Flora Public Works Director DATE: October 28, 1997 SUBJECT: Tim Bezdek, 1351 76th Avenue Councilman Schneider requested information regarding Mr. Bezdek's fence supposedly damaged by snow- plowing operations during the 1996-1997 winter. In January, 1997 the City was informed by Mr. Bezdek that the chain link fence along his easterly property had been damaged by snowplowing of the cul-de-sac. We indicated that the damage could not be assessed at that time because of the accumulation of snow but that we would address the issue in April or early May when the snow had melted to assess the damage. We indicated that if any damage was present, the City would take action to correct it. In the spring, Ken Holmstrom, our Street supervisor, inspected the property and found no damage to the fence and so indicated to the property owner. This September, the Public Works Department noticed that Mr. Bezdek had planted small trees in the boulevard on the road to the cul-de-sac. We were concerned that these trees could be damaged by the snow- plowing operations this coming winter and as a result, Kurt Jensen -Schneider, our Code Enforcement Officer, sent Mr. Bezdek a letter indicating that the City would not be responsible for the trees that he had placed in the boulevard as landscaping features such as trees, were not authorized in the City's boulevard. On October 24, 1997 Mr. Bezdek called Paul Lawrence indicating that he was concerned about the damage to the fence, indicating that he did not want the City to fix it but would bill the City for the work. As a result of this communication, we advised Mr. Bezdek that if a claim was necessary, he should submit it to the City's Finance Department for our insurance company to address. I inspected the property on October 28, 1997 and did not notice any damage to the property fence. It appears that the major issue might be that Mr. Bezdek is concerned about the City's position on the boulevard trees and accordingly is attempting to make an issue on the process of removing snow from the cul-de-sac and its impact on his property. JGF:cz �pF F PUBLIC WORKS MEMORANDUM TO: Marcy Everette, Finance Department FROM: Paul Lawrence, Superintendent of Public Works DATE: October 24, 1997 SUBJECT: Tim Bezdek, 1351 NE 76th Avenue I received a telephone call from Mr. Bezdek on October 24, 1997, regarding his complaint of January 9, 1997. He stated he intended to take some unspecified action against the City regarding his fence. Ken Holmstrom inspected the fence this spring after the snow melted, and didn't note any damage to the fence caused by last winter's snow. Mr. Bezdek further stated he wasn't going to let any City personnel fix his fence. I advised Mr. Bezdek that he should notify the City's insurance company and they would inspect his concerns and make a determination regarding the alleged damage. Ken also advised me that he recently requested that Kurt Jensen -Schneider notify Mr. Bezdek that trees he planted on the boulevard this summer would have to be relocated or the City would not be responsible for damage snow might cause to the trees. I don't know if Kurt has contacted Mr. Bezdek yet, but if he has this may be what caused the fence concern at such a late date. The Public Works Department expressed concern regarding the snow storage requirements of the boulevard and the high potential for landscape features such as trees to be damaged during the snowplowing season. As this is a cul-de-sac and snow storage areas are extremely limited (in fact, boulevard areas are specifically designated as utility and snow storage locations), I must inform you that the City will assume no responsibility for any damage to these trees.
