded pan evaporation values for the May through August period. The lack of evaporation exaggerated an already serious hydrologic Imbalance. The most significant rainfall event of the late summer occurred on August 15th and 16th along a line that stretched from near New Ulm to south of Austin (flgure 2). A multi -county area received more than four Inches of precipitation in this storm. Eight Inches of rain or more fell In southern Freeborn and Mower counties. Falling upon already saturated ground, this storm caused wide -spread soil erosion and rural flooding, as well as serious urban flooding In Austin and elsewhere. Fortunately, the rain slackened In the late summer and early fall. However, this dry weather was not accompanied by the warm temperatures needed to adequately dry crops and soils. September was one of ftothe coolest on record, and with some exceptions, October was also quite cool. At this time, soil moisture levels are very high for nearly all of Minnesota. As the soil freezes, the soli moisture status will remain generally unchanged through the winter season. Wetlands, lakes, rivers and streams are also at unusually high levels for this time of year. While it is too early to sound the alarm, It Is Important to recognize that the potential for significant spring flooding In 1994 does exist. A value of 90 moans that greater amounts would only be expected one out of ton years. New St. Cloud Bridge to be Env�-onmentally Compatible By Dale Homuth and C.B. Bylander When contractors begin building a new $ 10 million bridge over the Mississippi at St. Cloud they will follow a blueprint that protects herons, geese, fish and an archaeological site that was Inhabited 6,000 years before the birth of Christ. The bridge project is a federal demonstration project for which MnDOT will receive 80% federal funding. The new bridge has been on MnDOT's back burner for years. in fact, land for the bridge crossing was purchased in the year Alaska became .a state - 19591 State Highway 15 bridge construction began this fall and should be open for traffic by late 1995 or early 1996. The bridge Wil be built between the north side of St. Cloud and Sauk Rapids. It will be a boon for residents of the St. Cloud area and north -south travelers through the area. And, it won't be a bust for natural resources. That's because: • Construction noise will be limited during the great blue heron nesting season; • Dredging, dewatering, and other activities that send silt down the river will be prohibited during fish spawning periods; • Tree cutting will be limited to the actual con- struction area; and • A sensitive archaeological site will be covered with filter fabric and overlaid with fill to preserve it for future analysis. The bridge will span a 1200 -foot section of the Mississippi, crossing the south end of a large island. The north end of the Island is home to an active great blue heron rookery and is a nesting area for area Canadian geese. The river is fast flowing at the site, has many large boulders, and Is considered prime habitat for smallmouth bass and walleyed pike. The crossing site is just upstream of the water intake for the City of St. Cloud, which is the only water source for some 50,000 people in the area. The banks of the river at the site were used by prehistoric people as living sites. Archeologists have so far found evidence of human habitation at the site as old as 8100 years. The DNR permit for the project stipulates specific conditions to ensure that negative Impacts to the environment would be very small or none at all. He stated that with the tremendous amount of land in rural Anoka County, there are more attractive sites available to developers than sites in Fridley. He stated that if the City wants to maintain its tax base, there has to be some investment in the community. He stated that funds have been invested to rehabilitate the housing. 'In order to attract people to live in Fridley, there also needs to be jobs. He felt that industrial property provides the greatest return on the City's investment. No other persons in the audience spoke regarding this proposed amendment to the redevelopment project area and creation of Tax Increment District No. 13. MOTION by Councilman Billings to close the public hearing. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing closed at 8:34 p.m. 2. PUBLIC HEARING ON THE 64TH AVENUE STORM WATER PROJECT-- SMO. -260: MOTION by Councilman Schneider to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously, and the public hearing opened at 8:35 p.m. Mr. Flora, Public Works Director, stated that the City -received a petition for this storm water project which contained 21 signatures. He stated that since the petition was received, Mrs. Zimmerman, 1376 Mississippi Street, has requested that her name be withdrawn. He stated, therefore, the petition now only represents 49 percent of the properties involved. Mr. Flora stated that there are several options for this project. He stated that one option is to install a pipe from Mississippi Street to the Central Avenue culvert with a detention pond by Mississippi Street. He stated that another option is to install pipe from Mississippi Street to Central Avenue and construct a surge area in the Harris Pond ditch. Mr. Flora stated that the estimated cost is approximately $94,000. If there was a small surge area in the Harris Pond ditch, it is estimated it would cost an additional $7,000. He stated that $41,000 would be paid by the affected property owners, and $60,000 would come from government funds. Mr. Flora