1. CONSIDERATION OF VARIANCE REQUEST. VAR #93-28. BY SAWHORSE
DESIGNERS AND BUILDERS:
Per Section 205.07.03.D.(3).(a) of the Fridley Zoning Code,
to reduce the rear yard setback from 25 feet to 24 feet to
allow the construction of an addition on Lot 1, Block 2,
Quimette Terrace, the same being 1640 - 76th Avenue N.E.
MOTION by Ms. Smith, seconded by Mr. Kuechle, to waive the reading
of the public hearing notice and open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE,, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M.
Ms. McPherson stated this property is located at the intersection
of 76th Avenue and McKinley Street. The property is. zoned R-1,
Single Family Dwelling, as are all surrounding parcels. The
petitioner is proposing to construct a 12 foot deep by 18 foot wide
addition onto the rear of the dwelling unit.

Ms. McPherson stated the existing dwelling meets the required
setbacks for the front and side corner. The property is
approximately 95 feet deep which is shorter than typical lots in
the City and was platted with a lot area of approximately 8,700
square feet which is less than the minimum lot area of 9,000 square
feet.
Ms. McPherson stated the encroachment into the rear yard setback
is minimal at one foot, and it does not adversely impact the
property to the south. The dwelling unit on the property to the
south faces east so the proposed addition will be facing the side
yard of the adjacent property.
Ms. McPherson stated that if the Appeals Commission chooses to
approve this variance request, it is well within variances
previously granted for similar requests.
Mr. Darrell Carlberg, 1640 - 76th Avenue N.E., stated an 11 foot
deep addition would not be as useful for livable space as a 12 foot
deep addition. The proposed addition will be a family room, so the
one extra foot will give him more usable space. He stated there
is an existing 12 foot by 18 foot deck, so they will be replacing
the deck with the room addition.
Ms. Savage asked if the petitioner had received any opposition from
his neighbors.
Mr. Carlberg stated he was no aware of any objections. One
neighbor at 1620 - 76th Avenue N.E. indicated he does not have any
problem with the variance.
Mr. Gordon Shafer, 7584 McKinley Street N.E., stated he owns the
property directly to the south of Mr. Carlberg. He stated the
variance is only one foot, and he has no objection to the variance.
The back of the Mr. Carlberg's proposed addition will face the side
of his garage. He stated Mr. Carlberg has a well maintained
residence.
MOTION by Mr. Kuechle, seconded by Dr. Vos, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:37 P.M.
Dr. .Vos stated he considered this variance request to be within
the spirit of the Zoning Code. He would be in favor of approving
the variance request for three, reasons.
1. The encroachment is minimal.
2. The neighbor most directly affected at 7584 McKinley
Street appeared at the public hearing and expressed no
reservations or objections.

! 3. This is a small lot --about 300 feet under the minimum
lot size. It is difficult to construct an addition
without a variance on a small lot.
The other Commission members agreed with Dr. Vos.

request, VAR #93-28, by Sawhorse Designers & Builders, per Section

Ms. McP erson stated the petitioner has withdrawn its original
reques and has modified and resubmitted a variance request to
incr se the square footage of an institutional sign from 32 square
1 fe to 70 square feet. If this request is granted by the City
J C ncil, the petitioner will keep both the original brick monument
ign as well as the new sign. The petitioner has indicated that

the church would like time to review the type of permanent signage
they want to display on the property. They have indicated that
they would be willing to work within a two year timeframe, at the
end of which they would either comply with the institutional sign
requirements or apply for a new variance request.
Ms. McPherson stated that at the request of the C' y Council, staff
reviewed all the address files and made sit visits of other
community churches. The results of that resea ch were included in
the staff report. Typically, most of the hurches meet the 32
square foot maximum. However, two churches the community exceed
the maximum 32 square feet. Those churche , Valley View Christian
Church and Fridley Covenant Church, have approximately 56 square
feet of signage.
Ms. McPherson stated the Commission has reviewed two variance
requests in recent years requesting n increase in the amount of
institutional signage. These reques s were to increase the signage
from 32 square feet to 40 squa a feet. The Commission has
typically recommended denial of ese requests, and the requests
have then been withdrawn and the etitioners have complied with the
ordinance requirements.
Ms. McPherson stated that i the Commission chooses to recommend
approval of this request, s aff recommends two stipulations:
1. The length of a variance is for two years. At the end
of the two ye period, the petitioner shall comply with
the ordinanc requirements or apply for a new variance.
2. The petit' ner shall apply for a sign permit for a
permanent sign as required by the City Code. This
includes paying the $60 permit fee.
Ms. Savage stat d she did not see much difference between this
request and th previous. request. It still looks like they are
dealing with temporary sign.
Ms. McPhers n stated they are dealing with the sign that the
petitioner first defined as temporary. The petitioner has now
decided t ey would like to use this sign as a permanent sign for
the next two years, while they use the two year timeframe as an
opportu ty to review comprehensive signage for the property, at
which me they will either comply with the ordinance of 32 square
feet apply for a new variance.
Ms. Savage asked if the Commission is supposed to treat this
re est as a permanent sign request; and, if so, why didn't staff
do the usual analysis to the Sign Code?
s. McPherson stated that, yes, the Commission should treat this

and City Council's discussion of the previous variance request,
staff made the decision not to use the typical standards set forth

