The request was forwarded to the County for their action. Attached is a letter from the Anoka County Highway Department indicating they feel that the encroachment is not necessary and that the Anoka County Highway Department position is in opposition to the suggested encroachment. Gibbs SUBJECT: Filister Georgetown Apartments for bakery shop, barber shop and delicatessen in the basement of the recreation facility in the Georgetown Apartments. Filister requested Council approval to establish what appeared to be a commercial venture in an R-3 zoning. Fridley Code of Ordinance 45.08 #3 allows businesses in R-3 conducted as a servicefor guests thereof and accessible to customers from inside the building. I am of the opinion that considering the Georgetown Apartments as one complete complex, Filister'srequest is within the Code. This is true even though the businesses requested by Filister will be accessible from outside the building. I am of the opinion that the design, location and outside access to the service facilities requested are of such a nature so as to be within the intent of the Ordinance; that is, it is designed primarily as a service to the guests or residents of the Georgetown Apartments. McPhee MEMO DATE: March 24, 1969 SUBJECT: Filister Georgetown Apartments: Review of Recreational Area 1. It is noted that 6000 cubic feet per minute of fresh make-up air is provided for the pool area with exhaust system removing 6000 cubic feet per minute. I could not find the ceiling height so I was unable to calculate the number of air changes per unit of time, I don't know the amount of glass or other construction around the pool. In order to eliminate dripping and frost they must move air ttlrough the pool area. 2. No sewer line may be within 30 feet of any of the pool suction lines. Any line between 30-50 feet must be cast iron with leaded joints or the equivalent. This needs to be checked and watched. There appears to be sewer lines quite close to the pool and the equipment room pool liners. 3. The saunas must have ceramic tile floors. They will probably want wood walks. I don't like wood but they will want it to prevent burning they say. Benches must be built to provide easy floor cleaning. Do not permit enclosed baser around the wood benches. D4. Aldrich, Fire Prevention Chief Subject: Occupancy of Incompleted Construction Date July 31, 1969 I ►Rade a cursory inspection of the Filister apart:ient complex today, going through the building at 5760 Edst River Road. At the time of my inspection this bulldiug has some units occupied, with occupants on all floors of this three story frame constructed building. I am quite concerned about allowing occupancy in structures that have not been completed and do not provide at least rniniwal levels of safety to the occupants. This building, as it stands today, is deficient in at least two areas that t feet are extremely important to the safety of the D occupants. None of the three stairwells in the building are provided with hand ralis. The main extrance which includes a stairwell and elevator shaft, does not have a protective ralliny at the landing. None of the required fire extinguishloy appliances have been installed in the building. I can understand an owner being anxious to realize a return on his investment and I feel that this can be accomplished. I do feel that we should require rolnimum levels of safety be present before a tenant can occupy any structure, whether it be a multiple dwelling, commercial or an industrial establishment. We had received a complaint on it from one of the tenants. The clarity of the pool was good at the time of my visit. The chlorine residual and the p11 was not checked as I did not have a test kit wit:l me at the time. Keen the chlorine at or above 6.5 p.p.m., and tre pH between 7.2 and 7.6 . We are also finding that you should do alkalinity checks on a pool, and this should be maintained at about 100 p.p.m. Proper alkalinity will heli maintain a proper i.H. The hook should be hanging on the fence, and a piece of ro;e should be attached to ti;e life buoy. Don't forget to clean the suntan oils from the tile around the toy) of the Pool. Mr. Grell stated that the building would be setback 60 feet as required. A variance had been granted, however, because the building would be smaller than the minimum allowed in a commercial area. The exterior of the building will be brick facing around the entire building. The building will be used for a drive-in claims service. There will be room for two cars inside the building at one time. They will drive in for an estimate which takes about 10 to 20 minutes. There will be no overnight storage of cars. The Board asked what type of shakes they would be using and also if the block on the building would be painted. They stated that they would use hand split cedar shakes and the exterior block would be painted. MOTION by Tonco to recommend approval of a building permit subject to everything marked in red on the plans including the following stipulations: 1. Concrete curbing must be provided around all blacktop areas with a minimum 10' radius provided on all concrete curbing around islands and entries. Z. Mr. Bill Meyer from Suburban Engineering was present to present the request. • Building Standards -Design Control Meeting of February 18, 1971 Page 2 r Mr. Meyer stated that the change in the locations of the buildings was made due to the grade of the property. Also, with the new locations they will be able to make use of the river frontage. The Board informed Mr. Meyer that all the parking spaces would have to be changed from 9' x 20' to 10' x 20' to conform to City code. The Board also said that a complete plot plan would be needed showing the exact position of the buildings from an established point si..:h as the lot line behind the Lynwood Manor Nursing Home. They also said that the drainage should be shown on the final plans. It was also questioned whether there would be enough of a walkway left if the 5' walk was used for a curb stop for parking because of the overhang on the cars. A few other items mentioned to Mr. Meyer were that if there was any exterior refuse storage, it would have to be screened and that the swimming pool would have to be approved by the Health Inspector. MOTION by Tonco to recommend approval of the change in the building locations with the following stipulations to be included in the final plans: 1. All parking spaces be changed to 10' x 20'. 2. Bather and Associates, has submitted a plan for the safety improvement of East River Road from Interstate #694 to Rice Creek; WHEREAS, this plan was presented to -the public at three Public Hearings by the City Council to get the point of view of the citizens living along East River Road and come up with appropriate recommendations for the improvement on East River Road; WHEREAS, the general feeling of the public was not to accept the improvement plan as presented, but see some modifications to the plan; WHEREAS, the County is working to get the approval of the improvement plan under T.O.P.I.C.S. program and get some funds from the Bureau of Public Roads and the State Highway Department for the project; NOW THEREFORE, be it resolved, by the City Council of the City of Fridley that the Anoka County Commissioners are hereby requested to modify the County plan for East River Road improvements to only include the following items and conditions: 1. Provide three fully actuated signals at the Georgetown Apartments, 61st Avenue (School North entrance) and Mississippi Street along with the full development of - -----the-se- intersections. 