In reference to our telephone conversation, I 've enclosed for your
review an agreement which will permit the City of Fridley Fire
Department to use subject abandon dwelling for fire training
exercises. It is our intent to burn the dwelling, reducing it to
rubble which can then be removed by your contractor. Please note
that the garage is directly beneath electrical wires. Therefore,
we will be unable to burn the garage portion of the structure.
I have taken the liberty of providing to Keho Construction Company
a copy of this letter and the agreement for their review and
consent.
I will work out the schedule of our activities with Mr. Kelly at
Keho and then advise you of our plans. If the enclosed agreement
terms are acceptable, please return one executed copy of the
agreement to me for our files. Thank you for your cooperation.

AGREEMENT
FOR
FIRE DEPARTMENT USE OF VACANT STRUCTURE FOR TRAINING
This Agreement is entered the day of April, 1992, by and
between the City of Fridley, Minnesota Fire Department (hereinafter
"Fire Department") 6431 University Avenue NE, Fridley, Minnesota
55432, Valvoline Instant Oil Change .(hereinafter "Owner") 17360 W.
12 Mile Rd. , Southfield, Michigan 48076, and Keho Construction
Company (hereinafter "Contractor") 5801 Kemrich Dr. , Edina,
Minnesota 55439.
Whereas, the Fire Department desires to further its structural
firefighting training by conducting exercises involving the
controlled burning of a structure, and
Whereas, Owner possesses a vacant single family dwelling which is
not inhabitable due to deterioration, and is located at 348 57th
Place in the City of Fridley, and
Whereas, Owner is in the process of developing its land contiguous
to the above property and has contracted with Contractor for
removal of the building on the contiguous property as well as the
above described vacant dwelling:
Now, therefore, it is agreed by the parties to this Agreement that:
1. Owner grants to the Fire Department the right to enter
upon the premises with the street address 348 57th Place,
Fridley, MN, for the purposes of site inspection, drill
exercises, and demolition of the house thereon by
burning, in consideration of benefits received by Owner
from the demolition of this structure and enhancement of
Fridley's fire protection services through live burn
training exercises.
2 . Owner warrants to the Fire Department that it is the
exclusive owner of said dwelling which is to be burned,
that there are no liens, encumbrances, or other 3rd party
interest in the structure or the land upon which it is
situated which would create a third party claim against
the Fire Department as a result of the Fire Department's
activities recited in this agreement.
3. Owner, through its demolition contractor, will coordinate
its work schedule with the Fire Department to effect
removal of the vacant dwelling burn remains upon
completion of the training exercises. It is the parties'
intent to avoid leaving an attractive nuisance or hazard
to the public due to the remaining debris. Any old well
drilling will have to be removed and sealed by a licensed
contractor.

4. The Fire Department shall verify that all utilities to
the building have been removed, inspect the property
prior to conducting its exercises to identify hazards to
firefighting personnel, and coordinate with Contractor
on any issues not herein specified that may arise.
Additionally, the Fire Department shall:
A. Notify contiguous property owners of the training
exercises and dates.
B. Provide area security during the exercises.
C. Advise City officials of the activities.
D. Obtain permission from the Minnesota Pollution
Control Agency for a live training burn exercise.
E. Prepare and maintain on file a live burn safety
plan, training outline and site assessment outline
in accordance with OSHA Standards.
F. Limit participation during the exercises to
firefighters having requisite skills and experience,
and who are employees covered by workers'
compensation.
G. Assist the Contractor obtain from the City of
Fridley a demolition permit for the building to be
burned.
H. Protect exposures from heat and smoke, it being
understood that grass, shrubs, trees, or limbs on
owners property which are in the immediate proximity
of the dwelling will likely be damaged by the fire.
I. Release the Owner and its Contractor from any claims
by the Fire Department arising from the acts or
omissions of the Fire Department and its employees
as a result of the above identified training
exercises.
5. The post training condition of the building will be the
responsibility of the Owner. The intent is to use the
structure and/or demolish sections or all of the dwelling
during training exercises. If at any time prior to or
during the training sessions, the instructor in charge
deems it necessary to discontinue the training, the
remains will be the sole responsibility of the Owner.

6. Owner/Contractor shall be responsible for utilities
disconnection, and removal or burying of debris upon
completion of the burn, as required by the City of
Fridley.
7. Unless specifically recited herein, this Agreement is not
intended to alter any requirements of Owner arising from
its ownership and/or redevelopment of property in the
City of Fridley.
