You must submit to the City the solution you plan to implement before you commence this project. The lot at 1060 - 67th Avenue will drain, however the grade along the west property line could have been altered slightly to provide better drainage out to the street in front. As you know, nothing has been done to date to raise her walkout elevation. When I questioned you earlier about the corrections, you stated you were waiting to hear from Ms. Vierkant concerning what type of door she wanted installed. In my conversation with Ms. Vierkant, she stated that she is waiting for you to bring her the choices of units available to her. As I recall, from our meeting between Brad, Ms. Vierkant and myself, Brad did promise her he would bring her some literature on doors that could be substituted for the unit she now has. This correction work must be started shortly and be completed as soon as possible, certainly before the first of the year. I am concerned about the new support beam that you will have to install to support the existing floor trusses. They are bottom cord bearing trusses and if support is going to be something other than bottom cord support, we insist that you get the new support system approved by the truss designer. We feel that you have allowed this situation to go uncorrected for too long and if you do not take immediate steps to resolve this problem, we will refer this matter to our City Prosecutor for his legal consideration. JAM/jc Respectfully, J. B� SETTLEMENT AGREEMENT WHEREAS, certain disputes have arrisen between the builder, J.A. Menkveld & Associates, Inc. (Menkveld) and the purchaser/owner, Gwen Vierkant (Vierkant) with respect to the condition of a one -family residence located at 1040 -67th Avenue N.E., Fridley, Minn. and, WHEREAS, Menkveld and Vierkant entered into a Purchase Agreement on or about February 18, 1985, wherein Menkveld agreed to construct and Vierkant agreed to purchase the aforementioned residence, and WHEREAS, on or about July 15, 1985, the construction being substantially complete, a closing occurred, Vierkant took possession and the parties entered into a "Closing Agreement" wherein Menkveld agreed to complete and/or repair several items and Vierkant agreed to seed the yard, and WHEREAS, the City of Fridley, through its Building Inspection Department, objected to the elevation of the "walk out" sliding glass door in the rear of the dwelling due to potential flooding, and WHEREAS, Menkveld and Vierkant have for more than a year attempted to resolve through negotiations various conflicts that have arrisen between them, including but not limited to the condition of the residence and an acceptable solution to problems resulting from the elevation of the rear door, and 46 WHEREAS, the parties hereto wish to resolve all disputes d which have arrisen in the past and/or currently exist between them, NOW, THEREFORE, the parties agree as follows: 1) Menkveld shall pay Vierkant on the execution hereof $7,000.00. 2) Vierkant shall immediately undertake to repair or remodel the premises in such a manner as to make it acceptable to the City of Fridley. 3) Robert E. Halva, as escrow shall hold in trust $500.00 this date received from Menkveld. 4) The $500.00 held by Halva shall be paid to Vierkant upon verification by the City of Fridley that they are satisfied with the repairs or remodeling. 5) Verification by the City of Fridley shall be in writing to Robert E. This work is being performed by you as a correction notice initiated by the City and under a signed agreement between yourself and Ms. Vierkant dated June 25, 1986. The footing for this improvement was inspected by the City and was approved for placement of the concrete. It is my understanding that on July 10 and 11, 1986, you laid block and continued to frame up and enclose the structural addition to somewhat secure the dwelling against weather. As you reported, it was raining both days, causing same difficulty in performing the work. Our inspection noted block laid without mortar, poor cutting of the irregular block modules; all in all a very poor and unacceptable situation. The project has been stopped by the owner and as you know, corrections of the work already done must be corrected and inspected by the City prior to backfilling or closing up the project. Yesterday I had two phone conversations with your attorney, Mr. Robert Halva, and he informed me that he had advised you to only change the garage door and that all other work described in the June 25, 1986 letter (agreement) drawn by Mr. Halva's office and signed by the homeowner would be done by a contractor selected by Ms. Vierkant. Halva, as escrow shall hold in trust $500.00 this date received from Menkveld. 4) The $500.00 held by Halva shall be paid to Vierkant upon verification by the City of Fridley that they are satisfied with the repairs or remodeling. 5) Verification by the City of Fridley shall be in writing to Robert E.