stated that if this project was constructed, the City could amend their contract with Kenko, Inc. to incorporate the catch basins on 64th Avenue and the storm water pipe on Central FRIDLEY CITY COUNCIL MEETING OF SEPTEMBER 13, 1993 PAGE 8 Avenue. He stated that the additional culvert down from Mississippi Street, and the surge area could be constructed at a later date. Mr. Flora stated that mailings of this hearing were not sent to the residents in the neighborhood. In order to make sure everyone is notified, he suggested that this public hearing be continued to September 27. - Councilman Schneider asked about the options for the Council to proceed with this project if fifty percent or more of the affected property owners did not sign the petition. Mr. Herrick, City Attorney, stated that under Chapter 429 of the code, if the Council receives a petition where less than fifty percent of the affected property owners have signed, it takes a four-fifths vote of the Council to order a project. He stated that if there is a petition signed by more than fifty percent of the affected property owners, it takes a majority vote of the Council to order a project. Mr. Schwartz, 1372 64th Avenue, stated that he was not aware of any plan to widen the ditch located on the City property, but it may help the drainage. He presented a video of the culvert under Central Avenue showing how the ditch backs up with a one -inch rainfall. He stated that there are supposedly six detention ponds in the Rice Creek development that release water from that area onto his property. He stated that the detention ponds do not work. Since the ditch has been filled on the south side of 64th Avenue, water has beenbacking_uQ_onto his property. He stated that if something is done he is concerned that it be the right approach and not just moving water from one place to another. Mr. Schwartz stated that another concern is the cost of the project. He felt that much of the water comes from other developments, such as the one north of Mississippi Street. All of that water is dumped between 64th Avenue and Mississippi Street. He felt that the water from the Harris Pond development should have been pumped north to the creek. He requested that the City use monies from the storm water fund for this project. Councilman Schneider asked Mr. Schwartz how much he has paid for storm water control. Mr. Schwartz stated that he has not paid anything. Councilman Schneider stated that most residents in the City have contributed to the storm water fund. He stated that everyone should be paying their fair share for storm water control. He stated that some of Mr. Schwartz's problems may come from development around his property, as that is the case for almost every property in the City. Councilwoman Jorgenson stated that part of Mr. Schwartz's concern was that the water would_ end up in his back yard Mr. Flora came up with the idea of a detention pond to try to alleviate the problem. She stated that Council is trying to address Mr. Schwartz's concerns on this issue. Councilman Schneider asked Mr. Schwartz's view of the project with this change. Mr. Schwartz felt that it would probably work. Mayor Nee asked Mr. Schwartz if he signed the petition for this improvement project. Mr. Schwartz stated that he did not sign the petition. Mr. Schwartz stated that a lot of people in the neighborhood believe there is a problem, but they have a hard time believing they are part of the problem. He submitted a petition requesting the Council not assess the properties but instead use monies from the storm water fund for this project. In reviewing the petition, it was noted that this petition contained wording that five persons who signed the original petition in favor of this improvement requested their names to be withdrawn. Mr. Schwartz stated that this was not the intent of his petition. Mr. Nelson, 1357 64th Avenue, stated that he would encourage Council to delay a vote on this project until the next Council meeting. He stated that he never wanted to misrepresent himself or the statements made when he circulated the original petition for this improvement. He stated that because a letter had not been sent regarding the public hearing, he would appreciate if the residents would be notified. He stated that he would be willing to circulate the petition again to try and obtain additional signatures. Councilwoman Jorgenson stated that there are property owners who signed Mr. Schwartz's petition and also Mr. Nelson's petition. Mr. Herrick, City Attorney, stated that it seems five persons want their name taken off the petition, and Mr. Schwartz has stated that was not the intent. He felt that it would be helpful to the City if some of this ambiguity could be cleared up between now and the FRIDLEY CITY COUNCIL MEETING OF SEPTEMBER,13, 1993 PAGE to next Council meeting. He stated that if someone signs a petition and then asks that their name be removed, this could be done before the Council takes action. Mr. Nelson stated that he was disappointed with Mr. SchwartzIs petition, as it took individuals twenty to thirty hours to obtain the signatures on the original petition. He stated that he could obtain the signatures again, but an easier solution would be for Mr. Schwartz to withdraw his petition. Mr. Herrick stated that a clarification is needed from the five property owners who signed Mr. Schwartz's petition. Mrs. Schwartz, 1372 64th Avenue, stated that there were some errors in the original petition and that some homes that would be assessed were left off. Mrs. Schwartz