Gentlemen:
My complaint is concerning the property I own at 6880
East River tioad. There are no lateral water or sewer connec-
tions on my side of the street. Then I purchased this house
my lawyer checked out the water and sewer assesments to see
if they were in and paid for. Your record.es in the Financial
Department, do so indicate, however your Engineering Dept's
draw ings show differently. I checked this out with .ir. Les
Chesney. (Note) I just recently checked with the Engineering
Dept and found out this last fact.
I am now in the process.of selling this home, and my
Real Estate Agent informs me that I have to have evidence
that the water and sewer are in and paid for before a home
loan my be arranged for.
I ,,,,ant the water and Fewer laterals brought across East
River Road to nay property, as soon as possible. I feel that
you are responsible for having this servick available to me,
si nee you have accepted full payments for the a-sesments.
I would not have purchased said property if I knew that these

MUTUAL AGREEMENT
THIS AGREEMENT made and entered into this 10th day of June, 1970
by and between the City of Fridley, Anoka County, Minnesota, a Municipal
Corporation, hereafter referred to as the City, and Leslie W. and Dorothy L.
Wilke, owners of real estate within the City of Fridley, hereafter referred to
as the owners.
WHEREAS the City of Fridley has requested a permanent utility easement
described as follows: A strip of land 10 feet wide lying 5 feet on each side of
the following described line; commencing at the Northwesterly corner of Lot 8,
Block 2, Sandhurst Addition, said Plat on file of record in the office of
Registrar of Deeds, Anoka County, Minnesota; thence easterly along the North
line of said Lot 8 a distance of 25 feet to the actual point of beginning;
thence Southwesterly in a straight line to the point of intersection of center
line, center line of the Northerly and Easterly legs of Hartman Circle said point
also being the point of 50 foot radius, thence terminating; and
WHEREAS, the City desires to install a water and sewer line to serve
Lot 9, Block 2, Sandhurst Addition.
NOW THEREFORE, be it agreed by and between the parties hereto that the
owner authorizes the above construction. Said authorization being given upon the
condition and with the understanding that the above construction be subject to
the rights of the City to use said property for :.he above described easement
purposes.
IT IS further agreed said authorization being given by the owner subject
to the following:
1. The City will install the utilities by a method known as tunneling.

2. The City will pay all reasonable cost of replacing the damaged
landscaping. This shall include any correction work necessary in
the event of future settling.
3. The owner will reserve the right to obtain the landscaper of his
choice with City approval.
BE IT FURTHER RESOLVED, that this Agreement is to run with the property
and be made binding upon all future owners of said property and pursuant thereof,
the parties Agree to record this agreement with the Anoka County Register of Deeds.
In testimony whereof, the parties hereto have hereunto set their hands this

SUBJECT: Complaint of M. P. Bozony Concerning Water and Sewer Laterals
on Lot 9, Block 2, Sandhurst's Addition.
I have researched the records concerning the complaint of Mr. Bozony,
6880 East River Road, relating to the water and sewer lateral charges
on his property.
I find the assessment roll for the water and sewer laterals in the
Sandhurst's Addition was adopted on October 31, 1956. The total cost
of the sewer laterals in the Sandhurst's Addition was $8,104.03. The
total cost of the water laterals in the Sandhurst's Addition was
$10,073.65.
There apparently was a request from the developer and owner of the
property to spread the water and sewer lateral charges equally on
all of the lots in the subdivision. This was done, with the total
cost being divided among the thirty-four lots in the subdivision.
However, one of the lots does not front on Hartman Circle but fronts
on East River Road. I do not know whether the intention of the
developer was to put a lateral charge on this lot, or whethor it was
his intention to divide the total cost by thirty-three lots, rather
than thirty-four lots. In any event, Lot 9, Block 2, Sandhurst's
Addition does have water and sewer lateral charges but does not have
water and sewer service.
I feel that the extent of the liability of the City if any, would be,
to refund the sewer lateral charge of $238.35 and the water lateral
charge of $296.00 which was levied on Lot 9, Block 2, Sandhurst's
Addition and subsequently paid in full.

