PUBLIC HEARINGS: 5. Consideration of a Proposed Ordinance Amending Fridley City Charter, Chapter 7. Debra Skogen, City Clerk, stated the Fridley Home Rule Charter is the fundamental law defining the powers citizens agree to give to the City. The Charter Commission is comprised of 15 court-appointed citizens who meet 8 times annually to discuss and refine the Charter in response to the needs of the community. MN Statute Section 410.12, Subd. 7 allows for charter amendment by ordinance upon recommendation of the Charter Commission. It requires notice of public hearing and publication of the full text of the amendment at least two weeks prior to the public hearing. 2 FRIDLEY CITY COUNCIL MEETING OF JUNE 26,2017 PAGE 3 Ms. Skogen stated that on May 15, 2017, the Charter Commission recommended an amendment by ordinance to the City Council. On May 22, 2017, the Council scheduled the public hearing for June 26, 2017. On June 2, 2017, the proposed ordinance was published in full in the City's official newspaper. The Charter Commission has discussed and reviewed Chapter 7 extensively over the past year, in light of budget concerns due to the restrictions placed in the Charter in 2000. The amendment to Section 7.02.1 proposes to remove inflationary Consumer Price Index (CPI) allowing Council to increase tax levy up to 5% over the previous year's tax levy. Ms. Skogen said the Charter Commission also recommended the City Council have the ability to increase the previous year's tax levy up to an additional 3% with an affirmative vote of four members of the City Council. A few other amendments were required to correct inconsistencies with Minnesota State Law and general accounting standards. After the public hearing, the proposed amendment requires a first and second reading and a unanimous vote of the City Council to become adopted (July 10 and July 24). If a vote is unanimous, the ordinance becomes effective 90 days after publication, or on November 2, 2017. Staff recommends holding the public hearing on the proposed amendment to Fridley City Charter, Chapter 7. Taxation and Finances. Dave Oswald, Fridley resident and Chair of the Charter Commission, said he has been very involved with this ordinance. The Charter Commission has spent around 8 months looking at the information presented and the finances of the City. The Charter knew this amendment needed to be made. Fourteen voting members overwhelming approved the amendment to give freedom up to 8%. There were a few "no" votes because they thought the ordinance did not remove enough restriction. The Charter Commission came up with a compromise. Steven Eggert, 1090 Hathaway Lane, is a long-term resident and knowledgeable of the finance concerns of the residents. He has been concerned about the cuts that have happened over the last 15 years and is supportive of this amendment. Jerry Balls, 7514 Alden Way, is in favor of the amendment to give the City more flexibility in meeting obligations and paying bills. Councilmember Bolkcom commended the Charter Commission in their work on this and noted that this was a learning process for everyone. City staff provided a lot of information and guidance and now we have an amendment that we can all support. MOTION by Councilmember Barnette to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:34 P.M. 3 FRIDLEY CITY COUNCIL MEETING OF JUNE 26,2017 PAGE 4 NEW BUSINESS: 6. Resolution Approving Safe Routes to School Plans for Stevenson Elementary School, Hayes Elementary School, and Fridley Middle School Julie Jones, Planning Manager, stated SRTS addresses the collective need to address public safety issues, encourage biking/walking to school as part of the solution, qualify the City for future SRTS infrastructure funding and complete a task for the 2040 Comprehensive Plan. The three schools included in the SRTS are Stevenson Elementary, Hayes Elementary and Fridley Middle School. Ms.Jones said the planning team included consultants, City staff, ISD 14 staff, County Highway and Health Department staff, and community volunteers. The planning team participated in a 1 V2 day rapid planning session and walk audits to develop the plans. There were rapid planning sessions and walk audits, and a 1 %2 day team planning session to develop a plan. The Fridley School Board approved the three plans on May 16, 2017. Ms. Jones stated that on June 16, the City held a street event on Seventh Street to obtain public input on proposed changes in the plan for Seventh Street. Three hundred sixty postcards were sent out and 7th Street was blocked off. Different options were displayed for people to vote on. Thirty-seven adults and thirty-five kids took time to think through the options. The kids got to complete an exercise, enjoy a bounce house, see fire and dump trucks and get free bike stuff. Participants got a coupon for a free Grandpa's Ice Cream cone, compliments of the City. Ms. Jones shared the results: • 61St to 59th—2 of 37 said leave the street design as is; 86%want parking on both sides to remain for games/events and widening of existing sidewalk to 10' wide • 59th to Medtronic Parkway—4 of 36 said leave as is; 81% wanted to remove east side parking lane and construct a 10' wide raised multi-use trail in its place • Medtronic Parkway to 53`d Avenue — 2 of 32 said to leave as is; 72% wanted to remove the east side parking lane and replace it with a 10' wide raised multi-use raised trail The direction is consistently clear; for safety reasons, a grade separation from vehicles is desired. There was general agreement that parking on both sides of the street is not needed or used. Change is desired and there is an additional need to connect to shopping on 57th Avenue. Ms. Jones noted the plan must still be funded. Three SRTS Plans will serve as a guide to the City and ISD 14 to pursue funding. There is no guarantee that funding will be found for every project listed in the plan. Staff would like to hold future street events prior to future infrastructure grant applications to ensure public support. Staff recommends that the City Council approve the three SRTS Plans presented and adopt the resolution. Staff further recommends that the key components of the plan be incorporated in the City's 2040 Comprehensive Plan. 4 FRIDLEY CITY COUNCIL MEETING OF JUNE 26,2017 PAGE 5 Mayor Lund noted that the Safe Routes to School improvements will not be used just for students—it will be used by the public as well. Ms. Jones replied yes, it will benefit residents that live in the area too. Councilmember Bolkcom asked why the funds could not be used for the high school. Ms. Jones said she was not sure why. She would have to ask MnDOT. This funding is very limited and highly competitive. She assumed they limit it to the youngest students so they can get to school safely. Councilmember Bolkcom noted that this is a way to encourage people to move to our community. Ms. Jones stated that the Seventh Street proposal is just one project; but the most significant one in the plans. MOTION by Councilmember Bolkcom to adopt Resolution No. 2017-32. Approve Capital Project Grant Agreement #2021711 between the City of Fridley and the Mississippi Watershed Management Organization Jim Kosluchar, Public Works Director, said in 2015, the City constructed a chamber system in Summit Square Park to provide storm water quality. This project was funded by a capital grant from the Mississippi Watershed Management Organization (MWMO). We have monitored this system, and the system has outperformed its intended design, and has additional storage capacity. We also requested a budget allocation from the MWMO for the 2016 street project, but found no suitable cost-effective method of providing water quality treatment in this area, with the sole exception of adding capacity to an existing dry detention pond at 45th Avenue and Main Street. Mr. Kosluchar said during development of the Main Street Trail Project, it became apparent to the City through design evaluations provided by its consultant engineer, Bolton & Menk, that there was limited water quality treatment and capacity of the drainage system along Main Street. In order to offset added impervious surface, a concept plan was evaluated to allow controlled diversion to the Summit Square Park water quality treatment system. This would have the dual benefit of added water quality benefit and recovering pipe capacity on Main Street. The Mississippi Watershed Management Organization (MWMO) reviewed the feasibility of these two improvements and their use of previously allocated funding, and subsequently encouraged application for their Capital Grants Program. On May 9, the MWMO board approved the Capital Grant Request for