3. CONSIDERATION OF A REQUEST TO CONSTRUCT A COUNTRY VILLAGE SUPER MARKET

There was discussion as to plot plan of this proposal.
MOTION by Biermann to accept this proposal subject to the following stipulations:
a. Recommend checking with the City Engineer about the radius of curbed
approaches
b. Elimination of one parking stall located in the Northeast corner of
the parking lot and provide fenced 'rubbish or waste disposal area on
the Northeast corner of the proposed building with a gate facing the
North side of the fence.
c. Rear yard setback be 5'0" instead of 3'011, also changing front
planting strip'to a narrower width to conform with the parking requirements
d. Show on plan 2 additional exits in the rental area
e. Sidewalk in front of building to be raised at least 6" above blacktopped
parking area and increase this sidewalk width to 7'011; 210" of this
sidewalk to be -considered as part of the parking requirements
f. Curbing around all planting areas
g. All planting areas to be either white rock or sod -`at owner's option
Seconded by Tonco. Upon a voice vote, there being no nays, the motion carried
unanimously.
4. CONSIDERATION OF A REQUEST TO CONSTRUCT A 7 -UNIT APARTMENT BUILDING LOCATED ON
There was discussion as to the construction and plot plan of this request.
MOTION by Biermann to accept this proposal subject to the following stipulations:
a. Provide fenced rubbish or garbage storage area
b. Soundproof walls between apartments and corridors
c. Provide 1 3/4" solid core doors for apartment entrances
d. Amount of brick facing to be increased to comply with Code
e. A 5'0" wide easement for sidewalks located parallel with 79th Way to be
provided
Seconded by Tonco. Upon a voice vote, there being no nays, the motion carried
unanimously.

MOTION by Councilman Harris to grant the building permit subject
to the stipulations put forth by the Building Standards - Design
Control Subcommittee. Upon the vote, Kirkham, and Harris.
voting aye, Samuelson abstaining, and Liebl voting nay, Mayor
Kirkham called for a ruling from Mr. Gibbs on the Robert's Rules
of Order. Mr. Gibbs said that it would carry if there was a
second, if there was no second made, it would die for lack of a
second. Mayor Kirkham replied this was not necessarily so, as
the Chair has the right to call for a vote with no second. Mr.
Gibbs then researched this and it was re -considered later in the
Meeting.
Rr&9ZS DF3ATION OF THF VOTE ON REQUEST BY GEORGE WALQUIST :
Mr. Gibbs said that after research, he finds that the Chair can
call for a vote without a second. A Point of Order can be made
if there was no second, but the Mayor would then be requested to
proceed again and ask for a second. If there was no second, the
motion would die. If there is a no vote, only the dissenter
can call for a reconsideration. Mr. Gibbs said that the person
voting no is the only one that can request reconsideration on
the vote.
Councilman Liebl explained that he had voted nay on the motion as
he had some questions about whether the parking facilities were
adaquate. In the interim he had gotten his answer and would like
a re -vote.
MOTION by Councilman Liebl for reconsideration of Motion to grant
the building permit to George Walquist. Seconded by Councilman
Samuelson. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
MOTION by Councilman Harris to concur with the. Building Standards
Design Control in their stipulations and grant the building permit
to George Walquist. Seconded by Councilman Liebl. Upon a voice
vote, Kirkham, Liebl, Harris voting aye, Samuelson abstaining,r
Mayor Kirkham declared the motion carried. i

Mayor Kirkham asked the petitioner if he was aware of the stipu-
lations. Mr. Burkholder replied that he was. the City Engineer
added that he had agreed with the stipulations and meets the
City Code.
MOTION by Councilman Harris to concur with the Building Standards -
Design Control and issue the building permit subject to the stipu-
lations. Motion seconded and upon a voice vote, all voting aye,
Mayor Kirkham declared the motion carried.
r.PASIDERATION OF RESOLUTION ORDERING IMPROVEM,WT, PLANS AND
SEECIFICATIONS FOR WATER AND SEWER PROJECT #88 ADDENDUM #3s
The City Engineer explained that this Public Hearing was held
last Monday and is being brought back to the Council for their
consideration. if the Council wishes to proceed with the project,
he would suggest they pass the resolution, and authorize the
Administration to approach Spring Lake Park and the Highway
Department on their share of the cost participation. He said
until we get agreements from both bodies, we would not do any
additional work on the project. He suggested that the Council
action can be recinded at a later date if no agreement can be
reached for any of the three systems with Spring Lake Park and
the Highway Department.
Councilman Harris suggested that the resolution be passed but to
strike the word "improvement". The City Engineer felt that the
Council should adopt the resolution for the final plans and
specifications before we should approach Spring Lake Park and the
Highway Department. After that, it would just be a matter of
choice of which of the three proposals the City wishes to choose.
MOTION by Councilman Harris to adopt the Resolution striking the
word "improvement". Seconded by Councilman Samuelson.
Mr. Rodman, Attorney for J.W. Bernstein, said that he appreciated
the indulgence by the Council in moving this item forward on the
Agenda, He said that it was his understanding that if the
resolution is passed this would mean that the Council need not
hold another Public Hearing, however, the particular improvement
Is not known, nor is the cost known at this time. He would like to
ogee the Council instruct the Administration to bring in plans
and specifications and costs, rather than adopt the resolution.
$ge Gibbs replied that the Council felt that it was a question
pf ngeding the resolution to enter into agreements with Suring
Lige park and the Highway Department and that this was the usual
VXpc9dure. The Council is well within it's fights to order in