To serve this lot with water would not be too difficult, but the sewer line
is about 2' higher, so there would have to be an ejector pump, or tunnel
under East River Road to hook up to that line. Councilman Sheridan asked
if there would not be less maintenance if the line were run to the East
River Road line, The City Engineer said that he believed so.
Mr. M.P. Bozony said that he could get into the East River Road line. He
said that when he bought the property his lawyer did an assessment search and
found that there were water and sewer assessments in and paid for. He
knew that he had a well, but did not know that he was not hooked up to
City sewer. He said that he would not have bought the property if the re --
cords had been correct.
Councilman Sheridan said that the community has some kind of an obligation
to serve this man and he felt that it should be at the City's expense. It
may be cheaper right now to install a pump, but it may not be cheaper over
the years. He suggested that the City Engineer study this and bring back
some cost estimates. The City Engineer said that he thought that it would
be over $1,000 to bore under East River Road and in that case there would
have to be a contract let.
Mr. Bozony said that he now has the house up for sale. Councilman Samuelson
commented that for an F.H.A. loan there has to be one service connected.
Councilman Sheridan said that if the City were to order the work done,
there should be some assurance that he will hook onto the line. He said
that he did not feel that refunding the money would be the answer, rather
that the house has to be supplied with the services. Mr. Bozony said that
he would hook up if the City ran the line.
MOTION by Councilman Sheridan to supply the water and sewer services to
6880 East River Road at the City's cost when requested, and the City Manager
to prepare a letter to this effect to satisfy his financing company.
Seconded by Councilman Samuel$on. Upon a voice vote, all voting aye,Mayor
Kirkham declared the motion carried unanimously.
CONSIDERATION OF COMMUNICATION FROM FRIDLEY CIVIL DEFENSE REGARDING POLE AT
FIRE STATION:
MOTION by Councilman Harris to concur with the Director of Civil Defense and
the City Manager as outlined in the memorandum dated October 3, 1969.
Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.

The City has made a study to determine the method and
cost to serve the residence at 6880 East River Road.
The only way to serve the property is to tie into the
line on iiartman Circle, 'However, the elevation of the sewer
makes it necessary to install an ejector pub to liFe the
sewage up to the Hartman Circle line.
We are submitting, a report to the City Council which,
when approved, will authorize the City to allow you $390.00
toward; the purchase of a pump, $260.1)0 for pl.unbing instal-
lation and $300.00 for electrical work to serve the pun.p. This
would include a new 100 amp. electrical service. the City would
also install a Aster and sewer service to a point located bear
the Southwest corner of your lot.

EJECTOR PUMPS
Enpo heavy duty ejector pumps are available in 3" or 4" discharge sizes and in
a hp. range from 3/a to 5. They are recommended for pumping sewage, stringy
materials and irregular solids and liquids. Solids up to 2" pass through the non -
clogging impellers on the 3" pump and solids up to 3" pass through the 4" dis-
charge pump without the need for screens or shredders. The design of this pump
incorporates many of the features of the smaller Enpo ejector pumps ... features
that have earned their reputation of being the best in the industry. These features
include: (1) Shock resistant impeller; (2) Permanently lubricated bearings; (3) Motor
is completely sealed against water, moisture, dirt, and sewage gas; (4) Power failure
• does not cause motor damage due to flooding ... units start operating the instant the
power goes on; (5) Solid cover over sump or receptor in which pump is installed
saves space ... nothing above the floor occupying valuable space; (6) Enpo ejector

Submersible Motor:
All models feature 1/2 HP water -proof motors, 1750 RPM, with
automatic thermal overload protection. Motors are 115 or 230
volt, 60 cycle, single phase. Heavy cast iron housings. Stainless
steel shaft. Handle liquids up to 100°F.
Enpo-Cornell Non -Clog Pump:
Series 200 and 300 Enpo-Cornell pumps are non -clogging design,
with brass wear ring. Volute and impeller are heavy cast iron.
Series 200 (Models 218 & 224) will pass 11/2" solids; Series 300
(Model 324) will pass 2" solids.
Diaphragm Liquid Level Control:
Pressure type control, contained in separate cast iron housing.
Diaphragm is neoprene coated nylon.
Power Cord
Ten foot long heavy duty PVC covered 3 conductor cord, with
breather tube, and parallel bladed integrally grounded plug. If
cord terminates in damp, humid atmosphere, Enpo-Cornell
respirator to seal off breather tube is necessary.
Heavy Duty Tanks:
All tanks are steel construction with one 4" hubbed inlet.

