A. PUBLIC PURPOSE SERVED BY REQUUIREMENT:
Section 205.053, 4, A, requiring a minimum front yard setback of 35 feet
in residential areas.
Public purpose served by this regdirement is to allow for off street parking
without encroaching on the public right of way and for aesthetic consideration
to reduce the "building line of sight" encroachment into the neighbor's front
yard.
B. STATED HARDSHIP:
Want to add more length to the old garage for more storage space. There
is a patio in back of the old garage we want to keep. By coming out the
3 feet, I can move the gable to the front, making it look more like a house
than a machine shed.
C. ADMINISTRATIVE STAFF REPORT:
The petitioner proposes a 271x 14' garage addition of the west side of his
house. The house is now 35 feet from the front property line and 19 feet
from the weft property line. There is a 15 foot boulevard in the area.
The house to -the west is,10.5 feet from the petitioner's house, which
means that there will be 16.5 feet from the new garage wall to the neighbouring
house. The petitioner's house is 50 from the curb; the house to the
west is 52 feet from the curb; the �to the east is 45 feet from the
curb. The new garage will be 47 feet from the curb.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the Appeals Commission of the City of Fridley
will meet in the Council Chamber of the City Hall at 6431 University Avenue
Northeast on Tuesday, May 9, 1978 at 7:30 P.M. to consider the following
matter:
A request for a variance of Section 205.053, 4,
A, Fridley City Code, to reduce the required
front yard setback from 35 feet to 32 feet to
allow an addition to an existing garage, located
on Lot 2, Block 2, Dahlberg Terrace, the same
being 1670 75th Avenue N.E., Fridley, Minnesota.
(Request by Alan D. Muyres, 1670 75th Avenue
N.E., Fridley, Minnesota 55432).
Anyone who desires to be heard with reference to the above matter will
be heard at this meeting.

Note: The Appeals Commission will have the final action on this request,
unless there are objections from surrounding neighbors, the City Staff, or
the petitioner does not agree with the Commission's decision. If any of
these events occur, the request will continue to the City Council through
the Planning Commission with only a recommendation from.the Appeals Commission.

Mr. Lerberg 'said that they were not requesting to have an additional
pylon sign. He said that the shopping center was allowed to have two
free standing signs and they were only requesting to be able to
utilize that second permitted sign.
Mr. Kemper said that the Commission was questioning the desirability
of having tiro free standing signs located in the shopping center.
Chairperson Schnabel explained that even though they were recommending
denial of the requests, the City Council could override the recommendation
and approve the requests. She said that they could also sustain the
Appeals Commission's motion to deny.
Chairperson Schnabel said that the main concern was if it was
actually necessary to have a second pylon sign for the Center in view
of the fact that the existing sign was in excessive of the total square
footage allotted by the Code.

Chairperson Schnabel said that the second pylon sign had always
been a problem in'the area. She said it had not been kept in good
repair. She said that the Commission's concern was whether a second.
free standing sign should even be located at that point.
Mr. Lerberg said that they had been told that they could use the
existing pylon signs when their lease was discussed with Mr. Saliterman,
Mr. Barna said that someone should mention that Mr. Saliterman
should submit a comprehensive sign plan for all signs in the entire
Shorewood Shopping Plaza -- including all pylon signs.
Chairperson Schnabel said that Mr. Saliterman was most likely
aware of that requirement. She said that he has had previous
conversations With Mr. Boardman and he had been told of the requirement.
MOTION by Mr. Kemper, seconded by Ms. Gabel, to close the Public
Hearing. Upon a voice vote, all voting aye, the motiDn carried
unanimously. The Public Hearing was closed at 9:28 P.M.
Mr. Kemper said that there appeared to be a united feeling
that the Commission did not want to act on the requests until the
entire sign plan for the Shorewood Shopping Plaza was submitted to
the City Hall.
MOTION by Ms. Gabel, seconded by Mr. Plemel, to recommend denial
of the request for variances of the Fridley City Code as follows:
Section 214.046,B,2, to increase the maximum square footage of a free
standing sign per development from 80 square feet to 344 square feet
(existing sign 256 square feet); and Section_ 205.046,8,4,5, to reduce
the minimum setback of a sign from the property line from the required
10 feet to 0 feet, to allow the construction of a second free standing
sign on Lots 16 and 17, Auditor's Subdivision No. 88, the same being
the Shorewood Shopping Center located at 6225 Highway #65 NE,
Fridley, Minnesota for the following reasons:
1) A lack of information; including an overall plan for signage
that had been requested by Staff.
2) Excessive square footage of the existing sign.
3) There had been a prior request that the sign be removed.
4) There was a traffic safety factor resulting from the pylons
being located directly next to a driveway.
5? Having two pylon signs for a shopping ce'nter may not be
desirable.
UPON A VOICE VOTE, all voting aye, the motion carried unanimously.

