Dear Mr. Reese:
On Tuesday, February 27th, I went to the site to observe the basement
stud wall. I sent into eight townhouses and the stud wall construction
was basically the same. There was a double 2x4 post at the end of
the 12'-0" wall, then 3 unsupported studs, then 3 supported studs,
then 3 unsupported studs and the last stud is against the masonry wall.
The total load to the wall is about 12,000 lbs. The total capacity
of the wall is about 17,000 lbs. It is my opinion that the wall is
structurally adequate.

SUBJECT: Rice Creek Townhouse Playground Equipment
The issue of the Rice Creek Townhouse playground equipment has been
surfacing every year for the last 3 or 4 years. Jack Kirk and I
have talked with the management, the owners and the Anoka County
Parks Department as well as the Council about the condition and the
replacement of the existing playground equipment numerous times
during this period.
The playground equipment was originally provided by the townhouse
development behind the townhouses for their use. It was then
transferred to the City. When the City provided the Locke Park
properties to the County for the regional trail system, this
property and the playground equipment was transferred to the
County. It was also understood by the City that the requirement
for the establishment and maintenance of the playground equipment
was also transferred to the County. This issue has raised numerous
discussions in the past.
The City has not programmed or funded a playground facility for the
townhouses. The County does not feel it is warranted to provide
playground equipment for the townhouses but would rather place this
type of equipment within their park which is just to the west of
the townhouse property.
It appears that the County has $10,000 available to purchase a
playground set valued at $15,000 and, therefore, is asking the City
to participate in the additional $5,000 for its purchase and
installation.
The Park Capital Improvement fund had $15,000.00 allocated to
playground equipment and that is ordered for Plaza Park and Summit
Square Park. There is not any significant money available in the
Recreation and Natural Resource or Public Works budget. Unless an
additional $5,000.00 is allocated or donated money can be obtained,
it may be difficult to participate in the project.

This proposal was taken to the Parks and Recreation Commission in
September of 1989 and the biggest concern was one of safety; the
children would have to walk through a forested area to get to this
new site. The Commission was reluctant to support the project at
that time.
It would be my recommendation that we review this year's budget in
an attempt to facilitate the Anoka County Parks Department's
request as it would establish definite ownership and responsibility
to Anoka County Park Department.

Re: Deteriorating playground equipment located
adjacent to the Rice Creek Townhouses
Dear Mr. Burns:
In the development of the Rice Creek Regional Trail Anoka County purchased
the property along Rice Creek from the City. At the time of said purchase
it was agreed that the City of Fridley would maintain the playground
equipment that was provided for the Rice Creek Townhouses' children.
Since that time the equipment continues to deteriorate, as it was
non-commercial equipment to service children in the Rice Creek Townhouses
only.
We have had many discussions with the City of Fridley Public Works about
the maintenance and upgrading or replacement of this equipment. Last fall
I was informed by City staff that they would be talking to the townhouses'
management about the removal of this equipment and replacing it with a new
climbing apparatus, which includes slides and swings, on property adjacent
to the new restroom facilities off of 69th (see attached map).
In my discussions with the City staff last fall I suggested that the
$10,000 still remaining in the trail grant could be used for this project,
and that the City would be asked to participate with a $5,000 grant for
said project. This would provide updated, modern playground equipment and
definitely become the responsibility of the Anoka County Park Department
to maintain. I have discussed this in detail with John Flora, City
Engineer for the City of Fridley, and we believe this would satisfy the
needs of that particular area.

SUBJECT: Rice Creek Townhouse Tot Lot
The Rice Creek Townhouse tot lot has been an item of concern and confusion for a number
of years. No one is willing to accept responsibility for it. It was originally constructed by
the townhouse development but was placed on County land.
The most recent discussions we have had was that the City would assist in maintaining the
tot lot equipment and the County would take care of the tennis courts and adjoining
property. It appears these actions have not been followed up.
We inspected the tot lot area and have found that the benches and equipment need painting
and repair, the sand in the tot lot needs to be replaced, there is a considerable amount of
weeds growing due to lack of maintenance and use, the access to the area is obstructed by
tree growth, and the tennis court needs repair and a new net.
We have again repaired the swings with new chains and can initiate action to repaint the
equipment and benches with our summer maintenance program.
I am working with Dave Torkildson of the Anoka County Parks Department regarding the
tennis court, the sand and the access to the area. Currently, this has not been resolved.
I will keep you informed on this item as it develops.

Several residents have contacted me relative to a rumor regarding the
totlot behind the Rice Creek Townhouses. The rumor is unfounded and
untrue! There are NO plans to remove any safe totlot equipment, or to
turn the area into a parking lot. No such plans have ever been
discussed by the City Council, nor by the Anoka County Board of
Commissioners.
I have personally talked with Anoka County Oommissioner Paul McCarron.
He is absolutely supportive of the totlot, and assures me that the
County desires to allow the totlot to continue to operate.
One piece of park equipment is potentially dangerous; it will be
either repaired or removed (the merry-go-round). The City has already
repaired the four swings.
There is a question of responsibility for the totlot. Originally, the
owners of the Rice Creek Townhouse Complex agreed to maintain the land
and equipment (City Reoords indicate they purchased the equipment) .
The land has now become part of the Anoka County Rice Creek Park
System. The County is presently attempting to prepare and execute the
appropriate documents to determine ultimate responsibility for the
land and for maintenance.
Please rest assured that both the City and the County are concerned
about the recreational needs of the children in the area.

Based upon the Council's. concern expressed at the Monday, March 30, 1987
Conference Meeting regarding the totlot located behind the Rice Creek
Townhouses, I visited the site and communicated with Commissioner McCarron
and County Park Director Dave Tbrkildson regarding this subject.
The totlot currently has two pipe climbing apparatuses, a youth swing and a
child swing, teeter totter, two spring toys, two slides and a
merry-go-round plus a single tennis court. Two of the youth swings and two
of the child swings are in need of repair. The merry-go-round, base and
platform are all that remain. The tennis court lacks lines and the net is
loose and requires a new top tape. The area of the totlot and tennis court
are signed indicating they are private property and no tresspassing
allowed.
Commissioner McCarron indicated that if it is a County responsibility, they
would maintain it or initiate action to define responsibility for the
equipment.
Mr. Tbrkildson has indicated the equipment is not the responsibility of. the
County and they are attempting to resolve ownership and maintenance
responsibil ity.
I offered the County City support in repairing the four swings. They have
been repaired No further action is to be taken until they can resolve
with the Rice Creek Townhouse owner the responsiblity to operate and
maintain the facilities.
There are no plans at this time to remove or eliminate the existing
facilities.
Same time in the early 1970's, the owner of the townhouse procured the
playground equipment and the City installed it. The tennis court was
installed by the owner. When plans were being proposed for the Rice Creek
Trail System, the City sold the property to the County which contained the
existing tennis court and totlot. It was everyone's understanding, at that
time, that the responsibility for maintenance and operation of the
recreational equipment belonged to the townhouse owner. Apparently,
through sales, subsequent owners of the property did not understand or
accept this responsibility.
It is the County's intent to prepare and execute documents which will allow
the continuation of the recreational use of this area by the townhouse
ownership based upon their operation and maintenance of those facilities.
Until this is resolved or the County requests assistance from the City, we
are currently not initiating any further action.
