Dear Mr. Arneson:
I am writing to you to explain the stop -work order that was delivered to your
residence last Friday afternoon. we attempted to phone you then and again
this morning, but no one answered.
Upon review of the lot survey by Suburban Engineering that you dropped off
last Friday when you picked up your building permit, the staff discovered a
discrepancy in the existing side yard dimensions. The sketch that you
submitted for the Appeals Commission variance shows a four foot side yard.
But the lot survey dated September 18, 1984 appears to indicate a side yard
decreasing from 3.7 feet dawn to to 3.1 feet.
abe Appeals CcumUssion issued you a side yard variance on June 24, 1986 for
the four feet you requested. You now have two options. First, if you wish
to proceed immediately with building the garage extension, you must respect
the four foot setback which you were granted. Ibis may require an off -set in
the garage exterior according to the lot survey.
Or second, if you wish to build the extension without such an of f -set, you
reed a variance for a smaller side yard setback to acoomodate that extension
according to the said lot survey.
Please contact the Community Development Department as soon as possible and
let us know how you wish to proceed. Z have taken the liberty of putting
this on the agenda for the next Appeals Commission meeting which is scheduled
for July 15, 1986, in order to expedite the process if you choose to proceed
with the second option.
Again, please contact myself or Debbie Mootz as soon as possible so that we
may assist you in this matter.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.3, D, 2b, requires a side yard of five (5) feet between
an attached accessory building or use and side property lines.
Public purpose served by this requirement is to provide space between
individual structures to reduce conflagration of fire, to provide
access to the rear yard for emergencies and to limit the condition of
crowding in the residential neighborhood.
"I intend to build in line with existing garage, which is also 4' from
the east property line".
C. ADMINISMATWE STAFF REVIEW:
The petitioner presently has a 21' x 20' garage built 4' off the east
lot line. The house and garage was reconstructed in 1965. The
present garage is 2' into a 6' drainage and utility easement. All the
utility companies and the City granted the 2' encroachment. At that
time the petitioner has repetitioned the utility companies for the
addition which they have granted.
The house to the east is 10 feet from the common lot line and is
constructed in front where this addition would take place.
If the Board recommends approval the Staff has no stipulations to
recommend. The petitioner may want to petition to have the westerly 2'
of the 6' easement vacated.

Mr. Clark showed the Commission a picture taken looking at the front of the
existing garage and an aerial photo. As pointed out in the staff report,
the petitioner has gotten permission from NSP, Minnegasco, and Northwestern
Bell to encroach into the easement; and that if this variance is granted, the
petitioner might want to petition to have the 2 ft. easement vacated.
Mr. David Arneson stated they will keep the proposed garage addition in line
with the existing building line which aesthetically is the only thing to do.
The garage when originally built was 21 ft. x 20 ft. which only allows two
cars with very limited space for additional storage. He would like to add
more storage space and working space to the north end of the existing garage.
MOTION BY MS. SAVAGE, SECONDED BY MR. BARNA, TO CLOSE THE PUBLIC HEARING.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BETZOLD DECLARED THE PUBLIC
HEARING CLOSED AT 9:10 P.M.
PIs. Savage stated she felt the hardship had been indicated in the inadequacy
of storage space and work space. She was impressed with the fact that this
was a small variance request, only 1 ft. It was a reasonable request and
aesthetically the additional garage space would not encroach into anyone's
view.
Mr. Barna stated he had no problem with the variance. The hardship was the
fact that the house was built needing a 1 ft. variance when it was rebuilt
after the 1965 tornado. It was not a hardship created by the petitioner, but
an existing hardship.
Mr. Betzold agreed. He stated there was an existing structure that probably
should not have been built that close to the lot line but it was, and the
Commission could not penalize the present owners for mistakes made previously.
MOTION BY MS. SAVAGE, SECONDED BY MR. BARNA, TO APPROVE VARIANCE REQUEST,

