PUBLIC HEARING, DECEMBER 11, 1967 PAGE 14 arrows in the City of Fridley. He said young people are shooting the wild ducks in Rice Creek with steel tipped arrows, and they are also trapping muskrat. He said he wondered why a City of this size allowed this as it was dangerous to children and to pets. The Council thanked Mr. Grivna for bringing this to their attention, and said that something would be done on this right away. VISITOR: ICE SKATING RINK BY MATTERHORN DRIVE: A visitor to the Council Meeting asked if the City could set up a skating rink near Matterhorn Drive and the water tower. The City Engineer said that the City did own some park land in this area, but he could not remember any level spot. Mayor Kirkham told the visitor he could contact Paul Brown, the Parks and Recreation Director, and if a rink was feasible, maybe they could get one in there. RICHARD T. SIM40NS - VALIDITY OF BUILDING PERMIT FOR DOUBLE BUNGALOW AT 360 - 57TH AVENUE NORTHEAST: The City Manager said he had received a telephone call from the First Federal Savings & Loan Company who is handling the mortgage for Mr. Richard T. Simmons, and they would like verification from the Council that the building permit was a valid permit and within the requirements of the City ordinances. The City Manager asked the secretary to read the following letter, which was written to Mr. Richard T. Simmons, for Council verification: December 4, 1967 Mr. Richard T. Simmons 353 - 57th Place Northeast Fridley, Minnesota 55421 Dear Mr. Simmons: The permit for construction of the double bungalow at 360-57th Avenue Northeast has been reviewed and must be considered to be a valid permit and is being constructed within the requirements of City ordinances . Very truly yours, /s/ Homer R. Ankrum, City Manager MOTION by Councilman Liebl to approve the contents of the letter to Mr. Simmons and send a copy to the mortgage company. Seconded by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried . SALARY SURVEY: The City Manager said that the salary survey to be done by the Metropolitan Section of the Minnesota League of Municipalities would cost Fridley $231.00. Mayor Kirkham said that he would concur with doing the study if she Manager felt it would be to our advantage . Councilman Samuelson said that the price was more reasonable than anything that had been considered before. REGULAR COUNCIL MEETING, DECEMBER 4, 1967 PAGE 13 'r he has just glanced at the manual, but he thought that it will help the morale and the whole department, and the City Manager should be commended for it. Councilman Liebl said he felt it will be received with enthusiasm by the Civil Service Commission, and if they had had it a year ago, a lot of problems would have been prevented. VISITORS: Mr. R. T. Simmons, 353 - 57th Place Northeast, said he was building a home on 57th Avenue, and two weeks ago Mr. Carl Paulson had called the bank which is doing the financing, and more or less said that it was being built illegally. He said that the bank has now asked for a letter stating that the permit is valid. The City Manager read aloud a letter he had prepared informing the bank that the permit was valid, and the building is being built within the ordinances of the City. The City Manager said he has made a complete study of the complaint and the issuance of the permit, and as there was no ordinance pertaining to double frontage lots in existence at that time, the permit was valid. Mr. Paulson said he had called the bank, and asked if they had made an inspection as the building did not conform to the others in the neighborhood. He said it was natural that the bank wants everything on a legal basis. CARL PAULSON: TRANSPORTATION MEETING Mr. Paulson said he had talked to the Mayor about a year ago about a trans- portation meeting, and now has made reservations in the City Hall for a meeting to be held, December 12, 1967, and he would like the Council to sponsor it. He said that many people are interested in upgrading transporta- tion for Fridley and the entire metropolitan area. Mr. Paulson said there were many facets to be considered, and if the meeting is held in an official capacity, it would be more meaningful. He pointed out that the suburbs were being unduly penalized by having to pay 35c to get to Lowry Avenue, while in Minneapolis for 25� you can go all over the City, as far as Bloomington for instance. Councilman Harris questioned whether adequate time was being allowed in the preparation of this meeting. Mr. Paulson said he has been laying the groundwork for two weeks, and many companies and subdivisions of government have already said they will send representatives. Mr. Paulson asked Mayor Kirkham to chair the meeting. Mr. Kirkham said he would not be able to attend the meeting because of other commitments, but he appreciated the work Mr. Paulson was putting into this meeting. The Council felt that Mr. Paulson would be the best one to Chair the meeting, as he would be able to direct the questions. Mayor Kirkham said he would create a Mayor' s Committee_on Public Transportation as he has several other ideas they could consider, and Mr. Paulson is appointed as Chairman. Mr. Paulson asked for a complete transcript of the meeting for distribution, and he was told this would be possible . Mr. Paulson asked if a member of the Council could act as co-chairman. Mayor Kirkham asked Councilman Liebl if he would be available. Councilman Liebl said that he could be at the meeting, and asked for a rough draft of the ideas to be presented so that he could prepare himself for the meeting. Facts Bearing on the Problem: A. Background (Carl Paulson's complaint) (1) Mr. Carl Paulson introduced a complaint to