the improvement at this time, however, they could choose to
authorize the Administration to proceed without the resolution.
Councilman Liebl pointed out that the Council should indicate
to the people which plan would be adopted. Councilman Samuelson's
feeling was that perhaps the minimum system would be better at
this time, and would suggest that this be tabled until further
information is available.
COUNCILMAN HARRIS WITHDREW PREVIOUS MOTION.
MOTION by Councilman Harris to authorize the Administration to
meet with Spring Lake Park and the Highway Department for
cost sharing participation study. Seconded by Councilman
Samuelson. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
Mr. Rodman requested that he be informed when this item will next
appear on the Council Agenda.
CONSIDERATION OF RESOLUTION ORDERING FINAL PLANS AND SPECIFICATIONS
FOR WATER SANITARY SEWER AND STORM SEWER PROJECT #88, ADDENDUM #2;
The City Engineer said that this is for water and sewer and if
this project is ordered in now the cost factor would be good,
later, the cost will probably be higher. The Fire Department
would like to see the Council order in this improvement so the
area could have fire protection.
Mr. Harold Harris, 6210 Riverview Terrace, asked if this is the
same plan brought in before *here the water would be jacked in
under 79th Avenue and then an enlarged pipe would be put in to
serve adjacent properties at a cost to the people in the area.
What cost differential is there between the water and sewer now
and not knowing if the ditch is to be an open ditch or a partial
conduit or a full conduit. If it is a full conduit, how do you
put one past the other without considerable expense.
Mr. Comstock replied that this will have to be resolved before
the final plans and specifications are presented. The sewer and
water will have to be designed in conjunction with the storm
ewer plan. If the ditch is to be enlarged, there would be
culverts under Elm and Beech Streets. The drainage program will
have to be considered with the sewer and water project. He said
they are considering jacking under the tracks and connecting the
watar at 79th Avenue on the 8" line, this would loop back to

2. Request to construct an addition to the existing building located on.

3. Consideration of a request to construct a proposed four stall garage
located on Lots 11, 12, 13, and 14, Block 3, Spring Brook Park Addi-

NOTE: There is a Public Hearing pending on vacating the South, of
an alley. The Planning Commission recommended approval of the
vacation November 17, 1971. Mrs. Jacobson was told she just had
to make application for the vacation and then they could proceed
with construction.

181 Ely -Street N.E.: Building Permit #6229 issued 10/18/62

A building permit for construction of ad6_tional storage area was grant ..d
to Aladdin Pools Incorporated on December 7, 1966, subject to the following
conditions;
1. All exposed concrete block (old and nev) be painted.
2. A 7 foot redwood fence (stained or painted) be provided to enclose
the storage yard.
3. Crushed rock or blacktop (or better) be provided off Ashton, North
of the fence and also front drive and parking lot. The remainder of
the lot outside the fence to be sodded or landscaped.
4. A Certificate of Occupancy be issued when all the requirements are met.
Inspection shows the following discrepancies;
1. Areas to be sodded or seeded are overgrown with weeds.
2. Fence has not been painted or stained: One section in the Northwest
corner is falling down.
3. Only the front of the building has been painted. All other areas are
unpainted block.
4. There is no driveway North of the fence.
5. No Certificate of Occupancy has been issued.
We can use stipulations of building permit for landscaping.

Board of Appeals variance to reduce front yard setback front 100 feet to
44 feet 6 inches -to build an addition was granted on December 1, 1965, and
approved by Council but a building permit for the above addition apparently
was never issued.
There is some planting and landscaping on the front of building (South side).
There is concrete curb in front of the building and on the East side'of the
front parking area. Some precast concrete bumpers are stacked in parking area.
There is a circular drive with some rock but most of the area is dirt.
Most areas are overgrown with weeds.
Parking area can be required under 1961 City Ordinance and lots can be
maintained under pr9sent nuisance ordinances.
Compliance to the 1969 City Code can be required by January 1, 1973.

