Per our past discussions with Mr. Cis, we reviewed the problem and discussed the options of exiting the pipe above ground to the rear of his land and bfrming over it, or constructing a new line across the front of his lot and exiting unto the Easterly portion of his property, or waiting for the Meadowlands Park improvement to be designed and constructed and have the storm sewer pipe buried in his yard with that improvement. Mr. Cis preferred an immediate solution and discussed his various legal options, but finally agreed to wait for the Meadowlands Park improvement to be completed. I indicated it could start as early as 1985, but could be delayed until 1986. He indicated he would continue to follow this issue with the Council to insure his portion of the project is completed at no cost to him during the Meadowlands work. Moravetz, Engineering Administration su3jECT: storm Sewer Pipe on Outlot 2 Meadowlands Second Addition - (Cis Property) DAA: April 21, 1986 In 1969 or possibly 1970, the property owner of said Outlot 2 requested the City to pipe the storm water and to fill the existing ditch over his property. He apparently wanted to expand to the west to erect a garage and did not want the runoff aligned to his garage foundation. The property owner at that time was a Victor Olson who awned it frcan December, 1967 until March, 1979. At this time, a Gary Lofquist bought the property and Mr. Lofquist sold the property to Mr. Cis in April, 1982. Discussions with Ralph Volkman reveal that the City Public Works Department put the pipe in and the Park Department performed the landscape work. Ralph indicated that the property owner, at that time, was very pleased with the cooperation and work- manship of the City crews. RE: Cis Property DATE: June 24, 1986 While you were in Norway, I received a phone call from Councilman Goodspeed about the Cis property. He indicated to me that he had contacted you awhile earlier and asked for some information as to what the City's position was regarding the storm sewer pipe on the Cis property. I indicated to Councilman Goodspeed that you were on vacation and that I didn't have sufficient information to respond. Under the circumstances he seemed agreeable to wait until you returned. In the interim I asked Jimmy to do some research on this question. Enclosed you will find a memo he did regarding prescriptive easements. Based on the limited information I received from Councilman Goodspeed, it would appear that the City may be able to argue that it has a prescriptive easement. It would appear to me that we also might have another argument in the event that the storm sewer pipe only conforms with the natural flow of water. I gather that Mr. Cis's primary concern is the ponding that occurs on the property after a heavy rain storm. As an experienced ditch attorney, I suspect you could come up with some creative arguments that the current storm sewer pipe really conforms to the natural flow of water. I suspect that we should prepare a formal response to Brian. I would hope that the information prepared by Jimmy can be of some assistance. M E M 0 TO: VCH FROM: JDH RE: Prescriptive Easement - Cis Property DATE: June 24, 1986 The basic question considered herein is whether the City of Fridley can establish the existence of a prescriptive easement on the Cis property. Apparently Mr. Cis has brought it to the City's attention that he is displeased with the drainage flow from the storm sewer onto his property. Since the City does not have an easement on record, one option is to try and establish an easement by prescription. LAW To establish an easement by prescription, a party must prove use for the prescriptive period of fifteen (15) years and that the use was hostile, actual, open, continuous, and exclusive. McCuen v. McCarvel, 263 N.W.2d 64, 65 (Minn. 1978); M.S.A. 541.02. The general rule is that where the claimant of an easement by prescription shows open, visible, continuous use for the statutory period, inconsistent with the rights of the owner and under circumstances from which the owner's acquiescence may be inferred, the use is presumed to be adverse or hostile. Nordin v. Kuno, 287 N.W.2d 923, 926 (Minn. 1980). The court has defined "acquiesence" as "passive conduct on the part of the owner of the servient estate consisting of failure on his part to assert his paramount rights against the invasion thereof by the adverse user." Hartman v. Blanding's, Inc. 288 Minn. 415, 422, 181 N.W.2d 466, 470. Where the presumption is unavailable, adverseness is a question of fact with the burden to prove the allegation by a preponderance of evidence on the party claiming the easement. Rice v. Miller, 306 Minn. 523, 525, 283 N.W. 2d 609. APPLICATION The storm sewer pipe on the Cis property (Outlet 2 Meadowlands Second Addition) has been in existence since 1969 or 1970. Mr. Cis apparently made his complaint about the storm sewer in October, 1984. While the dates concerning the origin of the storm pipe are in some question, it appears that there may be a problem meeting the 15 year prescriptive period. The exact dates for the installation of the storm pipe should be established and compared to the date of the first complaint by Mr. Cis. If the 15 year prescriptive period requirement can be satisfied, I feel confident that the remaining elements for establishing a prescriptive easement can be met. The storm pipe and subsequent flow of water are open and visible. Presumably every time it rains there is water flowing through the storm pipe, therefore making the use continuous.