The petitioner proposes a 27' x 14' garage addition on the wes
side of his house. The house is now 35 feet from the front
property line and 19 feet from the west property line. Theis
a 15 foot boulevard in the area. The house to the west is 2
feet from the petitioner's house, which means that there wi 1 be
16.5 feet from the new garage wall to the neighboring house. The
petitioner's house is 50 feet from the curb; the house to the west
is -50.5 feet from the curb; the garage to the east is 45 feet from
the curb. The new garage will be 47 feet from the curb.

Mr. Muyres explained to the Appe Commission exactly where he
wanted to put the garage addition. He said that by changing the roof
line slightly he could vastly improve the appearance of his dwelling.
Mr. Plemel asked why Mr. Muyres didn't build to the rear of the
garage.
Mr. Muyres explained that they presently had a patio located at
the rear of the garage that they wanted to retain. He also said it
would look nicer to change the roof line the way he was proposing.
Mr. Barna asked who would be doing the work on the garage addition.
Mr. Muyres said that he would build the addition to the garage. He
said he would put the same siding on the addition that was on the
existing house and garage.
Chairperson Schnabel asked about the garage doors.
Mr. Muyres said that there would be two separate garage doors.
He said that the addition would mainly be used for storage and personal
hobbies.
MOTION by Mr. Plemel, seconded by Mr. Kemper, to close the Public
Hearing. Upon a voice vote, all voting aye, the motion carried
unanimously. The Public Hearing was closed at 9:53 P.M.

Ms. Schnabel for Chairperson of the Appeals Commission. After calling
for more nominations, Ms. Schnabel declared the nominations closed.
Upon a voice vote, all voting aye, the motion carried unanimously.
MOTION by Mr. Plemel, seconded by Mr. Barna, to nominate
Ms. Gabel for Vice -Chairperson of the Appeals Commission. After
calling for more nominations, Ms. Schnabel declared the nominations
closed. Upon a voice vote, all voting aye, the motion carried
unanimously. .
Mr. Kemper said that Ms. Gabel and Ms. Schnabel always do a
very professional job.
Mr. Plemel said that they both do very dedicated jobs.
5. OTHER BUSINESS:
Mr. Holden said that penalties can be assessed against variance
violations. He said that would include if someone doesn't apply
for a needed variance or someone who may build closer to the lot
line than had been allowed.
Chairperson Schnabel explained that the question had come up at
previous meetings when people came in to request variances on
properties that construction had already started on. She said that
the Commission had felt that some type of fine should be levied on
contractors that continuously are at fault of putting houses too close
to lot lines.
Mr. Holden said that presently Staff was stopping work on any
construction that they came across that was out of -Code,
ENERGY COMMISSION
Chairperson Schnabel said that City Council had asked the Planning
Commission to determine whether or not the City of Fridley should form
an Energy Commission. She said that the Planning Commission was
interested in any ideas from the sub -commissions regarding how an
Energy Commission should be organized. She said that they were looking
for both suggestions and names of people who could serve on the
Commission. She explained that anyone who served on the Commission
should have some knowledge of the Energy issues. She said that the
Commission would consist of six to eight people from the City of
Fridley. She said they would use several resources of information -
NSP, Minnegasco, State Energy Board, etc.