2. Provide the complete storm sewer system to take care of drainage and icy road conditions on the roadway. 3. The divider between 61st and Mississippi Street be elimin- ated except for the proper chanalization of the traffic at intersections. 4. The house at 100 Rivers Edge Way not be taken to provide the connection between signal and Rivers Edge Way. S. Provide roadway connection and walk ways on the West side of East River Road to provide safe pedestrian access to school property. 6. The road connecting Rivers Edge Way and 62nd Way has been eliminated. 2. Three fully activated signals (at Georgetown Apartment complex, 61st Way, and Mississippi Street) will be installed on East River Road instead of only two as originally proposed. 3. The entrance to Robert Louis Stevenson School has been moved from South of the school to North of the school. 4. The East service road North of Downing Box has been eliminated. 5. The West service road North of the Georgetown Apartment complex has been planned to go straight to 59 1/2 Way instead of going behind the garages. 6. The service road along the Georgetown Apartment complex will be moved further East from the existing location. 7. A signal will be located just North of Interstate #694 at the Georgetown Apartment complex and LaMaur entrances. 8. Additional right of way will not be taken on the West side of East River Road near the new homes which are already close to the roadway. 9. The main traffic lanes will be moved six (6) feet further away from the homes which are closer to East River Road on the West side. Page 2 10. New lighting has been added to brighten the road at night. 11. An extensive storm sewer will be provided to take care of existing drainage problems. 12. Improvements to the side connecting streets will be part of the total project. 13. Connecting roads between Rivers Edge Way and the school entrance will be shifted an additional 5 feet to the East go give the abutting home owner more protection. 14. The City of Fridley's original estimate for the preliminary assessment roll was $476,735.00, the total project cost was $939,161.00. This cost was figured without Federal assistance and with the following conditions the City would pay: A. All work on the service roads. B. All right of way acquisition. C. One half the signal -cost. D. All.drainage improvements. E. All lighting costs. Now we are assured of Federal assistance of fifty per cent. This would cut our costs to less than $250,000.00, but with additional County participation and project modifications our dollar participation has been estimated to be around $100,000.00, which is approximately 10 per cent of the project. The following items have been negotiated with the County: A. All paving on side connecting roads will be charged to the County including Ashton Avenue extension. B. All right of way along East River Road main line including the home at Rivers Edge Way and the gas station acquisition at Mississippi Street will be paid by the County. C. The City will only participate in one of the signals. D. The City will split the cost of the lighting improvement 50-50 with the Federal funds. r. This is a standard wet well, dry well lift station. We feel this would take approximately one hour of time, and probably one load of sand, The approximate cost to do this job would be $70.00. This would include the material, the man hours and equipment. Please see at- tached estimate from Art Olson, on the figures we have arrived at. These figures are estimated on our cost when we mix nine loads at one time, so we came up with a total for nine loads and divided it. I feel it is a pretty accurate cost. I have also discussed this matter with Dick Sobiech and Darrel. Clark. Some of the comments made were: We would create some liabilities with City trucks on private property. Some of these situations would cause a truck to back up, in order to do the sanding. We would be setting a precedent for other requests, such as: Requests from View Con, Five Sands, Roger Larson and Timbre Ridge apartments; also three trailer courts for the same type of service. From all the evidence that we have gathered and looked over, we do not feel this is a good move for the City. One ring buoy not more than 15 inches in diameter with 60 feet of 3/16 inch manila rope or equivalent attached. b. One separate throwing line of 14 inch rope with a length of not less than 14,2 times the maximum width of the pool. C. One life pole or shepherds crook pole with blunt ends and longer than 12 feet. 5. The filter system shall be provided with influent and effluent pressure gauges. A rate of flow indicator reading in gallons per minute shall be installed, preferably on the swimming pool return line, so that the rate of recirculation and backwash rate will be indicated. 7. That section of carpeting that is less than 10 feet from the pools edge will be allowed to remain, provided that it is kept clean, free of all harmful microorganisms and/or any other condition which might be dangerous to the health, safety or welfare of the public. Under no circumstances will the aforementioned carpet, once removed, be replaced with additional carpet. D B. Outdoor Pool - 5820 East River Road p a 1. (In reference to the indoor pool located in the recreation building; - it is closed each year during the summer months). I was informed pools cannot open unless they meet regulations. In other words, presently there are no outstanding; violations or tickets issued to the owners and operators of. Georgetown Apartments, to upgrade or make improvements. On this date, the 15th of October, I again called the City Offices to clarify that I was given correct information. Again I was told pools are not permitted to open unless they meet the approval of the city inspector. Following is a list of conditions/comments/observations I have made: 1. The ordinance calls for a certain fee for a pool at a particular location. Recently swimming pool inspections took place at the Georgetown Apartment complex. The Georgetown complex has four pools; one inside a building, one outside pool, and another pool inside a building together with an adjacent wading pool. We have charged the Georgetown complex for inspections of three pools and for the second pool at the same location. The apartment owner believes that all the pools are at the same location and therefore should not be charged as the City has noted. Could you please comment regarding what is determined to be a swimming pool "at the same location"? Our interpretation to date has been that a swimming pool location is determined by the en- closure. If one pool is within an enclosure; i.e. inside a building or fence, that is the location, whether there is another pool on the same premises or not. Our interpretation has led us to the conclusion that Georgetown complex has pools in three different enclosures, therefore three different loca- tions. I would appreciate your response as soon as possible since the complex owner has been sent an invoice for the inspection fees. The inspection on that date found the following deficiencies; A. Indoor Pool - 5750 East River Road / 37 /� ��J O�7' I. Repair or replace the ladder. 