On August 23, 1994, the Appeals Commission approved a variance request to reduce the front yard setback from 35 feet to 20 feet on the rear portions of 1476 and 1490 - 64th Avenue. Approval of the variance allows construction of two single family homes on properties created by lot split, L.S. #94-18. Staff received the attached letter from Timothy Strong requesting a one year extension on the variance, as construction has not yet begun. In speaking with Mr. Strong, he indicated that construction would begin on one of the new homes shortly after September 7, 1995 when he had obtained his construction financing. Mr. Schneider stated the property is generally located in the northwest corner of Arthur and Camelot Streets and consists of parcels C and D of Lot Split request, #94-03. The request is to reduce the front yard setback from 35 feet to 20 feet on parcels C and D. Mr. Schneider stated, as a result of the Lot Split, L.S. #94-03, parcels C and D which consist of the south 150 feet of both the west and east halves of Lot'l, Block 2, Spring Valley Addition, will be created. Lot Split, L.S., #94-03, was approved at the August 10, 1994, Planning Commission meeting and is still awaiting final approval by the City Council. The proposed dimensions of parcel C are 75 feet x 125 feet or 9,375 square feet. Parcel D is 75.39 feet x 125 feet or 9,423.75 square feet. The proposed split entry dwellings will face the east and be positioned on the front half of each parcel. Mr. Schneider stated the slope of parcels C and D along the proposed 20 foot setback line going east towards Arthur follows.a gradual 1 to 2 foot decline in elevation. The landscape features across the front lot lines include a slight ditch located in the easement. Directly to the south of parcel C is a ditch with 2:1 slopes. There is also a significant amount of trees and vegetation on both parcels. Ms. Schneider stated the front lot lines for both parcels border the recently re -constructed Arthur Street. Between Arthur Street and the front lot lines of the parcels is a 22 -foot wide boulevard. A typical boulevard is 12 feet to 15 feet wide. The Arthur Street right of way is 60 feet. Both parcels C and D have 125 foot lot depth and are of adequate size to comply with current standards. Taking into consideration the 22 foot boulevard, a standard setback would position the proposed dwelling 57 feet from the curb. Allowing the variance would permit future structures to be in line with the 20 foot setback of the adjacent garage and dwelling at 1490 64th Avenue. The City has previously granted front yard setback variances from 35 feet to down to 9 feet. Arthur Street was recently re -constructed and there is no plan for further modification. Significant changes in the right-of-way or APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 5 infrastructure contained within are not planned. Arthur Street has been vacated south of Camelot.and north of Rice Creek Road. Mr. Schneider stated the landscape features in the front yard area will require slight modification for drainage and driveway purposes.- Proper grading procedures should. be followed to allow for natural distribution and drainage from the site. The reduction of the setback should not adversely impact drainage. Mr. Schneider stated this variance request is within previously granted requests. Staff recommends approval with the following stipulations: 1. Lot Split request, L.S. #94-03, shall be approvedby the City Council. 2. The petitioner or his successor shall submit a plan of trees over four inches in caliper to the Planning staff for review - prior to issuance of the building permit. Staff will review the plans and visit the site to assure all significant trees have been marked and protected outside of the. building footprint. Ms. Smith asked if she understood correctly that this variance request would allow the proposed houses to line up with the side yard of the current dwellings. Ms. McPherson stated this was correct. Mr. Kuechle stated he was curious about the second stipulation about the tree plan. Mr. Schneider stated Mr. Hickok and he had visited the site. There is significant vegetation on the site and very nice saveable trees. Mr. Hickok stated there is a mix of significant trees and understory vegetation. In the lot split discussion, it was indicated that staf f would mark the trees that should- be saved, and we feel strongly about that. The house pad will take some trees and vegetation, staff would like to go out ahead of time and mark those trees to be saved. Mr. Kuechle asked if the grade would have to be changed. Mr. Hickok stated, in the area of the grading, there is vegetation of less significance. In the back is where the trees to be saved are located. Ms. Jan Filer, Burnet Realty, stated the petitioner is aware of the concerns of saving the trees. Moving the houses forward will help save more of the trees. APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 6 Mr. Kuechle asked why they did not move the structures back to the 35 foot setback. Ms. Filer stated the people at 1490 prefer to have the homes forward and gives a bigger yard for the homeowners. At the Planning Commission meeting, they talked about 15 feet on the back side which may end up being written as an easement. They are trying to get as much as possible while trying to save as many trees as possible. There will be fill brought in to bring to the proper grade. Dr. Vos stated, from the curb to the actual dwelling, there would be approximately 42 feet with the proposed setback. Ms. McPherson stated this was correct. MOTION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. Dr. Vos stated, in looking at the distance from the curb and imagining where the house will be, he thought it seems reasonable to line it up with the house to the north. He felt it would look better for the whole street. A. Ms. Smith agreed. It doesn't interfere with the line of sight and does not encroaching. Mr. Kuechle agreed given the fact that the boulevard is so wide in that area. MOTION by. Ms. McPherson stated the .subject parcel is zoned R-1, Single Family, as are .all the surrounding parcels in the Riverview Heights neighborhood. On the subject parcel is a detached two -car garage and a single family dwelling unit.' The petitioners are proposing to'construct an addition to the wear of the dwelling. The variance request is to reduce the rear yard setback from 40 feet to 30 feet. This particular parcel is a,,corner lot with the front. being the shortest of the .two street; -frontages, although the