this work. 5 FRIDLEY CITY COUNCIL MEETING OF JUNE 26,2017 PAGE 6 Mr. Kosluchar said the proposed project will both improve the water quality of storm water discharged to the Mississippi River, and reduce the potential for flooding on Main Street. It also maximizes prior investments in the Main Street detention pond and Summit Square Park systems. The first part of project includes improvements to an existing pond on Main Street, at 45th Avenue NE. The Main Street pond is owned by Anoka County and was created in 1961. As part of this project, we are proposing to excavate the existing pond to add approximately one additional foot of storage and to add an outlet control structure to the basin. Increasing the size of the pond and adding the control structure will provide an additional 4,639 cubic feet of treatment volume and encourage infiltration. Mr. Kosluchar stated these improvements are estimated to remove an additional 6 pounds of total phosphorus and 1,100 pounds of sediment each year. In addition, the pond will be planted with a native seed mixture, replacing the turf grass that is currently in place. The second project involves the installation of an 18-inch storm sewer pipe and diversion structure at 53rd Avenue to divert a limited amount of flow from an existing pipe along Main Street to another existing system in Horizon Drive. Benefits of this project include: 1) routing a "first flush" 11-acres of stormwater runoff that currently flows to the Mississippi River untreated (Main Street system) into a system that drains to an infiltration gallery at Summit Square Park (which the MWMO funded in 2015); and 2) providing hydraulic relief to the Main Street system under a 10-year storm event. Estimated water quality benefits of the 53rd Avenue diversion project are the removal of an additional 9 pounds of total phosphorus and 1,600 pounds of sediment per year. The City of Fridley prepared a funding request to the MWMO for this work, and they have provided the construction funding for these projects of$248,230. Mr. Kosluchar said staff recommends the City Council approve the attached Mississippi Watershed Management Organization Capital Project Grant Agreement#2021711 for the Fridley Main Street Pond and 53rd Avenue Diversion Projects. If approved, bid documents will be issued in July for completion of the project. Informal Status Reports Councilmember Barnette stated Plaza Park trail was closed off at the end of 69`h Avenue a few years ago due to a major project. There was a temporary trail put in. After talking with neighbors there is unanimous support that once the project is completed, they would like to see the fence replaced and the asphalt trail removed. This will take place in the next 2-3 weeks. Jim Kosluchar, Public Works Director, added that the plan is to start paving this week. 6 FRIDLEY CITY COUNCIL MEETING OF JUNE 26,2017 PAGE 7 Councilmember Bolkcom thanked everyone who attended Summer Solstice at the Banfill- Locke Center for the Arts. They had a good turnout and it was a huge success. She also commented that the `49er s parade attendance was down and there have been conversations on whether the parade should continue and if it should be held on a Thursday night or a Saturday. Julie Jones, Planning Manager, announced there will be a summer recycling day on Saturday, July 22. Postcards will be mailed out soon. The event will be at Green Lights Recycling Center to process materials, and there will be coupons to get 2 drop-off items free. There will be no paper shredding at this location, but same day paper shredding will be held outside City Hall under the electronic sign from 10 a.m. to 12 p.m. Recycling events will be held again in August, September and October--watch for details on the website. Councilmember Bolkcom said residents can sign up online to receive the Sun Focus by mail. Mayor Lund wished everyone a happy and safe 4th of July and noted City offices would be closed July 3 and 4. Wysopal, City Manage From: Scott Hickok, Community Development Director Julie Jones, Planning Manager Stacy Stromberg, Planner Subject: Consideration of an Extension Request for Variance,VAR#14-03,James Lange at 6940 Hickory Drive NE BACKGROUND On July 2, 2014, the Appeals Commission approved variance, VAR #14-03, for two variances, which will allow a single stall garage to be expanded to a double stall at the property located at 6940 Hickory Drive. • The first variance was granted to reduce the front yard setback (Hickory Place; is considered the code required front yard because it's the narrowest street frontage) from 25 ft. to 18.2 ft. • The second variance is to reduce % Bei ,7_ the side yard setback on the north '` ` ' side of the lot from 25 ft. to 20.8. ': ' Code requires that when the lot to -� the rear of the corner lot has frontage along the side street, an accessory structure needs to be a "! setback 25 ft. from the common ." f, i property line. : ' 4 f e _ City code states that if work as permitted ,' by the variance hasn't commenced within ; one year after granting of the variance, 404- then 04.then the variance shall become null and void unless a petition for an extension of '"' time have been granted by the Council. The City Council granted a one-year extension on this variance at their June 22, 2015 meeting. Staff received an extension request from Mr. Lange on June 13, 2016, stating he would like to formally request another one-year extension for the variance because he and his wife had a baby this year. 13 Consequently, they aren't able to complete the garage expansion this summer. The petitioner is a teacher and hopes to construct the garage addition himself next summer. The City Council granted a one-year extension on this variance at their June 27, 2016 meeting. Staff received an extension request from Mr. Lange on June 23, 2017. He states that he recently changed careers from being a teacher to a full-time Fire Captain here at the City of Fridley, so he won't have the time to start working on the project this summer. He hopes that next year will be the year to start this project. Section 603.07 of the Fridley City Code requires a public hearing be held to consider the approval of an on-sale intoxicating liquor license. The Notice of Public Hearing, Attachment A, was published in the Fridley Sun Focus on June 30, 2017, which meets the ten day advance notice requirement. After the public hearing, the City Council has the ability to approve the license at the same meeting. Mr. Slawson currently operates Route 65 Pub & Grub in Ham Lake. He plans to operate a similar operation here in Fridley geared more towards families. He has done some remodeling and extensive cleaning of the establishment and has a lease agreement with the Fridley Lions to conduct charitable gambling on this site. Staff received the liquor license application on May 24, 2017. The Police Department has conducted the background investigation and credit history of the applicant. The Police found no reason to deny the application at this time. The Fire Marshall also reviewed the application and conducted an inspection. The Fire Marshall found no outstanding issues or reason to deny the license. Recommendation At this time, staff recommends the following actions: 1. Hold a public hearing for an intoxicating liquor license for Brad Slawson, Applicant, to operate Route 47 Pub & Grub located at 7820 University Ave NE; and 2. Taxation and Finances The Fridley home rule charter is the fundamental law defining the powers citizens agree to give their city government. The Charter Commission is comprised of fifteen court appointed citizens who meet eight times a year to discuss and refine the charter in response to the needs of the community. Over the past year the Charter Commission has reviewed and discussed Chapter 7 extensively pertaining, to taxation and finances to the financial impacts of the restrictions placed in the Charter in 2000. The amendment to Section 7.02.1 would remove the inflationary Consumer Price Index (CPI) and allow the City Council to increase the tax levy up to five percent (5%) more than the prior year tax levy. In addition, if necessary, the amendment would also allow the City Council to add up to an additional three percent (3%) with an affirmative vote of four members of the City Council. Minnesota Statute, Section 410.12, subd. 7, allows for an amendment by ordinance upon recommendation of the Charter Commission. Within thirty days of receiving a recommendation, the City must publish notice of a public hearing on the proposed ordinance. The public hearing must be held at least two weeks but not more than one month after the notice is published. On May 15, 2017, the Charter Commission recommended an amendment by ordinance to the City Council for their review and action. On May 22, 2017, the City Council scheduled the public hearing for June 26, 2017 and the notice of publication was published in the Fridley SunFocus on June 2, 2017. The public hearing was held and there was no public opposition to the proposed ordinance. Staff recommends a motion to waive the reading and hold the first reading of an ordinance amending Fridley City Charter Chapter 7, Taxation and Finances, as shown in Attachment 1. 