ORDINANCE N0. 286 AN ORDINANCE RELATING TO MULTIPLE MLLINGS, AND ANENDIhG THE CITY CODE OF FRIDLEY, MINNESOTA 1963, SECTIONS 49.045 AND 49.052 rdEREOF. The City Council of the City of Fridley do ordain as follows: SECTION 1. That Chapter 49 of the City Code of Fridley be amended so that Section 49.045 thereof hereafter reads as follows: "Section 49.045. That the annum, fee to be paid by the applicant for the cost of license and the issue thereof and the administration of Chapter 49, including the cost of inspection required is in the minimum of $10.00 for each multiple dwelling for which a license application is made. In addition thereto, for each dwelling unit in excess of 10 noted in said applica- tion, a further and additional fee of $1.00 is required to be paid. The fee is pro-rated (for each month or major part thereof) for any license period whose duration is less than one (1) year. SECTION 2. That the City Code of the City of Fridley shall be amended so that Section 49.052 thereof shall read as follows; `Section 49.052. The owner shall subscribe to an application form for said license giving such information as may be necessary to determine compliance with this Chapter. The owner shall furnish such further information to the City as may be requested and relating to compliance with this Chapter. The City shall inspect the premises one or more times a year to assure such compliance of the premises. Except in an emergency that involves an immediate hazard to the health, safety and welfare of human beings, no entry into the premises for the purposes of inspection to determine compliance shall be made without the consent of the owner or occupant, after notice of intent to inspect. Where consent is refused, then the City may proceed to inspect, after a hearing before the City Council with five (5) days registered written notice to the last known address of the owner or occupant and where the City Council determines from such hearing that inspection is reasonably necessary to assure compliance with this Chapter. The failure and refusal without good cause shown, to furnish the information requested relative to the compliance of the premises with this Chapter or the failure or refusal to give consent to an inspection, without good cause, is grounds for disapproval and denial of a license as well as suspension or revocation of the license. The Telephone Company has applied for a permit to construct a 40 x 10 foot storage building to be built in back of their present garage at 6424 5th Street . The proposed location indicates the structure to be built three (3) feet from side and rear lot lines . The present code states that buildings should be thirty-five (35) feet from zoning boundary lines with exception to essential services . Since this structure is for storage of materials , perhaps it could be considered an essential service to the operation of the Telephone Company, therefore , could be built at the location they request , I feel City Council should make a determination on this before a permit can be issued. REGULAR COUNCIL MEETING OF SEPTEMBER 20, 1971 PAGE 9 MOTION by Councilman Kelshaw to grant the permit for Donlyn Manufacturing Corp. subject to the Board's stipulations. Seconded by Councilman Breider. Councilman Harris asked about the landscaping plan, and commented that one of the buildings is done fairly well. The City Engineer said they are going to landscape and showed the landscaping plans at the Council table. There will be a blacktopped access onto 73rd Avenue. There will be a 100' lot left to the south that could be a problem to the City, as it is rather small and could require some variances to build upon. Councilman Harris said that he hoped that before the building is occupied, the landscaping would be completed. He did not want the same situation the Council had with Brothen in Commerce Park. MOTION AMENDED by Councilman Harris that the landscaping is to be completed by June' l, 1972.