2. Replace all missing weirs for the skimmers. 3. The sign warning of the lifeguards absence must be displayed in a conspicuous place, e.g. wall across from entrance. 4. The following pieces of lifesaving equipment must be provided and displayed in a conspicuous place; a. One ring buoy not more than 15 inches in diameter with 60 feet of 3/16 inch manila rope or equivalent attached. b. One separate throwing line of k inch rope with a length of not less than 1� times the maximum width of the pool. c. One life pole or shepherds crook pole with blunt ends and longer than 12 feet. 5. A rate of flow indicator reading in gallons per minute shall be installed, preferably on the swimming pool return line, so that the rate of recirculation and backwash rate will be indicated. 7. That section of carpeting that is less than 10 feet from the pools edge will be allowed to remain, provided that it is kept clean, free of all harmful microorganisms and/or any other condition which might be dangerous to the health, safety or welfare of the public. Flora DATE: October 5, 1990 'Englneenng Sewer Water Parks Streets Maintenance MEMORANDUM City Manager Public Works Director SUBJECT: Filister Complaints PW90-397 When we were notified of a sanitary lift station failure and a water line break at the Georgetown Apartments, Ralph Volkman contacted Mr. Filister and explained to him that these were private problems associated with the Georgetown Apartments and he needed to take some corrective action. Mr. Filister indicated that they were not his problems and felt that the City should take some action to complete it. Based upon the fact that we were losing water, we initiated the water break repair and the fact that we had to provide sanitary lift to the complex, we initiated the sanitary lift station repair. After the lift station was repaired and we were patching the trench in the parking lot, Mr. Filister called me and asked that since we were in the area if we could also patch the water break on the parking lot since our equipment was there. I indicated to him that we would do so and bill him accordingly. I then informed Joe Gonsoir, the Acting Street Foreman, and told him to patch the water break repair. There was a considerable amount of poor material in the area which required removal, compaction and asphalt placement. As these problems did occur, we did a number of searches in the files and I have provided you extracts of the Council meetings that indicate from our records that the sanitary and sewer lines within the Georgetown Apartments are private with the exception of the lift station of which the City accepted responsibility for. John Flora, Director of P.W. X On the morning of August 26, 1990 the weekend duty person received a call concerning a possible watermain break at the Georgetown apartments. A sewer person was on call that weekend and having investigated the break, determined that it was not causing any further damage and so barricaded the area and notified water personnel on Monday August 26, 1990. Don Carrigan, the water foreman at this time, went to investigate the problem. When he saw its location, which was in the southernmost entrance to the Georgetown apartment complex, he thought that it might be part of the private waterlines in Georgetown. Before contacting the Georgetown offices, Don went back to the main filtration plant to verify where the original waterline had ended and where Georgetown had connected. Having determined that this was a part of the Georgetown construction, Don notified, by phone, the offices at Georgetown that they had a watermain break and that they should hire a contractor to repair it. This occurred before 9:30 a.m. on August 27, 1990. At approximately 10:15 a.m. Mr. Filister called the filtration plant asking about the watermain break. He felt that the City should repair it because he contended that it was "our" main. I explained to him that according to the asbui.lts the City -owned main ended near the hydrant at Lynwood Manor Nursing Home and that the Georgetown construction had begun from that point where there had originally been a plug in place. Mr. Filister became argumentative so I referred him to speak with Ralph Volkman, Superintendent of Public Works. Shortly after Ralph and Mr. Filister concluded their conversation. Ralph then called the plant and instructed us to r9pair the watermain break because we would be wasting the City's water if it didn't get repaired promptly and if we were to shut the water off to the complex it would pose a health threat to the residents. We were told to keep track of our time and materials so that Mr. Filister could be billed for the repair. At this point we notified Gopher State One -Call for locations and spent the remainder of the day drilling, to pinpoint the break, and arranging with Lynwood Manor a time that would be most convienent to shut their water off for the repairs on the following day. The repair itself was not routine. The pipe showed signs of deterioration due possibly to improper blue clay fill. A section of pipe had to be removed and replaced using two mechanical sleeves. This activity created a two hour delay in repair because the cause of the leak could not be predetermined until the watermain was exposed. In addition this particular watermain break repair required extra materials and labor. Attached you will find a copy of the watermain break report. The Sewer Department was notified and immediately made an inspection of the station. It was determined within minutes that there was no electricity at the station. NSP was then called and informed of the problem. Approximately 30 minutes later they were on the scene. They determined that the problem was caused by a ground fault in the electrical cable that supplies power to the station. The City of Fridley was told by NSP that because the cable was a secondary line, and not a primary electrical line, NSP would not take responsibility for the problem. They did agree to provide a temporary connection to the station in order that it could be kept in operation. NSP did emphasize, that because of the way the temporary line was laid across the parking lot, a 24-hour watch of the line was necessary. We agreed to do so. Due to the fact that NSP would not do the repair, Bacon Electric Company was called by the City of Fridley to assist with the problem. Bacon Electric made an attempt to locate and pinpoint the ground fault, but was unable to do so. At that point, it was determined by Bacon Electric that