asked about the detention pond and if trees would be removed. Mr. Flora stated that some trees would be removed to obtain an area where a volume of water can be stored. He felt that the best location for the detention pond would be where the depression exists and where it could be reshaped. Mrs. Schwartz stated that unless this area is dug out, it would not solve any of the water problems. Mr. Flora stated that it is proposed to widen the ditch from 6 feet to 50 feet and increase the length by hundreds of feet in order to obtain storage capacity. Mrs. Schwartz asked how much would actually be dug out, as this would definitely sway how she would feel about the project. She stated that just clearing out what is there now would not do anything. She stated that there has to be more holding capacity. Just clearing out the trees would not accomplish this end. Mr. Flora stated that until they survey it, he does not know how much would be dug out. Mrs. Schwartz asked what would happen if the project was done and it does not work. She stated that she would not want to be assessed again for fixing it. Mayor Nee stated that for the most part, if there is a mistake made by the City on the projects the City has completed, they would try to fix it. Mrs. Schwartz felt that the Rice Creek and Harris Pond developments created part of this 'problem. She felt that other properties should also be assessed. FRI_DLEY CITY COUNCIL MEETING OF SEPTEMBER 13, 1993 _PAGE 11 Councilman Schneider stated that these properties in the Rice Creek and Harris Pond developments have been assessed. It comes back to the question if they would be assessed again if something does not work. Mrs. Schwartz felt that the whole thing was piecemeal. Only one small section is being considered, and that will impact another area. Councilman Schneider stated that storm water issues are very difficult to address, and no one wants to pay. He stated that there have been water problems in this area for many years. He stated that Mr. Nelson did a tremendous job in the neighborhood trying to get this problem resolved. Mrs. Schwartz stated that their problem is not from rain water on 64th Avenue but with water coming from the north and Harris Pond area. She felt that this had to be a fair project for everyone so it does not flood more people on the south side of 64th Avenue. Councilwoman Jorgenson stated that the City cannot give final design standards at this point. She stated that Council is trying to address the issues, and the detention pond is a new proposal. She stated that the City would not hire an engineering firm to go look at the project without first knowing if they have a project. Councilman Schneider stated that the intent of having such a project is to make it work. He stated that if it does not work, the City would have to go back and fix it. Ms. Kowski, 6391 Central Avenue, stated that she spent several hours working on the original petition for this improvement. She stated that there are property owners who stated that this did not affect them, but that is what is wrong with this world. She stated that *she has to replace a furnace because of the water problems. She felt that everyone in the City should be assessed for storm water control because this project is needed. Mr. Schwartz, 1372 64th Avenue, stated that he wished to withdraw his petition because certain wording contained in the petition has changed the intent. He stated that the intent of the petition was for the project to be paid out of the storm water fund. MOTION by Councilman Schneider to return the petition as requested by the submitter, Mr. Schwartz. Seconded by Councilwoman Jorgenson. Upon a voice vote, Councilman Schneider, Councilwoman Jorgenson and Mayor Nee voted in favor of the motion. Councilman Billings voted against the motion. Mayor Nee declared the motion carried. Councilman Billings stated that there are a number of other signatures on that petition, not only the person who submitted it. This is his reason for not supporting the motion. Councilman Billings asked if some of the properties on the south side of 64th Avenue have standing water hours or days after a rainfall. Mr. Flora stated that some of the properties do have standing water. Councilman Billings asked if this was due to the fact that those properties are below the elevation of the ditch. Mr. Flora stated that it is due to the high water table, and that there is a raised culvert under Central Avenue so the drainage is not the best. He stated that there is also a wetland in that area. Councilman Billings stated that this project would not insure that every one of those properties on 64th Avenue would be dry. Mr. Flora stated that was correct; however, the water north of Mississippi Street would no longer run across the properties. He stated that the detention pond deals with the back yards and gives a "bounce" area so that the water can go through the pipe under Central Avenue. He stated that there. would be water on the property in the low areas. Answer 1: In my opinion, no. While the added burden olaced on the culvert under Old Central by the 64th Avenue Stcrm Water Project certainly would cause the water in the ditch = stream from that culvert to be higher than it otherwise would have been, it would not be high enough to make the rear yards any wetter than they would be from the trapped pockets on those properties that would be f _lied by rain fall in any significant storm event. Question 2: Mr. Schwartz contends that the project contributed to congestion in the ditch that