This memorandum is in reponse to your inquiry dated March 7, 1991.
It is my understanding that the City collected a park fee on Lot 10,
Block 3, Riverwood Park Addition. Apparently an original park
fee was collected on this property in 1963. The property was
then replatted in 1986. In 1989 a second park fee was paid by
the builder when he took out a building permit on the replatted
lot.
You asked the question whether the refund should be paid to the
contractor or to the owner of the property. I would suggest that
you determine whether the present owner is the original owner of
the property; if so, I believe the refund check should be paid
jointly to the contractor and to the homeowners. If the present
owner is not the original owner, then we had better have some
additional conversation on this subject.

It was brought to my attention in January 1991 by Darrel Clark,
that a certain property in Fridley had paid a park fee twice. The
property involved was originally platted into Riverwood Manor. At
that time a park fee of $15.00 per parcel was paid on 8 lots for

In April 1986 several parcels were replatted into Riverwood Park
Addition. At that time another park fee of $1500.00 was placed on
these replatted parcels. This should not have happened since only
one park fee is required per parcel when platted. When a building
permit was taken out on Lot 10, Block 3, Riverwood Park, on April
261, 1989 by Jerry Tollefson Construction, the second park fee of
$1500.00 was paid per receipt # 32139.
Darrel Clark stated that we should be refunding the second park fee
of $1500.00. The question is to whom, taking into consideration
that Jerry Tollefson Construction more than likely, passed this
cost onto the new home buyer at the time.

It has been brought to our attention that your property has paid
a park fee twice. When your property was originally platted in
1963 into Riverwood Manor a park fee was paid. In 1986 several
parcels were replatted into Riverwood Park Addition and another
park fee was placed on the replatted parcels. This should not have
happened since only one park fee is required per parcel when
platted. When a building permit was taken out on Lot 10, Block 3,
Riverwood Park, on April 26, 1989 by Jerry Tollefson Construction,
the second park fee was paid.
Enclosed is a refund check in the amount of $1,500 for the second
park fee collected on your property. The check is made out to
Terry M. Oltmanns, Nancy P. Thole, as owners of the property, and
Jerry Tollefson Construction, Inc. The question of who to return
the park fee to was researched by the City Attorney and it is his
opinion that the check be made payable to all parties concerned,
as it is normal practice to have incorporated the park fee in the.
cost of building the home.