the electrical line would have to be replaced. Because of the time of day, approximately 4:00 pm, a decision was made to let the station run on the temporary hookup for the night, and start the necessary repairs of the electric line in the morning. The five members of the Sewer Department took two hour shifts for surveillance of the station. In the morning before any work was begun, I went to the office of the Georgetown Apartments, and talked to Mr. Filister. I explained the situation with the lift station and with NSP. I explained to him that it would be necessary to replace the electrical cable from one of the apartment buildings to the pumping station, and that it was necessary to jackhammer a narrow trench across the blacktop parking lot, about 120 feet. I also explained that it would be necessary to shut off the electricity to that building for a short period of time. After completely explaining the situation to the management of the Georgetown Georgetown Apartments Sewage Pumping Station Page 2 Apartments, work was begun to repair the cable. Several times during the day, the elder Mr. Filister stopped at the work site and was informed of our progress. The City Sewer Department and Bacon Electric Company worked together to install the new cable. Copper cable was used, and also a 2" PVC conduit was used to protect the cable. The job was completed at approximately 3:00 pm, and NSP was then called to reconnect the cable to their power line. They outline the need for the right of way needed for proper safety f and traffic flow on East River Road. Here it is February, 1972, and still no right of way. Mr. Caplan said in 1969 that they would be willing to sit down with the City Engineer and work it out and that they would abide by the deter- mination of an independent third party. Mr. Filister said that is still true, he will be willing to sit down at any time with the City Engineer, but at no time has he been called in to discuss it. He said he has been fooling around with this since 1969. He said he had talked to the City Assessor many times and he thought he had everything in order, then 4 - 5 months ago he discovered he needed the registered land survey in proper form to have it registered. He thought it was a matter of formality to have it done, and now he finds that he is supposed to give some right of way. The Acting City Attorney read from the minutes of November, 1969 which covers the need for the right of way. The City Engineer added that he could dig out minutes from a number of meetings, and also letters he had written. However, that is neither here nor there, the problem before us is the need to solve the problem to everyone's mutual benefit. V Councilman Utter said that it seemed to him that the City must get that dedication. With the additional building, the traffic problem will get worse, and something must be done about the access. If the land is split now, the City would have to deal with three mortgage companies. He would like this taken care of as soon as possible. It was agreed that Mr. Filister, Mr. Caplan, the City Engineer and the City Attorney were to try to work something out soon. Mr. Filister said he would like to bring another item before the Council. He said he has spent $65,000 - $70,000 in running water and sewer through his pro- perty, and also putting in a lift station to take care of the south end of the property. This has all been done with the approval of the City Engineer and according to his recommendations. He has talked to the City Engineer about taking over the maintenance of the sewer, water and lift station. The City Engineer agreed the City should take over the maintenance, however, he believes Mr. Filister should be 100% responsible for any major repairs and the cost of the maintenance. Mr. Filister contended that the City should take over at City cost minor and major costs of the sewer, water and lift station. This is an improvement he had to put in because the sewer and water lines were not built adequately to handle his needs, so he had to spend more because the City did not do it properly. The City Engineer said that basically, facilities maintained by the City are within City right of way and are built by the City or under City supervision. In this case Mr. Filister has a large -complex and the facilities were built by his own contractor. The lines are between buildings where it would be difficult to get to. He said he felt these facilities were built and owned by Mr. Filister. Fie compared it to a house, if there is a prob"lem in the street,it is a City responsibility, but from the street to the"house it is the home owners responsi- bility. This is the case here, only on a larger scale. If the City were to do as requested here, it would be settinn a precident. There are other lift stations in the City,and if the City maintained lir. Filister's, others would say; "main- tain mine too". He believed Mr. Filister should pay the major costs. n� tJ' SPECIAL PUBLIC HEARING MEETING OF FEBRUARY 14, 1972 z PAGE 12 Mr. Filister said that he owned 27 acres of land, and he will be the largest taxpayer in the City of Fridley, and it is probably 10 times as large as anyone else per acre of land. He felt that paying $300,000 - $400,000 in taxes entitled him to.the same service as a house down the street. He said he was paying more than his proportionate share for his service, and this is part of the service the City should provide for his tax money. Mayor Liebl asked that this problem be referred to the City Manager, City Engineer, and the City Attorney, and asked them to come up with a recommendation. He said he, as a homeowner, is liable for any costs from his house out to the street. Mr. Filister said he is willing to stand any expense from his buildings down to the main. Mayor Liebl asked if the City maintains any other lift stations. The City Enigneer said yes, built by the City. Mayor I.iebl asked if his lift station was built to the specifications of the City. The City Engineer said he checked the plans, so he would assume so, he did not physically look at it. Mr. Filister said that the City uses the same type of lift station he has. He said he was asking for maintenance of the lift station and water and sewer maintenace. This is asking no more than what is done for 100% of the.people of the City of Fridley. Councilman Utter asked if the lift station was on his property and Mr. Filister said yes. The Acting City Attorney said that he has a lift station on his pro- perty, and if the City maintains Mr. Filister's, he will ask for maintenance on his too. Other people with lift stations are paying their share. As far as talking about a tax break, he would have to talk to the County Assessor. Mr. Filister said that it seems the City assesses for sewer and water services, but does not provide maintenance. INION by Councilman Utter to refer the sewer, water and lift station maintenance, and the dedication of the right of way needed for access for signalization back to the City Manager, City Engineer and -'the City Attorney for their investigation and recommendation. The