The petitioner requests that a variance be granted to reduce
the rear yard setback from 25 feet to 24 feet. The request
is for Lot 1, Block 2, Quimette Terrace Addition, the same
being 1640 - 76th Avenue N.E.
Site
Located on the property is a single family dwelling unit with
an attached two -car garage. The subject property is located
in the southwest corner of the intersection of McKinley Street
and 76th Avenue. The property is zoned R-1, Single Family
Dwelling, as are all the surrounding parcels.
Analysis
Section 205.07.03.D.(3).(a) of the Fridley Zoning Code
requires a rear yard setback of not less than 25% of the lot
depth with not less than 25 feet permitted or more than 40
feet required for the main building.
Public purpose served by this requirement is to provide rear
yard space to be used for green areas which enhance the
neighborhood.
The petitioner is proposing to construct a 12 foot by 18 foot
addition to the rear of the dwelling unit. The dwelling unit
meets the required setback requirements for front and side
corner setbacks. The property is approximately 95 feet in
depth and was platted at 8,697.25 sq. ft. The encroachment
by the addition into the rear yard setback is minimal and
should not adversely impact the property to the south. The
adjacent dwelling to the south faces east; therefore, the
proposed addition will be facing the side yard of the adjacent
property.
If the Appeals Commission chooses to approve this variance
request, it is well within similar previously granted
variances.

CALL TO ORDER:
Chairperson Savage called the November 9, 1993, meeting to order
at 7:30 p.m.

APPROVAL OF OCTOBER 19, 1993, APPEALS COMMISSION MINUTES:
MOTION by Ms. Beaulieu, seconded by Mr. Kuechle, to approve the
October 19, 1993, Appeals Commission minutes as written.
UPON A VOICE VOTE# ALL VOTING AYES CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED UNANIMOUSLY.
1. CONSIDERATION OF VARIANCE REQUEST, VAR #93-28, BY SAWHORSE
DESIGNERS AND BUILDERS:
Per Section 205.07.03.D.(3). (a) of the Fridley Zoning Code,
to reduce the rear yard setback from 25 feet to 24 feet to
allow the construction of an addition on Lot 1, Block 2,
Quimette Terrace, the same being 1640 - 76th Avenue N.E.
NOTION by Ms. Smith, seconded by Mr. Kuechle, to waive the reading
of the public hearing notice and open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M.
Ms. McPherson stated this property is -located at the intersection
of 76th Avenue and McKinley Street. The property is zoned R-1,
Single Family Dwelling, as are all surrounding parcels. The
petitioner is proposing to construct a 12 foot deep by 18 foot wide
addition onto the rear of the dwelling unit.

Ms. McPherson stated the existing dwelling meets the required
setbacks for the front and side corner. The property is
approximately 95 feet deep which is shorter than typical lots in
the City and was platted with a lot area of approximately 8,700
square feet which is less than the minimum lot area of 9,000 square
feet.
Ms. McPherson stated the encroachment into the rear yard setback
is minimal at one foot, and it does not adversely impact the
property to the south. The dwelling unit on the property to the
south faces east so the proposed addition will be facing the side
yard of the adjacent property.
Ms. McPherson stated that if the Appeals Commission chooses to
approve this variance request, it is well within variances
previously granted for similar requests.
Mr. Darrell Carlberg, 1640 - 76th Avenue N.E., stated an 11 foot
deep addition would not be as useful for livable space as a 12 foot
deep addition. The proposed addition will be a family room, so the
one extra foot will give him more usable space. He stated there
is an existing 12 foot by 18 foot deck, so they will be replacing
the deck with the room addition.
Ms. Savage asked if the petitioner had received any opposition from
his neighbors.
Mr. Carlberg stated he was no aware of any objections. One
neighbor at 1620 - 76th Avenue N.E. indicated he does not have any
problem with the variance.
Mr. Gordon Shafer, 7584 McKinley Street N.E., stated he owns the
property directly to the south of Mr. Carlberg. He stated the
variance is only one foot, and he has no objection to the variance.
The back of the Mr. Carlberg's proposed addition will face the side
of his garage. He stated Mr. Carlberg has a well maintained
residence.
MOTION by Mr. Kuechle, seconded by Dr. Vos, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:37 P.M.
Dr. Vos stated he considered this variance request to be within
the spirit of the Zoning Code. He would be in favor of approving
the variance request for three reasons:
1. The encroachment is minimal.
2. The neighbor most directly affected at 7584 McKinley
Street appeared at the public hearing and expressed no
reservations or objections.

3. This is a small lot --about 300 feet under the minimum
lot size. It is difficult to construct an addition
without a variance on a small lot.
The other Commission members agreed with Dr. Vos.
MOTION by Dr. Vos, seconded by Mr. Kuechle, to approve variance
request, VAR #93-28, by Sawhorse Designers & Builders, per Section
205.07.03.D.(3).(a) of the Fridley Zoning Code, to reduce the rear
yard setback from 25 feet to 24 feet to allow the construction of