40 Attachment 1 ORDINANCE NO. AN ORDINANCE AMENDING FRIDLEY CITY CHARTER CHAPTER 7. TAXATION AND FINANCES WHEREAS, The Fridley City Charter has reviewed, discussed and recommended an amendment of the Fridley City Charter by Ordinance to the City Council on May 15, 2017; WHEREAS, the public hearing was scheduled for June 26, 2016 and published in the Official Legal Newspaper Fridley SunFocus on June 2, 2017; and WHEREAS The Fridley City Council hereby finds after review, examination and recommendation of the Charter Commission and staff that Fridley City Charter Chapter 7 related to taxation and finances be hereby amended and ordains as follows: FRIDLEY CITY CHARTER CHAPTER 7. The City shall have,in addition to the powers by this Charter expressly or impliedly granted, all the powers to raise money by taxation pursuant to the laws of the State which are applicable to cities of the class of which it may be a member, from time to time, provided that-tThe amount of taxes levied against real and personal property within the City for general City purposes shall not exceed in dollars, five percent (5%) more a tax levy that is greater than the prior year tax levy, increased. The term "fees" also does not include rental housing fees,building permit fees,liquor license fees,the extension or transfer of cable television service authority to additional service providers for which fees are already being charged, fees for the operation of junk yards, annual license fees for the operation of pawn shops and other regulated business, and any other charge for services, including health and safety related Code enforcement, and other goods, services or materials routinely provided by the City to its citizens or other members of the public which,by law,must be limited to the actual cost of the service being provided. The term "fees" shall not include any special assessments made under Minnesota Statutes Section 429. (Ref Ord 1152, 1244) C. For the purposes of this subsection, "fee increase" includes a new tax or fee, a monetary increase in an existing tax or fee, a tax or fee rate increase, an expansion in the legal definition of a tax or fee base, and an extension of an expiring tax or fee. (Ref Ord 1152) D. For the purposes of this subsection, "city" includes the city itself and all its departments and agencies that are organized to exercise the"Powers of the City" as defined in Chapter 1 of this Charter. "City" shall not include any body of government owing its existence to separate constitutional or statutory authority outside of the Charter,regardless of whether that other body of government has jurisdiction or performs duties and services within the boundaries of the City. (Ref Ord 1152) E. For the purpose of addressing natural disasters this subsection does not apply to any specific emergency measure authorized in Chapter 7, Section 7.08 or state law. SECTION 3: THAT SECTION 7.03 BE HEREBY AMENDED AS FOLLOWS: Section 7.03. BOARD OF REVIEW. The Council shall constitute a board of review and shall meet as such in the usual place for holding Council meetings to review, amend and equalize the assessed valuations according to state law_--a d (10) days prior to the day of said meeting. Weierke, Public Safety Director Date: June 27,2017 Re: First Reading of an Ordinance Amending Fridley City Code 102.01, Disposal of Lost,Unclaimed and Stolen Property to Allow for the Private Sale of Unclaimed Property to a Nonprofit Organization with a Significant Mission of Community Service The police department receives approximately 70-100 lost,unclaimed, or stolen bikes into police storage inventory annually. According to Fridley City Code Chapter 102, we currently wait 60 days for the proper owner to claim their bike. If no one comes forward, the bikes are considered unclaimed and auctioned off with our current auction company Propertyroom.com. Police department staff spends a significant amount of time entering bike information into the Propertyroom.com system before the bikes are picked-up by Propertyroom.corn. In addition, they assist in the labeling of each individual bike and help load them on to a truck for pick-up. The proceeds from the sales of the bikes are deposited into the City of Fridley's general fund. The bikes sell anywhere from$6.00- $25.00 with a majority of them selling at the lower end range. The bikes are frequently sold in groups of up to ten bicycles, rather than individually, due to their condition. In 2016 the City received$142.00 for bikes sold through Propertyroom.com. Staff is interested in helping the police department become more efficient in disposing of the unclaimed, lost or stolen bikes. The proposed amendment would save police staff time by allowing the police department to conduct a private sale of lost, unclaimed or abandoned bicycles at a price of$2.00 per bicycle to a local non-profit community organization, for the purpose of refurbishing and repairing bicycles that may be distributed to the youth within the community. The Fridley Columbia Heights Rotary Club is interested in acquiring the bikes and working with Bikes 4 Kids, a non-profit located in Ham Lake. The cities of Blaine, Lino Lakes, St. Paul and Spring Lake Park are currently participating with the Bikes 4 Kids program. I spoke with Al Sannerud, Executive Director, and found they will work with the Rotary Club and come to the City when requested to pick up our eligible bikes with very little police staff time involved. Local #310) for the 2017, 2018 and 2019 calendar years. The City and Union entered into negotiations in December of last year and reached an impasse with regards to some of the terms of the contract, which resulted in continuing discussions in a formal mediation on June 15, 2017. With the assistance of a mediator from the Bureau of Mediation Services, both parties reached,what we believe is a positive and reasonable settlement. The unit has taken a vote and have approved the tentative agreement, which is attached for your review and final Council approval at the July 10, 2017 Council meeting. The terms of the agreement are summarized below: SUMMARY OF CHANGES: 1. Article 33 - Duration (Three years -2017, 2018 and 2019) 2. Article 16 -Insurance Employees in this bargaining unit will receive the same insurance benefit package as all other City employees, which includes the health, dental and life insurance and alternatives (cash option or benefit leave). Having the same benefit package across the board has been a long-standing pattern and valued practice at Fridley, which is unique to our City and difficult to important to defend to keep fairness between all groups. 3. Article 21 -Wages The biggest challenge in negotiations has been in establishing a list of cities which compare to Fridley in order to determine what the market is. Both parties disagreed as to who should be on that list of comparisons and ultimately no agreement was reached about the list, making it impossible to establish the market. It is the City's position that our Sergeants are paid at the market or within one percent(1%)of the 2016 rates for comparable cities. 47 Memo to Walter T. Wysopal July 7, 2017 Page 2 Both parties agreed to a 2.5% general increase or COLA for 1/1/2017, a general increase of 2.75%on 1/1/2018, and a 3% general increase on 2019. 4. Article 23—Separation Benefit Plan Both parties agreed that there was some outdated language which no longer applied to current employees and it was removed from the contract. The benefit provided a separation benefit of$200 per year for each year of service up to 20 years of service. It was only provided to employees hired prior to 1/1/1986 and since no Sergeants meet this criteria, the language was eliminated. 