Dear Mr. Kelly:
We have reviewed the proposed plans for relocation of the structure located at 6880 East River
Road. The following letter details the minimum requirements for issuance of a permit to relocate
this dwelling. These comments are based on the plans we have received to date. Additional
comments may arise if different information is received when a permit is submitted.
Engineering Requirements
The County shall pay for the extension of the sewer and water services located in East River Road
to the new structure. The County shall also pay for the abandonment of the existing lift station,
sewer system and well.
Zoning Requirements
The City of Fridley zoning code does require a hardsurface driveway; however, if the
County is not relocating or reconstructing the existing garage, the City cannot mandate
that a hardsurface driveway and parking area be installed at this time.
2. The following are the required and proposed setbacks:
a. Front Yard - 35 feet required - 64 feet proposed
b. Rear Yard - 36.5 feet required - 40 feet proposed
C. Side - 10 feet required - 10 feet proposed along the north property - 55 feet
proposed along the south property line

I would like to point out that the proposed rear yard setback only allows an additional 3.5 feet of
expansion for any future additions or the enclosure of the deck. Any future additions or enclosure
of the deck will require a variance.
Building Requirements
Please refer to the attached addendum from Bob Roach, Code Consultant, regarding building
requirements.

Task: Examine plans for altered residence to identify construction items which exceed code
requirements.
Note: Review of plans for items which exceed code requirements is beyond the normal scope of
plan review by a municipality. Such items are the result of design decisions and are
inherently inter -connected with multiple, related, other items. Design decisions inherently
preclude the use of other alternatives, some more costly, some less. At times, a design
decision may require the inclusion of work which would not have otherwise been required
for a project.
Any review is subject to interpretation of what constitutes appropriate equivalent
replacement of existing construction. Code requirements have increased since the house
was originally built. The impact of resulting additional work has been ignored for
purposes of this review. It is important to note, however, that in most instances items in
a house may be repaired or replaced without being required to bring the work up to
current code, if the item is being restored to a prior condition compliant with codes
applicable at the time of constructionfinstallation.
The following list of comments attempts to identify items of both levels of work which
goes beyond code requirements. It identifies areas which may have an alternate,
reasonable approach for providing equivalent replacement. It is not comprehensive
identifying the areas which could be involved, nor in the range of alternative solutions for
the areas which are identified. Nor does it attempt to provide a recommendation of cost-
effectiveness of alternate solutions
Further work is required to complete the evaluation. Further analysis for equivalent
replacement should consider cost -in-place; this was not considered for this review. Such
work might include having several housing contractors provide estimates for alternate
solution(s).
Note: "Code" refers primarily to Building Code. It may also/instead refer to the Plumbing,
Mechanical, and/or Electrical Codes.

GENERAL
01. This review is for preliminary estimating purposes only, and does not constitute
acceptance or approval of the proposed project, nor imply that such would be necessarily
granted upon application for such. Appropriate plan review will occur when/if building
permit is applied for.
02. Please note that the State Building Official has mandated that the City not address, nor
consider, the Americans with Disabilities Act (ADA) but, instead, enforce the Minnesota
State Accessibility Code, Chapter 1340 (MSAC). Owner and owner's agents are
responsible for their own provision enforcement of all accessibility code requirements
other than the MSAC.
03. This review is based on the owner's assertion that any daycare use would be licensed
under MN Rules 1300.2400. Subp.7a (Licensed Family Day Care) or Subp.7B (Licensed
Group Family Day Care). If use of the home would differ from the aforementioned (and
residential) use, an application for new building permit and Certificate of Occupancy must
be applied for prior to any such use. Non -complying day care must be separated from
residential use by an occupancy separation; other code requirements would also apply.
OTHER
04. UBC 302 (b) & 1804. Submit the following additional plans, calculations, diagrams,
reports or other data: Deck framing Plan; Soils Investigation Report; and signed &
stamped engineered design for support of structure, with evaluation &
recommendations for existing house structure.
E EGRESS
05. UBC 3403.2. Where the occupants of the new addition (basement) use the existing
building's exit system for egress purposes, the entire exiting system (existing and
proposed) must comply with all of the requirements of Chapter 10 as currently adopted by
the State of Minnesota.
06. UBC 1004.9. Exterior landing may not be more than 8 -inches lower than interior floor.
07. UBC 1004.9. Main floor door to basement stairs may not swing over the stairs.
08. UBC 1004.10. Landings shall be minimum 36 inches long in direction of travel.
09. UBC 1004.10. Doors swinging over landings and in the fully open position shall not
reduce the required dimension by more than 7 inches.
10. UBC 1006.1. All interior and exterior stairways with 2 or more risers must conform to
this section.