flows south of his property and eventually into Moore Lake. To what extent did the project contribute to congestion in that ditch and is the concesticn or potential for additional overflow of the ditch harmful tc either the Schwartz or Dahlberg properties ? Answer 2: From past topographic maps of the area and current maps, it appears that filling has occurred in the ditch area. The 64th Avenue Storm Water Project removed some, but not all c- that fill and contributed more water to the ditch via a neer pipe discharging there. While it is reasonable to assume that the water in -he ditch reaches higher levels as a result of the project, it. does ^ot appear that there is any negative effect on these properties tra- are a_ready wet due to rainfall being trapped by the topography on these sites during any significant rainfall event. Question 3: To what extent did the various elements of the project benefit the Schwartz and Dahlberg properties ? Is there $1,,000 worth of benefits to these properties from any of the projects elements ? As I see it there are three major components to the project: A. The largest component of the project is a drainage system that extends from Mississippi Street south to 64th Avenue and then south from 64th Avenue in a large storm water conduit and eventually empties into the Rice Creek ditch. B. The second component of the project is the curb and gutter work and catch basin work that was done on 64th Avenue. C. The third component of the project is a detention area approximately one acre in size that was carved out north of the Rice Creek d4rt-ch along Rice Creek r""ft! To what extent do you believe that each of these elements contributed to the Schwartz or Dahlberg properties ? Answer 3: I should point out that the concept of "benefit" as it relates to assessments is a complex legal issue and that I am not an attorney or legal expert by any means. Subject to review by your legal counsel, I attempt the following answer: There are some services rendered by a municipality to its citizens that are appropriately paid for from general tax revenues such as fire and police protection. There are other services that, because they benefit a very specific part of the city, could not be fairly paid for with general funds. For example, if an older part of the city experienced flooding problems because an adequate storm sewer system had never been installed in their neighborhood and if the properties in that older neighborhood had never paid for an adequate storm sewer system and if a new storm sewer system were installed to remedy these flooding problems, then it would not be fair to assess the entire city, including home buyers in new subdivisions, who had been required to pay, as part of the price of their new homes, for a storm sewer system that completely met all of their storm sewer needs and obligations. Such projects are often assessed, based on a drainage area that flows to a common collection point. It is not uncommon that owners in the higher parts of the drainage area complain that there is no benefit to them from the project since they do not have flooding or erosion problems and that the people in the lower parts of the drainage area should pay for the project because they are the ones who are suffering problems. It is true however that the development of all of the properties in the drainage area contribute to the problem whether or not they are directly affected by it. When a house and driveway is placed on an undeveloped lot, the amount of water soaking into the ground is reduced and the amount of water flowing onto downstream neighbors increases. It is my understanding that all properties in the drainage area must contribute to the cost of a system built to solve the problem they have helped create, whether or not they have a direct drainage problem that needs solving. All elements of this project are part of a system designed to solve drainage problems in the drainage area in which the Schwartz and Dahlberg properties are located. Water is conveyed from the front of the Schwartz and Dahlberg properties by the curb and gutter on 64th to catch basins at a low point on 64th and then enters the storm sewer main which dumps into the ditch. The upper parts of the system do not carry water from these properties but this argument could be made by any except the very highest neighbor in the area. The retention area created by the project did provide some measure of protection against very severe storm events. In view of the low percentage of the cost of the entire project that was actually assessed, it seems that these properties were benefited at least $1000 each. Question 4: Did the elevations you shot for the detention pond and the Schwartz and Dahlberg properties corroborate the elevations that were previously defined by the City's consultant, MSA (Maier Stewart & Associates) ? Answer 4: With very minor and insignificant differences, our results are the same as MSA's results. Question 5: In your opinion, could the detention pond along Rice Creek Road have overflowed on to the Schwartz property as a result of the rainfall that occurred on or about April 24, 1994. Answer 5: While I don't have enough information to conclusively rule that over flow out, it seems quite unlikely to me. Further, the low pot hole areas on the property would have been full of water from the rain that fell on that date whether or not such flooding occurred, so it is difficult to see how any adverse impact on the property could have occurred from such overflowing, whether or not it occurred.