5. Article 2—Holidays Both parties agreed to increase the number of City-paid holidays from eleven(11)to twelve (12). Currently all groups have eleven (11) City-paid holidays, which are counted as eight (8) hour days. Both parties agreed that this would become effective for 2017 and that the City would designate the holiday each year going forward. The City's research showed that the cities we identify as peer cities provide 12 paid holidays per year. 6. Article 25 -Retiree Health Insurance Since the last contract ratified in 2014, employees in the unit agreed to participate in an Retiree Health Savings Plan (RHSP) or often referred to as a post-employment health savings plan (PEHSP)through ICMA. This fund is administered by the ICMA-RC Corporation, which manages the City's Deferred Compensation 457 Plan. While there are no City contributions made into this fund, there may be some taxes related to offering this plan due to the Healthcare Reform Initiatives. At this point, it is expected any fees will be nominal. Employees agreed to increase their contributions from $25 per pay check up to $50 per paycheck. With the exception of the PCORI taxes mentioned above, there are no additional costs to the City to manage this fund. Employees pay for any fees related to their own investments. 7. Article 30—Employee Education Program Both parties recognize the value an importance in continuing education and agreed to increase the Tuition Reimbursement from $2,925 per year to $3,600. The City Manager agreed to consider any additional requests on a case-by-case basis. 8. Housekeeping Changes Since there was an article that was removed (Article 23), it meant that all of the article numbers would change and there were some minor changes to language to provide clarification and/or fix grammatical errors. 48 Memo to Walter T. Promotions and Additional Member Added To Unit With the recent retirements and changes in police administration, Public Safety Director Brian Weierke has prepared for promotional appointments for September of 2017 initiated by the pending retirement of Captain Mike Monsrud. In addition, he has proposed some internal restructuring and title changes, one of which is the current Police Inspector who will become a Sergeant and added to the unit. Currently the PERA P&F Fund Employer Contributions is 16.2% and is likely to see increases (up to 1.5% over two years for 2017 and 2018), but it has not been approved by the time of this settlement. 3) In 2017, one additional sergeant was added to the unit. Purpose of Agreement This Agreement is entered into between the City of Fridley, hereinafter called the Employer, and Law Enforcement Labor Services, Inc., hereinafter called the Union. It is the intent and purpose of this Agreement to: 1.1 Establish procedures for the resolution of disputes concerning this Agreement's interpretation and/or application; and 1.2 Place in written form the parties' agreement upon terms and conditions of employment for the duration of this Agreement. Article 2. Recognition 2.1 The Employer recognizes the UNION as the exclusive representative for all employees, under Minnesota Statutes, Section 179A.03, subdivision 8, for all employees in a unit certified by the State of Minnesota Bureau of Mediation Services. 1. Article 4. Employer Security 4.1 The Union agrees that during the life of this Agreement the Union will not cause, encourage, participate in or support any strike, slow-down or other interruption of or interference with the normal functions of the Employer. Article 5. Employer Authority 5.1 The Employer retains the full and unrestricted right to operate and manage all personnel, facilities, and equipment; to establish functions and programs; to set and amend budgets; to determine the utilization of technology; to establish and modify the organizational structure; to select, direct, and determine the number of personnel; to establish work schedules, and to perform any inherent managerial function not specifically limited by this Agreement. 5.2 Any term and condition of employment not specifically established or modified by this Agreement shall remain solely within the discretion of the Employer to modify, establish, or eliminate. Article 6. Union Security 6.1 The Employer shall deduct from the wages of Employees who authorize such a deduction in writing an amount necessary to cover monthly Union dues. Such monies shall be remitted as directed by the Union. 6.2 The Union may designate Employees from the bargaining unit to act as steward(s) and alternate(s) and shall inform the Employer in writing of such 3 56 choices and changes in the position(s) of steward and/or alternate. 6.3 The Employer shall make space available on the Employee bulletin board for posting Union notice(s) and announcement(s). 6.4 The Union agrees to indemnify and hold the Employer harmless against any and all claims, suits, orders, or judgments brought or issued against the Employer as a result of any action taken or not taken by the Employer under the provisions of this Article. Article 7. Employee Rights -Grievance Procedure 7.1 Definition of a Grievance A grievance is defined as a dispute or disagreement as to the interpretation or application of the specific terms and conditions of this Agreement. 7.2 Union Representatives The Employer will recognize Representatives designated by the Union as the grievance representatives of the bargaining unit having the duties and responsibilities established by this Article. The Union shall notify the Employer in writing of the names of such Union Representatives and of their successors when so designated as provided by Section 6.2 of this Agreement. 7.3 Processing of Grievance It is recognized and accepted by the Union and the Employer that the processing of grievances as hereinafter provided is limited by the job duties and responsibilities of the Employees and shall therefore be accomplished during normal working hours only when consistent with such Employee duties and responsibilities. The aggrieved Employee and a Union Representative shall be allowed a reasonable amount of time without loss in pay when a grievance is investigated and presented to the Employer during normal working hours provided that the Employee and the Union Representative have notified and received the approval of the designated supervisor who has determined that such absence is reasonable and would not be detrimental to the work programs of the Employer. 7.4 Procedure Grievances, as defined by Section 7.1, shall be resolved in conformance with the following procedure: Step 1 An Employee claiming a violation concerning the interpretation or 4 57 application of this Agreement shall, within twenty-one (21) calendar days after such alleged violation has occurred, present such grievance to the Employee's supervisor as designated by the Employer. The Employer- designated representative will discuss and give an answer to such Step 1 grievance within ten (10) calendar days after receipt. A grievance not resolved in Step 1 and appealed to Step 2 shall be placed in writing setting forth the nature of the grievance; the facts on which it is based; the provision or provisions of the Agreement allegedly violated; the remedy requested; and shall be appealed to Step 2 within ten (10) calendar days after the Employer- designated representatives final answer to Step 1. Any grievance not appealed in writing to Step 2 by the Union within ten (10) calendar days shall be considered waived. Step 2 If appealed, the written grievance shall be presented by the Union and discussed with the Employer-designated Step 2 representative. The Employer-designated representative shall give the Union the Employer's answer in writing within ten (10) calendar days after receipt of such Step 2 grievance. A grievance not resolved in Step 2 may be appealed to Step 3 within ten (10) calendar days following the Employer-designated representative's final answer in Step 2. Any grievance not appealed in writing to Step 3 by the Union within ten (10) calendar days shall be considered waived. Step 2a If the grievance is not resolved at Step 2 of the grievance procedure, the parties, by mutual agreement, may submit the matter to mediation with the Bureau of Mediation Services. Submitting the grievance to mediation preserves timeliness for Step 3 of the grievance procedure. Any grievance not appealed in writing to Step 3 by the Union within ten (10) calendar days of mediation shall be considered waived. Step 3 A grievance unresolved in Step 2 or Step 2a and appealed to Step 3 by the Union shall be submitted to arbitration subject to the provisions of the Public Employment Labor Relations Act of 1971, as amended. The selection of an arbitrator shall be made in accordance with the "Rules Governing the Arbitration of Grievances" as established by the Bureau of Mediation Services. 7.5 Arbitrator's Authority a. The arbitrator shall have no right to amend, modify, nullify, ignore, add to, or subtract from the terms and conditions of this Agreement. 