Dear Ron:
This correspondence is to recognize the use of insulation board to
maintain the integrity of the frost footings near the West end of the
residence at 6880 East River Road in Fridley.
We recognize that as we pour a patio for the walkout of the
basement we have removed 6 to 10 inches of dirt which lowers the
frost protection for the footings near that entrance. We will put a 4'
x 10' barrier, 2 inches deep providing an R-10 insulating factor
along the foundation. We are not overly concerned since we also
have in -floor heating cables which will offer additional protection
around the entire foundation.
I hope this clarifies any questions and removes any concerns about
maintaining the integrity of the frost footings in this area.

Dear Mr. Miller:
Per your request we submit the following information.
Prior to pouring the concrete patio at the above address, we
discussed with you an alternative method of frost protection next
to the walkout house foundation. You suggested placing R-10
insulation board along the side of the house foundation and also
under the slab of the patio to protect the 42 inch minimum frost
depth.
I agreed with the proposal, and requested a letter from the
homeowner stating the insulation requirements and their approval of
this method. A letter from Anna and Curtis Pribula was received on
June 23, 1997.

When we removed dirt with the help of Dean Johnson and R. Miller to prepare
N"Wl for installation of the in -floor heating system there was neither sand or vapor barrier
placed there, nor was it installed after we laid the certifoam. Ms. Maiers in a letter to Mr.
Kelly 6/10/96 explained why these were included on the blueprint. This was not installed
nor was the amount bid for materials and labor returned to the project. EXHIBIT

3D. RESPONSIBILITIES DENIED/REFUSED-
a. Patio design- When it was time to pour the patio, R. Miller was confused on
how to pour the patio slab against the foundation because of frost line code requirements.
He said he could not pour the patio until he received a variance. Curtis consulted with
the Fridley Building Inspector, wrote a proposal of how it could be done and sent it to the
Fridley Building Inspectors for their approval. They approved it and the project was once
again able to go forward. Why didn't R. Miller take this responsibility rather than
delegating the responsibility to Curtis? EXHIBIT # 26)
b. Retaining wall & step design- R. Miller used Curtis' design for the steps and
retaining walls as well. R. Miller offered us no design or suggestion on this part of the
landscaping. EXHIBIT # J /
R. Miller informed us on April 24, 1997 that he was having trouble finding
landscapers, because as he told us, he felt it was his responsibility to tell them how hard
�✓ we were to work for. This slander was instigated by R. Miller and further added to his
delays. EXHIBIT # -"/5 - 0- .
c. Handrail- A month after returning home, Ann was given a correction notice by
county licensing, stating that a code -required handrail stili needed to be installed on the
concrete steps leading down to the patio. R. Miller was aware of the requirement two
months before the correction order came. He simply ignored it until we were forced to
install it ourselves. EXHIBIT 'J -3. a*h
d. Gas Meter- In a letter to the Minnesota Department of Commerce, R. Miller
glosses over the matter of the placement of the gas meter. He writes, "Since the meter
was moved by Minnegasco, it is a non -issue." R. Miller's conduct around this item is
very much at issue! EXHIBIT # q'7 d
R. Miller called Minnegasco to reconnect the gas line and meter on November 26,
1996, after relocating the house. He apparently did not direct Minnegasco as to where
the gas meter needed to be placed to accommodate our fence. The blueprint was clear
that the fence was to butt up against the southeast corner of the house. Without R.
M'iller's direction or without giving Minnegasco access to the on-site blueprint,
Minnegasco placed the gas meter in a position that would clearly interfere with the
subsequent installation of the fence.
Minnegasco installed a pipe that extended out past the corner of the house into the
N"Wo sidewalk area. We immediately noted the danger to R. Miller. When nothing had

SUBJECT: Update on Anna (Wichern) Pribula Request, 6880 East River Road
Ms. Anna (Wichern) Pribula appeared at the City Council meeting on June 9, 1997.
The question was whether the City could enforce a stipulation as part of a required
landscape bond to establish a deadline for the contractor to complete the work.
The $10,000 outdoor improvement bond was only to be required if Ms. Pribula had
moved into the home, and the outside work was not completed. Ms. Pribula has not
moved into the home and wants to complete all the items prior to occupancy.
Therefore, work is still ongoing as part of the building permit. The stipulation regarding
a compliance deadline is only legally applicable as part of the outdoor improvement
bond. A stipulation for a completion deadline cannot be made solely on a building
permit since "adequate progress" is being made.
The contractor is under contract with the owner, Anna Pribula. The County will
reimburse Ms. Pribula for certain agreed-upon expenses. At this point in time, the items
that remain to be completed include the deck, concrete steps and sidewalk, final
grading of the lot, sodding the yard, connecting the new furnace with appropriate gas
shutoff valuves, connecting the water heater, and a number of miscellaneous items
inside the building which need to be rectified. I spoke to Mike Kelly from Anoka
County. He advises that Ms. Pribula will be receiving an additional payment for the
easement acquisition as well as agreed-upon expenses.
I contacted Ms. Pribula on Thursday, June 12, 1997, and explained to her the issue of
the stipulation and the permit. She understood my explanation and thanked the City for
its help during the project.

The Building Inspection staff has also spoken to the contractor on several occasions
during the week. We have asked for timeframes as to when some of the items are to
be completed so that proper inspections can be scheduled. Ms. Pribula, in some of the
cases, may decide to do the work on her own (for example, completing the sodding of
the front and side yards). We are trying to keep track of who is responsible for each
item on a day-to-day basis.
At this time, I do not believe there is any further action that the City can take. Issues
between the owner and the contractor need to be resolved between them. Based on
the investigation I have conducted, the City does not have a basis to revoke the
contractor's license. We will, however, monitor progress on the site.

Dear Ron:
This correspondence is to recognize the use of insulation board to
maintain the integrity of the frost footings near the West end of the
residence at 6880 East River Road in Fridley.
We recognize that as we pour a patio for the walkout of the
basement we have removed 6 to 10 inches of dirt which lowers the
frost protection for the footings near that entrance. We will put a 4'
x 10' barrier, 2 inches deep providing an R-10 insulating factor
along the foundation. We are not overly concerned since we also
have in -floor heating cables which will offer additional protection
around the entire foundation.
I hope this clarifies any questions and removes any concerns about
maintaining the integrity of the frost footings in this area.
Thanks for allowing us an alternative and creative approach.
