ALLOW THE CONSTRUCTION OF A SINGLE FAMILY DWELLING. GENERALLY
LOCATED AT -991 67TH AVENUE N.E.:
MOTION by Councilman Billings to grant Variance Request,
VAR #92-14, to reduce the front yard setback from 35 to 17.5 feet.
Seconded by Councilman Fitzpatrick.
Councilman Billings stated that this structure would be in line
with the other homes on the block.
Councilwoman Jorgenson stated that a number of other variances of
this magnitude have not been approved.
Councilman Billings stated that if the variance is not granted this
would be the only home that would be set back 52 feet from the curb
line of the street. He felt that this is one of the few cases that.
meets the definition.for what a variance is intended.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, Councilman Billings,
Councilman Fitzpatrick, and Mayor Nee voted in favor of the motion.
Councilwoman Jorgenson voted against the motion. Mayor Nee
declared the motion carried by a 3 to 1 vote.
D. VARIANCE REOUEST. VAR #92 -
LOCATED AT 6299 UNIVERSITY AVENUE N.E.:
Mr. Van Den Berg, of Comstrand, Inc. stated that he would be
moving his business from St. Antho to Fridley.
Councilman Billings asked ho, any people he employs, to which Mr.
Van Den Berg stated he has -nine employees.

Manager to ente into this agreement with Anoka County for the
Residential Rec cling Program. Seconded by Councilman Fitzpatrick.

Mr. Bur s, City Manager, stated that this contract allows the City
to emp oy interns with the City paying between 50 and 70 percent

B. ADMINISTRATIVE STAFF REVIEW:
Request
The petitioner requests that a variance,be granted to reduce
the front yard setback from 35 feet to 17.5 feet to allow the
construction of a single family dwelling. The request is for
Lot 5, Block 1, Michael Servetus Addition, the same being 991
- 67th Avenue N.E.
The petitioner requested and received a variance for the same
request in 1990. As a dwelling unit was not constructed
within the one year timeframe, the variance became null and
void.
Site
The property is vacant and has mature trees on it. The
property is zoned R-1, Single Family Dwelling, as are the
parcels to the north, south, and east. Meadowlands Park is
located to the west.
Analysis
Section 205.07.03.D.(1) requires a front yard setback of 35
feet.
Public purpose served by this requirement is to reduce visual
pollution in the front yard.
The Michael Servetus Plat was approved in 1978. At that time,
the right-of-way for 67th Avenue was dedicated but the street
was not constructed. The City completed construction of 67th
Avenue in 1990 after approval of the Michael Servetus Second
Addition which created three additional lots on the south side
of 67th Avenue. The street was constructed with a modified
turnaround instead of a full cul-de-sac.
The staff recommendation and Appeals Commission action in 1990
required filing a request to vacate the "bubble" portion of
right-of-way which exists along the north right-of-way line
of 67th Avenue.

Upon review by the Ward Councilmember and City Council, it was
determined the vacation request was not necessary. The
present request does not include a request to vacate the
additional right-of-way. It is the additional right-of-way
which causes the proposed dwelling to be pushed back to the
north locating the dwelling closer to the north lot line of
Lot 5. The petitioner, however, can construct the dwelling
in a manner which complies with the code requirements. Ample
buildable area exists on the lot. Staff recommends that the
variance request be denied as the petitioner can meet the code
requirements.
The petitioner has requested that if the variance request is
granted, the one year time limitation be waived and the
variance be granted for an indefinite period of time. The
reason for the previous request expiring is that the potential
buyer did not close on the property. The petitioner is
requesting a longer time frame in order to avoid going through
the process again. the purpose of the limit is to enable the
City to gauge whether circumstances have changed which would
affect the City's position on the request.
Recommendation
Staff recommends that the Appeals Commission recommend denial
of the variance request, VAR #92-14, as the petitioner can
meet the code requirements. If the Commission chooses to
recommend approval of the variance request, the Commission
should determine the appropriate length of time that the
variance would be valid prior to construction of a dwelling
unit. The ordinance requires a one year time period on all
variance requests. Staff recommends the Appeals Commission
maintain the one year time limitation.
Appeals Commission Action
The Appeals Commission voted unanimously to recommend approval
of the request to the City Council and not to extend the time
limitation.
City Council Recommendation
Staff recommends that the City Council deny the variance
request as the petitioner can meet the code requirements.

MOTION by Ms. Beaulieu, seconded by Ms. Smith, to waive the reading
of the public hearing notice and open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, ACTING CHAIRPERSON VOS DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:28 P.M.

