Mr. Wolke stated that if the Consulting Engineers stated they were qualified bidders, and they are low bidders, what else could the City do but award them the bid, and that he would like to recommend Bianconi as the low bidder if they are qualified. Phil Dolan was present and stated that he is representing Bianconi Construction Company, and stated that .Bianconi had bid on a job in New Brighton the night before the bids were awarded in Fridley, Mr. Dolan stated that Bianconi was the second low bidder at New :Brighton the night before, and, therefore, was of the opinion that they did not have any work lined up when their bids were submitted to Fridley, but New Brighton subsequently threw out the low bidder and awarded the bid to Bianconi, which was the second low bidder. Bianconi is a small company, and has only one machine, and they did not feel they could do the work within the completion date. If the .:completion date could be extended, it would be appreciated. Mr. Wolke suggested that maybe this matter should be tabled temporarily. Mr. Kohlan asked when the 30 days from the .bid letting expires. Les Knutson stated August 1. Mr. Kohlan stated the Council could move that it is found that Bianconi is the low bidder, and the bid is therefore .awarded to them, and that should there be a failure on their part within the time limit, ,the bids be awarded to the next lowest bidder. Mr. Johanson asked about the penalty. Mr. Kohlan stated if the Council took the above action, they would lay the groundwork for possible damages. Mr. Greig suggested that the Council award the bid. Motion by Johanson to adopt Resolution #63-1962, awarding the bid to Bianconi Construction Company for Project #58 in the amount of $41,787.40. Seconded by Nee. The Planning Commission had recommended that this part of Gardena right- of-way as shown on,Drawing No. 62-59 be vacated. Motion by Johanson to concur in the recommendation of the Planning Commission and set up a public hearing on this matter and draw up the necessary ordinance. Seconded by Nee. MINNEAPOLIS GAS COMPANY DRAWING N0. 18-1962 - PROPOSED LANDSCAPING AND GAS REGULATION STATION LOCATED AT THE SOUTHWEST CORNER OF 62ND WAY AND EAST RIVER ROAD: The Planning Commission had.recommended that this be accepted and approved. Motion by Johanson to concur in the recommendation of the Planning Commission. Seconded -by Nee. Upon a voice vote, there being no nays, the motion carried unanimously, Mr. Wolke arrived at. 9:45 P.M. - COMMUNICATIONS: BETTER FROM FIRE CHIEF HUGHES WITH REFERENCE TO HILLTOP CONTRACT: fire Chief Hughes was present and explained that the men of the Fire Department had voted to cancel the contract with the Village of Hilltop, because of several incidents that had occurred. Fire Chief Hughes stated that lie was not entirely in accord with the vote taken. He also stated that there were fire calls on the average of two or three times a year in the Village of Hilltop. He explained that if the City fire 'rigs were called to Hilltop, and a fire call came into Fridley, Fridley could always call on the mutual aid to take care of the Hilltop fire, and their own rigs could respond to the Fridley fire. Mr. Johanson suggested writing a letter to Hilltop to see if this matter could be resolved. Mr. Hughes explained the things that had happened during theyear which had.made some of the Fridley firemen unhappy. These being the way the Village of Hilltop had handeled the fire at the super market and also, the way they had handled some of the open burning in the area. Mayor Greig left the meeting temporarily. NEW BUSINESS: PUBLIC HEARING - REQUEST TO BUILD FOUR-PLEXES - NAGELS WOODLANDS Jfl The Mayor declared the hearing on four-plexes in Nagels Woodlands re -opened. A question was asked what, Mr. Peterson's alternate plans were if the four-plexes coi go in, and what the completion date of his proposed buildings was. Mr. Peterson stated that his alternate plans were to put in double bungalows with the cars com: in off Able Street, but if he puts in the four-plexes, he would bring in the cars from 'Baker Avenue. Mr. Lubeck - 7525 Able Street asked if the Council"could not k control the directioAs that the houses would face. Mr. Johanson stated that the Building Board would take a dim view of the bungalows facing.Baker Street. Mr. h Peterson stated that the four-plexes would have a stone front and would sell for, around.