motion was seconded and upon a voice vote, all ayes, i Mayor Liebl.declared the motion carried. The Finance Director volunteered to furnish a review of the special assessments that are levied against his property. Mr. Filister said he could not understand why the City Engineer promised him signals, now he hears that they are to be sometime in the future. The City Engineer said that he would never promise something he could not deliver. That determination is up to the County and is under their jurisdiction. Upon a voice vote, all ayes, the motion carried. REGULAR COUNCIL MEETING OF OCTOBER 2, 1972 i Mr. Filister said that his property is financed by three d;fferent companies. Each mortgage company wants to own the land on which the structure sits. He would like also to have the assessments split. As it is now all the assessments are on one parcel of land, naturally the mortgage company does not approve of that. Mayor Liebl asked if he was the owner and Mr. Filister replied yes, sole owner. Mayor Liebl said that in regard to the City taking over the maintenance of the ,- utilities, he could not agree with that, however, as far as his registered land j survey is concerned, he would have no objections, as long as it is properly drawn. He asked the City Engineer why this has been held back. The City Enginee said that this item has been considered by Council a number of times. He and the City Attorney were directed by the'Council to meet with Mr. Filister and his attorney to try to resolve the problems. He did meet with Mr. Filister and his attorney and the items the City is requesting of Mr. Filister and those Mr. Filister is requesting of the City were discussed. Mr. Filister's attorney recommended that Mr. Filister grant the City's request, then Mr. Filister said that he had better get himself another lawyer. The City Engineer said that he has not discussed this with him since then. Mayor Liebl said that he did not believe that either Mr. Filister or the City should use something like this as leverage. Mr. Filister is a tax payer in the City and if the Council asked his cooperation for the benefit of his property, he should give it. There should be mutual cooperation and working together to solve this problem. He could see no reason this survey should be held in abeyance and that he would recommend granting approval, providing the survey is proper in all engineering aspects. Mr. Filister commented that these were the nicest words he has heard for many years from the Council. He had always considered withholding approval as blackmail so the City could get what they wanted, and this is the first time he has heard something that sounds reasonable. He said if the Council will work with him, he will surely work with them. Councilman Braider said that he understood Mr. Filister's problem, and the City's problem, but he was not sure what was talked about at the meetings between the City Engineer and Mr. Filister. He said he did not think the Visitors section is the proper time to consider a registered land survey, this is an Agenda -type item, and he would like it placed on the Agenda for a regular meeting. He said he would like all the background material furnished also, to refresh them on what has happened in the past. If there is a problem with this survey he would like it on the Agenda until it is resolved. The Visitors section is only a 15 minute time period to gear complaints etc., and for non - agenda type items. Mr. Filister said there was no problem with the survey, he considered the problems brought up by the City Engineer, to have absolutely nothing to do with the survey and were -another matter entirely. The City Engineer explained that one of the items needing a solution is that Mr. Filister and the City would like a signal at the exit of the Georgetowns onto 1;#4t River Road. The problem is that it is difficult to justify a signal for oM paplex, therefore the plan is to connect onto the property to the north, byethoso cars down to the signal, thereby providing more justification to the County for the semaphore. TQ iwplement this plan, right of way is needed from Y!-. Filister, which he has refused to sive. * Another problem is that Mr:' ' iilister would like to turn over some of his utilities to the City. As I understand the facts, the work was done to repair a break in a water line and to install an underground electric conduit to a sanitary lift station. It is my understanding that the water line that broke was on private property, not on an easement running to the City of Fridley, and that likewise the installation of the electric conduit was also on private property. It is also my understanding that Mr. Filister was made aware of the water line break and the inoperable condition of the lift station. It is also my understanding that while Mr. Filister maintained that the problems of repairing the water line break and fixing the lift station were the City's problems he did request the City to proceed with the repairs. Based on the information that I have/the City's representatives told him that they would do the repairs but would bill him for the cost of the work. I understand that you have furnished me all of the material that you can find in the City files pertaining to the responsibility for maintaining water lines and sewer lines on the Georgetown complex. It would appear that there is no written agreement between Mr. Filister and the City regarding the questions of repair and maintenance of these facilities. I have reviewed the council minutes of February 14, 1972, wherein Mr. Filister asked the City to take over the maintenance of the sewer and water line and the lift station. At that meeting the city council declined to do so and referred the matter to the city manager, city engineer and city attorney for a recommendation. There does not appear to be anything in the records that would indicate that the administration made a recommendation on Mr. Filister's proposal. Mr. Filister also appeared at a council meeting on October 2, 1972. In lieu of any agreement to the contrary it would appear that that should be the policy in this situation. I suggest that Mr. Filister be sent a copy of the bill along with a letter demanding payment. If he refuses to pay an action in Anoka County District Court to collect the sum of money expended in the repairs would be warranted. Herrick, City Attorney DATE: October 15, 1990 RE: Morrie Filister This memo is in response to a memo from Bill Burns dated October 15, 1990. After receipt of Bill's memo, I had an office conversation with John Flora. It is m; understanding that the City of Fridley was called in regard to a sewer and water problem at the Georgetown Apartments. The water problem consisted of a break in a private water line. A large amount of water was escaping and being wasted through this broken line. The City notified Filister of the break, and because of the large amount of water escaping, decided that it needed to repair the break immediately. This was done with Mr. Filisi:er's knowledge. At about the same time, it was discovered that the lift pump for