The contractor shall make arrangements with the Owner for use of the following: a. Temporary storage facilities and parking b. Temporary electrical power c. Water supply d. Sanitary facilities All of the above items are available at the site without charge. The contractor shall be responsible for any costs associated with temporary hook up or extension of utilities. The Owner will be responsible for the costs of power consumption. 6. The contractor shall be held responsible for the repair and replacement of any items (including, but not limited to: vehicles, equipment, drains, adjacent structural elements, etc.) which are damaged or rendered less effective by the Contractor's activities for the duration of the work. It shall be the contractor's responsibility to document any items which are deficient prior to the start of the work. 7. The American Institute of Architects Document A205-1993, "General Conditions of the Contract for Construction, Small Projects Edition", is a document of this contract. All provisions of A205-1993 shall apply to this contract unless specifically modified herein. Supplementary conditions to specific sections of A205-1993 are given on page 6: 5 Georgetown Garage Repairs 8. The form of agreement between the Owner and contractor shall be the "Standard Form of Agreement between Owner and Contractor for a small project where the basis of payment is a stipulated sum," AIA A105-1993. Supplementary Condition to A205 - 1995 Article 1 1.4 Wherever "Architect" appears in the document, change to "Consultant." Article 7 7.3a Applications for payment shall be made monthly. The Owner shall not pay for any material until it has been delivered to the site and /or satisfactorily incorporated into the work. 7.3b Retainage of 10% of the value of work performed shall be deducted from payments for the first half of the work. The retainage shall be payable 30 days after Substantial Completion, less any amount required to pay for correction or completion of the work. Release of holdback will be made upon receipt of waivers of claim from all furnishers of labor, material and equipment. Article 8: 8.2 In 11.1 the Contractor's Comprehensive General liability insurance coverage for this work shall be for $1 million and shall be maintained in force for a period of one year from the date of substantial completion. This insurance shall include an Owner's Protective Liability Policy in the names of the Owner and Consultant and their sub -consultants, agents and employees. 8.3 Prior to commencement of the work, the Contractor shall purchase and maintain throughout the duration of the work: Worker's Compensation insurance, including Employer's liability to cover employee injuries or disease compensable under the Workers' Compensation Statutes of the state of Minnesota; disability benefit laws, if any; or Federal compensation acts if applicable. Self-insurance plans approved by the regulatory authorities in the state are acceptable. 8.4 The Contractor shall provide Comprehensive Automobile Liability to cover bodily injury and property damage arising out of operation of all motor vehicles by the contractor, sub- contractors and all employees, in the amount of $1 million for each occurrence. 8.5 The Contractor shall purchase and maintain the required property and loss of use insurance naming the insured parties to be the Contractor, all subcontractors, the Owner, the Consultant, sub -consultants and the Lynwood Golden Living Center.