front door of the dwelling faces Riverview Terrace.. The petitioners are proposing to construct''a one-story addition to the rear of the dwelling with three bedrooms and a bath. The petitioners have the alternative of shortening the addition by 10 feet and perhaps widening to make it/longer. They can also add on to the front of the dwelling unit.' Mr. Maher, 7965 Riverview Terrace, stated his neighbor is approximately 10 feet from hid lot line. Mr. Maher has a large yard to what he considers th4� side. He eventually would like to build on to the front of the,,'ouse with a kitchen. and living room. The house is very small and,' he lot is -large. He wants to put the bedrooms to the back and bring the kitchen and living room forward which is the side with th6�'view. The garage will also be moved to the side. Dr. Vos asked if this, ould require a variance. Ms. McPherson stated'; o. Mr. Maher stated h'i's yard is at an angle and he has no way.to use that other part the back yard except with the addition. This still leaves 30/ eet from the neighbor. Mrs. Maher st�i�eed it was not feasible for them to add bedrooms to the front. i y now have one bedroom and they do not want to separate th 'family. It is feasible to add bedrooms to the back so the family/is located in the same area. They need three bedrooms. For them, 1 is a choice. They love their neighborhood and would like to y and have a comfortable home. The comment of adding to the fro and to the rear does not make sense when thinking of bedroomw. Mr. Maher stated they have a south view and they don't want the bedrooms with a south view. The house is at an angle. BACKGROUND• ♦ As a result of L.S. #94-03, parcels C and D which consist of the south 150 feet of both the west and east halves of Lot 1, Block 2, Spring Valley Addition will be created. Lot split, L.S. #94-03 was approved at the August 10, 1994 Planning commission meeting and is awaiting City Council approval. The proposed dimensions of parcel C are 75 feet by 125 feet or 9,375 square feet. Parcel D is slightly larger measuring 75.39 feet by 125 feet or 9,423.75 square feet. Proposed split entry dwellings will face the east and be positioned on the front half of each parcel. The slope of parcels C and D along the proposed 20 foot setback line heading east towards Arthur follow a gradual one to two foot decline in elevation. The landscape features across the front lot lines also include a slight swale/ditch located in the easement. Directly to the South of parcel C is a ditch with 2:1 slopes. ANALYSIS• ♦ 205.07.03.D.(1) A front yard setback of not less than 35 feet is to allow for off-street parking without encroaching Staff Report VAR #94-18, by Timothy Strong Page 2 on the public right of way and also for aesthetic consideration to reduce the building "line of sight" encroachment into the neighbor's front yard. The front lot lines for both parcels border the recently reconstructed (1993) Arthur Street. Between Arthur Street and the front lot lines of the subject parcels is an unusually wide boulevard measuring 22 feet. A typical boulevard width is 12 to 15 feet. The Arthur street right of way is 60 feet. Both parcels C and D have a 125 foot lot depth and are of adequate size to comply with current setback standards. Taking into consideration the 22 foot boulevard, a standard setback would position the proposed dwellings 57 feet from the curb. Allowing the variance would permit future structures to be in line with the 20 foot setback of the adjacent garage and dwelling at 1490 64th avenue north. The city has previously granted front yard setback variances from 35 feet to 9 feet. Arthur Street was recently reconstructed. There is no current plan for modification. Significant changes in the right of way or infrastructure contained within are not planned. Arthur street has been vacated south of Camelot and north of Rice Creek Road. Landscape features in the front yard setback area will require slight modification for drainage and driveway purposes.. Proper grading procedures should be followed to allow for natural distribution and drainage from the site. The reduction of the setback should not adversely impact drainage. RECOMMENDATION/STIPULATIONS: ♦ This variance request is within previously granted requests. Staff at this time recommends approval. Ms. Smith asked if she understood correctly that this variance request would allow the proposed houses to line up with the side yard of the current dwellings. Ms. McPherson stated this was correct. Mr. Kuechle stated he was curious about the second stipulation about the tree plan. Mr. Schneider stated Mr. Hickok and he had visited the site. There is significant vegetation on the site and very nice saveable trees. Mr. Hickok stated there is a mix of significant trees and understory vegetation. In the lot split discussion, it was indicated that staff would mark the trees that should be saved, and we feel strongly about that. The house pad will take some trees and vegetation, staff would like to go out ahead of time and mark those trees to be saved. Mr. Kuechle asked if the grade would have to be changed. Mr. Hickok stated, in the area of the grading, there is vegetation of less significance. In the back is where the trees to be saved are located. Ms. Jan Filer, Burnet Realty, stated the petitioner is aware of the concerns of saving the trees. Moving the houses forward will help save more of the trees. APPEALS COMMISSION MEETING, AUGUST 23, 1994 PAGE 6 Mr. Kuechle asked why they did not move the structures back to the 35 foot setback. Ms. Filer stated the people at 1490 prefer to have the homes forward and gives a bigger yard for the homeowners. At the Planning Commission meeting, they talked about 15 feet on the back side which may end up being written as an easement. They are trying to get as much as possible while trying to save as many trees as possible. There will be fill brought in to bring to the proper grade. Dr. Vos stated, from the curb to the actual dwelling, there would be approximately 42 feet with the proposed setback. Ms. McPherson stated this was correct. MOTION by Ms. Smith, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:50 P.M. Dr. Vos stated, in looking at the distance from the curb and imagining where the house will be, he thought it seems reasonable to line it up with the house to the north. He felt it would look better for the whole street. Ms. Smith agreed. It doesn't interfere with the line of sight and does not encroaching. Mr. Kuechle agreed given the fact that the boulevard is so wide in that area.
