Dear Mr. Meclich:
It is our estimate that there is 591, 000 cubic feet per
building. Can you insert this number in my building
permit application?
Gus Welter told me this date he confirmed with you on
the telephone about the approximate permit cost. If we
use your computation the permit fee would be approximately
$1, 270. 00. Just what is this $635. 00 plan -checking fee?
This is new to me. I feel it is absolutely ridiculous and
uncalled for and in no event will we pay this plan -checking
fee on every building. The plans are the same and I am
sure you will be making only one examination of the plan.

I have reviewed the plans for the above named proposed construction.

Previously this office had spent a considerable amount of time on the
structural review of this building complex as to fire protection and
separation.
It appears that on the rear elevations there will be some brick work
in excess of the 20 feet allowed in Chapter 29 of UBC.
Hydrant spacing is very difficult for this complex therefore requiring
longer than usual hand laid lines. Wet standpipes are required in all
units including fire department connections.
The plans as submitted are approved,

November 18, 1970
We ask for a waiver from the old Minneapolis Plumbing
Code, Section 132, to the new Minnesota State Plumbing
Code, Section 123, in regard to materials.
The City of Minneapolis adopted the new Minnesota
State Plumbing Code, the week of October 1, 1970.
We are building two 59 -unit apartment buildings at
79th & E. River Road. We would like to use the new
plastic on waste and vent as written in the new Minnesota
State Code as adopted by the City of Minneapolis.

I did not hear any.response from Nasim, relative to my correspondence
to him of February 9, 1971, of which I sent you a copy and so I called
him the morning of February 22, 1971.
Nasim then indicated that he would present the matter to the Council
on the hearing of March 1, 1971.
I will be out of town on that date, so no representative of Five Sands
Development will be appearing.

However, Nasim indicated that he would provide the Council with a copy
of my letter uneer date of February 9, 1971. I indicated surprise to
Mr. Nasim that this matter would be directed to the Council, because
thera is no official Council action whatsoever at the moment that would
restrict our use of 79th Way and, therefore, it seems to me to be purely
a mistake in issuing the building permit.
I have previously discussed the matter with Mr. Darrel Clark of the
Engineering Department and Mr. Clark confirmed with me that he had ex-
amined all of the Planning Commission Meeting Minutes and all of the
Council Minutes in connection with the rezoning of this property, and
could find no official action which would restrict our use of 79th.
As 79th is a state aid road and is proposed to cut through, in the future,
to University Avenue we, as the developers, cannot tolerate a situation
whereby the City of Fridley would restrict our use of this public road.
Further, it is our position that there is no legal authority for the
City Council to restrict our use of a state aid road.
I belive my letter of February 9, 1971 is fairly self-explanatory but I
am also sending you this letter because I assume that you will be at the
Council and the Council will request your legal opinion in connection with
this matter.

I know you are familiar with this matter because you and I have met and
discussed the matter personally.
I am indeed sorry that I cannot be at the March 1, 1971 meeting, but I
believe that these letters and the background material sufficiently ex-
plains the matter so that my presence is unnecessary.
However, I will be very pleased to meet with yourself and the Engineering
Department and the members of the Council, either formally or informally
at any time whatsoever, to discuss this matter.
We are finding it very difficult to carry on with the financing of this
project under FHA insured mortgages when our use of state aid roads is
restricted.
The whole thing is turning into a mountain out of a molehill, because
I believe it all started out with a mistake in issuing the building per-
mit for the second building, which mistake we must now correct.
If you have any questions about this correspondence or if you would like
to meet on the matter prior to March 1, 1971, I will be available for
any meetings all of this week.

THE HONORABLE CITY COUNCIL
Gentlemen:
Supplementing the attached correspondence relative to the problem that
Five Sands Development has now encountered with respect to the use of
79th Avenue, our position from a legal point of view is outlined as
follows:
That 79th Way is a state aid public highway set up under Article 16
of the Minnesota Constitution.
That Minnesota Statute 160.18 reads as follows:
(Subdivision 3) "The owner or occupant of property abutting
upon a public highway, having a right of -direct private ac-
cess thereto, may provide such other or additional means of
ingress from and egress to the highway as will facilitate the
efficient use of the property for a particular lawful purpose,
subject to reasonable regulation by and permit from the road
authority as is necessary to prevent interference with the
construction, maintenance and safe use of the highway and its
appurtenances and the public use thereof".
The "road authority" mentioned in this Section, is the Anoka County Board
as defined in Minnesota Statute 160.02, Subdivision 9.
The Five Sands Development premises adjoining 79th Way Northeast was re-
zoned to multiple dwelling by the City Council on July 7, 1969 (Ordinance
No. 424, published July 16, 1969).
Therefore, the permitted use on this property is apartment complexes. The
above stated statute specifically says that the owner has a right to
direct private access to a public street.
If there is to be any reasonable regulation, it is to be by a County
Board on a state aid road and not a City Council.