Building Permit #6824 issued 11/5/63
Original building permit stipulates front of building to be stucco and
brick with side yard setback on East to be 5 feet and front yard setback to
be 35 feet.
The building permit for the addition in 1963 stipulates a front yard
setback of 35 feet and a side yard setback of 20 feet. The sketch attached to
the building permit shows the 20 foot side yard on the West side of the
building. The sketch also shows a blacktop parking area in front of the building.
Inspection shows no blacktopping in front of building and no landscaping
of any kind. Front yard setback appears too short.
Some improvements could be made by compliance with 1963 building permit,
also by using 1963 Zoning Ordinance in effect at time of second building permit.
Other compliance can be made by January 1, 1973.
140 Liberty Street N.E.: Building Permit #5159 issued 3/16/61
Building Permit #10,532 issued 1/2/70
Original permit stipulated that front of building must be stucco or
brick or both. Front yard setback was 35 feet and East side yard was 0 feet.
The second building permit was for interior alterations only.
No stipulations were noted on the building permits.
This building should be considered with 148 Liberty Street because there
is only five feet between buildings and originally the permit was granted for
a common wall.
148 Liberty Street N.E.: Building Permit #6380.issued 3/11/63,
Originally; permit was granted for addition to existing building at
140 Liberty -but nearly 1 year after permit was issued (2/21/64) apparently a
verbal arrangement was made to separate the two buildings with the second
addition being added to the existing building as per permit plans. There
are now two separate buildings approximately 5 feet apart.
Inspection shows one concrete drive up to East end of building and one
concrete drive to loading ramp at West end of building. Rest of lot is dirt
with no landscaping.
Parking, and landscaping can be enforced under some provisions of the
1963 City Ordinances, and balance by January 1, 1973.

151 Longfellow Street N.E.: Building Permit #6398 issued 3/28/63
A front yard variance from 100 feet to 60 feet was granted on March 21,
1962 to allow erection of the above building. The Board of Appeals also
stipulated that the building was to be 50 feet from the West property line.
The Council concurred.
A sketch attached to the Board of Appeals minutes shows a building
68 feet by 70 feet with the West side 50 feet from the property line.
.The building permit issued was for a building 85 feet by 44 feet. The
building on the site is considerably less than 50 feet from the West property
line.
Stipulations on the building permit stated that the parking lot and
driveway must be blacktopped with the balance of the front to be sodded and
planted.
A recent complaint was issued against this property because water and oil
were running from this building into a shallow pool adjoining the residential
property on the West and the water and oil seeped onto the lawn. There were
also complaints of illegal parking and poor maintenance.
The owner was notified and the vehicles were parked in a different area;
the lot was cleaned up; interior masonry work eliminated the water and oil flow;
and the owner has stated that a six foot screen fence will be erected between
his property and the residential property West of the building. The fence is
to be done by November 24, 1970 and the holes along the west side of the building
filled shortly thereafter.
Compliance in this case is voluntary, for the most part, but compliance
can be obtained under 1963 Ordinances and present ordinances.

This is ari 8 unit apartment building which is landscaped and being
maintained in an adequate manner.
211 -79th Way N.E.: Building Permit #5751 issued 2/10/62
This is an 8 unit apartment building which is landscaped and being
maintained in an adequate manner.
231 -79th Way N.E.: Building Permit #10,059 issued 12/10/68
This is a:7 unit apartment building which is landscaped and being
maintained in an adequate manner.

136 Liberty Street N.E.:
This is a nonconforming use of an automobile junk yard. According to the
Zoning Ordinance this may continue as a nonconforming use if it is enclosed in
a fenced area.
The owner has been notified to move all vehicles onto his own property
and fence the area from public view.
The fence has been started and one section is complete. Materials and
equipment are on the site. Vehicles are being moved from adjoining property.
CONCLUSION:
It seems although no specific area was mentioned that the area North of
79th Way mentioned by Mr. Breider would most likely be the industrial buildings
along the West side of the railroad tracks. The apartment buildings along
79th Way seem adequate in appearance and maintenance and the residential
area for the most, also appears adequate.
The industrial area is being improved in those areas where we have
proper authority under applicable ordinances and some problems will be
eliminated this fall.
However, a general plan for the area should be worked out so that a
concerted effort could be made to improve the whole area at once, probably
beginning next spring. In the meantime specific ordinance violations such
as undue amount of litter or poor maintenance can be corrected as they occur.
