Dear Bill:
I received your fax and here are some answers for ycur.ouescions:
Question 1: Did the 64th Avenue Storm Water =roj-ct Harm, the Schwartz
of Dahlberg properties ?
Answer 1: In my opinion, no. While the added burden placed on the
culvert under .Old Central by the 64th Avenue storm Water Project
certainly would cause the water in the ditch up stream from: that culvert
to be higher than it otherwise would have been, -t would not be high
enough to make the rear yards any wetter zha- they would be from the
trapped pockets on those properties that would be f -lied by rain fall in
any significant storm. event.
Question 2: Mr. Schwartz contends that the projec- contributed to
congestion in the ditch that flows south of his proper -y and eventually
into Moore Lake. To what extent did the project contribute to
congestion in that ditch and is the concesticn or potential for
additional overflow of the ditch harmful tc ei---e= the Schwartz or
Dahlberg properties ?
Answer 2: From past topographic maps of the _area and current maps, it
appears that filling has occurred in the ditcz area. The 64th Avenue
Storm Water Project removed some, but not all cf that fill and
contributed more water to the ditch via a new pipe discharging there.
While it is reasonable to assume that the wa-er _n -he ditch reaches
higher levels as a result of the project, it does rot appear that there
is any negative effect on these properties the-- are a -ready wet due to
rainfall being trapped by the topography on these sites during any
significant rainfall event.
Question 3: To what extent did the various elements of the project
benefit the Schwartz and Dahlberg properties ? Is there $1,,000 worth of
benefits to these properties from any of the projectis elements ? As I
see it there are three major components to the project:
A. The largest component of the project is a drainage system that
extends from Mississippi Street south to 64th Avenue and then south from
64th Avenue in a large storm water conduit and eventually empties into
the Rice Creek ditch.
B. The second component of the project is the curb and gutter work and
catch basin work that was done on 64th Avenue.
C. The third component of the project is a detention area approximately
one acre in size that was carved out north of the Rice Creek d4rt-ch along
Rice Creek Rea'.�•�i ��k `'�
To what extent do you believe that each of these elements contributed to
the Schwartz or Dahlberg properties ?
Answer 3: I should point out that the concept of "benefit" as it
relates to assessments is a complex legal issue and that I am not an
attorney or legal expert by any means. Subject to review by your legal
counsel, I attempt the following answer:
There are some services rendered by a municipality to its citizens that
are appropriately paid for from general tax revenues such as fire and
police protection. There are other services that, because they benefit
a very specific part of the city, could not be fairly paid for with
general funds. For example, if an older part of the city experienced
flooding problems because an adequate storm sewer system had never been
installed in their neighborhood and if the properties in that older
neighborhood had never paid for an adequate storm sewer system and if a
new storm sewer system were installed to remedy these flooding problems,
then it would not be fair to assess the entire city, including home
buyers in new subdivisions, who had been required to pay, as part of the
price of their new homes, for a storm sewer system that completely met
all of their storm sewer needs and obligations.
Such projects are often assessed, based on a drainage area that flows to
a common collection point. It is not uncommon that owners in the higher
parts of the drainage area complain that there is no benefit to them
from the project since they do not have flooding or erosion problems and
that the people in the lower parts of the drainage area should pay for
the project because they are the ones who are suffering problems. It is
true however that the development of aU of the properties in the
drainage area contribute to the problem whether or not they are directly
affected by it. When a house and driveway is placed on an undeveloped
lot, the amount of water soaking into the ground is reduced and the
amount of water flowing onto downstream neighbors increases. It is my
understanding that all properties in the drainage area must contribute
to the cost of a system built to solve the problem they have helped
create, whether or not they have a direct drainage problem that needs
solving.
All elements of this project are part of a system designed to solve
drainage problems in the drainage area in which the Schwartz and
Dahlberg properties are located. Water is conveyed from the front of
the Schwartz and Dahlberg properties by the curb and gutter on 64th to
catch basins at a low point on 64th and then enters the. storm sewer main
which dumps into the ditch. The upper parts of the system do not carry
water from these properties but this argument could be made by any
except the very highest neighbor in the area. The retention area
created by the project did provide some measure of protection against
very severe storm events. In view of the low percentage of the cost of
the entire project that was actually assessed, it seems that these
properties were benefited at least $1000 each.
Question 4: Did the elevations you shot for the detention -pond and the
Schwartz and Dahlberg properties corroborate the elevations that were
previously defined by the City's consultant, MSA (Maier Stewart &
Associates)?
Answer 4: With very minor and insignificant differences, our results
are the same as MSA's results.
Question 5: In your opinion, could the detention pond along Rice Creek
Road have overflowed on to the Schwartz property as a result of the
rainfall that occurred on or about April 24, 1994.
Answer 5: While I don't have enough information to conclusively rule
that over flow out, it seems quite unlikely to me. Further, the low pot
hole areas on the property would have been full of water from the rain
that fell on that date whether or not such flooding occurred, so it is
difficult to see how any adverse impact on the property could have
occurred from such overflowing, whether or not it occurred.