11. UBC 1006.2. Stairways shall have a minimum 36 inch width; handrails may project 3-1/2
inches into both sides.
12. UBC 1005.4. Nonstructural projections such as trim may not project more than 1-1/2 "
on each side.
13. UBC 1006.9. Handrails must be full length, continuous and installed on at least one side
of stairways; Handrails must be between 1 -1/4 -inches and 2 -inches in diameter (orrp ovide
equivalent grippable surface), and be placed between 34 and 38 inches above tread nosing
with ends returned or terminated in newel posts.
14. UBC 1006.12. Protect enclosed useable space under interior stairways on the enclosed
side as required for 1 -hour, fire -resistive construction.
15. UBC 1006.15. Provide minimum 6-8" headroom clearance for stairways.
GENERAL DESIGN
16. UBC 2602. Foam plastic insulation must comply with all requirements herein.
1 Separate foam plastic insulation from interior of the building by an approved UBC
Standard 62 -2 -complying thermal barrier installed such that the foam plastic
insulation is not exposed at all.
.2 Provide alternate barrier below gypsum board if it is "gapped" above concrete.
17. UBC 804/T -8B. Exposed vapor barriers must comply with requirements herein.
18. UBC 509.1. Provide guardrails per this section at unenclosed floor and roof openings,
open and glazed sides of stairways, landings and ramps, balconies and porches, which are
more than 30 -inches above grade or floor below.
19. UBC 509.2/3. Provide 36 -inch high guardrails constructed with intermediates installed to
prohibit a 4 -inch diameter sphere from passing through (6 -inch at triangular openings at
riser/tread/rail).
PL PROPERTY LOCATION
20. UBC 1006.13 & 1005.9. Exterior stairway/balcony/deck can not project into area
where wall openings required to be protected or are banned.
1 Provide minimum six -feet separation between this construction and the "existing
shed to remain".
.2 UBC 104.2.1. Provide survey stakes for house and deck, and for North property
line, in place and visible at the footing inspection.

OU OCCUPANCY OR USE REQUIREMENTS
21. UBC 310.4. Provide egress window/wells for every sleeping room in the basement, with
a minimum of one for that story. At least one egress window is also required in each
existing sleeping room (and minimum one per story) when window units are replaced.
1 Provide egress windows with minimum 5.7 square feet of net clear opening,
minimum 24 -inch net clear height, and 20 -inch net clear width; with bottom edge
of net clear opening no more than 44 -inches above finished floor. [Note corrected
height in Wichern letter of 09-08-95.]
.2 UBC 310.4. Provide egress window well with minimum 9 square feet net open
area, and 3 -foot minimum dimension when window is opened;rp ovide ladder or
stairs for well when its floor is more than 44 -inches below grade. Bars, grilles,
grates, or similar devices, shall conform herein.
22. UBC 310.9. Provide smoke detectors, per this section, in each sleeping room in the
house, and one centrally located in each access corridor/area for each separate sleeping
area, and minimum of one at each level in the building; all audible in the sleeping areas.
23. UBC 310.12. Storage and use of flammable & combustible liquids shall comply with
the Fire Code.
MR MISCELLANEOUS REQUIREMENTS
24. UBC 513. Post approved numbers or address in such a position as to be plainly visible
and legible from the street or road fronting the property.
25. UBC 1402.2. Provide flashings for all new exterior openings exposed to weather per this
section.
26. UBC 1402.4. Basement foundation wall dampproofing shall conform herein.
27. UBC 2317.2. Provide wood treated for ground contact for all wood embedded in earth,
or in concrete in contact with earth or exposed to weather.
28. UBC 2317.5. Provide approved (heartwood) wood of natural resistance to decay or
treated wood for all wood columns located on concrete basement floors, and those
supporting the exterior decks, and which support permanent structure.
29. UBC 708.2.1. Fireblock all soffits, drop or cove ceilings, and other interconnections
between concealed vertical & horizontal spaces.
1 UBC 708.2.1. Fireblock concealed spaces between stair stringers at top &
bottom of stairs, and unfinished walls between studs along and in line with the
stair run.