CONTROLS — Diaphragm enclosed control switch is factory
set to start pump when liquid level reaches approximately
14" in the tank. Pump stops when liquid level is lowered
to 6". Control switches on duplex units are adjustable in
the field to control start -stop liquid level in the tank.
ALARM BELL — (Duplex only) Sounds when liquid level in
tank rises above a pre-set point.
ELECTRICAL ALTERNATOR — (Duplex only) Alternates
pumps and operates both pumps when liquid level rises
above a pre-set point. Provides stand-by service in the
event of an emergency.
MOTOR — 1/2 H. P., single phase, 115/230 volt, 60 cycle,
1725 R. P. M., capacitor -start with automatic thermal over -

Dear Mr. Bozony:
The City has made a study to determine the method and
cost to serve the residence at 6880 East River Road.
The only way to serve the property is to tie into the
line on Hartman Circle, however, the elevation of the sewer
makes it necessary to install an ejector pump to lift the
sewage up to the Hartman Circle line.
We are submitting a report to the City Council which,
when approved, will authorize the City to allow you $390.00
towards the purchase of a pump, $260.00 for plumbing instal-
lation and $300.00 for electrical work to serve the pump. This
___would include a new 100 amp. electrical service. The City would
also install a water and sewer service to a point located near
the Southwest corner of your lot.
If you have questions on this, please call me.
Also, if you do not agree with the method or amounts as indi-
cated above, please notify us and/or attend the Council meeting
on April 20, 1970.

To serve this lot with water would not be too difficult, but the sewer line
Is about 2' higher, so there would have to be an ejector pump, or tunnel
Under East River Road to hook up to that line. Councilman Sheridan asked
if there would not be less maintenance if the line were run to the East
River Road line. The City Engineer said that he believed so.
Mr. M.P. Bozony said that he could get into the East River Road lige. He
" said that when he h.Dught the property his lawyer did an assessment search and
found that there were water and sewer assessments in and paid for. EIe
knew that he had a well, but did not know that he was not hooked up to
City sewer. He said that he would not have -bought the property if the re-
cords had been correct.
Councilman Sheridan said that the community has some kind of an obligation
to serve this man and he felt that it should be at the City's expense. It
may be cheaper right now to install a pump, but it may not be cheaper over
the years. He suggested that the City Engineer study this and bring back
some cost estimates. The City Engineer said that he thought that it would
be over $1,000 to bore under East River Road and in that case there would
have to be a contract let.
Mr..Bozony said that he now has the house up for sale. Councilman Samuelson
commented that for an F.H.A. loan there has to be one service connected.
Councilman Sheridan said that if the City were to order the work done,
there should be some assurance that he will hoof: onto the line. He sa`iid--
that he did not feel that refunding the money would be the answer, rather
that the house has to be supplied with the services. Mr. Bozony said that
he would hook up if the City ran the line.
MOTION by Councilman Sheridan to supply the water and sewee services to
6x80 East River Road at the City's cost when requested`, and the City Manager
to prepare a letter to this effect to satisfy his financing company.
Seconded by Councilman Samuelson. Upon a voice vote, all voting aye,Mayor
Kirkham declared the motion carried unanimously.
CONSIDERATION OF COMMUNICATION FROM FRIDLEY CIVIL DEFENSE REGARDING POLE AT
FIRE STATION:
MOTION by Councilman 'Harris to concur with the Director of Civil Defense and
the City Manager as outlined in the memorandum dated October 3, 1969.
