#30855 - PROJECTS: STREET IMPROVEMENT:
The City Attorney reported that in his opinion the City should not appeal, as
he felt they could not do any better through an appeal. Councilman Harris
commented that the City is now owners per se of this property. The City
Attorney said that possibly the City could abandon the condemnation, but
he was not sure if this was entirely legal. Councilman Harris said that he
felt that the land was a good buy at this price.
MOTION by Councilman Liebl to authorize transfer of funds from the
emergency general fund to the Parks and Recreation fund, and payment of the
commissioners fees for Condemnation #31257 and #30855. Seconded by
Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
COMMUNICATIONS:
A. RAYMOND RENNER: REQUEST FOR REMOVAL FROM ASSESSMENT - PROJECT ST.
1971-2 (MSAS) -
MOTION by Councilman Harris to receive the communication from Raymond
Renner, 1564 Gardena Avenue, dated July 7, 1970. Seconded by Councilman
Liebl. Upon a voice vote, all voting aye, Mayor Kirham declared the motion
carried.
RECEIVING PETITION NO. 10-1970 REQUESTING COUNCIL TO TAKE ANY AND ALL
ACTIONS THAT WILL RESULT IN THE IMPROVEMENT AND GENERAL LIVING CONDITIONS
ON THE PROPERTY AND BUILDINGS AT 6025 3RD STREET N.E. :
MOTION by Councilman Liebl to receive Petition No. 10-1970 and instruct the
Inspectors to check out this property and report back- on the condition and
give the people sufficient time to correct the condition. Seconded by
Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
REPORT ON WATER LINE IN HICKORY DRIVE:
The City Engineer explained that the Council previously authorized giving the
contract for the repair of the joints in the water line to G.L. Contracting
Inc. Since then his department has found that there is more repair necessary
than was anticipated. He suggested that the laying of the new line in
Hickory Circle could be put into the street improvement project (although
it would not be assessed) and have that contractor do•this work, and have
G.L. Contracting Inc. continue to replace the joints. Councilman Liebl
asked if this would save any money. The City Engineer, said no, it would
just be splitting up the work to eliminate letting another contract.
Councilman Liebl said that this would have to be done before the new street
is put in anyhow. He asked what preventions were going to be taken to
forestall this happening again.. The City Engineer said that the 4" line
in Hickory Circle was going to be increased to 6" so that it could be
flushed and the joints are going to be wrapped with polyethylene. Council-
man Breider asked how much the new line would cost. The City Engineer said
that it would be over $3500 and would not be assessableit would be in
the nature of a repair.

Mr. Richard Anderson, 861 West Moore Lake Drive N.E. , said that he agreed
that the street needed fixing, although he must also agree with Mr.
Savelkoul. This street is not strictly a residential street, there is too
much traffic. He felt that a three way stop sign at Able might help to
control the traffic. He said that he did not understand why the proposal
for the sidewalks. They would go out to T.H. #65 and quit at the Highway.
Councilman Harris said that the sidewalks were part of an overall plan
that includes a controlled access at that intersection. Mr. Anderson
asked if-there were any plans for sidewalks for Able.or Baker. Mayor
Kirkham said not to his knowledge. Mr. Anderson asked how wide the street
was going to be and how much boulevard there is for the sidewalks. The
City Engineer said that the street would be the-same width as by the. St.
Philips Church. If the same procedure-for the sidewalks is followed,
the property would be given by the property owner and then they would not
be assessed. The sidewalks would then be on the property owner's land.
If the land is not given freely, he would recommend that there not be
sidewalks as there would be no room for snow storage. Usually 8' is
needed in the boulevard, but there have been cases=where-sidewalks have
been put in with less. . Mr. Anderson asked if there was considerable amount
of objections, could the City condemn. The City Engineer said that they
do have that right. The sidewalk program was adopted in conjunction with the
schools, -and this sidewalk was in-the plans.
A resident asked about the drainage. The City Engineer said that the
syxtem was installed when the rest of West Moore.Lake_Drive was paved.
in 1966. . The storm sewer- system is already provided for. The resident
said that he also would object to the sidewalks. He .felt that he would
not be _able to maintain the grass because of the salt used,-and the
grass would not grow in the boulevard area.
Mayor Kirkham suggested just putting the sidewalks on the north side of
the street and off centering the street within'the`right of way. The
City Engineer said that there was only 60' right of way here, but it
could probably be worked out.
Mr. Stan Carlson, 6219 Baker Street N.E. said that he agreed with his
neighbors on the sidewalks. He said .that he. could see no good use
during the school year, when. they would be needed, they would be covered
with snow. The sidewalks by the church are not cleared. Consideration
must be given to how to clean and maintain them once they are put in.
A resident from the area said that he belonged to St. Philips Church and
they havefoundit impossible to keep,their sidewalk cleared in winter. .
He said that he was not in favor of sidewalks,. and he thought that the
City would have trouble getting land from the north side of the street.
MOTION by Councilman Harris to close the public hearing on Street Improve-
ment Project St. 1971-2 (MSAS) . The motion was seconded and upon a voice
vote, all voting aye, _Mayor• Kirkham declared the motion carried and the
public hearing closed at 10:20 P.M.