the Council. that a building being erected at 360 - 57th Avenue N.E . A double bungalow is being faced in an opposite direction to all other structures on 57th Place. Mr. Paulson in- dicates the location of this structure and garage, detached, constitute a threat to aesthetic values, and possibly sets a dangerous precedent to both our street and the City as a whole (copy of letter dated November 15, 1967, at-1--ached as enclosure No. 1, hereto. (2) In petition presented to City Council by Mr. Paulson, it states" "it appears to -us that the reversal in fronting this property is out of line with the majority of the City Council ' s intent and represents a breach of rules as set down by the Board of Appeals (see zoning ordinance, poviers, and duties of Board of Appeals and City Council) . The petition further states that according to property appraisal standards, this type of eyesore adversly affects the aes- thetic and money values, not only over the length of appealz of 57th Place, but to adjoining areas. (Petition attachea as Enclosure No. 2) . B. Processing and issuance of Permit: (1) A memo was sent through the city Engineer to the Building Inspector asking him to provide anmv7ers on processing of permit and inspections. Also, as to Whether we should fon,7ard a letter to Mr. Simons indicating the b-ailding permcf.- is valid and in accordance with ordinances. The City ordinance at time of Building permit issuance did not contain stipulations dealing with facing of buildings on Double frontage lots. An ordinance has been drawn up to cover double .frontage lots but nothing existed in the ordinance at the time. D. Building Official Gasterland on inspection report -#2232, dated October 24, 1967, indicated that soil conditions were good and location and aesthetics were not objectionable. 3. Conclusions: Several steps in the issuance of the permit were irregular and administrative processing was not the best. Certain information was fed into the permit requirement piecemeal and in all left much to be desired. The information was all eventually available, but not with orderly procedure. The Council was polled on the issuance of a permit and since this procedure had been used before could be considered to be policy. The Council did later approve the license of the contractor m so he was a legal con- tractor when project was accomplished. We did not have anything in our ordinance that precluded the man from electing which street he desired to face the house on, on a double frontage lot. The question of aesthetics can be considered. However, aesthetics to a degree is opinion and the Inspector indicated aesthetics in his judgment was all right. One over-riding factor appears to be that the petition was filed with the Council after the house and garage were both virtually completed. This in itself presents a problem as it was obvious for some time that the house was facing a di- rection opposite from the others. The question appears to be one of whether in fact the person has a valid permit and if the City should take action against the owner or contractor. The permit was issued and as far as I can determine is valid. The contractor did not call for timely inspections, but since no action was taken at the time, the value of filing an information against him at this time is questionable. The owner of property in the neighborhood, always have recourse to filing an injunction against the builder or suing the City. However, whether a court would require the building to be torn down, or the City to make restitution to property 0v7ners is an answer our City Attorney would be better qualified to provide. 4. Recommendations: A. That the permit be considered a valid per mit and Mr. Simons be so notified. d ' Decerriber 1, 1967 Page 3. . . B. Mr. Paulson in- dicates the location of this structure and garage, detached, constitute a threat to aesthetic values, and possibly sets a dangerous precedent to both our street and the City as a whole (copy of letter dated November 15, 1967, attached as enclosure No. 1, hereto. (2) in petition presented to City Council by Mr. Paulson, it. states" "It appears to us that the reversal in fronting this property is out of line with the majority of the City Council ' s intent and represents a breach of rules as set down by the Board of Appeals (See zoning ordinance, powers, and duties of Board of Appeals and City Council) . The petition further states that according to property appraisal standards, this type of eyesore adversly affects the aes- thetic and money values, not only over the length of appeals of 57th Place, but to adjoining areas. It has been the policy of this office since May 1965 that since only the Building Inspector makes notations on surveys and prints and computes the fee on the application this constitutes approval of the permit and his signature has not been used except that the Building Inspectors name was typed in by the secretary. The applicant at this time was informed to call in for footing inspections, which according to our records he did not do. 2. D. On October 24, 1967 a plumbing rough-in was called for and made by Building Official' Gasterland on inspection report #2232. At that time he advised the builder that he should call in for all inspection and also made a rough-in frame inspection on report # B-21.97 which he noted as o.k. He also noted soil conditions were good and location and esthetics were not objectionable. 