Ms. McPherson stated staff recommends that the Appeals Commission
recommend denial of the variance request as the petitioner can meet
the setback requirements. If the Commission chooses to recommend
approval of the variance request, the Commission should determine
the appropriate length of time that the variance would be valid
prior to construction of a dwelling unit. Staff recommends the
Appeals Commission maintain the one year time limitation.
Dr. Vos asked Ms. McPherson to explain the "bubble" in the curb
line.
Ms. McPherson stated the area has been platted since 1978. Part
of the concern is whether 67th Avenue and Oakley will some day be
connected. The road currently is constructed as a corner. The
street does not go through. However, the right-of-way is planned
for the future construction of a'cul-de-sac.
Dr. Vos asked the distance from the existing curb to the dwelling.
Ms. McPherson stated she would guess there would be about 60 feet
between the dwelling and the curb to keep within the curb line.
Dr. Vos stated the neighbor could be right at 35 feet.

Ms. McPherson stated, yes. The difference is caused by the curve
to be used for the turnaround.
Ms. Beaulieu asked why, in 1990, did the City Council say it did
not have to be vacated.
Ms. McPherson stated there was discussion and concern by the
neighbors that Oakley and 67th would be connected. The ward
councilmember felt at that time a vacation was not necessary.
Ms. Beaulieu stated that if the Commission recommends approval,
would they want to have them vacate it now.
Ms. McPherson stated the variance should be approved on its own
merits.
Ms. Smith stated that if the variance is approved, the house is
built and then the curb cut put in, would the house be 17.5 feet
from the curb?
Ms. McPherson stated that with the boulevard, the house would be
approximately 27 feet from the curb.
Dr. Vos asked how deep the lot was and if there was space for a
house.
Ms. McPherson stated there was adequate area.
Ms. Beaulieu asked if there were houses on Lots 7 and S.
Ms. McPherson stated the houses are there now.
Ms. Beaulieu asked if the houses on Lots 7 and 8 are 35 feet back.
Ms. McPherson stated, yes. There was a variance granted across the
street to correct.a side yard encroachment.
Mr. Brickner stated they have a plan and a customer who would like
to have a house line up with the others. That street has extra
wide boulevards of about 18 feet. If the house is set back, the
driveway would be about 70 feet and the house would be back 17 feet
further than the house next door. He is trying to line up the
houses.
Ms. Smith asked that since the petitioner has a buyer, why would
the petitioner want an extension on the variance?
Mr. Brickner stated that if the house is set back so far, the
customer may not want to buy.
Ms. Beaulieu asked if there is a lot on the other side of this lot.

Mr. Brickner stated the road deadends there.
Dr. Vos stated his property abuts this property to the north. He
voiced concern about the drainage. If the developer has to move
as much soil as they did, there are drainage problems. He thought
it changed the water table and he had to do work in his basement.
In self interest, he would like to see the structure moved south.
Ms. Beaulieu asked what the chances are that the road would go
through.
Ms. McPherson stated the chances were slim, but she could not speak
to what may happen in the future.
NOTION by Ms. Beaulieu, seconded by Ms. Smith, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, ACTING CHAIRPERSON VOS DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:45 P.M.
Ms. Smith stated she was inclined to vote for approval. The
purpose is to reduce visual pollution. The petitioner wants to
line up the structure with the rest, and she does not have a
problem with lining them up.
Ms. Beaulieu agreed. If there are drainage problems, the longer
driveway would create more of a problem. The house would look
unusual if set back so far.
Dr. Vos stated, to the West is a park, and he did not see that the
road will go anywhere.
MOTION by Ms. Beaulieu, seconded by Ms. Smith, to approve variance
request, VAR #92-14, by Brickner Builders, to reduce the front yard
setback from 35 feet to 17.5 feet to allow the construction of a
single family dwelling, and that the term of the request be limited
to one year, for Lot 5, Block 1, Michael Servetus Addition, the
same being 991 - 67th Avenue N.E.

Ms. McPherson stated this would be considered by the City Council
on June 29.

parcel (easement, street, etc.) to be vacated.
Complete site plans, signed by a registered architect, civil
engineer, landscape architect, or other design professional, to
include the following:

Dear Tom:
You requested an application for a variance for 991 - 67th Avenue
N.E. I have enclosed an application and the minutes from the last
meeting on October 2, 1990.
At that time, staff recommended approval based on the fact that a
vacation request to vacate the northern 20 feet of the cul-de-sac
was going to be pursued. Because the vacation may not occur, we
will recommend denial of the variance request. This is because the
house could be built on the property meeting the setback
requirements. The Appeals Commission and the City Council will
need to decide if a variance should be granted. There are cul-de-
sacs elsewhere in the City where homes have been built in
conformance with the setbacks.
Please complete the attached application, submit it and a check
made payable to the City of Fridley in the amount of $60.00, to
either myself or Michele McPherson by 5:00 p.m. on Friday, May 1,
1992. The Appeals Commission will hear this item on May 19, 1992
and will be scheduled for the City Council on June 29, 1992. If
you cannot file the application by Friday, please contact me for
the next hearing dates.
