Commissioner Vos stated he had viewed the pe ltioner's property and this appears to be a
reasonable request; the proposed change willot encroach any further on the neighbor, and the
lot is very short.
Commissioner Sielaff, Commissioner Jon ,Commissioner Zinter and Chairperson Kuechle all
stated they had no objections to this pro sal.
MOTION by Commissioner Jones, se nded by Commissioner Vos, to approve VAR #05-02 for
Saw Horse Construction to reduce th rear yard setback from 28 feet to 17.3 feet to correct an
existing non -conformity and to allow he conversion of a three season porch to a four season

Ms. Stromberg stated the petitioners are seeking a variance to reduce the rear yard setback
from 29 feet to 16 feet to allow the construction of a 16 foot by 20 foot living addition off the back
of their home, which is located at 1383 76th Avenue.
Ms. Stromberg reviewed the summary of hardship submitted by the petitioner as follows: "We
live on a cul-de-sac where the lot is wide in the back and narrow in the front. Overall our lot isn't
very deep which restricts the opportunity for a rear yard addition."
Ms. Stromberg explained the property is zoned R-1 Single Family as are all surrounding
properties. The existing home was constructed in 1968 and the detached garage was
constructed in 1970. City code requires a rear yard setback with a depth of not less than 25%
of the lot depth. In the petitioner's case, the minimum rear yard setback is 29 feet. The
petitioner's plan is to construct a 16 foot by 20 foot addition off the back of the house to allow a
kitchen expansion on the main floor and a bedroom in the basement. City staff has received no
comments from neighboring property owners.

Ms. Stromberg stated staff has no recommendation as similar variances have been granted in
the past:
• VAR #02-16 6065 McKinley St. — to reduce the rear yard setback from 32 feet to 14
feet to allow the construction of a house/garage addition.
• VAR #00-28 1428 Glacier Lane — to reduce the rear yard setback from 39 feet to 11
feet to allow the construction of an addition.
Staff recommends that if the variance is granted, Ms. Stromberg explained, that the following
stipulations be attached:
1. Petitioner shall obtain all necessary building permits prior to construction of addition.
2. Addition shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme.
Commissioner Sielaff asked if the existing garage, has to meed the same setback requirement.
Ms. Stromberg responded that a detached garage can be 3 feet from the side or rear lot line.
Greg Wacek, petitioner, stated he has no objections to the stipulations stated by staff. He
explained the entire house will be re -sided and re -roofed.
Chairperson Kuechle asked if the petitioner had considered placing the addition on either side of
the house.
Mr. Wacek explained that extending to the north would block the existing detached garage.
Extending to the south would not be possible because the house is 9.9 feet from that lot line.
The extension to the rear of the house made the most sense.
Commissioner Sielaff asked if the petitioner will leave the garage detached from the house.
Mr. Wacek responded for now it will remain detached but he may choose to make it attached at
some point in the future. He also stated he understands if he does proceed with that, the rear
yard setback for the house would also apply to the attached garage.
MOTION by Commissioner Jones, seconded by Commissioner Zinter, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
PUBLIC HEARING CLOSED AT 7:50 PM.
Commissioner Zinter stated the petitioner's plans will be a nice addition to the property and he
would be in favor of this request.
Commissioner Jones stated he would also be in favor of this request. Cul-de-,qacs do result in
odd size lots making it difficult to meet setback requirements.
Chairperson Kuechle stated this lot is odd shaped making it difficult to expand without a
variance.
Commissioner Sielaff stated the petitioner has done a good job of placing the addition on the
.property.

Mr. Hickok stated the Ashley Fu iture sign variance was approved by the Council at their last
meeting. They did have a finding of fact that supported a hardship on that site by virtue of the
distance from East River Road. A d the previous history with Home Valu having a similar
variance influenced their decision.
Mr. Hickok stated the St. Phillips sign ariance request was denied by the Council as they did
not believe that there was a sufficient rdship to support the variance. Another factor was that
St. Phillips, not located on a frontage ro d, allows them to place their sign further forward than
the commercial signs along the frontage oads. The Council approved a finding of fact to
support the denial. Councilmember Billin has suggested the City take a look at an overlay
district for University Avenue, Highway 65 nd Interstate 694 to see whether or not a sign
package that would be unique to the highwa s would be appropriate.
Mr. Hickok also reported that there has been k building permit issued for the Melle variance
approved at the last Appeals Commission mee ' g.
Ms. Stromberg reported both February meetings the Appeals Commission have been
cancelled.

REQUEST

ANALYSIS AND CODE REQUIREMENTS
The property is zoned R-1 Single Family as are all surrounding properties. The
property is located on the first cul-de-sac of 76th Avenue, just east of Central Avenue.
The existing home was constructed in 1968 and the detached garage was constructed
in 1970.
Existing Home and Garage
City Code requires a rear yard setback with a depth of not less than twenty-five percent
(25%) of the lot depth. In the petitioner's case, the minimum rear yard setback is 29
feet. The petitioner's plan to construct a 16 ft. by 20 ft. addition off the back of the
house, which will allow a kitchen expansion on the main floor and a bedroom in the
basement.

STIPULATIONS
Staff recommends that if the variances are granted, the following stipulations be
attached.

addition.
2. Addition shall be architecturally compatible with the existing home and
finished with complementary siding and color scheme.
We recently moved to Fridley and currently reside at 1383 — 76' Ave. N.E. We'd like to add
living space to the existing dwelling in the form of a kitchen on the main floor with a bedroom
beneath. The addition would be 16 feet deep by 20 feet wide (see drawing) off the back of the
house.
We live on a cul-de-sac, which may not be evident on the attached survey. The lot is wide in the
back, narrow in the front and overall, not very deep. As I mentioned, we are seeking additional
kitchen space. Since the kitchen is in the back left hand side of the house (as you look at the
survey of the existing dwelling) it makes sense to either add space to the back of the house or to
add to the North East side of the house where the driveway is currently. If the addition was
situated to the North East, it would block access to the existing garage, so we are applying for a
variance to add to the back of the house.
In our view, if the variance is granted for the addition, it would not alter the character of the
neighborhood. In fact, we believe the appearance of the neighborhood would be enhanced.
Along with the addition, we plan to re -side and re -roof the entire dwelling. The additional space
would be very unnoticeable from the front of the house as the existing dwelling and the garage
are very close in proximity.