Within legal authority, please accomplish the
necessary inspection of the property and direct letter to pro-
perty owner when owner is not complying with the law and applicable
City Codes.
The Building Inspection section of the Engineering
Department will be accomplishing building, plumbing and electrical
inspections. Please coordinate with them to ensure that
duplicate itc—as arc not covered.

A survey was made by me of this property on July 18, 1970. Mr. and
Mrs . Jack Habel, renters, were present during my inspection. The interior
of the house was also checked by me including the basement .
Mr. and Mrs . Habel have lived in the house for almost three years .
Mr. Habel is partially crippled and is repairing the property as fast as
he is able to do so. Mr. Habel works at Snyder's Drug and could be contacted
there if necessary. The property is owned by Ranko and xrene Schuur . ' Mr.
Habel informed me that this is "Shorty" of Shorty's Towing Service on
University. The owner may contact you relative to this report by various
staff people . I said we would like to discuss it with him.
This is a rather large piece of property with a rather old house and
garage on the rear of the lot from 3rd Street . The house does not conform
with the setbacks of the newer properties . The garage is somewhat atypical
in looks because it has the appearance of an old house from the exterior .
It may. have been a house at one time .
The majority of the house and garage is covered with asphalt shingles . r
Mr. Habel has painted the house exterior but not the garage. The garage is
a dark brown, and he says he will also paint the garage . Some exterior
shingles of the house need toreplaced .

-The interior of the house is heated by two space heaters, one is gas
and the other is oil . Mr. Habel desires to eliminate the oil as soon as
possible. Some of the floor tile needs to be replaced, and some wood rot

of the garage. Mr . Habel was requested to remove it .

The property is marginal. However, it is not in a dilapidated

1. Remove all litter on- the west side of the garage.

We represent Mr. and Mrs. Michael Parlin who reside at 6025 3rd Stree
N .E. in your City. Our clients have contacted us and reques e at
we explain to them any rights they may have regarding the City' s
apparent recent denial of their rehabilitation grant application.
I refer specifically to the letter from Mr. Boardman to our clients
dated October 10, 1978.
As I understand it, the City has denied the grant application of our
clients in spite of the fact that they are clearly eligible for the
same, for two reasons. One is that the bits obtained for the rehabilita-
tion work amount to more than 50% of the assessed market value of the
house structure (not including land) , as apparently determined .by the
City. Two it is the opinion of one of your inspectors that our client's
residence could not be made ' structurally sound.
It appears that the requirement made by the City concerning the relation-
ship between the amount of the bid and the assessed market value for
the house structure only was a determination made well after our client' s

