At the March 28, 2001 Appeals Commission meeting for the Public Hearing: Variance
Request, VAR #01-13, by Robert Engesether it was stipulated that the variance was
contingent on the petitioner and City Staff agreeing on the exact dimensions of the
existing house on the lot. City Staff and Mr. Engesether have agreed on the
measurement of 20.6 from the house to the rear yard lot line as provided by Mr.
Engesether. VAR #01-03 was approved to reduce the rear yard setback from 33.5 feet
to 20.6 feet to recognize an existing nonconformity, with the stipulations attached.

On March 28, 2001, the Fridley Appeals Commission officially approved a request for a
variance, VAR #01-03 to reduce the rear yard setback from 33.5 feet to 20.6 feet to recognize an
existing nonconformity on Lots 29-30, Block 15, Camp Howard & I -1=s 11, to Fridley, generally
located at 36 700' Way, with the following stipulations: 4�Ws
1. The petitioner shall obtain all necessary building permits prior to construction of the
additions.
2. Any additions shall be architecturally compatible with the existing home.
3. The variance is contingent on the petitioner and City staff agreeing on the exact
dimensions of the existing house on the lot.
You have one year from the date of the Appeals Commission action to initiate construction: If
you cannot begin construction during this time, you must submit a letter requesting an
extension at least three weeks prior to the expiration date.

REQUEST
Petitioner is seeking to reduce the required rearyard setback from 33.5' to 21.8' in order to
recognize an existing non -conformity at 36 NE 70' Way. A corner of the existing garage is
21.8' from the code defined rear property line. The recognition of this non -conformity is
required prior to the issuance of any building permits to expand the home.

ANALYSIS
The property is located on the corner of Hickory Place and 70t` Way. The lot is somewhat
irregularly shaped, with the home being "squared up" to and fronting on 70t` Way, despite
Hickory Place being the Code defined front yard. The existing home and attached garage was

MOTION by Ms. Jackson, seconded by Mr. Jones, to approve the February 14, 2001, Appeals
Commission meeting minutes as presented.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED UNANIMOUSLY.

Per Section 205.07.03D.(3).(a) of the Fridley Zoning Code, to reduce the required rear
yard setback from 33.5 feet to 21.8 feet to recognize an existing nonconformity on Lots
29-30, Block 15, Camp Howard & Hushs 1St Addition to Fridley, generally located at 36
70th Way.
MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading and open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:31 P.M.
Mr. Hickok stated that the petitioner is requesting a variance to reduce the required rear yard
setback from 33.5 feet to 21.8 feet to correct a nonconforming existing condition. His hardship
summary states: "When our house was built in 1959, the placement of the house caused a
nonconformity on the rear setback. Now we need a variance to get the rear setback non-
conformity legal for future family room addition plans." After reviewing and analyzing this, staff
has no recommendation as the request is within previously granted dimensions. Similar
variances were granted in the past. Examples are VAR #99-20 at 1561 Rice Creek Road with
the rear yard setback reduced to 10.5 feet and VAR #00-28 at 1420 Glacier Lane with the rear
yard setback reduced to 11 feet. If the Commission recommends approval, staff recommends
some stipulations.

Dr. Vos asked about the required setback on this kind of configuration.
Mr. Hickok stated the required setback is 33.7 feet.
Dr. Vos stated that the comer is at that required setback, but everything after that is not.
Mr. Hickok stated that is correct.
Mr. Kuechle stated that the nonconformity right now is on the corner of the house.
Mr. Hickok stated that is correct.
Mr. HRckok stated that an addition is proposed, If no additions were proposed, that non-
conformity would sit there. The petitioner plans to build an addition onto the back of the home.
Dr. Vos stated that the 21.8 feet needs to be approved from the comer of the garage to the back
yard straight back from Hickory Place. It has nothing to do with the addition.
Mr. Hickok stated that is correct. A nonconforming use can be maintained but not enlarged.
Dr. Vos asked if the proposed addition could come back further because it is a side yard.
Mr. Jones asked if that was the way the dimensions were measured instead of coming out
perpendicular to the side yard with the 33.8 foot dimension.
Mr. Hickok stated that the proper way is to create a dimension that is straight in perpendicular
on the Hickory side to the lot line.
Dr. Vos stated that it would be longer than 30 feet.
Mr. Hickok stated it would. It does not meet the minimum standard, but that is a valid point. He
is sorry they did not catch that.
Mr. Kuechle asked how this would be dealt with. - —
Mr. Hickok stated staff will need to figure this out mathematically.
Dr. Vos stated that it should be straight out from Hickory Place.
Mr. Hickok stated that the existing nonconforming rear yard situation could be accepted and
recognized.
Ms. Jackson asked if they have to have the exact number of feet in the approval.
Mr. Hickok asked the petitioner if he had the scale illustration.
Mr. Engesether stated he did not. Those two lines that run in an angle straight at the house
came off the building permit. That is the only thing it showed.
Mr. Kuechle asked if he drew those lines on the picture.

Mr. Engesether stated that the architect drew the plans. He drew the house on the paper. He
measured out to the street and the back yard.
Mr. Kuechle asked if it was an as -built survey.
Mr. Engesether stated it was not.
Mr. Hickok asked if he could distinguish the lines better on the aerial.
Mr. Engesether stated that the other picture had the line right on the lot line.
Mr. Hickok stated that on a 20 scale it looks like 13 feet.
Mr. Tynjala asked if they had to give an exact number.
Mr. Hickok stated they did not.
Dr. Vos stated they are talking about a garage they are not going to tear down or the addition
that should not go any further. It is an existing nonconformity that they do not know the answer
to.
Mr. Jones stated that it seems it is not going to make a big difference if it is off a foot or two.
The question is if they could approve it subject to determining this. Has the permit been drawn
for the addition?
Mr. Hickok stated that the permit is not issued until the variance is approved.
Mr. Jones asked if the addition would be in compliance.
Mr. Hickok stated it would.
Ms. Jackson stated that the proposed addition goes to the side yard.
Mr. Engesether stated that the addition would be close to 33.5 feet.
MOTION by Dr. Vos, seconded by Mr. Jones, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:47 P.M.
Mr. Kuechle stated they could add another stipulation that approval of the variance request is
contingent on the petitioner and staff agreeing on the correct dimensions for the nonconformity.
Mr. Hickok stated that would work.
Dr. Vos stated it is a nonconformity that will not affect the neighborhood, and he would vote in
favor of the variance.
Mr. Kuechle stated that the idea for having the setbacks from side yards is to preclude
overcrowding. The lot is obviously not overcrowded.
