In order to provide safe passage for vehicular and pedestrian traffic in
the City of Fridley, periodic inspections of street intersections are
conducted. An inspection on July 17, 1980 has determined that the
intersection on your property is obstructed and could present a hazard to
traf'f is .
Section 205.154 of the City Code requires that, "On a corner lot in a
vision safety control zone, nothing shall be erected, placed, planted or
allowed to grow in such a manner as to impede vision..., the vision
safety control zone is described as follows: That area bounded by the
street right of way lines of a corner lot and a straight line joining
points on said right o£ way lines twenty five (25) feet from the inter-
section of said right of way lines."
Therefore, the City is requesting you, the property owner, to correct the
following problem and thereby make the City's streets safer for travel. A
reinspection will be conducted on or about August 4, 1980 to determine
compliance. We are confident in your cooperation to correct this matter
and if any questions or problems result frau this letter, please contact
me at 571-3450.

AGREEMENT
This Agreement, dated this 1-4+— day of A
1995, by and between John M. Rice, Jr. and Karleen V. Rice,
husband and wife (hereinafter referred to as "owners"), and the
City of Fridley (hereinafter referred to as "the City").
WHEREAS, the owners own residential real estate in the -City
located at 8041 Riverview Terrace N.E. and legally described as
follows:
Lots 19 - 22, Block U, Riverview Heights (hereinafter
referred to as "the subject property"); and
WHEREAS, said property is located within the CRP -2 Flood
Fringe district; and
WHEREAS, the owners are interested in constructing a two car
garage on their property; and
WHEREAS, the construction involves a portion of the garage
which will be at an elevation below the regulatory flood plain
elevation; and
WHEREAS, the City has agreed to issue a special use permit
allowing the construction upon certain conditions.
NOW, THEREFORE, in consideration of granting the special use
permit, John M. Rice, Jr., Karleen V. Rice, their heirs,
successors, and assigns hereby covenant and agree as follows:
1. That the garage shall not be used nor made usable as a
habitable space as defined in the City's building code.
2. That they shall hold the City harmless for any injuries
or damages to property by reason of the construction of the
garage below the regulatory flood plain.
3. John M. Rice, Jr., Karleen V. Rice, their heirs,
successors and assigns shall defend the city against any and all
claims arising as a result of construction within the flood
plain. The city may defend and charge the costs of such defense
against John M. Rice, Jr., Karleen V. Rice, their heirs,
successors and assigns, and assess such costs against the subject
property if adequate and timely defense is not commenced on the
city's behalf.
4. John M. Rice, Jr., Karleen V. Rice, their heirs,
successors and assigns agree to promptly pay any sums due under
this agreement.
The city may pursue judgments to collect the amounts owing
under this agreement, and if said sums are not promptly paid, the
city may assess the costs against the subject property.

Dear Mr. Rice:
On October 3, 1994, the Fridley City Council approved a Special Use Permit to allow
construction of a second accessory structure in excess of 240 sq: ft., and to allow construction of
said accessory structure in the flood fringe district. This letter is to inform you that on October 3,
1995, your Special Use Permit will expire due to the lack of construction. If you do not wish to
have your Special Use Permit expire, please respond in writing by September 3, 1995 regarding
your need for an extension. Initiation of construction via a building permit application will also
prevent expiration of your Special Use Permit. I will schedule your extension for consideration by
the City Council at the September 11, 1995 meeting.

Dear Mr. and Mrs. Rice:
In followup to our most recent communications I am sending this letter to restate and clarify the
October 31, 1995 cleanup deadline we have established. As you know, we established this
cleanup deadline to allow for enough time to complete a garage construction project. We agreed
that completion of the garage would result in more than adequate space to properly store the
numerous materials and vehicles on your property that are currently in violation of City Code.
This October 31, 1995 deadline will be strictly adhered to. Should any of the outside storage,
junk vehicle, or vehicle parking violations continue into November, citations will be issued. A
citation will result in a court appearance with a -possible misdemeanor charge and/or fine. I
encourage you to take the necessary corrective actions to avoid this citation process.
To clarify any confusion about City Code requirements and the specific violations that shall be
corrected by October 31, 1995, please refer to the attached diagram. If you have any questions
or concerns about the required actions, please contact Code Administration at 572-3595.

RE: The Outside Storage/Garage Construction Project
Dear Mr. Rice:
I appreciated the opportunity to meet with you on Friday, September 8th, 1995. As you will
recall we discussed the current code violations at your location and the garage construction
project.
During our discussion you agreed that the garage project would be completed by October 31,
1995. You also agreed that upon completion of the garage, all materials being stored outside
would be fully screened from the public right away. I agreed that the garage construction project
has created a reasonable hardship, and if all materials were properly screened by it's completion
the city would be satisfied. If the outside storage of materials and the inoperable vehicles remain
after October 31 st, legal action will be approved and a citation will be issued.