I am writing you again because I would like to_ point out a
couple things about the latest letter from Fridley-
-First of all, the set of policy standards sent to you, is a
complete new list from at the beginning, in Marchtwhen we first
I applied. I've enclosed a copy of the original rules. Notice how
t the ones that were changed seem to fit us personally. This new set
of rules did not come out until after we wrote to both you and
the state HUD office.
Second, we don't want to argue the point anymore, but the
$30,000* limit on houses was voiced at the first council meeting
- on this money. (Mike was at that meeting.) It was just never
put in the qualifications. The point is, the money was for low
income families, and to improve on the looks of the neighborhood.
Third, their statement of selling being better for us, is nutsi
How could it be? They get the land, payments on 2 properties-
inoluding, certainly, higher tares than we now pay. We would lose-
we would have only -j our land, would start making payments all
over again, probebly higher than we now pay. We honestly can't
afford a higher payment than we now pay, and further, this land
is our only asset- the only thing we have worth anything.
Fourth, we don't know where they arrived at the figure 313,100.
for our house. I have enclosed copies of our home-owners insurance
(Farmers Insurance Co.) which show our house valueat $22,000. now.
Mr. Sasse came out and inspected the house, and put this figure on
our insurance policy. Plus, our estimated market value by the city
is $21,000.
Also, our $20,242. bid is not a "piecemealing" bid. It is
simply independent contractors giving bids on each section of work-
which we were told we could do- and they all agreed at the time of
their bids, to work out a timetable with each other. The $11,632.
bid is by a general contractor- who will do all the work, by bidding
it out to sub-contractors- which is what we did with the independents.
Lastly, they have added the words "within the limits of the
program" now that they have new guidelines. Bei'ore, they were telling
us, "would not be structurally sound after work was complete". Now,

with their new rules, they can get out of what the contractor said
about being structurally sound.
We still Seel we should get this work done, so I hope you feel

you can still help on these things I have pointed out. Do you
think there is someone higher than the state HUD that .we should
write to, since they don't seem to have an interest in our
problems either? We honestly feel we are being took all the way
down the line. Fridley really sounds good, because they are
covering themselves every step with new rules. Please try to
help.

Dear Mr. & Mrs. Parlin,
In reading your correspondence to Doug Olson from the Minneapolis Office
of Housing and Urban Development, there seems to be a general misunderstanding
of our program and the programs intent.
I am attaching a copy of the Policy Standards that we have been following
for our housing rehabilitation program. These standards are the basis for deter-
; mination whether or not a family, or a structure, qualifies for rehabilitation
under our program.
There are several misconceptions that you have stated iny our letter that
I would like to have cleared up for the record.

1 . There has never been any determination on a housing value limitation
of $30,000 or under. The two primary monetary limitations relate only to
adjusted gross income of the family and 50% of the assessed valuation of th `
house structure (not including the land value) , as noted in the attached i
Policy Standards.

2. The finding of the building officizil that the structure cannot be made
structurally sound was correct in the fact -that it could not be made struct
ally sound within the limits of this program. It would entail too much cos

under our prgram for the following reasons:
1 . The 1978 assessed market value for your house structure is S13,100
and the one complete estimate for rehabilitation that vie received is
$11 ,632. The 510,242 estimate that you refer to in your letter is piece-
mewling parts of bids which may or may not be valid as a contractor makes
his bid on the total project. Nonetheless , the bid exceeds the required 50`
level and even exceeds the 60% optional level .
2. It is in the opinion of our building official that the structure could
not be made structurally sound v,ithin the limits of this program.

POLICY STANDARDS FOR
HOUSING REHABILITATION
ELIGIBILITY
1. Only single family owner-occupied units are eligible.
2. The homeowner must have an annual adjusted gross income
of $16,000 or less (adjusted using 14HFA guidelines).
3. Qualify and obtain a low interest MHFA loan from the
Fridley State Bank. Certain families may qualify for
100% grants (see income loan/grant sliding scale).
4. Grant monies need only be paid back if a recipient sells
his/her property within five years.
ELIGIBILITY STANDARDS FOR STRUCTURES
1. The structure must be located in the neighborhood strategy
area.
2. All code violations must be repaired and brought up
to building code standards as per inspection by the
building officials.
3.. The structure must be at least 15 years old, or require
correction of items which are hazardous to health or
safety or- be in need of energy conservation improvements.
4. Every structure must be determined ;to be structurally
sound or be made structurally sound upon the completion
of the rehabilitation. This shall be determined by the
building official before any rehab shall begin.
5. The total grant funding for all rehabilitation to the
structure may total no more than 50% of the assessed market .
value of the structure (minus the assessed value of the
land) .
In certain approved cases, rehab costs mai, ul to
60% of the value provided the unit is structurally
sound upon completion. This increase must be approved
by the City Planner based on the following conditions:
a) The structure can be made structurally sound
with the additional rehab work.
b) That the livability of the sturcture, when
rehab is completed, will be substantially
raised from the 50% level of cost.
c) That the rehab versus the removal of the unit
will be of greater -benefit to the neighborhood.
d) That the additional rehab will satisfy the intent
of the City Housing Goals and the purpose of the
rehab program.

