GENERALLY LOCATED AT 7615 BAKER STREET N.E.: Ms. Dacy, Community Development Director, stated that this is a request to reduce the front yard setback from 100 feet to 90 feet to allow the construction of a small addition to be used as an entry vestibule. She stated that this would improve the energy efficiency of this area. She stated that the petitioner is proposing to add additional parking in front of the building by increasing the number of spaces from four to eight. STATED HARDSHIP: None stated. B. ADMINISTRATIVE STAFF REVIEW: Request The petitioner is requesting that a variance be granted to reduce the front yard setback from a right-of-way adjacent to a residential district from 100 feet to 90 feet. The request is for Lot 7, Block 1, Nagel's Woodlands, the same being 7615 Baker Street N.E. Site Located on the property is a single story masonry building. The property is zoned M-1, Light Industrial, as are the properties to the north, east, and south. The property to the west is zoned R-1, Single Family Dwelling, and R-2, Two - Family Dwelling. Analysis Section 205.17.03.D.(4).(a) requires a setback of 100 feet from any street right-of-way abutting a residential district. Public purpose served by this requirement is avoid congestion in the public street, safety hazards and other dangers, and to protect and conserve the character of the adjoining neighborhoods. The petitioner is proposing to construct a 10 ft. by 17 ft. addition to the front of the building. The addition is to be used as an entry vestibule to improve the climactic conditions of the office space inside the building. Currently, offices adjacent to the existing entry are difficult to heat in the winter due to their exposure to the northwest winds. The petitioner is proposing to improve the energy -efficiency of the entry area. In addition, the petitioner is proposing to add additional parking at the front of the building increasing the number of spaces provided from four to eight. The variance as proposed does not adversely impact the adjacent properties. The addition will not encroach into the adjacent properties' lines of sight. Adequate green area will be maintained in the front yard after the parking and building expansion. MOTION by Dr. Vos, seconded by Mr. Ruechle, to waive the reading of the public hearing notice and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 9:10 P.M.' Ms. McPherson stated the request is reduced the front yard setback from a right of way adjacent to residential district from 100 feet to 90 feet for 7615 Baker Street N.E. The property is located south of Osborne Road on Baker Street. The property is zoned M-1, Light Industrial, as are the properties to the north and east. The property across the street to the west is zoned R-1, Single Family, and R-2, Two Family Dwelling. The petitioner is proposing to construct a 10 foot x 17 foot addition to the front of the building. The intent of the addition is to create a separate vestibule or entry which will improve the climatic conditions of the office space adjacent to the proposed addition. The petitioner stated it is difficult to heat these offices to a comfortable level due to the exposure on the west side of the building to the northwest winds. The variance will not adversely affect the adjacent properties, it does not impact the line of site, and there is adequate green area remaining after the expansion. The petitioner, however, should provide additional landscaping to screen the parking area from the public right of way. Ms. McPherson stated staff does not have a recommendation; however, if the Appeals Commission chooses to recommend approval, staff has one stipulation: 1. The petitioner shall provide a landscape plan which provides screening for the parking lot along Baker Street prior to issuance of a building permit. Screening shall be provided by either a three foot berm, hedge, or combination thereof. As this is a commercial/industrial request, this will be reviewed by.the City Council. Mr. Abraham stated, in the wintertime, the entrance opens directly into the office space on the west side of the building. When it gets cold, they get ice build up on the door, and have much traffic in and out of the building making it impossible to.work in the front office in the winter. This vestibule would provide a climatic barrier. The other request increases parking from 5 spaces to 9. In the past, when they have increased the size of the building, they have added employees and, with the business having grown, they find that their customers end up parking on the street. The increased parking would be adequate to service their business. Ms. Savage asked if they had any problems with.the stipulations. Mr. Abraham stated he was not sure where staff wants the landscaping to be, whether right along Baker Street or next to the parking lot. Currently, the property is well landscape and will continue to be. They will work with staff. He would not like to put landscaping right along the parking lot because of snow removal and snow storage concerns. He would prefer to put it closer to Baker Street because of concerns with snow. MOTION by Mr. Kuechle, seconded by Ms. Smith, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 8:18 P.M. Mr. Kuechle stated this is a straight forward request. It is APPEALS COMMISSION MEETING. JUNE 1, 1993 PAGE 18 reasonable and fits in with the surroundings. He would recommend approval with the stipulation that they work with City staff on landscaping. Ms. Savage stated she agreed. Dr. Vos stated he thought at one time you could building something having to do with weather conditions closer to the street than other structures. Ms. McPherson stated this was true only in residential areas. MOTION by Mr. Kuechle, seconded by Dr. Vos, to recommend the City Council approve Variance Request, VAR #93-11, by Top Tool Company to reduce the front yard setback from 100 feet to 90 feet to allow the construction of a small addition with the stipulation that the petitioner work with City staff on a landscape plan.
