MOTION by Mr. Barna, seconded by Mr. Kemper, to recommend approval of the request for variances of the.Fridley City Code as follows: Section 205.134, 4C, to reduce the required rear yard setback from 25 feet to zero feet, and Section 205.134, 6, to reduce the required setback for the building, when the property is adjacent to a different zoning district, from the required 100 feet to 90 feet, to allow the construction of an addition to an existing building, located on Parcel 1300, NJ of Section 3, Anoka County, the same being 8251 Ashton Avenue NE, Fridley, MN 554329 with the stipulation that if the building was to ever be sold separately, the petitioner would be required to plat the land rather than'be granted a lot split. UPON A VOhCE VOTE, all voting aye, the motion carried unanimously. Chairperson Schnabel said that the item would be reviewed by the City Council on March 20, 1978. MOTION by Ms. Gabel, seconded by Mr. Barna, that City Council consider the construction of a fence on the park property abutting Ashton Avenue be expedited as a safety factor due to the increasing traffic load on Ashton Avenue. Karla & Tom Blomberg and Jerome & Carol Machlitt i,.ere at the meeting; regarding this item. MA APPEALS COMMISSION MEETING - FEBRUARY 149 1978 Page 1 Chairperson Schnabel said that Staff had commented that a stipulation be put on the request that Arnal Company share in the expense of putting a fence along the park property. Mr. Toews said that the Company would object to that stipulation. He said that their Company was on that property long before any plans were made to Put a park in that area. They didn't feel any responsibility to help in the.expense of fencing that park property. Mr. Kemper.asked.if the request was being asked for the zero lot line for Mr. Toews' entire property. Mr. Toews said that they would need the zero lot line variance for their entire property, Ms. Gabel pointed out that if they granted a variance, it would only be valid for one year from the date it was granted. Mr. Toews said that it really wouldn't make any difference. He said he wanted to request it for the entire property and there would be a chance that more construction would take place within the year. He said that if another building was not constructed within that time, then they would just make another request at a later date. Ms. Gabel asked what the distance was between the building and the railroad tracks. Mr. Moravetz said that it was 50 feet. He also said that the rear of the building would be solid brick/block. Mr. Toews pointed out that with the present building, plus the planned construction of a 50,000 square foot building, and including a.future proposed building of 20,000 square feet, the Company still would not violate the 40% coverage requirement. Chairperson Schnabel asked if the front of all the buildings, present, proposed, and future planned, would all conform to the existing design. Mr. Toews said that all the buildings would have the mansord design. He felt that the design was aesthetically pleasing to the area. P -Is. Gabel agreed that the building locked much better since they had done the improvements. Mr.. Barna said that he viewed the building every day and that it really did look nice. APPEALS COMMISSION MEETING - FEBRUARY 143 1978 PAGE 15 Chairperson Schnabel said that the request did not get into City Hall in time to go through the normal channels of publication and notices sent out to the adjacent property owners. Ms. Schnabel said that the petitioner spoke to Councilman Hammernik and he in turn spoke to the City Manager and in conjunction with several people on the staff. She said that it was determined that if the petitioner would take a petition around to the property owners within 200 feet and explain to them the variance request, and have them sign the petition, that the normal process could be waived. Ms. Schnabel said that it was being handled in the above manner because of a time element involved with the request. Chairperson Schnabel asked why the request needed to be processed in the above manner and why it couldn't be processed normally. Ms. Blomberg said that Mr. Machlitt was having a contractor build the house and contractors tivouldn't hold the prices for very long. She said that the soonest the request could have been before the Appeals Commission would have been March 14, 1978. She said that if there had been problems, there were only so many lots for sale and the contractor wouldn't hold the lot that Mr. Machlitt wanted. She said that financially it would be in the price range that the Machlitt's could afford. Mr. Moravetz said that one concern that Staff had with the request was whether the petition when it was circulated represented properly what would take place. Chairperson Schnabel said that the petition read, "ffe the undersigned waive our right to the traditional 10 day notice of public hearing for variance request on property located on the SE corner of 76th Avenue and Hayes Street NE address being 1400 76th Avenue NE legally described as follows: Lot 7, Block 19 Meadoarmoor Terrace 2nd Addition. We understand the public hearing will be February 14, 1978, 7:00 P.M. at Fridley City Hall. Signature does not necessarily mean approval but merely notification of public hearing." Chairperson Schnabel said that the petition was signed by 17 people with .one house being vacant. Ms. Blomberg presented to the Commission the petition and a letter from Calhoun Realty that indicated address. 1361 -75th Ave. NE was vacant and under a sales contract. MOTION by Ms. Gabel, seconded by Mr. Barna, to receive the petition and letter. Upon a voice vote, all voting aye, the motion carried unanimously. M APPEALS COMMISSION MEETING - FEBRUARY 14, 1978 Page 16 Ms. Blomberg showed the Commission a survey upon which she had drawn the proposed house. She also explained the. reasons why the house was positioned the way it was shown. Ms. Blomberg said that she spoke with each of the people on the petition previous to her going to their homes in order to obtain their signatures. She said that she explained to each of the people that she wanted them to be able to think over exactly what was being requested before she showed up at their doors with a petition to sign. Mr. Machlitt said that there were a couple of neighbors that -had expressed some concern, so he said that he took his proposed house plans over to the neighbors and showed them exactly what he planned to'build. Ile said that after he went over the plans and explained them to the neighbors that the neighbors were in complete agreement. Ms. Blomberg said that the whole neighborhood was very concerned and aware of their neighborhood and had expressed their concerns at different times previously. She said that they were mostly concerned about not having any low income housing going into the neighborhood. She said that they had no objections to the house that Mr. Machlitt had proposed. Chairperson Schnabel asked how soon construction would begin if the request was granted. Ms. Blomberg said that construction would begin within the month. Chairperson Schnabel asked if the names.o.f the people contacted were received from City Hall. Ms. Blomberg said that the names were given to her by City Hall. Mr. Kemper asked what the total length of the house was. Ms. Blomberg said that it was 68 feet long. 14r. Kemper pointed out that a house with a t,,�o-car garage could be built on that lot without any variances. Ile said that before the Appeals Commission could act on the request the hardship would have to be defined. Ms. Blomberg said that one of the reasons causing the need for a variance was to locate the house on the lot so as to save a clump of trees.