Accordingly, it is our position that under State Statute, the City Governing
Body has no authority to restrict our use of a state aid public road. I
trust, therefore, that the building permit for building no. 2 will be
properly amended and that no further building permits will have this re-
strictive language in them so that we can proceed with our anticipated
use of the premises without further difficulty or proceedings.
Therefore, thanking the City Council for its cooperation and attention
to this matter, I am,

him first.

We have no objection whatsoever to granting the City of Fridley the ease-
ment as prepared.
However, we do not want to execute officially any easement grants until
after the permanent mortgages are closed on the property.
Doing otherwise would mix up the title because the mortgage companies have
already approved the title and we would then have to go through a lot of
explaining, etc., and diagrams, etc., in connection with any new easements
that we create.
The permanent mortgages will be completed sometime in the year 1971 and
we will sign the Deed in 1972 and mail it to you for recording.
In the interim, please consider this correspondence authority to proceed
to construct Lincoln Street as set forth in the diagram which you sent us.

now part of the code and include the following:

3 - Smoke and draft stops are required on all doors

I still have no plans on,the pool. The owner is letting any con-
tracts on the pool, and the architect has no involvement in the pool
except to provide the space in his puns. Please watch for these
pool plans for me.

Please note that we recommend reduction of cover under the
72" storm sewer to allow better surface drainage of our
project.
We also recommend a man hole in the storm service line to
receive our 12" line from the catch basin.
We recommend a catch basin grate in the top of the man hole
to receive surface run-off coming from the area primarily
between the garages and the railroad tracking.
We have revised our invert elevations of the other two storm
sewers to conform to the new ditch grade.
If it appears to either you or Nasim that our engineering
plans and those of the City are not in coordination in any
respect in this regard, would you please call me.

Ve have reviewed your drainage plan and recommendations as dated
January 24, 1972, :3ud w149I, to submit the follmying comments in regard to
your proposed drainage outlets.
We concur in your recommendation of reducing the cover on the 72" storm
sewer. '-he cover will be graded in the field to provide overland dra..nage
of the trackage and your southern area.
We do not, However, feel that a manhole is necessazy at the junction of
your 12" RCP with our 721' line. Our experience has shown that, with
lines of 4' diameter or larger, this connection can be made by cutting
an opening in the pipe and grouting the connection in place.
We concur in the 'location and grades of your other two storm sewers, but
recommend that bends of at least 450 be added mead of the outlet to
direct floe along the ditch bottom. We also feel that, since the grade
on these pipes; is very steep, energy dissipators be added to minimize
ditch erosion.
Should you have any questions regarding our above comments, please feel

I trust that this information shall complete your file with respect to the
performance bonds and that these surety bonds can now be released.
If you need any more information prior to the release of the surety bonds,
please advise.
With respect to the 5th building, I would anticipate applying for a Building
Permit in approximately two weeks.
The 5th building will be, in all major respects, the same as the other
four buildings. We have found that we consistently improve on the interior
design and decorating of each building as we get experience from our tenants
and from building the past buildings. Also we, of course, are redrawing
the building so as to make same conform with the new state code and new
FHA regulations relative to certain units for the disabled.
With respect to the location of the 5th building, we have made some rather
exhaustive engineering studies and soil borings in the area and have con-
cluded that the best position for this 5th building is as far north and
as far easterly as possible to keep the building away from the creek and
the organic material adjoining the creek.
At any rate, when I come in with the new plans and specifications and ap-
ply for the building permit, we can discuss this matter further.
With respect to the birm on 79th, east of the garages and south of the
Jacabson residence, it is my understanding that Mr. Jacabson will be sat-
isfied with an alternative, being a three foot high fence which will sheild
the headlights from his residence.
We have looked at the pros and cons of the birm -vs- the fence and have
decided that a bank, created by the birm, would be difficult to hold and
would also result in the necessity of a tremendous amount of sod being
torn up, together with the removal of the Russian Olive trees which we
have just recently planted. I will, therefore, be getting in touch with
Mr. Jacabson in the next week or so and will then proceed t uild as
soon as possible any type of a fence which will satisf r. Jac bson
this regard.