29. .2 UBC 708.2.1. In concealed combustible wood construction, openings at ceiling
and floor levels around vents, pipes, ducts, & similar openings, shall be
fireblocked with noncombustible materials. Specify material to be used.
.3 UBC 708.2.1. Fireblock at factory -built chimenys' chase opening into attic
spaces.
.4 UBC 708.2.2. Construct fireblocking of securely -fastened 2 -inch nominal lumber,
gypsum board, cement asbestos board, mineral fiber, or other approved material to
stop fire and drafts between floors, and between attic or roof space and other
spaces below.
30. UBC T-15B1/Amended. Provide snow & ice protection to 24 -inches inside the interior
face of exterior wall for roof slope of 2/12 to 4/12.
31. UBC 2406. Install bottom edge of glazing at least 18 -inches above finished floor, or
provide safety glazing where required herein.
32. UBC 2512. Do not install water-resistant gypsum board:
.1 Over a vapor barrier, nor
.2 On any ceiling with frame spacing more than 12 -inches on center.
S STRUCTURAL DESIGN CRITERIA
33. UBC 106/3/2 & MSBC. Structural Engineer must confirm on the plans that "the
structural design is in accordance with the Nf mesota amended 1994 Uniform Building
Code".
34. UBC 1804. Prepare & submit a soils investigation report:
1 UBC 1804.3. Building design shall comply with the soils investigation report
prepared for this project including, but not limited to, the following: design soil
bearing capacity, granular fill/subgrade, subsoil drainage system, equivalent fluid
pressure, minimum footing sizes.
.2 UBC 1804.3. The structural plans shall reference the soils investigation report
prepared for this project and identify compliance with it.
35. UBC 1806. Provide footings and foundation under exterior stairs at front and rear of
house, or provide design to allow for movement of stairs at deck attachment point, while
assuring compliance with riser/tread requirements.
36. MSBC 1300.6100. Provide foundation walls which meet or exceed requirements herein
for conventional foundation walls. Topics include, but are not limited to:
.1 Reinforcing, anchor bolts, clips, backfilling, exterior drainage system.
.2 Provide engineering for foundation walls more than 8-1/2 feet high above
basement floor.

37. UBC 2107.2. 2.6. Reinforced masonry lap splices must be sufficient to transfer stress
per this section; but splice length shall not be less than 30 bar diameters for compression,
nor 40 bar diameters for tension, with additional increases per UBC 2409(e)6.
38. UBC 1903.6. Submit proposed concrete admixtures for review. All are subject to prior
approval by the Building Official.

39. UBC 1203.3. Provide minimum three -feet separation between bathroom / other exhaust
and any opening which allows air entry into occupied portion of the building.

must not exceed 35 feet in length.
42. MSPC.0580 F &.0600 H. Vertical PVC/ABS waste and vent piping must not exceed 35
feet in height unless expansion and contraction joints are installed accordingly.
43. MSPC 1220. Set water closets not less than 15 inches from the center to any side wall
while maintaining 24 inches clear in front of the bowl.
44. MSPC 1380 Subp.5. Anti -scald shower control valves complying with this section must
be installed in showers and combination shower -baths.
45. MSPC 1430. Provide pipe support for all pipe as required in this Section.
46. MSPC 2800-2890. Comply with notification and testing requirements.