5 58 The arbitrator shall consider and decide only the specific issue(s) submitted in writing by the Employer and the Union, and shall have no authority to make a decision on any other issue not so submitted. b. The arbitrator shall be without power to make decisions contrary to, or inconsistent with, or modifying or varying in any way to application of laws, rules, or regulations having the force and effect of law. The arbitrators decision shall be submitted in writing within thirty (30) days following close of the hearing or the submission of briefs by the parties, whichever be later, unless the parties agree to an extension. The decision shall be binding on both the Employer and the Union and shall be based solely on the arbitrator's interpretation or application of the express terms of this Agreement and to the facts of the grievance presented. c. The fees and expenses for the arbitrator's services and proceedings shall be borne equally by the Employer and the Union provided that each party shall be responsible for compensating its own representatives and witnesses. If either party desires a verbatim record of the proceedings, it may cause such a record to be made, providing it pays for the record. If both parties desire a verbatim record of the proceedings the cost shall be shared equally. 7.6 Waiver If a grievance is not presented within the time limits set forth above, it shall be considered "waived." If a grievance is not appealed to the next step within the specified time limit or any agreed extension thereof, it shall be considered settled on the basis of the Employer's last answer. If the Employer does not answer a grievance or an appeal thereof within the specified time limits the Union may elect to treat the grievance as denied at that step and immediately appeal the grievance to the next step. The time limit in each step may be extended by mutual written agreement of the Employer and the Union in each step. 7.7 Choice of Remedy If, as a result of the written Employer response in Step 2 or 2a, the grievance remains unresolved, and if the grievance involves the suspension, demotion or discharge of an Employee who has completed the required probationary period, the grievance may be appealed either to Step 3 of Article 7 or to another procedure such as Veteran's Preference or Fair Employment. If appealed to any procedure other than Step 3 of this Article, the grievance is not subject to the arbitration procedure as provided in Step 3 of Article 7. The aggrieved Employee shall indicate in writing which procedure is to be utilized - Step 3 of Article 7 or an alternate procedure - and shall sign a statement to the effect that the choice of the alternate procedure precludes 6 59 the aggrieved Employee from making a subsequent appeal through Step 3 of Article 7. Except with respect to statutes under jurisdiction of the United States Equal Opportunity Commission, an employee pursuing a statutory remedy is not precluded from also pursuing an appeal under this grievance procedure. If a court of competent jurisdiction rules contrary to the ruling in EEOC v. Board of Governors of State Colleoes and Universities, 957 F.2d 424 (7th Cir.), cert. denied, 506 U.S. 906, 113 S.Ct. 299(1992), or if Board of Governors is judicially or legislatively overruled, this paragraph of this Section shall be null and void. Article 8. Savings Clause 8.1 This Agreement is subject to the laws of the United States, the State of Minnesota and the City of Fridley. In the event any provision of this Agreement shall be held to be contrary to law by a court of competent jurisdiction from whose final judgment or decree no appeal has been taken within the time provided such provisions shall be voided. All other provisions of this Agreement shall continue in full force and effect. The voided provision may be renegotiated at the written request of either party. Article 9. Seniority 9.1 Seniority shall be determined by Job Classification Seniority and posted in an appropriate location. Seniority rosters may be maintained by the Director of Public Safety on the basis of both Job Classification Seniority and Employer Seniority. 9.2 During the probationary period a newly hired or rehired Employee may be discharged at the sole discretion of the Employer. During the probationary period a promoted or reassigned Employee may be replaced in his/her previous position at the sole discretion of the Employer. 9.3 A reduction of work force will be accomplished on the basis of Employer Seniority. Employees shall be recalled from layoff on the basis of Employer Seniority. An Employee on layoff shall have an opportunity to return to work within one (1) year of the time of his/her layoff before any new Employee is hired. 9.4 Senior Employees will be given preference with regard to transfer, job classification and assignments when the job-relevant qualifications of Employees are equal. 9.5 Employees shall be given shift assignments preference on the basis of Job Classification Seniority. 7 60 9.6 One continuous scheduled annual leave period (not to exceed two weeks) shall be selected on the basis of Job Classification Seniority until March 1st of each calendar year. After March 1st, scheduled annual leave shall be on a first-come, first-served basis. 9.7 Employees shall lose their Employer Seniority for the following reasons: a. Discharge, if not reversed; b. Resignation; c. Unexcused failure to return to work after expiration of a vacation or formal leave of absence. Events beyond the control of the Employee, which prevent the Employee from returning to work, will not cause loss of seniority; d. Retirement. Article 10. Discipline 10.1 The Employer will discipline Employees for just cause only. Discipline will be in one or more of the following forms: a. oral reprimand; b. written reprimand: c. suspension; d. demotion; or e. discharge. 10.2 Suspensions, demotions and discharges will be in written form. 10.3 Written reprimands, notices of suspension, and notices of discharge which are to become part of an Employee's personnel file shall be read and acknowledged by signature of the Employee. Employees and the Union will receive a copy of such reprimands and/or notices. 10.4 Employees may examine their own individual personnel files at reasonable times under the direct supervision of the Employer. 10.5 Discharges will be preceded by suspension without pay for forty (40) regularly scheduled working hours unless otherwise required by law. 10.6 Employees will not be questioned concerning an investigation of disciplinary action unless the Employee has been given an opportunity to have a Union representative present at such questioning. 10.7 Grievances relating to this Article shall be initiated by the Union in Step 2 of 8 61 the grievance procedure under Article 7. Article 11. Constitutional Protection 11.1 Employees shall have the rights granted to all citizens by the United States and Minnesota State Constitutions. Article 12. Work Schedules 12.1 The normal work year is an average forty (40)-hour workweek for full-time Employees, to be accounted for by each Employee through: a. hours worked on assigned shifts; b. holidays; c. assigned training; e. authorized leave time. 12.2 Nothing contained in this or any other Article shall be interpreted to be a guarantee of a minimum or maximum number of hours the Employer may assign Employees. Article 13. Overtime 13.1 Employees will be compensated at one and one-half(1-1/2) times the Employee's regular base pay rate for hours worked in excess of the Employees regularly scheduled shift. Changes of shifts do not qualify an Employee for overtime under this Article. 13.2 Overtime will be distributed as equally as practicable. 13.3 Overtime refused by Employees will for record purposes under Article 13.2 be considered as unpaid overtime worked. 13.4 For the purpose of computing overtime compensation overtime hours worked shall not be pyramided, compounded or paid twice for the same hours worked. 13.5 Overtime will be calculated to the nearest fifteen (15) minutes. 13.6 Employees have the obligation to work overtime or call backs if requested by the Employer unless unusual circumstances prevent the Employee from so working. Article 14. Court Time 14.1 An Employee who is required to appear in court during his/her scheduled off- duty time shall receive a minimum of three (3) hours pay at one and one-half 9 62 (1-1/2) times the Employee's base pay rate. The City may assign the Employee to stand by pending the notification of their appearance being required. Unless otherwise specified by the City or the prosecutor, this period of standby shall commence two (3) hours prior to the time scheduled for the Employee's appearance in court. The Employee will be compensated for three (3) hours at their base rate as provided in Article 21.1 for each day on standby. 