SUMMARY OF PROJECT
The petitioners are seeking to decrease the
required side yard setback between their living
area and the side property line from 10 feet to 5
feet in order to convert the existing garage into
living area. The petitioners are also proposing a
new two car garage in the east side of the rear
yard connected with a new driveway. The old
driveway being removed and sodded.
SUMMARY OF HARDSHIP
With the growth of family, a need to convert a
small, single car attached garage into a bedroom
is requested. A new detached two -car garage on
the other side of the property the rear will be
built to fulfill parking needs. (Full letter

City Staff has no recommendation due to the
fact that these requests are within previously
granted dimensions.

HARDSHIP STATEMENT
• Due to normal growth in family, converting the single car garage into an additional
bedroom would be needed. This would also improve the property value.
• The current lack of space for parking will be enhanced as the two teenagers in the
house buy additional vehicles. Building a detached two -car garage on the other
side of the property in the rear yard will be built after the variance is granted.

ANALYSIS
Section 205.07.03.D.(2a) requires a side yard of ten feet is required between any living
area and side property area. Section 205.07.03D.(2b) requires a side yard of five feet
between an attached accessory building or use and a side property line. The
petitioners are seeking to decrease the required side yard setback from 10' to 5' to
allow the conversion of a single car attached garage into a bedroom.
The proposed conversion to a bedroom from a single car attached garage would then
allow them to build a two -car detached garage on the other side of the property in the
rear. The petitioner has stated that the two trees in the rear yard next to the future
garage and adjacent to the neighbors will remain. The existing driveway would then be
removed and sodded.
In an inspection of the property staff determined that due to a discrepancy between
measurements given with the variance request and field verification, a survey will be
required. This is a concern for the neighbor to the east. By eyeing the property it does
not look like it is 18 feet wide where the proposed new driveway would go. It looks as
though the required setbacks and existing window wells would pose a problem.
Additionally, a concern is also raised about drainage and site runoff conditions on the
east side of the property. Requiring a five foot setback will allow the petitioners to do
any grading that would be needed to solve these problems that may arise with the
property or the adjacent property.

STIPULATIONS
If approved by the appeals commission, staff recommends the following stipulations be
attached:
1. A drainage swale to control site runoff shall be created in the 5' setback area, along
the east property line, between the garage/driveway adjacent to the property line.
2. A site survey shall be prepared prior to City Council review on August 9, 1999.
3. All site grading shall be done in a manner that will not detrimentally impact the
petitioner's home or the adjacent property.
4. A hard surface drive of concrete or asphalt shall be installed in conjunction with the
garage construction. The driveway shall be complete prior to final garage
inspection.
5. Existing drive shall be removed and sodded prior to final inspection.
6. Garage door of former garage shall be removed and space enclosed for living area
no later than 12 months form final City approval of variance request.

To Whom It May Concern;
Due to normal growth of family and the desire to improve
my property,I am requesting a variance in the code that
requires 10 feet from side lot line for livable space.
I currently only have 5 feet.
The variance is needed to convert a small single car
attached garage to a bedroom.
The current situation is extremely difficult Jeto a
lack of space and off street parking.
We will be building a detached two -car garage on the
other side of the property and to the rear (see attached)with
a paved driveway. The old driveway would be ;&9Qand
sodded.
It would be impossible for us to comply with street parking
regulations if this is not granted. Also there are
several properties on the block that already were granted
such variances.
