I have just had the opportunity to review the Public Nuisance
Policies as well as the Summary Abatement Policies set forth in
the City Code by reason of a summary abatement that was in front
of the City Council this last week. It is the recommendation of
our office that, following service of the notice demanding
termination or abatement of the nuisance, and the issuance of a
citation, the City should serve an additional Notice of Hearing
upon interested persons. The notice should state that the
interested party will be given an opportunity to be heard and
shall state the time, date and place of the Council meeting in
which City Staff will request authorization by the City Council
to abate the nuisance, and charge the abatement costs, plus
administration fees against the property. We are requesting that
the additional notice of the hearing be served upon parties in
interest to assure that the party in interest cannot claim they
did not have an opportunity to be heard on the summary abatement
proceedings.

REGARDING: Nuisance Abatement at 1571 - 75th Avenue N.E
We have a vacant house at 1571 - 75th Avenue which is presently
unsecured with broken windows and doors that are open. The
property is going through a foreclosure process which will not be
settled until early January, 1991.
We have notified all parties who may have an interest in the
property. The letter and the list of persons notified is attached.
We have received two quotes for abating the nuisance by installing
plywood over all windows and doors; one from Timbercraft
Construction for $475.00 and one from Brickner Builders for
$250.00.
We request and recommend that the City Council, at their meeting
on December 17, 1990, approve the execution of a purchase order to
Brickner Builders for $250.00 to cover the nuisance abatement, and
to approve the abatement cost plus 25 percent to be placed as an
assessment against the property.

SUBJECT: 1571 - 75th Avenue N.E.
We have been contacted by Roger Luebeck regarding the above -
referenced property (see location map). It appears that the
dwelling was constructed in 1947 and is Mr. Luebeck's childhood
home. Mr. Luebeck has recently acquired the property and intends
to restore it. We anticipate that we will receive a variance
request from Mr. Luebeck, as the property is a legal nonconforming
property which has lost its legal status, as it has been vacant for
more than one year. The property does not meet the minimum square
footage requirements as outlined in the Zoning Code.
Darrel Clark, former Chief Building Official, wrote the attached
letter to the VA Loan Guarantee Division which.states that there
are structural problems in which the repairs would exceed 50% of
its fair market value. You may recall that we processed a variance
request for 501 Glencoe Street N.E. in which the City Council
permitted a nonconforming structure to be repaired although the
cost of repair exceeded 50% of the fair market value. In reviewing
the property with Clyde Wiley, Acting Building Official, he stated
that the bottom sill plates continue to rot, the roof is sagging
and needs to be rebuilt, and the home is set too low as compared
to the adjacent street. Staff will recommend denial of the
variance request to the Appeals Commission and the City Council
based on the amount of repair required to bring the structure up
to current code. If there are any questions regarding the

You requested me to research a mortgage default on the property as HUD now owns (or
will own) the property. All records indicate that Luebeck remains the owner and no
mortgage default has occurred. I checked with the County Recorders office including the
tax and lien files. I also inquired with the County Court. system, Judgment Division, and
they did a search on owner going back 10 years. Nothing of record.

the above -referenced property was vacant and constituted a public
nuisance. Recently, the Fridley City Council at its September 21,
1992 meeting officially denied a variance request, to upgrade the
structure when the necessary repairs exceed 50% of the fair market
value of the structure and to allow habitation of a single family
dwelling less than 1,020 square feet. We believe that the
petitioner for the variance request purchased the dwelling from a
real estate broker who acquired the property via a Sheriff's sale.
We would like to inquire as to what types of disclosure claims you
may have within your sales contracts which may alert the buyer to
any code violations or areas of noncompliance a dwelling which you
are' selling may contain. I would appreciate receiving this
information as soon as possible.

She sent me the attached real estate listing in regards to 1571 -
75th Avenue N.E. It appears that the purchaser was informed that
the City would not allow the property to be repaired. Ms. Keller
told me that the property was sold to a real estate broker who then
sold the property to Mr. Luebeck. Ms. Keller did not provide me
with the name of the real estate broker.

Re: Final Inspection of Wrecking Permit at 1571 75th Avenue NE
Dear Mr. Luebeck:
On November 16, 1992 a wrecking permit was issued to you for
demolition of the building located at 1571 75th Avenue NE. An
inspection of the site noted that the building has been demolished
but the debris has not been removed nor has the foundation depression
been filled. The sewer and water must also be properly capped.
We will expect the site to be cleared of all debris, the sewer and
water properly capped and inspected, and the foundation filled or the
banks sloped so as not to present a danger to a person accidentally
falling into the hole, or an alternative would be to fence the
excavation to prevent children from endangering themselves.
This needs your immediate attention. If you have any questions on

letter is due to several illnesses that have struck Mrs. Cisewski since last fall. She had a
stroke and three heart operations, and we have been reluctant to bother her while she was
ill.

installation site is acceptable to me. It neither encroaches on my property nor is too noisy.