My name is Anna A. Wichern. I am currently a licensed child
care provider. I do my child care in my licensed home at 6880
East River Road. I am currently licensed (C 1) for ten (10)
children. A month ago I was licensed (C 2) for twelve (12)
children. Enclosed are copies of both licenses.
My home currently meets all the requirements of Minnesota
Rules, Parts 9502.0300 - 9502.0445.
My home is under consideration for a move on the property
because of the widening of East River Road and my home no longer
meets the set back requirements for the city of Fridley.
There has been some dialogue about the new basement meeting
the codes for licensed child-care being done on that level.
If you will look at FAmily Day Care and Group Family Day
Care: Minnesots Rules, Parts 9502.0300 - 9502.0445 I think
9502.0425 PHYSICAL ENVIRONMENT can clear up our door issues.
Subpart 1 - B. Usable indoor space may include a
basement if it has been inspected by a fire
marshal, is free of hazard, and meets the minimum
exiting standards specified in subpart 4.
Subpart 4 Means of Escape. From each room of the
residence used by children, there must be two
means of escape. One means of escape must be a
stairway or door leading to the floor of exit
discharge The other must be a door or window
leading directly outside. The window must be
openable without special knowledge. It must have
a clear opening of not less than 5.7 square feet
and a minimum opening dimension of 20 inches wide
and 24 inches high. The window must be within 48 A4 -('C-(2_

My basement if you look at the blueprints has a door exiting
to the outdoors. It will be a walk out basement. Every room has
windows also that meet the.codes.
If you do not have a copy of the Family Day Care and Group
Family Day Care rules I know there is a copy at the library for
the use of the general public.
The standards I quoted come from the updated rule as of
12/1/91.
I hope to continue providing child-care in my home and as
soon as possible move the child - care into the basement.

Task: Examine plans for altered residence to identify construction items which exceed code
requirements.
Note: Review of plans for items which exceed code requirements is beyond the normal scope of
plan review by a municipality. Such items are the result of design decisions and are
inherently inter -connected with multiple, related, other items. Design decisions inherently
preclude the use of other alternatives, some more costly, some less. At times, a design
decision may require the inclusion of work which would not have otherwise been required
for a project.
Any review is subject to interpretation of what constitutes appropriate equivalent
replacement of existing construction. Code requirements have increased since the house
was originally built. The impact of resulting additional work has been ignored for
purposes of this review. It is important to note, however, that in most instances items in
a house may be repaired or replaced without being required to bring the work up to
current code, if the item is being restored to a prior condition compliant with codes
applicable at the time of construction/installation.
The following list of comments attempts to identify items of both levels of work which
goes beyond code requirements. It identifies areas which may have an alternate,
reasonable approach for providing equivalent replacement. It is not comprehensive
identifying the areas which could be involved, nor in the range of alternative solutions for
the areas which are identified. Nor does it attempt to provide a recommendation of cost-
effectiveness of alternate solutions
Further work is required to complete the evaluation. Further analysis for equivalent
replacement should consider cost -in-place; this was not considered for this review. Such
work might include having several housing contractors provide estimates for alternate
solution(s).
Note: "Code" refers primarily to Building Code. It may also/instead refer to the Plumbing,
Mechanical, and/or Electrical Codes.

GENERAL
01. This review is for preliminary estimating purposes only, and does not constitute
acceptance or approval of the proposed project, nor imply that such would be necessarily
granted upon application for such. Appropriate plan review will occur when/if building
permit is applied for.
02. Please note that the State Building Official has mandated that the City not address, nor
consider, the Americans with Disabilities Act (ADA) but, instead, enforce the Mnnesota
State Accessibility Code, Chapter 1340 (MSAC). Owner and owner's agents are
responsible for their own provision enforcement of all accessibility code requirements
other than the MSAC.
03. This review is based on the owner's assertion that any daycare use would be licensed
under MN Rules 13 00.2400. Subp. 7a (Licensed Family Day Care) or Subp.7B (Licensed
Group Family Day Care). If use of the home would differ from the aforementioned (and
residential) use, an application for new building permit and Certificate of Occupancy must
be applied for prior to any such use. Non -complying day care must be separated from
residential use by an occupancy separation; other code requirements would also apply.
OTHER
04. UBC 302 (b) & 1804. Submit the following additional plans, calculations, diagrams,
reports or other data: Deck framing Plan; Soils Investigation Report; and signed &
stamped engineered design for support of structure, with evaluation &
recommendations for existing house structure.
E EGRESS
05. UBC 3403.2. Where the occupants of the new addition (basement) use the existing
building's exit system for egress purposes, the entire exiting system (existing and
proposed) must comply with all of the requirements of Chapter 10 as currently adopted by
the State of 11Tnnesota.
06. UBC 1004.9. Exterior landing may not be more than 8 -inches lower than interior floor.
07. UBC 1004.9. Main floor door to basement stairs may not swing over the stairs.
08. UBC 1004.10. Landings shall be minimum 36 inches long in direction of travel.
09. UBC 1004.10. Doors swinging over landings and in the fully open position shall not
reduce the required dimension by more than 7 inches.
10. UBC 1006.1. All interior and exterior stairways with 2 or more risers must conform to
this section.

