under Minnesota Statutes Chapter 429, and the City Charter,
for the benefits of which said lands are subject and liable
to special assessments, and for the payment of which the
City of Fridley has a lien until the same are fully paid
with payment to be in one full and complete installment
thereof (unless otherwise hereafter provided by the City
of Fridley). That the improvements effected or caused to
be effected and of concern herein are:

2. That pursuant to the ordinances of the City of Fridley
the sale and transfer of record of any of said lands by
the owners herein without first making payment of said
special assessments is unlawful; and the said sale acid
transfer of record is prohibited undei the terms of said
ordinances and any building permits granted thereunder,
until the said special assessments are fully paid (or
payments otherwise, excused or waived).
3. That pursuant to the provisions of said ordinances, the
terms of the building permits granted thereunder, and
the representations and agreements made relative thereto
by the owners, the Owners and each of them represent and
covenant for themselves, their heirs and assigns that no
sale or transfer of said premises or any of them shall be
made or attempted of record except and unless said..
special assessments are fully paid, (excused or waived)
and the lien of the City of Fridley therefor satisfied;
and that any sale or transfer attempted in violation thereof
without the knowledge and consent of the City of Fridley is
and shall be void. That upon receipt of said payments, the
lien of the City of Fridley shall be satisfied and the City
may and shall execute and file notice there of record.
4. That this instrument and the notice of receipt of payment
or excuse or waiver, executed by the City of Fridley may
be filed of record among the land records of the County
of Anoka, and State of Minnesota.

SUPPLEI4ENTARY AGREEMENT
THIS AGREEMENT supplements and shall be construed as an addendum
to the foregoing agreement.
WHEREAS, it is understood and agreed that:

1. Subsequent to the execution of the prior agreement, Alan
3p has acquired iights and interests in further and addi-
tional lots and parcels of land for which he requests a
building permit.
2. That the sales of the dwellings on other lots for which
permits have already been granted are not yet consummated,
and the dwellings constructed thereon are in varying stages
of completion or awaiting sale or approval for mortgage
loan purposes.
3. That should the City of Fridley grant any permit for a
dwelling to be constructed by the said ® on any
last or parcel ofAand, whether the same be already noted
within the terms of agreement or not, that then the pro-
visions of said agreement relative to escrow payments
shall apply.
4. That to insure to the City the payment of such moneys
(assessments for improvements) the said IM and
the owner of the lot or parcel involved shall execute a
notice in favor of the City of•Fridley, which may and
shall be filed among the title records of the County,
such notice shall be in substance like that attached

Dear Ms. O'Brien:
This letter is to make clear this department's requirements for the swimming pool
construction at the above address.
1. As indicated, one (1) skimmer approved by the National Sanitation Foundation
will be provided.
2. As indicated, one (1) inlet of approved design for fresh and/or repurified
water will be provided.
3. As indicated, a main drain of approved construction will be provided.
4. The filter and pump shall be approved by the N.S.F. and be of sufficient
capacity to provide a minimum turnover of at least two (2) times in 24 hours.
This department recommends a turnover rate of 6 - 8 hours.
5. A deck of at least three (3) feet wide, measured from the pool waters edge,
shall be provided which extends completely around all private residential pools.
Above ground private residential pools may be provided with decking of a minimum
size of 4 feet by 4 feet at pool entry points and provided that such decking has
the approval of the City.
6. Fencing or other effective means including but not limited to walls or
buildings, acceptable to the City, shall be provided to positively control all
access to public and private residential swimming pools. Fencing shall meet the
following criteria:
(a) The fencing shall prevent the entrance of children and be without hand or
foot holds that would enable a person to climb over it.
(b) The fencing shall be at least 6 feet high and entrances shall be equipped
with self-closing and self -latching gates capable of being locked.
(c) Self-closing and self -latching devices shall be placed at the top of the
gate or otherwise inaccessible to small children.
(d) The opening between the bottom of the fence and the ground or other
surface shall be not more than four inches.

8. All electrical and plumbing installations shall be inspected and approved by
the City Inspection Department.
9. All overhead electrical lines must be a minimum of 10 feet horizontally from
the pool surface, and 18 feet straight line distance from the waters edge. An
alternative is to bury said lines.
10. The pool fill spout must be protected by a vacuum breaker or air -gapped.
11. Suitable safety equipment to include but not limited to a ring buoy and rope
that is 1-1/2 times the pool diameter and shepherds crook pole must be provided
and maintained with the pool at all times.
Furthermore, these and any other requirements must meet the provisions of the
Fridley City Code, Section 115, Swimming Pools. The building permit is approved
contingent on final inspections and approval of the City.
