Ms. Dacy, Community Development Director, stated that this is a
request to reduce the side yard setback from 10 feet to 6 feet to
allow the construction of a three season porch. She stated that
the Appeals Commission recommended approval of the variance on a
3 to 1 vote based on the fact that 16 feet will remain between the
two properties. She stated that staff has recommended denial, as
the petitioner can meet the Code requirements.
Mrs. Buck stated that the addition would be 20 feet from the
adjacent property owner.
Councilman Billings asked if there were any objections at the
Appeals Commission meeting. He asked Mrs. Buck if she has talked
to her neighbors about the addition.
Mrs. Buck stated that her neighbors were in favor of the addition.

approval of the side yard setback variance and of the existing
encroachment. She stated that no stipulations ave been
recommended regarding this variance.
MOTION by Councilman . Billings to grant Vari ce Request,
VAR #91-32, for the following variances: (1) to correct an
existing encroachment to the front yard setback from 80 feet to
76 feet; and (2) to reduce the side yard setba from 15 feet to
0 feet. Seconded by Councilwoman Jorgenson. Pon

recommending approval of this junkyard icense renewal, as Sam's

for Sam's Auto Parts. Seconded by Councilwoman Jorgenson. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously.

Expansion of Redevelopment Project Area No. 1 for June 29, 1992.
Seconded by Councilman Sc eider.
Councilman Schneider sta ed that he would not be in attendance at
the June 29 meeting and sked if the public hearing could be held
on July 6.
Councilman Billings ated that no vote would be taken on June 29,
so Councilman Schne' er would have an opportunity to ask questions
before action is t en by the Council.
Councilman Schne der suggested that perhaps the public hearing
could be contin d to July 6, 1992.

A. STATED HARDSHIP:
Allow porch addition on the rear of garage expansion.
B. ADMINISTRATIVE STAFF REVIEW:
Request
The petitioner requests that a variance be granted to reduce
the side yard setback from 10 feet to 6 feet. This will allow
the construction of a three season porch off the rear of a
garage addition, at 372 - 66th Avenue N.E.
Site
Located on the property is a single family dwelling unit with
an attached single car garage. The petitioner has applied for
and received a building permit to expand the garage by adding
an additional stall. The garage addition meets the five foot
side yard setback requirement. Adjacent properties are also
zoned R-1, Single Family Dwelling.
Analysis
Section 205.07.03.D. (2). (a) of the Fridley City Code requires
a side yard of ten feet adjoining a living area.
Public purpose served by this requirement is to maintain a
minimum of 20 feet between living areas and 15 feet between
garages and living areas in adjacent structures to reduce
exposure to conflagration of fire. It is also to allow
aesthetically pleasing open areas around residential
structures.
The code requires a ten foot side yard setback adjacent to a
living area. The proposed addition will be six feet from the
lot line. The petitioner has several alternatives: she could
construct a deck, construct a detached screened gazebo, or
reduce the width of the proposed porch. Reducing the width
would limit the porch to six feet instead of the proposed ten
feet. The adjacent property which would be affected by the
proposed addition appears to have the required setback of ten
feet, as the living area of the adjacent house adjoins the lot
line of the proposed addition.

Recommendation
As the petitioner has other alternatives which will allow her
to meet the code requirement, staff recommends that the
Appeals Commission recommend denial of the request, to reduce
the side yard setback from 10 feet to 6 feet.
Appeals Commission Recommendation
The Appeals Commission voted 3-1 to recommend approval of the
request to the City Council.
City Council Recommendation
Staff recommends that the City Council deny the request as the
petitioner can meet the Code requirements.

Ms. McPherson stated the variance request is to reduce the side
yard setback from 10 feet to 6 feet to allow the construction of
a three -season porch at the rear of a garage addition at 372 - 66th
Avenue N.E. The property is zoned R-1, Single Family Dwelling.
The petitioner is proposing to construct a garage addition and to
the rear would be .a three -season porch addition. The petitioner
has a building permit to start the garage addition since it meets
the setback requirement of 5 feet from the side lot line. The Code
requires a 10 foot side yard setback adjacent to a living area and
the proposed addition would be 6 feet from the lot line. The
petitioner has several alternatives. She would be allowed to
construct a deck, a detached screened gazebo, or reduce the width
to meet the setback requirement. This would limit it to being 6
feet wide as opposed to 10 feet which may not be a viable size.
The adjacent property to the east appears to have a setback to the
living area of 10 feet. There is living area next to the proposed
construction.
Ms. McPherson stated, as there are alternatives, staff recommends
denial of the request to reduce the side yard setback.

Ms. Beaulieu asked if it was alright for the garage to be that
close, but not alright for a porch.
Ms. McPherson stated this is correct. The Code makes a distinction
between an accessory building and living space.
Ms. Smith asked if there is any problem in the back if the width
was reduced to 6 feet.
Ms. McPherson stated the City has dealt with these issues before
and there are some building code issues to make sure there is
adequate window area and the necessity to have light and
ventilation through those windows. That would be an issue.
Ms. Buck stated this only came about because she wanted to do the
garage and had an empty corner space. Without a porch, it would
look stupid to have a 10 -foot garage and space behind the house.
The builder suggested a three -season porch. It would have light,
screens, and ventilation. In the kitchen, she has a window above
the kitchen sink and windows by the dining area. She believed that
the porch would fill this out and make the construction look
better. She was surprised to learn that she would need a variance.
This is not a living space, it is a porch. It will not be heated.
It will make the structure look nicer. The neighbors thought her
plans were good.
Ms. Smith stated the setback is required in case of fire.
Ms. Buck stated the neighbors are 15 feet from their property line.
She thought there would be more concern about fire in a garage than
in a porch.
Ms. Savage stated the Commission must follow the regulations, and
there must be a hardship in order to grant the variance.
Mr. Buck stated the hardship is the look of the building so she had
decided to add a porch.
Ms. Smith asked if this was for aesthetics.
Ms. Buck stated, yes. She had thought about expanding the kitchen,
but felt a porch would be better.
Mr. Kuechle asked if the footings were in.
Ms. Buck stated only the footings for the garage are in.
MOTION by Mr. Kuechle, seconded by Ms. Beaulieu, to close the
public hearing.

Mr. Kuechle stated the hardship in this case is weak. On the other
hand, the negative impact is probably non-existent as well. He did
look at the house, and it looks as if there is a good separation
between the houses. However, the City has no control over the
neighbor adding to the 10 foot line. Secondly, the house is well
set back from the street so the visual impact from the street or
aesthetically looking crowded would not have a negative impact in
that way. He would be inclined to say yes to the variance.
Mr. Smith stated she was in agreement. She thought the idea behind
the Code is good and that is the possibility of too many buildings
too close to close to the property line.
Ms. Beaulieu agreed. She did not see a hardship demonstrated;
however, the negative impact is slight as well. She would be
willing to recommend approval of the variance.
Ms. Savage stated she had concerns about the hardship.

approval of variance request, VAR #92-10, to reduce the side yard
setback from 10 feet to 6 feet to allow the construction of a
three -season porch on Lot 10, Block 3, Rice Creek Terrace Plat 2,

UPON A VOICE VOTE, KUECHLE, BEAULIEU, AND SMITH VOTING AYE, SAVAGE
VOTING NAY, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED BY A
VOTE OF 3-1.
Ms. McPherson stated the request will be scheduled for the City
Council meeting on June 1, 1992.