11. UBC 1006.2. Stairways shall have a minimum 36 inch width; handrails may project 3-1/2
inches into both sides.
12. UBC 1005.4. Nonstructural projections such as trim may not project more than 1-1/2 "
on each side.
13. UBC 1006.9. Handrails must be full length, continuous and installed on at least one side
of stairways; Handrails must be between 1 -1/4 -inches and 2 -inches in diameter (orrp ovide
equivalent grippable surface), and be placed between 34 and 38 inches above tread nosing
with ends returned or terminated in newel posts.
14. UBC 1006.12. Protect enclosed useable space under interior stairways on the enclosed
side as required for 1 -hour, fire -resistive construction.
15. UBC 1006.15. Provide minimum 6-8" headroom clearance for stairways.
GENERAL DESIGN
16. UBC 2602. Foam plastic insulation must comply with all requirements herein.
1 Separate foam plastic insulation from interior of the building by an approved UBC
Standard 62 -2 -complying thermal barrier installed such that the foam plastic
insulation is not exposed at all.
.2 Provide alternate barrier below gypsum board if it is "gapped" above concrete.
17. UBC 804/T -8B. Exposed vapor barriers must comply with requirements herein.
18. UBC 509.1. Provide guardrails per this section at unenclosed floor and roof openings,
open and glazed sides of stairways, landings and ramps, balconies and porches, which are
more than 30 -inches above grade or floor below.
19. UBC 509.2/3. Provide 36 -inch high guardrails constructed with intermediates installed to
prohibit a 4 -inch diameter sphere from passing through (6 -inch at triangular openings at
riser/tread/rail).

20. UBC 1006.13 & 1005.9. Exterior stairway/balcony/deck can not project into area
where wall openings required to be protected or are banned.
1 Provide minimum six -feet separation between this construction and the "existing
shed to remain".

21. UBC 310.4. Provide egress window/wells for every sleeping room in the basement, with
a minimum of one for that story. At least one egress window is also required in each
existing sleeping room (and minimum one per story) when window units are replaced.
1 Provide egress windows with minimum 5.7 square feet of net clear opening,
minimum 24 -inch net clear height, and 20 -inch net clear width; with bottom edge
of net clear opening no more than 44 -inches above finished floor. [Note corrected
height in Wichern letter of 09-08-95.]
.2 UBC 310.4. Provide egress window well with minimum 9 square feet net open
area, and 3 -foot minimum dimension when window is opened;rp ovide ladder or
stairs for well when its floor is more than 44 -inches below grade. Bars, grilles,
grates, or similar devices, shall conform herein.
22. UBC 310.9. Provide smoke detectors, per this section, in each sleeping room in the
house, and one centrally located in each access corridor/area for each separate sleeping
area, and minimum of one at each level in the building; all audible in the sleeping areas.
23. UBC 310.12. Storage and use of flammable & combustible liquids shall comply with
the Fire Code.
MR MISCELLANEOUS REQUIREMENTS
24. UBC 513. Post approved numbers or address in such a position as to be plainly visible
and legible from the street or road fronting the property.
25. UBC 1402.2. Provide flashings for all new exterior openings exposed to weather per this
section.
26. UBC 1402.4. Basement foundation wall dampproofing shall conform herein.
27. UBC 2317.2. Provide wood treated for ground contact for all wood embedded in earth,
or in concrete in contact with earth or exposed to weather.
28. UBC 2317.5. Provide approved .(heartwood) wood of natural resistance to decay or
treated wood for all wood columns located on concrete basement floors, and those
supporting the exterior decks, and which support permanent structure.
29. UBC 708.2.1. Fireblock all soffits, drop or cove ceilings, and other interconnections
between concealed vertical & horizontal spaces.
1 UBC 708.2.1. Fireblock concealed spaces between stair stringers at top &
bottom of stairs, and unfinished walls between studs along and in line with the

fireblocked with noncombustible materials. Specify material to be used.

spaces.
4 UBC 708.2.2. Construct fireblocking of securely -fastened 2 -inch nominal lumber,
gypsum board, cement asbestos board, mineral fiber, or other approved material to
stop fire and drafts between floors, and between attic or roof space and other
spaces below.
30. UBC T-15B1/Amended. Provide snow & ice protection to 24 -inches inside the interior
face of exterior wall for roof slope of 2/12 to 4/12.
31. UBC 2406. Install bottom edge of glazing at least 18 -inches above finished floor, or
provide safety glazing where required herein.
32. UBC 2512. Do not install water-resistant gypsum board:
.1 Over a vapor barrier, nor
.2 On any ceiling with frame spacing more than 12 -inches on center.
S STRUCTURAL DESIGN CRITERIA
33. UBC 106/3/2 & MSBC. Structural Engineer must confirm on the plans that "the
structural design is in accordance with the Minnesota amended 1994 Uniform Building
Code".
34. UBC 1804. Prepare & submit a soils investigation report:
1 UBC 1804.3. Building design shall comply with the soils investigation report
prepared for this project including, but not limited to, the following: design soil
bearing capacity, granular fill/subgrade, subsoil drainage system, equivalent fluid
pressure, minimum footing sizes.
.2 UBC 1804.3. The structural plans shall reference the soils investigation report
prepared for this project and identify compliance with it.
35. UBC 1806. Provide footings and foundation under exterior stairs at front and rear of
house, or provide design to allow for movement of stairs at deck attachment point, while
assuring compliance with riser/tread requirements.
36. MSBC 1300.6100. Provide foundation walls which meet or exceed requirements herein
for conventional foundation walls. Topics include, but are not limited to:
.1 Reinforcing, anchor bolts, clips, backfilling, exterior drainage system.
.2 Provide engineering for foundation walls more than 8-1/2 feet high above
basement floor.

To Whom It May Concern:
My name is Anna A. Wichern. I am currently a licensed child
care provider. I do my child care in my licensed home at 6880
East River Road. I am currently licensed (C 1) for ten (10)
children. A month ago I was licensed (C 2) for twelve (12)
children. Enclosed are copies of both licenses.
My home currently meets all the requirements of Minnesota
Rules, Parts 9502.0300 - 9502.0445.
My home is under consideration for a move on the property
because of the widening of East River Road and my home no longer
meets the set back requirements for the city of Fridley.
There has been some dialogue about the new basement meeting
the codes for licensed child-care being done on that level.
If you will look at FAmily Day Care and Group Family Day
Care: Minnesots Rules, Parts 9502.0300 - 9502.0445 I think
9502.0425 PHYSICAL ENVIRONMENT can clear up our door issues.
Subpart 1 - B. Usable indoor space may include a
basement if it has been inspected by a fire
marshal, is free of hazard, and meets the minimum
exiting standards specified in subpart 4.
Subpart 4 Means of Escape. From each room of the
residence used by children, there must be two
means of escape. One means of escape must be a
stairway or door leading to the floor of exit
discharge. The other must be a door or window
leading directly outside. The window must be
openable without special knowledge. It must have
a clear opening of not less than 5.7 square feet
and a minimum opening dimension of 20 inches wide
and 24 inches high. The window must be within 48
inches from the floor. ,UX
My basement if you look at the blueprints has a door exiting
to the outdoors. It will be a walk out basement. Every room has
windows also that meet the.codes.
If you do not have a copy of the Family Day Care and Group
Family Day Care rules I know there is a copy at the library for
the use of the general public.
The standards I quoted come from the updated rule as of
12/1/91.
I hope to continue providing child-care in my home and as
soon as possible move the child - care into the basement.