the sanitary sewer service was no longer working. There was a break in the underground electrical cable which supplied power to the lift pump. Again, because a large amount of sewage was backing up and not being pumped, it was necessary for the City to repair the pump as quickly as possible. The electrical company advised the City that it was necessary to lay a new electrical cable to get power to the pump. Again, Mr. Filister was aware of this situation. It is my understanding that the total bill for this work came to something in excess of $6,000 and that this sum was approximately equally divided between the work on the water line and the work on the lift station; including the cost of repatching the Georgetown parking lot. Mr. Filister has offered to pay 50% of the total cost. The work done, including both the work on the water line and on the lift station, was done on private property. Apparently the City in the past has done work on the lift station, but as indicated in an earlier memorandum and as stated in council minutes, the City declined to accept the responsibility of maintaining the sewer and water lines on the private property. I beieve that the City's chances of recovering the amount are better than 50-50. I would estimate perhaps 75% or 80% chance of recovery. I would estimate that the cost of litigation would run approximately $1000 to $1200. Because the City has in the past indicated that they would maintain the lift station, I would suggest we advise Mr. Filister that we will share 50-50 the cost of the underground electrical line to the lift station, but advise him that the water break expense is entirely private. I also feel the City should enter into an agreement with Mr. Filister that spells out the City's responsibility, which should be limited to the lift station. The agreement should provide that future work on the sewer and water lines that are on private property will be paid for by the owner of that property. If we have to, I would concur with the agreement to pay, on a one time basis only, for one-half of the cost of installing the electrical service to the sanitary lift station. All other costs and particularly the asphalt repair, which was requested by Mr. Filister, are properly borne by him. If this proposal is to be submitted, I would recommend that the proposal include an agreement or statements to the effect which indicate that this is a one time only process and that it is understood in the future all of the streets, storm sewer, water and sanitary sewer systems located on the Georgetown properties are the responsibility of the Georgetown Apartments ownership. With the exception of the sanitary lift station. Only the sanitary lift station, which consists of the structure and the pumps and piping located within the structure will remain a responsibility of the City Public Works Department. The attached maps are submitted for enclosure which identify the areas and the utilities within those areas which remain the responsibility of the Georgetown Apartments. Request that these items be incorporated into any agreement or settlement reached with Mr. Filister. Anoka County has apparently been successful in negotiating a location and placement of an eight foot bituminous bikeway/walkway on the Georgetown Apartment site. Attached are the construction plans for the project. Of major concern for Anoka County is the location of the bikeway/walkway in between the southbound lanes of East River Road and the access drives for the Georgetown Apartments. The options we discussed at the meeting for the location of the eight foot bikeway/walkway are as follows: 1. Striping an eight foot bikeway/walkway as part of the existing frontage road/access drive which runs parallel to East River Road (see sheet 8 of 11 sheets). 2. Construct an off-street eight foot bikeway/walkway. This cannot be done because of the location of the six foot chain link MnDOT fence toward the south part of the property and the narrow width between the frontage road pavement and the southbound travel lanes of East River Road. 3. Striping a four foot lane on both sides of the frontage road for bikeway/walkway traffic to travel in the direction of automobile traffic. The third option was preferred by Jack Kirk. It appears this would be the safest option and would enable people to travel with the automobile traffic and minimize conflicts at the location of the intersection of the Georgetown driveway with East River Road. Georgetown Bikeway/Walkway November 19, 1990 Page 2 From the construction plan that Anoka County submitted, apparently the property line jogs in several areas which leads us to question whether or not the frontage road is public or private property. Please provide any information you may have on this particular issue. Secondly, please provide your input on this matter as to which option would be preferred. Again, our recommendation would be option #3. If you disagree with our recommendation, we should meet to resolve the disagreement and come up with another alternative. Public Works Director DATE: November 20, 1990 SUBJECT: Bikeway/Walkway along Georgetown Apartments Property I have reviewed the plans for the proposed bikeway/walkway through the area adjacent to the Georgetown Apartment site. I have the following comments: 1. The plans by Midwest Land Surveyors do not indicate a piece of right-of-way at the Georgetown entrance which includes all of the entryway. I have indicated this additional right-of- way which is shown on the half section on the bikeway/walkway preliminary plans. 2. With regard to options of where and what manner a bikeway/walkway should be constructed through this section it is my opinion that it could be potentially safer for users of the bikeway/walkway to utilize the alignment currently shown on the plans with the following changes: a. Where the bikeway/walkway comes in close proximity to the southbound lane of East River Road just north of the Georgetown Apartments entrance there could be placed wooden guard posts to provide some protection for pedestrians from the southbound traffic using the right turn lane. This section of the service drive for the apartment complex is lower than the highway and there is a definite separation in grade of the service road and East River Road. b. Where the bikeway/walkway crosses the Georgetown Apartments entrance there should be placed signage that states "walkyour bike". a C. Essentially the only conflict occurs at the entrance way instead of at the individual entrances to the garages and apartment buildings. With regard to the jurisdiction of the frontage road/service drive, based on the right-of-way that exists, that portion south of the entrance to Georgetown and including the entrance would be considered public as it provides access to the Lynwood Nursing Home. That portion north of the entrance would be private as a majority of it is outside of the right-of-way and serves only to provide access to the various apartment buildings and garages. I suggest that a meeting be set up in the near future between Jack Kirk, yourself, Michelle McPherson, John Flora and myself to finalize the City staff position on the location of this bikeway/walkway. At our meeting on November 16, 1990, we indicated a preference for striping a four foot wide strip on either side of the existing frontage road. After further review, we believe the proposed construction as indicated on the preliminary construction plans is the preferred alternative. The proposed plans indicate creation of an eight foot wide strip separated by a six inch concrete curb. This option minimizes conflicts with intersection points along the roadway. If a bikeway/walkway lane would be striped along the frontage road, it would conflict with parked cars from apartment residents. 