2. E. On or about November 15, 1967 complaint reached this office regarding location and direction of frontage. According to inspection report #B-2407 dated 11/15/67 a red tag stop work was posted by the Building Inspector worded "Bldgs . not located on surveys", after a check of the survey filed r with the permit. On November 16, 1967 the owner, Mr. Simmons appeared at this office and furnished information by which the City Engineer drew in the building locations on the survey filed with permit # 9435 . This proceedure would not have been necessary had this office been able to locate the office copy of the blue print & the plot plan submitted and approved at the time the permit was issued. When this office moved its records into the new Civic Center some of our plans and records were placed in the vault. Other departments also moved into this vault and one carton of our records was misplaced and have not been located as yet . On November 17 the Building Inspector took a copy of an unmarked print submitted prior to permit application out to the site and making identical notations on it traded this print for the field copy from which buildings were actually located and constructed, which copies are now on record in this office. 3.A. PETITION #39-1967 OBJECTION TO A VARIANCE IIS EXTREMITY AS NOTED IN THE PLACING OF TWO SEPARATE STRUCTURES�NUMBERED 360 - 57TH AVENUE NORTHEAST: ~��T Mr. Carl Paulson, 430 Northeast 57th Place, presented a petition, a letter from a property owner on his street, and additional information which he said set forth the City regulations according to the Zoning Ordinance, City Charter and Building Code on which they base their objections to a double bungalow being built between 57th Avenue and 57th Place. He said that Councilman Li_ebl`s name was mentioned in this, and he would like to know what role he had played. The City Engineer showed the location of this building being built on Lot 10 and Lot 11 on the plat map. He said that it faces 57th Place, and there is no requirement in the Ordinance requiring him to face 57th Avenue. Councilman Liebl said that his name was mentioned because he had talked to the Building Inspector about this in regard to a Building Permit , and had asked if every- thing was up to code. He had concurred when he found that it was up to code, and had not been aware that it fronted on the wrong side. He said that it would be impossible to look into every detail. REGULAR COUNCIL MEETING, NOVEMBER 20, 1967 PACE 10 The City Manager said that he has discussed this with the Mayor and the City Attorney, has investigated it, and has an answer on the City's stand. He also said he has recommended a change in the Ordinance so this cannot happen again. Mr. Paulson asked about the contractor getting a permit when he was not licensed or bonded. Councilman Liebl said that the contractorsaid he was faced with a problem of not being able to build this year if he could not get started right away. He said that he had applied the first part of September, and the bond had been ratified at the following meeting. Mr. Paulson felt that in a situation like this, the Building Department has a right to refuse the permit and notify the people of any problem that may effect property values. He complained about the lack of inspection. The City Manager said that when the permit was issued the Building Inspection Department was shorthanded and if the failure to have a footing or basement inspection were taken as a point of conjecture, and he were told to tear his home down again, the City would not be in the best position. He said that in the Code there are no rules for double frontage lots. The City Manager read a part of the ordinance he is proposing on double frontage lots so this will not happen again. The owner of the home being built, Mr. Richard Simmons, 353-57th Place Northeast, was present at the Council Meeting. He said that Mr. Paulson has said that the owner across from the home he is building is perturbed, and if this is so, Mr. Simmons wondered why he did not say something in September, or three weeks ago when the garage slab was poured. He said that the garage can only be seen from across the street. A woman present at the Council Meeting said that it could be seen from way down the street. Mr. Simmons said that the man next door had come over and, talking about the petition, laughed and said he could care less. Mr. Paulson said that this neighbor, Mr. Weigel, had told him differently. Mr. Paulson said that politically the people will see this problem and point at the Council, so he wants it part of the record so that the people will know the Council did not concur in this action. Councilman Samuelson said that the Council sees R-3 construction plans which do have to come before the Council, and suggested that perhaps anything over R-1 construction, which would include double bungalows, should come to the Council for concurrence also, so that this does not happen again. In this way, they could also be sure the developer provides landscaping, black- topping and other items required. He said he agrees that Mr. Paulson has a rightful complaint. MOTION by Councilman Liebl to receive Petition #39-1967 objecting to the variance in the placing of the home at 360-57th Avenue Northea.>t, and the accompanying letters and information presented by Mr. Carl Paulson. Seconded by Councilman Sheridan. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried. Later in the meeting, Mr. Paulson came back to the Council Meeting with his neighbor Mr, Leonard Weigel, 6000 - 6th Street Northeast. Mr. Weigel told the Council he had gone over and spoken to Mr. Simmons' wife and asked why the house was facing the other way. Mrs. Simmons had said that the City of Fridley had told them they could build it either way. Mr. Paulson said that he had brought Mr. Weigel to the meeting because Mr. Simmons had lied and tried to give the Council a false impression.