A. PUBLIC PURPOSE SERVED BY REQUIRE1ENT:
Section 205.07.3, D, 2b requires a side yard of five (5) feet between
an attached accessory building or use and side property lines.
Public purpose served by this requirement is to provide space between
individual structures to reduce conflagration of fire, to provide
access to the rear yard for emergencies and to limit the condition of
crowding in the residential neighborhood.
B. STATED HARDSHIP:
"I intend to build in line with existing garage, which is also 4 ft.
from the east property line."
C. ADMININSTRATIVE STAFF REVIEW:
The petitioner presently has a 21 ft. x 20 ft. garage built 4 ft. off
the east lot line. The house and garage were reconstructed in 1965.
The present garage is 2 ft. into a 6 ft. drainage and utility easement.
All the utility companies and the City granted the 2 ft. encroachment.
At that time the petitioner has repetitioned the utility companies for
the addition which they have granted.
The house to the east is 10 ft. from the common lot line and is con-
structed in front where this addition would take place.
If the Board recommends approval, the Staff has no stipulations to
recommend. The petitioner might want to petition to have the westerly
2 ft, of the 6 ft. easement vacated.

Dear Mr. Arneson:
I am writing to you to explain the stop -work order that was delivered to your
residence last Friday afternoon. We attempted to phone you then and again
this morning, but no one answered.
Upon review of the lot survey by Suburban Engineering that you dropped off
last Friday when you picked up your building permit, the staff discovered a
discrepancy in the existing side yard dimensions. The sketch that you
submitted for the Appeals Commission variance shows a four foot side yard.
But the lot survey dated September 18, 1984 appears to indicate a side yard
decreasing frcm 3.7 feet down to to 3.1 feet.
RY,e Appeals Commission issued you a side yard variance on June 24, 1986 for
the four feet you requested. You now have two options. First, if you wish
to proceed immediately with building the garage extension, you must respect
the four foot setback which you were granted. This may require an off -set in
the garage exterior according to the lot survey.
Or second, if you wish to build the extension without such an off -set, you
reed a variance for a smaller side yard setback to acoomodate that extension
according to the said lot survey.
Please contact the Cmmumity Development Department as soon as possible and
let us know how you wish to proceed. I have taken the liberty of putting
this on the agenda for the next Appeals C mmd scion meeting which is scheduled
for July 15, 1986, in order to expedite the process if you choose to proceed
with the second option.
Again, please contact myself or Debbie Hootz as soon as possible so that we
may assist you in this matter.

Mr. Clark showed the Commission a picture taken looking at the front of the
existing garage and an aerial photo. As pointed out in the staff report,
the petitioner has gotten permission from NSP, Minnegasco, and Northwestern
Bell to -encroach into the easement; and that if this variance is granted, the
petitioner might want to petition to have the 2 ft. easement vacated.
Mr. David Arneson stated they will keep the proposed garage addition in line
with the existing building line which aesthetically is the only thing to do.
The garage when originally built was 21 ft. x 20 ft, which only allows two
cars with very limited space for additional storage. He would like to add
more storage space and working space to the north end of the existing garage.
MOTION BY MS. SAVAGE, SECONDED BY MR. BARNA, TO CLOSE THE PUBLIC HEARING.

f1s. Savage stated she felt the hardship had been indicated in the inadequacy
of storage space and work space. She was impressed with the fact that this
was a small variance request, only 1 ft. It was a reasonable request and
aesthetically the additional garage space would not encroach into anyone's
view.
fir. Barna stated he had no problem with the variance. The hardship was the
fact that the house was built needing a 1 ft. variance when it was rebuilt
after the 1965 tornado. It was not a hardship created by the petitioner, but
an existing hardship.
Mr. Betzold agreed. He stated there was an existing structure that probably
should not have been built that close to the lot line but it was, and the
Commission could not penalize the present owners for mistakes made previously.