2. We request that stop signs be placed where the bikeway/walkway crosses the Georgetown Apartments entrance. The sign should also state "walk your bike". 3. Where the bikeway/walkway comes in close proximity to the southbound lane of East River Road north of the Georgetown Apartments entrance, we recommend placement of delineators to provide identification of a bikeway/walkway trail. The separation in grade in this area of the service road helps to separate the roadway function and the bikeway/walkway function. A store with check-out aisles shall ensure that an adequate number of accessible check- out aisles are kept open during store hours. or shall otherwise modify its policies and practices, in order to ensure that an equivalent level of convenient service is provided to individuals with disabilities as is provided to others. If only one check-out aisle is accessible. and it in generally used for express service. one way of providing equivalent service is to allow persons with mobility impairments to make all their purchases at that aisle. for deaf persons (TDD's). videotext displays, or other effective methods of making aurally delivered materials available to individuals with hearing impairments; (2) Qualified readers, taped texts, audio recordings. (c) Effective communication. A public accommodation shall furnish appropriate auxiliary aids and services where necessary to ensure effective communication with individuals with disabilities. (d) Telecommunication devices for the deaf (TDD s). (1) A public accommodation that offers a customer, client, patient, or participant the opportunity to make outgoing telephone calls on more than an incidental convenienc,p basis shall make available upon request, a'TDD for the use of an individual who has impaired hearing or a communication disorder. (c) Priorities. A public accommodation is urged to take measures to comply with the barrier removal requirements of this section in accordance with the following order of priorities. (1) First, a public accommodation should take measures to provide access to a place of public accommodation from public: sidewalks, parking, or public transportation. These measures include, for example, installing an entrance ramp, widening entrances, and providing accessible parking spaces. (2) Second, a public accommodation should take measures to provide access to those areas of a place of public accommodation where goods and services are made available to the public. (4) Fourth, a public accommodation should take any other measures necessary to provide access to the goods, services, facilities, privileges. advantages. or accommodations of a place of public accommodation. (d) Relationship to alterations requirements of subpart D of this part. (1) Except as provided in paragraph (d)(2) of this section, measures taken to comply with the barrier removal requirements of this section shall comply with the applicable requirements for alterations in § 36.402 and §§ 36.404-36.406 of this part for the element being altered. The path of travel requirements of § 38.403 shall not apply to measures taken solely to comply with the barrier removal requirements of this section. (2) 1f, as a result of compliance with the alterations requirements specified in paragraph (d)(1) of this section, the messurey required to remove a barrier would not be, readily achievable, a public accommodation may take other readily achievable measures to remove the barrier that do not fully comply with the specified requirements. Such measures include, for example, providing a ramp with a steeper slope or widening a doorway to a narrower width than that mandated by the alterations requirements. No measure shall be taken. however. that poses a significant risk to the health or.safety of individuals with disabilities or others. (e) Portable ramps. Portable ramps should be used to comply with this section only when installation of a permanent ramp is not readily achievable. In order to avoid any significant risk to the health or safety of individuals with disabilities or others in using portable ramps. due consideration shall be given to safety features such as nonslip surfaces, railings, anchoring. and strength of materials, (f) Selling or servr'ng space. The rearrangement of temporary or movable at*uctures, such as furniture, equipment, and display ranks ie not readily achievable to the extent that it results in a significant loss of selling or serving apace. (g) Limitation on barrier removal obligations. (1) The requirements for t;arrier removal under § 36.344 shall not be interpreted to exceed the standards fur alterations in subpart U of this part. (3) This section does not apply to rolling stock and other conveyances to the extent that § 36.310 applies to rolling stock and other conveyances. §30,305 AtIamelives to barrier removal. (a) General. Where a public accommodation can demonstrate that barrier removal is not readily achievable, the public accommodation shall not fail to make its goods, services, facilities, privileges, advantages, or accommodations available through alternative methods, if those methods are readily achievable, (b) Examples. Examples of alternatives to barrier removal include, but are not limited to, the following actions -- (1) Providing curb service or home delivery; (2) Retrieving merchandise from inaccessible shelves or racks; (3) Relocating activities to accessible locations; (c) Multiscreen cinemas. if it is not readily achievable to remove barriers to provide access by persons with mobility impairments to all of the theaters of a multiscreen cinema, the cinema shall establish a film rotation schedule that provides reasonable access for individuals who use wheelchairs to all films. Reasonable notice shall be provided to the public as to the location and time of accessible showings. § 36.306 Personal devices and servtcss. This part does not require a public accommodation to provide its customers. clients, o- participants with personal devices, such as wheelchairs; individually prescribed devices, such as prescription eyeglasses or hearing aids: or services of a personal nature including assistance in eating, toileting, or dressing, § 36.307 Accessible or special goods. (a) This part does not require a public accommodation to alter its inventory to include accessible or special goods that are designed for, or facilitate use by. individuals with disabilities. (bJ A public accommodation shall order accessible or special ;cods at the request of an individual with disabilities, if, in the normal course of its operation, it makes special orders on request for unstocked goods, and if the accessible or special goods can be obtained from a supplier with whom the public accommodation customarily does business. (r) Examples of accessible or special goods include items such as Brailled versions of books, books on audio cassettes, closed captioned video tapes, special sizes or lines of clothing, and special foods to meet particular dietary needs. § 36.308 Seating In assembly area&. (a) Existing facilities. (1) To the extent that it is readily achievable, a public accommodation in assembly areas shall— (i) Provide a reasonable number of wheelchair seeting spaces and seats with removable aisle -side arm rests; and (ii) Locate the wheelchair seating spaces so that they— (A) Are dispersed throughout the seating area; (B) Provide lines of sight and choice of admission prices comparable to those for members of the general public; (C) Adjoin an accessible route that also serves as a means of egress in case of emergency; and (D) Permit individuals who use wheelchairs to sit with family members or other companions. (2) If removal of seats is not readily achievable, a public accommodation shall provide, to the extent that it is readily achievable to do so. a portable chair or other means to permit a family member or other companion to sit with an individual who uses a wheelchair. (3) The requirements of paragraph (a) of this section shall not be interpreted to exceed the standards for alterations in subpart D of this part. (b) New construction and alterations, The provision and location of wheelchair seating spaces in newly constructed or aiiered assembly areas shall be, governed by the standards for new construrtion and alterations in subpart f) of this part $ 36.309 Examinstlons and courses. (a) Genoral. Any private entity that offers examinations or courses related to applications. licensing, certification, or credentialing for secondary or postsecondary education. professional, or trade purposes shall offer such examinations or courses in a place and manner arr.Pssible to persons with disabilities or offer alternative accessible arran;cmonts for such individuals. SECTION 1106 — ACCESSIBLE EXTERIOR ROUTES 1106.1 General. Accessible exterior routes shall be provided from public transportation stops, accessible parking and accessible passenger loading zones and public sidewalks to the accessible building entrance they serve. When more than one building or facility is located on a site, at least one accessible route shall connect accessible elements, facilities and buildings that are on the same site. The accessible route / between accessible parking and accessible building entrances shall be the most practical direct 1 route. 1106.2 Definition. CABO/ANSI A117.1 is American National Standard Al 17.1-1992 published by the Council of American Building Officials. 1106.3 Design and Construction. When accessibility is required by this section. it shall be de- signed and constructed in accordance with CABO/ANSI A 117.1. SECTION 1107 — PARKING FACILITIES 1107.1 Accessible Parking Required. When parking lots or garage facilities are provided, acces- sible parking spaces shall be provided in accordance with Table A -11-A except for the following occupancies: 1. In Group 1, Divisions 1.1 and 2 nursing homes and lone -term care facilities. at least one in every two patient rooms, or fraction thereof, including, associated toilet rooms and bathrooms. 4. In Group I, Division 3 mental health occupancies. at least one in every 10 patient rooms. or fraction thereof, including associated toilet rooms and bathrooms. 5. In Group I, Division 3 jail, prison and similar occupancies, at least one in every 20 rooms or cells, or fraction thereof, including associated toilet rooms and bathrooms. 6. In Group I Occupancies, all treatment and examination rooms shall be accessible. 1103.1.2.8 Group M Occupancies. Group M Occupancies shall he accessible as provided in this chapter. Assembly spaces in Group M Occupancies shall comply with Section 1103.1.2.2. 1103.1.2.9 Group R Occupancies. 1103.1.2.9.1 General. Group R Occupancies shall be accessible as provided in this chapter. When accessible dwelling units, guest and sleeping rooms are required, public- and common -use areas and facilities such as recreational facilities, laundry facilities, garbage and recycling collec- tion areas, mailbox locations, lobbies, foyers and management offices shall be accessible. EXCEPTION: When recreational facilities are provided accessory to accessible dwelling units, only 25 percent of recreational facilities need be accessible, provided not less than one of each type in each group of such facilities shall be accessible. All recreational facilities of each type on a site shall be considered in deter- mining the total number of each type which are required to be accessible. 1103.1.2.9.2 Apartment houses. In apartment houses containing more than 20 dwelling units, at least 2 percent, but not less than one, of the dwelling units shall be accessible. All dwelling units on a site shall be considered to determine the total number of accessible dwelling units. EXCEPTIONS: 1. Dwelling units required to be accessible may be adaptable dwelling units. 2. Dwelling units with two or more stories in a nonelevator building need not be accessible. 1103.1.2.9.3 Hotels and lodging houses. -In hotels and lodging houses containing six or more guest rooms, one of the first 30 guest rooms and one additional guest room for each additional 100 guest rooms, or fraction thereof, shall be accessible. Bathing, toilet and other facilities accessory to an accessible guest room shall be accessible. In hotels with 51 or more guest rooms, 50 percent, but not less than one, of the accessible guest rooms shall have a roll -in shower. In addition to the accessible guest rooms required above, guest rooms for persons with hearing impairments shall be provided in accordance with Table 11-B. I visited the site this afternoon and discussed the problems with Mr. Fillister. I observed that the garages that have water coming in are built into the hillside. The water is coming into the garage at the base of the walls located in the back of the garage. I also noticed one garage stall had water seeping up through the floor cracks. I observed the sink hole in front of the garage. The sink hole was approximately 3' deep and 3' in diameter. The bottom of the sink hole was saterated and had water standing. There was a drain tile suspended in the middle of the hole. I didn't observe any other pipe. I asked if Mr. Fillister had any construction records to look at and he said he may have some in the files. After observing the water problems, I told Mr. Fillister he may want to consider hiring a private engineer to assess the situation and give recommendations. I also told him he may consider filling the sink hole with sand and observe to see if the sink hole reappears again.