CONTRACT FOR DEMOLITION
THIS AGREEMENT entered into this lZk4 ay of April , 1980 by and between
the Fridley Housing and Redevelopment Authority, a Minnesota Public Non-profit
Corporation, (hereinafter referred to as "the Authority") , and Herbst Constru-
ction Company, (hereafter referred to as the Contractor) , is for certain
services and conditions as set forth below:
I. Work to be Performed by Contractor
A. Structure demolition at 6025 3rd Street N.E. including both the
single family house and The garage.
B. Remove all foundation and footings.
C. Fill 'with clean fill and grade to, match surrounding grades.
D. All salvage material to be hauled and is the property of the
Contractor.
II. Work to be Performed by the Authority
A. Utility terminations will be by the City of Fridley.
III. Compensation
Authority agrees to pay contractor $1400.00 as per submitted written
estimate by contractor .for work as conditioned by this contract.
IV. Licensing
The Contractor must obtain all necessary license's and permits as required
by the City of Fridley. All permits are to be paid by the Contractor.
V. Insurance and Liability
The Contractor, as part of the licensing, must submit a Certificate of
Insurance evidencing the holding of Public Liability Insurance in the limits of
$50,000 per person, $100,000 per accident for. bodily injury and $25,000 for
property damage, and a Certificate of Insurance evidencing the holding of Work-
man's Compensation, as .required by law.
In all cases the Authority shall not be liable for any actions arising out of
the Contractor's activities in providing service for the City.

K. Parlin, formerly residents of 6025 3rd St. N.E. , Fridley, Mie! 55432 in regard
to their claims against the City of Fridley.
Notice is hereby given pursuant to Minnesota Statutes Annotated §466.05 that
on or about April 14 or April 15, 1980 at 6025 3rd St. N.E. , Fridley, MN 55432,
the former residence of Michael G. and Diane K. Parlin, the City of Fridley and
its representatives or parties employed or directed by them demolished the house
and garage located upon the site. This property was acquired by the City of Fridley
under the City's large family home ownership program. The Parlins were to have
the home vacated by Wednesday, June 4, 1980 and were permitted to take fixtures
and personal property items with them. The Parlins had begun to remove these items
from the home to their new residence address but had not completed the task of
moving and had,inot�not__ i f* 04 4.1. of Fridley that the move was completed.
Additionally, the '

that Parlins had completely vacated the house and removed the fixtures and -personal
property items they desired to take with them.
When the house and garage were destroyed on or about April 14 or April 15, 1980
prior to the June 4, 1980 deadline, numerous personal property items of the Parlins
were destroyed including kitchen cabinets, desk, gas stove, armchair, easychair,
A small dresser, metal storage cabinet, two sets of doors, waterheater, workbench,
storage cabinet, 1967 Chevrolet 4-barrel manifold, 1967 Chevrolet 4-barrel carburetor,
two year old Delco battery, 1972 Ford 400 CID Heads, 1972 Ford 400 CID Manifold
dual exhaust system with manifolds, two INT. 3/4 ton 5x6 rims, 4-speed Muncie
transmission, 4-speed Hearst Shifter, two 1960 T-Gird bucket seats, one 1949 Ford
radiator, one 1965 Olds radiator, one 1965 Buick radiator and miscellaneous small
parts.
