When these buildings were built, the parking stalls provided met the existing Code.
Even though three of these buildings are a couple of stalls short based on the formula
of 1 stall per 1 bedroom apartment and l'i stalls per 2 bedroom apartment (1983 Code),
each unit does have one stall provided. Even if the apartments expanded their parking
lot, if this is possible, Z feel there would still be a problem because most tenants
have 2 cars.

Per our discussion yesterday, I'm sending you this letter. As I articulated to you last week, staff
discovered the attached correspondence regarding Transformation House at 35174th Avenue, from
Virgil Herrick, who was the City's Attorney in 1993. The City's current attorney, Fritz Knaak, is of the
same opinion that was determined in 1993 by Mr. Herrick. The Transformation House use; can be
located at 36174th Avenue, despite the non -conforming status of the property.
Drafting a cross -parking agreement will help alleviate the City's parking concerns.

This Memorandum is in response to your Memo of December 15, 1993
regarding the above subject.
It is my understanding that Betty Matthews has inquired about
establishing a for-profit facility for chemically dependent
counseling services for women.
It is proposed that this facility be located in an it -unit
apartment building at 351 -74th Avenue Northeast. This apartment
building is located on property which is currently zoned R-2, Two
Family Dwelling.
In your Memorandum of December 15, 1993 you asked the following
three questions:
il Is the proposed uec a permitted use under State Statute
and the City's zoning ordinance for a residential
licensed facility?
2. Is a special use permit required for this type of use?
3. The 11 -unit building is located on a property which is
currently zoned R-2, Two Family Dwelling. Does the
nonconforming status of the building affect the
proposed use in any way?
In previous conversation you advised me that Betty Matthews has
been in contact with the Licensing Department of the Minnesota
Human Services Department. I contacted a representative of that
Department and discussed the proposed facility as well as the

licensing procedure of the Department. I have been advised that
this type of facility is considered as one of the residential
programs which is governed by State Statute 245A. Section
245A.11 is entitled "Special conditions for residential
programs".
"Subdivision 1. Policy statement. It is the policy of
the state that persons shall not be excluded by
municipal zoning ordinances or other land use
regulations from the benefits or normal residential
surroundings."
"Subd. 3. Permitted multifamily residential use.
Unless otherwise provided in any town, municipal, or
county zoning regulation, a licensed residential
program with a licensed capacity of seven to 16 persons
shall be considered a permitted multifamily residential
use of property for the purposes of zoning and other
land use regulations. A town, municipal, or county
zoning authority may required a conditional use or
special use permit to assure proper maintenance and
operation of a residential program. Conditions imposed
on the residential program must not be more restrictive
than those imposed on other conditional uses or special
uses of residential property in the same zones, unless
the additional conditions are necessary to protect the
health and safety of the persons being served by the
program. Nothing in Section 245A.01 to 245A.16 shall
be construed to exclude or prohibit residential
programs from single-family zones if otherwise
permitted by local zoning regulations."
In your first question you ask whether the proposed use is
permitted under the State Statute. If the applicant secures the
required licenses from the Human Services Department it is my
opinion that they would be a licensed residential program and
could conduct a facility for up to sixteen persons. It is my
opinion that Section 245A.11 would override any municipal zoning
ordinances that would attempt to prohibit this facility.
You also inquire as to whether a special use permit is required.
In my opinion a special use permit is not required. Section
245A.11, Subd. 3 which is quoted above states that a city may
require a conditional use permit to assure proper maintenance and
operation of a residential program. However, it also states that
the conditions imposed on the residential program must not be
more restrictive than those imposed on other conditional uses or
special uses of residential property in the same zones. I

believe that the City can rely on the licensing and inspection of
the State Human Services Department to provide adequate
protection for the health and safety of the persons being served
by the program. An attempt to require a conditional use permit
that would prohibit this type of facility would be similar to the
situation the City of Fridley was involved in with Community
Options. In that case the City denied the special use permit and
the district court found that the City was arbitrary in refusing
to issue the conditional use permit and that its refusal was
contrary to the provisions of Minnesota Statute 245A.
You also asked whether the fact that the building is a
nonconforming building had any affect on my opinion. This is an
11 -unit apartment building and even though it is on an R-2 zone
it has nonconforming status. This means that the owner of the
property can operate the building and could under the terms of
the Fridley ordinance have five unrelated individuals in each of
the eleven units. I do not believe that the fact that some of
these individuals are being treated for alcohol dependency while
they are residents in the building would change the nonconforming
status. I base this conclusion on two premises: 1) this is a
licensed facility by the State and the State Legislature has
indicated that the City may not adopt ordinances to restrict the
location of these licensed residential facilities in residential
areas of the City and 2) that alcoholism is considered a
"disability" in Minnesota Statute 363.03. It is my understanding
that as long as the individual suffering from alcoholism is no
longer drinking and is in treatment that they are a "disabled
person". Refusal to rent to "disabled persons" would be a
violation of the Minnesota Human Rights Act.
For the reasons cited above, I do not believe that the City
should require a conditional use permit. If a permit were to be
required, the terms of the permit could only go to the safety and
welfare of the residents as opposed to prohibiting the operation
of the facility.

Regarding 8 unit apartment building at nth Ave.. N�
Transformation House operates a dorm style living for there clients. The clients live on site for 30 to
60 days where they receive counseling regarding chemical addiction. This is a faith based program
and licensed by the state.
Transformation House has been operating at 351 74th Ave for 20 plus years, and has a very good
track record. This is the building next to 361 74th Ave that they wish to buy and convert.
To address your concerns of parking they would have up to 24 clients and 3 staff people at the site,
the majority of clients do not have cars on site. On average 20% have cars which figures to 5 plus 3
for staff totaling 8, we feel the current 10 stalls will service our needs. The 351 building is a 12 unit
building, with like ratios that we are basing this information on. Another advantage of expanding the
business in adjacent building is that parking can balance between the 2 building if one lot is full.
Please consider the conversion of this building to like use. The conversion is minor and can be
converted back to a standard apartment if this program ever goes away. One unit becomes the
kitchen dining for the building and one unit becomes office and counseling area. Both of these units
use the bedrooms as counseling rooms, The dining area also serves as a TV room.

Hi Fritz,
Last week we received a request from John Weicht, as to whether or not he could operate transitional housing
(women's group home) at 36174th Avenue. They currently operate a facility next door at 35174th Avenue. Scott,
Julie and I did some research and discovered the following:
• This is a 8 unit building, however it doesn't meet lot size requirements from 8 units. It is only 15,000 sq. ft.
in size, where code would require 19,000 sq. fL for 8 units. As a result, it is considered non -conforming.
• There are only 8-10 parking stalls on site. Which would be deficient to what Mr. Weicht would like to use
the building for.
As Mr. Weight describes in the attached letter, he would set each unit up like a dorm, and each unit could house 4-5
women. This means that there could be up to 40 women that could occupy the building, thus the parking concern
we have.
As a result, of the above, I called him back and told him that this type of use wouldn't work on this property based
on the fact that the existing building is non -conforming and there are parking and occupancy concerns. He would
like a formal opinion from our City Attorney.

Transition House, which occupies both of the above referenced properties has had some issues with getting their
license from the State of Minnesota for the 361 74th Avenue address because the properties are too close to one
another. Scott and I suggested they combine the parcels to alleviate that concern. Now, the State would like some
documentation from us saying the lot combination has been complete.
Can you let me know if the lots have been combined and if the process is complete?