14.2 If the court appearance is scheduled during the Employee's off'time, and if the court appearance is cancelled, the Employee will be notified by the end of the business day (5:00 p.m.) preceding the court appearance. If notification of cancellation is not made by the end of the business day (5:00 p.m.) preceding the court appearance, the Employee will receive standby pay for three (3) hours at their base rate of pay. 14.3 The business day notice applies to all court cases for which the Employee receives notice resulting from their employment with the City. 14.4 Employees who are assigned to standby for a court appearance during their off-duty time, and who are then notified by the prosecuting attorney that they need to appear and who do appear in court shall receive a minimum of three (3) hours pay at one and one-half(1-1/2) times the Employee base rate of pay. Employees will not be paid both standby pay and for three (3) hours at one and one-half their base rate of pay. 14.5 Employees will be required to appear for the Court Trials/Traffic Court, for Contested Omnibus Hearings, for Implied Consent Hearings, and for any other court appearance where the City or the prosecuting attorney directs that standby is not feasible. Article 15. Call Back Time 15.1 An Employee who is called to duty during the Employee's scheduled off-duty time shall receive a minimum of three (3) hours pay at one and one-half(1- 1/2) times the Employee's base pay rate. An extension or early report to a regularly scheduled shift for duty does not qualify the Employee for the three (3) hour minimum. 15.2 An Employee who works extra-duty work (outside employment) during the Employee's scheduled off-duty time shall receive a minimum of two (2) hours pay at one and one-half (1-1/2) times the Employee's base pay rate. Article 16. Insurance 16.1 For the calendar year 2017, for Employees who choose single coverage in the Base Plan, the Employer will contribute up to $739.88 per month per employee toward the single health insurance premium and $1,571.07 per 10 63 month toward the dependent health insurance premium, or an amount equal to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years of 2018 and 2019, for those Employees who choose coverage in the Base Plan, the Employer will contribute the same amount provided to non-union employees. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.2 For the calendar year 2017, for Employees who choose the high deductible health plan and health reimbursement arrangement (HRA), the Employer will contribute $603.97 per month toward the single health insurance premium and $1,459.07 toward dependent health insurance premium, or an equal amount to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years of 2018 & 2019, for those Employees who choose coverage in the HRA Plan, the Employer will contribute the same amount provided to non-union employees. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.3 For the calendar year 2017, for Employees who choose the high deductible health plan and health reimbursement arrangement (HRA), the Employer will contribute $100 per month toward the VEBA Trust Account, or an equal amount to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan For the calendar years of 2018 & 2019, for those Employees who choose coverage in the HRA Plan, the Employer will contribute the same amount provided to non-union employees in their HRA VEBA. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.4 For the calendar year 2017, for Employees who choose the high deductible health plan and healthcare savings account (HSA), the Employer will contribute $570.17 per month toward single health insurance premium and $1,459.07 toward the dependent health insurance premium, or an equal amount to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years of 2018 & 2019, for those Employees who choose coverage in the HSA Plan, the Employer will contribute the same amount provided to non-union employees in their HSA account. 11 64 If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.5 For the calendar year 2017, for Employees who choose the high deductible health plan and healthcare savings account (H.S.A.), the Employer will contribute $100 per month toward the H.S.A. Account, or an equal amount to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years 2018 & 2019, for Employees who choose the high deductible health plan and healthcare savings account (H.S.A.), the Employer will contribute an equal amount toward the HSA as is provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. 16.6 For the calendar years of 2017, for Employees who choose dental coverage, the Employer will contribute up to $25 per month toward the dental insurance premium, or an amount equal to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years of 2018 & 2019, for those Employees who choose dental coverage, the Employer will contribute the same amount provided to non-union employees. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.7 For the calendar year of 2017, the Employer will provide group term life insurance with a maximum of $25,000 per Employee and additional accidental death and disability insurance with a maximum of $25,000 per Employee (current cost is $2.88 per month), or an amount equal to that provided to non-union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. For the calendar years of 2018 & 2019, the Employer will contribute the same amount for group term life insurance provided to non-union employees. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. 16.8 For the calendar year 2017, 2018 & 2019, in accordance with the Employer's Flexible Benefit Plan, Employees have the option during an open enrollment period or during approved qualified events to decline health or dental insurance coverage, provided they provide proof of coverage elsewhere. In lieu of electing health and dental benefits, Employees may elect the option of 12 65 having ten (10) additional Benefit Leave Days or a monthly cash benefit of $476.77, or the amount equal to or greater than the amount provided to non- union employees. For the calendar years 2018 & 2019, for Employees who choose to waive the health and dental programs and elect Benefit Leave Days or the monthly cash option, the Employer will contribute the same amount provided to non- union employees, whichever is greater, in accordance with the Employer's Flexible Benefit Plan. If the 2018 or 2019 employer contribution rates for the non-union employees are less, the previous year's contribution will remain in effect. Benefit Leave days are required to be used within in the calendar year and may not be carried into the following year. Article 17. Standby Pay 17.1 Employees required by the Employer to stand by shall be paid for such standby time at the rate of one hour's pay for each hour on standby. Employees placed on standby shall remain able to respond within a reasonable time. Such reasonable time, if not otherwise specified at the time of assignment to standby, shall be one (1) hour to the police department, or other location designated by the City. Employees placed on standby shall remain available to be contacted by the Employer by normal means to include phone or wireless communication devices. Article 18. Uniforms 18.1 The Employer shall provide required uniform and equipment items. Non- uniformed Employees shall be reimbursed up to $450.00 per year for clothing allowance. Article 19. P.O.S.T. Training 19.1 Employer shall assign training at Employer's expense for Police Sergeants to complete a minimum of 48 hours of P.O.S.T. Board-approved education during each three-year licensing period. 19.2 Employer shall pay the cost of maintaining P.O.S.T. licensure for all Employees required to maintain the license. Article 20. Working Out of Class Pay 20.1 Employees assigned by the Employer to assume the full responsibilities and authority of a higher job classification shall receive the salary schedule of the higher classification for the duration of the assignment. 13 66 Article 21. Wage Rates 21.1 The following hourly wage rates will apply for 2017, 2018 & 2019 (amounts may be rounded to two decimal points): Step Jan. 1, 2017 Jan. 1, 2018 Jan. 1, 2019 Start 43.00 44.18 45.51 1 Year 43.63 44.83 46.18 2 Year 44.86 46.10 47.48 21.2 Specialty Pay - Any sergeant assigned to investigation will be compensated an additional $225 per month. 