$40,000.00. Mrs. Klingl - 7364 Able Street, asked if the Council could not make.him face the double bungalows to Able Street. Mr. Kohlan stated that his off -hand opinion is that the Council could not, but he would have to check s further.into this matter to be sure. Mr.:Johanson stated that if Mr. Peterson faced his buildings on Baker Street, the people on Able Street would have-to.pay the entire cost of street surfacing. Mr. Johanson stated that the people were led to believe that there would be double bungalows in this area in the first plac The question, was asked what the recourse of the people was. It was stated that the official decision would be made by the Council. The Mayor stated that if Mr. ¢ Peterson builds double bungalows and faces them to Baker Street the people on Abl x Street would have to pay.for the curb and street themselves. Mr. Wolke asked if`t were service connections :to the east on the storm sewer.and water line on Able Sheet. Mr..Knutson stated that. there were, and that they had been put in at the m request of: the owner of the,property.._Mr. Wolke stated that he would think.ia- � this.instance,.a:_developer to the.east would have to pay .for them. Mr. Peterson stated that if he puts in the lour-plexes, u he would try to do most of his construction off Baker Street to keep the -traffic off Able Street. He stated that he would put in Baker Street within the next two months. Mr. Johanson asked if the people would like to come back next week and ti have another meeting on this if the drawings of the four-plexes, and the double bungalows could be available at that time. Councilman Johanson stated it should be understood the City Council?., was not going against the wishes of any board of the City of Fridley but that any matter can be drawn out just so long and it does become a necessity for the City Council to pass on any given subject. BUILDING BOARD M-TU'1'ES - NOVEMBER 27, 1963:„ BUILDING PERWT APPLICATION BY SHERMP.N HANSON TO BUILD A FROST -TOP AT 353 MISSISSIPPI STREET NORTID+AST: Mayor Nee announced the item under consideration was a building permit ap- plication to build a Frost -Top at 353 Mississippi Street N rtheast. The City Manager read to the City Council the action taken by ?he Building Board. Mr. Sherman Hanson was represented by his attorney who stated the application was for Lot Ten on the Northeast corner of University and Mississippi Street and it was the third lot in from the corner, that Lots twelve and eleven had been sold to the Pure Oil Company and are going to have a filling station built on them. He stated he was present with Mr. Hanson to ask for a building permit for the Frost -Top in question, that Mr. Hanson is operat- ing a drive-in and the reason he needs to move is the property is being ac- quired by the Minnesota State Highway Department. It was explained Mr. Hanson runs a good operation and is agreeable to all the terms and condi- tions as expressed by the Building Board and he intends to abide by them. Mr. Hanson's attorney explained that once before he obtained a building permit which was later rescinded and he had to sell the property he had purchased. Motion by Wolke to concur with the recommendation of the Building Board and approve the application for a building permit by Sherman Hanson to build a Frost -Top at 353 Mississippi Street Northeast subject to the.conditions ex.- pressed by the Building Board which were: no access from gas station lots to this property and suitable barrier must be provided on the lot line; if sign is installed other than on the building, it shall be installed in the Southwest corner of the parking lot. BUILDING PERMIT APPLICATION BY STEVE HAWRYSH TO BUILD A 20 UNIT APARTMENT HOUSE AT 195 MERCURY DRIVE NORTHEAST: Mayor Nee announced the item under consideration was the application by Steve Hawrysh for a building permit to'build a twenty unit apartment house. Councilman Johanson stated he had asked the chair to bring this matter to the floor. Dir. Hawrysh was present and presented plans which he stated he would have revised to include necessary windows on the east end of the build- ing. Councilman Johanson explained to the City Council no action had been taken by the Building Board because of plan showing insufficient windows. A discussion period was held regarding windows and air conditioning units. Motion by Johanson to approve the application for a building permit by Steve Hawrysh to build a twenty unit apartment house at 195 Mercury Drive Northeast subject to the proper windows being installed in the East end of the building as agreed.
