ALLEY VACATIONS - OAK GROVE ADDITION AND MOORE LAKE PARK 2ND ADDITION: Mr. Dave Fuerstenberg, 1601 - 66a Avenue, appeared before the Council regarding vacation requests for t e vaca ion o 'fie alley easement in Oak Grove Addition and Moore Lake Park 2nd Addition. He stated it was his understanding, from information he received from the Planning Commission and staff, this item would be before the Council this evening. j r 292 REGULAR MEETING OF OCTOBER 27, 1980 PAGE 2 Mr. Flora, Public Works Director, stated the Council took action at the October 20 meeting to set the public hearing on these alley vacations for November 10, 1980. Councilman Schneider stated he has talked to Mr. Fuerstenberg regarding this matter and he wished to begin construction and questioned if this would be a problem. He pointed out there is 100% petition for the vacation and the Planning Commission did recommend approval. Councilman Schneider asked how close Mr. Fuerstenberg would be from the lot line, with the vacation and Mr. Fuerstenberg indicated he would be about 13 feet. Mr. Qureshi, City Manager, asked Mr. Fuerstenberg if all the alley easement came from his property. He stated six feet is from his property and six feet obtained by a quit clain deed. Councilman Schneider asked if a building permit could be Issued so Mr. Fuerstenberg could put in the footings. Mr. Herrick, City Attorney, asked if Mr.•Fuerstanberg obtains the entire width of the alley by vacation or quit claim deed, if that was sufficient to meet the setback requirements of the code. Mr. Fuerstenberg indicated he had a drawing of his plans which he could present to the Council. Mayor Nee stated, since this wasn't a regular agenda item, the Council would hear discussion later in the meeting, which was acceptable with Mr. Fuerstenberg. ISSIPPI RIVER CORRIDOR CRITICAL AREA PLAN - 1007 . Mr. Flor Public Works Director, stated, as discussed at the preceding meets , there were two issues before the Council, one.was the adoption of the Crit' al Area Plan and th& other was the adoption of the Zoning Code which implemente he Critical Area Plan. Flora stated, in talking to`the"Metropolita�� Cauncil t is necesbary to adopt the C 'tical Area Plan, however, the City can delay the king requirement: which implements this plan to a later date when the entire zo g code is reviewed. Councilman Fitzpatr k asked about the extent of the ar involved and if that would be adopted now, with the plan, or considered the zoning. Mr. Flora stated the Critical Are Plan was adopted by stc. statute and all the City is doing is implementing th into the City's p1p. He explained the ciritcal areas have already been establi ed as this plan rtains to Fridley. He stated one of the concerns brought up at a last Counc meeting was the effect on exiting properties in the critical a a. Councilwoman Moses asked if hom in he critical area were totally damaged, if they could be rebuilt. He stated, although there is no formal procedure for allowing Mr. Fuerstenberg to proceed, he didn't have a problem with an informal agreement that he may proceed with construction in order to beat the cold weather. He felt if the Council was going to proceed with the vacation, and noted there was a 100% petition in favor, he couldn't see a real problem, barring any unforeseen conditions. Mr. Herrick asked Mr. Fuerstenberg if he inteded to build anything, other than putting in the footings,- before November 10, 1980. Mr. Fuerstenberg stated he hoped to begin construction on the addition before this date and presented his plans to the Council. Mr. Fuerstenberg stated he would agree to the easements requested by the City. Mr. Qureshi, City Manager, felt Mr. Fuerstenberg could proceed with construction at his own.risk, however,�the permit would not be issued until the vacation is approved. He explained it is for Mr. Fuerstenberg's benefit to go through the legal process for vacation of the right-of-way to make sure it is done properly. Mr. Qureshi stated at the meeting next Monday he wants to give the Council a full picture of the property and, hopefully, when the hearing is held on November 10, 1980, they can also have a first reading of the ordinance. Mr. Fuerstenberg stated he didn't foresee any problems and Mayor Nee questioned if any of the Council Members had any problems with this item, to which there was no negative response. Dear Sirs: This letter is to make clear this department's requirements for the swimming pool construction.at the above address. 1. As indicated, one (1) skimmer approved by the National Sanitation Foundation will be provided. 2. As indicated, two (2) returns of approved design for fresh and/or repurified water will be provided. 3. As indicated, a main drain of approved construction will be provided. 4. The filter and pump shall be approved by the N.S.F. and be of sufficient capacity to provide a minimum turnover of at least two (2) times in 24 hours. This department recommends a turnover rate of 6 - 8 hours. 5. No diving board will be provided as the head clearance provided does not meet the Code. 6. The enclosure entrances to the pool area shall be provided with self-closing and self -latching devices to prevent the entrance of small children. 7. An automatic chlorinator should be provided with a suitable test kit. 8. All electrical and plumbing installations shall be inspected'and approved by the City Inspection Department. 