21.3 Shift Differential -Employees who work between 11 p.m. and 7 a.m. shall be paid a shift differential for hours worked between those times, according to the following schedule: a. An additional $1.00 per hour will be paid for regular hours worked. b. An additional one and one-half(1 1/2)times the shift differential ($1.50 per hour) will be paid in addition to overtime compensation for hours worked in addition to a regularly scheduled shift, and for call back or early report to a shift, for extra duty hours, or voluntary overtime shifts. c. An additional two (2)times the shift differential ($2.00 per hour)will be paid in addition to overtime pay for overtime hours worked on a holiday. d. Shift differential does not apply to any leave type taken for hours during those hours. Article 22. Legal Defense 22.1 Employees involved in litigation because of proven negligence, or non- observance of laws, or of a personal nature, may not receive legal defense by the municipality. 22.2 Any Employee who is charged with a traffic violation, ordinance violation or criminal offense arising from acts performed within the scope of his/her employment, when such act is performed in good faith and under the direct order of his/her supervisor, shall be reimbursed for attorney's fees and court costs actually incurred by such Employee in defending against such charge. 22.3 Employer will provide protection for all Employees against false arrest charges. Article 23. Probationary Periods 23.1 All newly hired, rehired, or promoted Employees will serve a one year 14 67 probationary period. Article 24. Annual Leave 24.1 Each Employee shall be entitled to annual leave away from employment with pay. Employees shall accrue annual leave based on an average eight (8) hour workday. Annual leave may be used for scheduled or emergency absences from employment. Annual leave pay shall be computed at the regular rate of pay to which such an Employee is entitled provided, however, that the amount of any compensation shall be reduced by the payment received by the Employee from workers' compensation insurance, Public Employees Retirement Association disability insurance, or Social Security disability insurance. An Employee's accumulation of annual leave will be reduced only by the amount of annual leave for which the Employee received compensation. 24.2 Seniority shall apply on scheduled annual leave up to March 1st of each year. After March 1st scheduled annual leave shall be on a first-come, first-served basis. 24.3 Annual leave shall accrue at the rate of eighteen (18) days (144 hours) per year for the first seven (7) years (84 consecutive months) of employment with the City. An Employee who has worked seven (7) years (84 consecutive months) shall accrue annual leave at the rate of twenty-four (24) days (192 hours)per year, beginning with the eighty- fifth (85th) month of consecutive employment with the City. An Employee who has worked fifteen (15) years (180 consecutive months) shall accrue annual leave at the rate of twenty-six (26) days (208 hours) per year, beginning with the one hundred eighty-first (181st) month of consecutive employment with the City. These rates are based on a forty-hour (40) regular workweek. The actual amount credited to an Employee in any given pay period shall be pro-rated according to the actual number of regular hours worked during that pay period. Hours worked on overtime, callback, or standby shall not enter into the calculation of the accrual of annual leave. 24.4 The maximum total accumulation of annual leave at the end of any given year shall be thirty (40) days (320 hours). Effective 1/1/2014, an Employee who has worked twenty (20) years (240 consecutive months) shall accrue annual leave at the rate of twenty-eight (28) days (224 hours) per year, beginning with the two hundred forty first (241) month of successive employment. 15 68 24.5 An Employee who wishes to take advantage of the catch-up provision for the City's 457 Deferred Compensation Plan may exchange as many days as desired for cash under the following conditions: a. The Employee's cap is reduced by the number of days exchanged. b. In no case may the cap be reduced below thirty (35) days (280 hours). c. An Employee taking advantage of this provision must file the appropriate forms with the payroll division of the Employer. 24.6 Upon separation from employment with the City, an Employee will be paid one (1) days salary for each day of accrued annual leave remaining in the Employee's balance. 24.7 Effective adoption of the contract, all sergeants shall be enrolled in a retirement health savings plan (RHS) and shall contribute $50.00 per pay period into their account. Upon separation from employment, sergeants will contribute 50% of all unpaid leave or accruals due to the employee (such as accrued annual leave, comp time, holiday pay, wellness leave, benefit leave, separation benefit, etc.) and shall be placed into the employee's PEHCSP. This would not include any regular wages or benefits paid out in the employee's final paycheck. Article 25. Holidays 25.1 Employees will accrue eight (8) hours of holiday leave for each of twelve (12) holidays in a calendar year. 25.2 In addition to the twelve (12) holidays, Employees shall be paid at one and one-half(1-1/2) times their base rate of pay for all hours worked on the actual holiday between the hours of midnight and midnight. For any overtime hours worked on a holiday Employees will be paid two (2) times their base rate of pay. 25.3 Employees, with approval, may use accumulated holiday leave time in any hourly increment the Employee chooses. 25.4 If an additional holiday is awarded to other non-union employees, it would be provided to the Union as well. 25.5 Once a year, Employees will be paid for any unused holiday hours remaining 16 69 after Dec. 31st of each year. Payment will be made at the Employee's hourly rate in effect on Dec. 31st of the affected year. 25.6 The City will be responsible for designating the holidays and communicating to Employees in advance of the effected year. Article 26. Short Term Disability 26.1 Calculation of the short-term disability benefit shall be based on an average eight (8) hour workday. Each Employee who has successfully completed the Employee's probationary period shall be eligible for the short-term disability benefit. Such an Employee shall be entitled to full pay commencing on the twenty-first (21st) consecutive working day on which the Employee is absent (after absence for 160 consecutive regularly scheduled working hours) due to a physician-certified illness or injury off the job, and continuing until the Employee returns to work able to carry out the full duties and responsibilities of the Employee's position or through the one hundred tenth (110th) working day (880th regularly scheduled working hour) of absence whichever occurs first. Such an Employee shall also be entitled to full pay commencing on the eleventh (11th) consecutive working day on which the Employee is absent (after absence for eighty consecutive regularly scheduled working hours) due to a physician-certified illness or injury on the job and continuing until the Employee returns to work able to carry out the duties and responsibilities of the Employee's position or through the one hundredth (100th) working day (800th regularly scheduled working hour) of absence, whichever occurs first. The amount of any compensation for the short-term disability benefit shall be reduced by any payment received by the disabled Employee from workers' compensation insurance, Public Employees Retirement Association disability insurance, or Social Security disability insurance. Payment of short-term disability benefit by the City to an Employee shall not exceed ninety (90) working days (720 working hours) for any single illness or injury, regardless of the number and spacing of episodes. The annual leave balance of an Employee receiving short-term disability benefit shall not be reduced nor shall such Employee accrue annual leave during that period. 26.2 Before any short-term disability payments are made by the Employer to an Employee, the Employer may request and is entitled to receive a certificate signed by a competent physician or other medical attendant certifying to the fact that the entire absence was, in fact due to the illness or injury and not otherwise. The Employer also reserves the right to have an examination made at any time of any Employee claiming payment under the short-term disability benefit. Such examination may be made on behalf of the Employer by any competent person designated by the Employer when the Employer deems the same to be reasonably necessary to verify the illness or injury claimed. 