Dear Mr. Brickner: As you are aware, there exists a problem with a post footing that supports the northwest corner of a screen porch at 1499 - 66th Avenue N.E. The construction of the home and porch was commenced during the winter of 1986- 87 and completion was in late March, 1987. Near the end of June, 1989, the homeowner, Mr. John Benedict, called our office and reported that one corner of his porch had settled some 3 inches. On June 27, 1989 we inspected the site with Rick Brickner. It was determined that the northwest corner of the porch had settled due to a footing problem under a 6 x 6 inch support post. The corrective action was discussed and it was my understanding that your company would correct the situation. It is now my understanding that you feel your HOW homeowner's warranty should be responsible for the repair. Consequently the homeowner filed a claim against the HOW policy which was investigated by Mr. Dick Wiehle of Meyer, Borgman & Johnson. I was told that his recommendation to his home office in Dallas, Texas was that the claim be denied based on their definition of major structural defect. I do not agree with their findings because I feel the settlement is more than what the allowable settlement is according to the industrial standards for structures in this area. I base this on information from the industrial standard manual and also on the fact that in soils reports prepared by engineering professionals it is stated that acceptable differential settlements can be anticipated up to 1/2 inch . The construction standard for allowable tolerance is 1/4 inch in 20 feet. The settlement on this post footing is 2 inches which is far in excess of the 1/2 inch normally allowed for a footing design.