9. Suitable safety equipment to include but not limited to a ring buoy and rope that is ll� times the pool diameter, and shepherds crook pole, must be provided and maintained with the pool at all times. Furthermore, these and any other requirements must meet the provisions of the Fridley City Code, Section 115, Swimming Pools. Dear Mr. and Mrs. Secor: It has been brought to my attention that a serious and recurring drainage problem exists on your property. Upon observation by myself and a member of the City's engineering staff, it is also clear that this drainage problem appears to have significantly affected an adjacent property. Further research indicates that you have been notifed about the problem by our staff on previous occasions. The purpose of this letter is to emphasize the importance of correcting the problem, propose two possible solutions to the existing drainage problem, and inform you of the Fridley City zoning code requirements regarding land alteration and water'iunoff. Repair the existing system a. Extend the gutter from the rear of the garage to create a hard connection with the floor drain in the dog kennel. b. Place all patched together PVC connections with permanent joint connections. c. Perform regular maintenance and monitoring to ensure the system is directing the runoff without negatively affecting both yours and your neighbor's property. 2. Redirect drainage and develop a new system a. Connect existing gutters on the front and rear of the garage and direct the drainage toward the driveway and street. b. This option would likely require a long extension from the existing gutter, approximately half the distance to the street. c. This option would require far less maintenance and monitoring, but might represent a higher cost up front. Please consider these options as well as any other alternative we may have overlooked. City code requirements make it necessary that you shall proceed in correcting the current violation in a timely manner. If we can be of any further assistance in the development of a new system, or repair of the old system, please let me know. In fact, I had intended on performing the necessary work before having been notified by your office last year. Allo me to also remind you that I have made no "alterations" whatsoever to the design of this syste as your letter would otherwise suggest. The present interconnecting system of gutters, down pouts, and P.V.C. piping was installed some twelve to fifteen years ago by the previous owne s (David and Rose Fuerstenberg). My wife and I have only owned the property for the past four y ars, during which I have performed regular maintenance. The ork which I performed last year included replacing most of the exposed 4" P.V.C. fittings and a length of ice damaged 4" pipe. Additionally, I devised a "frost plug" to prevent a repeat fra a from ice expansion during the winter months. I inserted a pipe tee facing downward, to which I had bonded a light gauge plug to act as a "frost plug". If you consider this improvement to be noteworthy alteration of the original system design, I will remove it.. Furthermore, I had assisted the previous owner of the adjacent property in filling a rather large sinkho a in the area abutting our property. I felt somewhat obligated to offer assistance due to last su, nmer's untimely rupture of our rainwater drainage system, which may have contributed to the erosion / sinkhole, compounded by the simple fact that the previous owner had been a senior woman. The majority of the erosion was due to natural runoff from the neighbor's own backyard, however, since the area in question is located at the lowest corner of the yard and was devoid of ground cover (until being sodded prior to selling the property to the current owners). Interestingly enough, I observed firsthand that the sinkhole exposed a rather unusual combination of landfill materials (a bird bath, scrap metal, branches, cinder blocks, etc.) which undoubtedly contributed to the collapse due to disproportionate settling. Since I am limited to inspecting the rainwater drainage system from my neighbor's property, I find it rather difficult to check the system more than three or four times a year. I do, however, rid the kennel area of accumulated leaves and such far more frequently. The new owner alerted me to a section of pipe which was leaking, and to which he had affixed a makeshift patch. Perhaps it is this to which you refer when you stated that the system was "disconnected, patched or destroyed". In view of my previous repairs, I can only conclude that any other damage that you may have observed to be the result of deliberate vandalism. I had scheduled additional repairs of the system before the end of this summer, and have commissioned someone to assist me in performing this work within the next two weeks. I appreciate your recommendations, but have dismissed the second scenario for several reasons. First, it would clearly violate the spirit, if not the letter, of the prevailing codes under which the present system was constructed. Secondly, it would doubtless become the neighborhood eyesore by running downspouts some 30' to 40' toward the street. Thirdly, there is no storm drain in the immediate area. Fourthly, our front yard and driveway are virtually "flat". Lastly, the cost would likely prove to be considerable. I propose a minor modification of the existing system, similar to your first scenario. I shall be extending the rear downspout so that it discharges in close proximity to the kennel floor drain. I shall once again repair any damaged areas of the P.V.C. piping up to the edge of the bluff. I would like permission to replace the downhill P.V.C. run with 4" flexible tubing which would be buried a few inches below the surface of the soil. Money permitting, I would also like permission to replace and bury a matching downhill run at the opposite side of our property. Burying portions of the system would make it less susceptible to damage or vandalism. I would also appreciate your input regarding some sort of paint which might be used to camouflage the white P.V.C. piping, so that it might better blend with its surroundings. Such paint should probably have an acidic quality so as to etch the surface of the plastic to establish a permanent bond. I would also like to ask that you allow me until August 218, due to my not being able to raise sufficient cash to purchase the required materials much before that time.