17 70 26.3 If an Employee hired before January 1, 1984, has received payments under the injury-on- duty provisions of previous contracts, the number of days for which payment was received will be deducted from the number of days of eligibility for coverage under short-term disability for that same injury. Article 27. Bereavement Leave 27.1 Bereavement leave will be granted to full-time Employees up to a maximum of twenty-four (24) scheduled hours. Bereavement Leave is granted in case of deaths occurring in the immediate family. For this purpose, immediate family is considered to include those individuals (either by blood or by law) such as: spouse, children, parents, brothers, sisters, grandparents, grandchildren, parents in-laws, brothers in-law, and sisters in-law. 27.2 The City will allow union employees to follow current practices for non-union employees, which gives Employees an option to appeal directly to the City Manager for additional time off if extenuating circumstances prevail. Article 28. Jury Pay 28.1 It shall be understood and agreed that the Employer shall pay all regular full-time Employees serving on any jury the difference in salary between jury pay and the Employee's regular salary or pay while in such service. Article 29. Compensatory Time 329.1 Management reserves the right to approve compensatory time in lieu of overtime pay. Compensatory time shall not be accumulated in excess of thirty-six (36) hours, and must be used within the calendar year in which it was accumulated as determined by the Employer. Article 30. Employee Education Program 30.1 The Employer will pay certain expenses for certain education courses based on the following criteria: a. The training course must have relevance to the Employee's present or anticipated career responsibilities; b. Attendance shall be at an institution approved by the Employer. The course must be approved by the Chief. c. Financial assistance will be extended only to courses offered by an accredited institution. This includes vocational and technical schools, Minnesota School of Business, etc. 30.2 Programs Financial Policy 18 71 Financial assistance not to exceed the amount of two thousand, nine hundred, twenty-five dollars ($3,600.00) per Employee per calendar year will be extended to cover the cost of tuition, required books or educational materials, and required fees related to the course (i.e. lab fees, etc.). Charges for student union membership, student health coverage, mileage, parking, and other charges for which the student receives some item or services other than actual instruction will not be paid. Upon successful completion of the course, an Employee will be required to present to the Chief a certification of satisfactory work. Satisfactory work is defined as follows: a. In courses issuing a letter grade, a C or above is required. b. In courses issuing a numerical grade, seventy percent (70%) or above is required. c. In courses not issuing a grade, a certification from the instructor that the student satisfactorily participated in the activities of the course is required. 30.3 If the Employee satisfactorily completes the course and provides the required documentation, the Employee will be reimbursed for 100% of the cost of the eligible costs (i.e. tuition, books, course fees, etc.). If the Employee fails to satisfactorily complete the course, the Employee will not be reimbursed for these costs. 30.4 The program will not reimburse the Employee for the hours the Employee spends in class, only for the tuition. 30.5 Expenses for which the Employee is compensated under some other educational or assistance program, scholarships, or programs such as the GI bill, will not be covered. 30.6 The City will not pay tuition or other costs for those courses, which are used to make the Employee eligible for additional salary. 30.7 The City will not reimburse the Employee for any course which is not completed and/or any course which may be a duplicate or retaken. 30.8 The City Manager will review and consider requests for reimbursement which exceed $3,600 per year based on unusual or extenuating circumstances. Requests, documentation and justification must be submitted in writing in advance of registration for the course and will be reviewed on a case-by-case basis. • 19 72 Article 31. Waiver 31.1 Any and all prior agreements, resolutions, practices, policies, rules and regulations regarding terms and conditions of employment, inconsistent with the provisions of this Agreement, rea hereby superseded. 31.2 The parties mutually acknowledge that during the negotiations, which resulted in this Agreement, each had the unlimited right and opportunity make demands and proposals with respect to any term or conditio of to employment not removed by law from bargaining. All agreements and understandings arrived at by the parties are set forth in writing in this Agreement for the stipulated duration of this Agreement. The Employee and the Union each voluntarily and unqualifiedly waives the right to meet and negotiate regarding any and all terms and conditions of employment referred to or covered in this Agreement or with respect to any term or condition of employment not specifically referred to or covered by the Agrment, even though such terms or conditions may not have been within the owledge or contemplation of either or both of the parties at the time this contact was negotiated or executed. Article 32. Duration 32.1 This Agreement shall be effective as of first day of January, 2017, and shall remain in full force and effect through the thirty-first day of December, 2019. Wysopal, City Manan= FROM: James Kosluchar, Public Works Director Scott Hickok, Community Development Director DATE: July 7, 2017 SUBJECT: Resolution Receiving and Awarding Millwork Bid for the City of Fridley Civic Campus Project 505; and Resolution Assigning the Contract On Thursday, July 6, at 9:00 a.m., a third and final round of bids were opened for the Fridley Civic Campus Project 505 for Bid Package 15 (Millwork). This package received no qualifying bids on the initial bid round occurring on May 4. Responsive bids have been tabulated and are presented along with most recent cost estimates and a recommendation for award. The Lowest Qualifying Responsible Bidder Selection is used for bidding of this package. We received two qualified bids, which were both above the original estimate for the work; however, they were both less than the allowance for the Construction Manager's Guaranteed Maximum Price (GMP) of$814,000. They should provide a net savings of over$125,000 to the City versus the current construction budget based on the GMP. Staff recommends the City Council approve the following actions: 1. Move to receive the bids per the attached bid tabulation for the City of Fridley Civic Campus Project 505 Bid Package 15 (Millwork); 2. Adopt the attached resolution awarding the base bid tax-exempt materials bid to Vision Woodworking, Inc., in the amount of$688,294.59; and • 3. The City Council hereby awards a contract to Vision Woodworking, Inc., for labor and miscellaneous non-taxable materials in the amount of$688,294.59; and 2. The Mayor and City Manager are duly authorized to execute the associated contracts with the aforementioned contractor for the City of Fridley Civic Campus Project 505. SKOGEN—CITY CLERK 76 RESOLUTION NO. 2017- A RESOLUTION ALLOWING THE ASSIGNMENT TO MCGOUGH CONSTRUCTION COMPANY,LLC AS PRIME CONTRACTOR AND ASSIGNMENT OF THE CONTRACT BETWEEN THE CITY OF FRIDLEY AND VISION WOODWORKING,INC.TO MCGOUGH AS THE CITY OF FRIDLEY'S CONSTRUCTION MANAGER AT RISK FOR THE CITY OF FRIDLEY'S CIVIC CAMPUS PROJECT WHICH INCLUDES: CITY HALL,POLICE,FIRE AND THE PUBLIC WORKS BUILDINGS WHEREAS, The City Council has contracted with McGough Construction Company, LLC as its Construction Manager; and WHEREAS, The City Council has accepted the Guaranteed Maximum Price (GMP) from McGough Construction Company, LLC, making McGough its Construction Manager At Risk (CMAR); and WHEREAS, A formal bid process commenced with a bid packet advertised and available for BID Packet 15, Furnish Millwork on June 12, 2017; and WHEREAS, respondents to this bid category were evaluated by a lowest responsible bid process according to bid guidelines; and WHEREAS, the processes have resulted in two (2) responsible bids which were opened according to advertized schedule on July 6, 2017; and WHEREAS, now that the lowest responsible bidder is known: Vision Woodworking, Fridley, Minnesota and contracts are ready to be signed, it is most appropriate to have the CMAR manage the contracts; and WHEREAS, those contracts that include materials and labor will require bond and insurance submittals prior to award and be awarded once those items have been provided, through a notification letter attached as Exhibit B; and WHEREAS,that contract award recipient can be identified as follows: 15.