SUBJECT: Review of Federal Housing Administration Applications
The Metropolitan Council is required by federal law and regulations to review
certain speQified applications for federal loans, grants, or other assistance.
One of the many types of applications which the Council reviews is Federal
Housing Administration (FHA}Form 2013, Application --Project Mortgage
Insurance. This application is submitted to the local Federal Housing Adminis-
tration office by a developer as a preliminary step in securing Federal Housing
Administration insured financing for new multi -family housing.
Such applications are forwarded to the Council by the Federal Housing Adminis-
tration for comment concerning:
1) "...the consistency of the proposed project with ... area
wide development plans."
2) "identification of major environmental concerns.
The Council must complete such a review and return it to the Federal Housing
Administration office within 15 days. The ultimate purpose of this particular
notification and review process is to encourage the coordination of federal and
federally assisted housing programs with regional planning to facilitate
orderly growth of local areas.
It is the Council's intention to forward a copy of each of these applications to
the municipality in which the project is to be built in order to notify it that
such a review is taking place and to invite questions or comments . These will
be incorporated into the review and relayed to FHA. Since the permitted re-

This letter will serve to confirm our conversation of the morning of
January 4, 1973, to the following effect.
That with respect to a proposed plat of Meadow Run 1st Addition, I am en-
closing a proposed plat reflecting a drainage and utility easement on the
Southerly sides of proposed Lots 3 and 4 and the Westerly side of Lot 4
and 1.
That I will have our engineers revise the proposed plat to eliminate the
drainage and utility easements shown thereon, with the exception of a presently
existing 15 foot drainage easement along the southerly end of proposed Lots
3 and 4.
That I will then prepare an easement grant running in favor of the City of
Fridley, under the land contained within the boundaries of the drainage and
utility easements shown on the enclosed proposed plat.
That essentially this will be an easement grant to the City of Fridley to
enter upon this land for the purposes of construction of any underground
conduit for the passage of water; together with maintenance and repair of
the conduit, etc.
The agreement, of course, will also have to contain the usual language to
the effect that the use of this easement by the City of Fridley will not in
any way impair our use of the property, particularly the parking lot on Lot
4. Also, the agreement will necessarily have to provide that in the event
that such an underground system is constructed, that Fridley will restore
any parking areas and other improvements, etc.
At any rate, Iwill draw such a proposed agreement as soon as possible and
then submit it to yourself and Virgil for approval.

Description of Municipality
Fridley is a fairly developed municipality of southern Anoka County
that experienced significant population growth and development during
the 1960-70 decade. Although the majority of its housing units are
single family detached, multiple dwelling units do account for roughly
a quarter of all Fridley's units . Both the average value of single
family homes in Fridley ($25, 430) and the average monthly rent ($154)
are slightly above that of the total Metropolitan Area.
Less than 7 % of its housing is affordable by persons of low and moderate
incomes, and there are to date only eight subsidized housing units in
the City.
C. Site
Size of site: approximately 3 acres
Location within municipality: SE corner of 79th Street and East River
Road in the northwest section of Fridloy
Surrounding land uses:
North and east Other multi --family dwellings, the first stages
of the larger development

Compatibility with municipal comprehensive plan: The project is
consistent with the proposed community plan.
Zoning: The site is properly zoned for the development.
General neighborhood charateristics: The area is primarily residential.
Environmental impact: No negative environmental impact is foreseen.
Site design: Site plans were not submitted.
D. Relationship of Services to Site
Utilities: Public sewer and wate.r service are available to the site.
Fridley has submitted a comprehensive sewer plan and the project
appears to be compatible with it.
Transportation: Bus service runs along East River Road, adjacent to the
project site; access to two major highways and one interstate is
within four miles to the north, east and south. Transportation
service both public and private, is therefore adequate.
Parks: A small neighborhood park is less than two blocks away;
several other parks are within walking distance. The developer
has also indicated that to the rear of each building will be a
court equipped with playground facilities. The site is therefore
adequately provided with park facilities.
Major Metropolitan Centers. Brookdale and Apache Plaza are approximately
three miles from the site, and are readily accessible to prospective
project residents.
Convenience Shopping: Two small shopping areas are within a mile of
the site, and are therefore not as accessible as would ordinarily
be desirable.
Schools: An elementary school is one mile south on East River Road.
The junior and senior high schools for District #14 are about
four miles away. None are, therefore, within walking distance
of the -project.
Day Care: The..developer stated that day care may be provided with the
project if it can be determined that there is a market for such
a service.
Health Facilities: Unity Hospital and at lust one physician group are
within throe miles of the site and are therefore within good proximity
of the project site.
Community Space: Each building within the Five Sands development will
have a playroom, and one building will have an indoor pool,
2 saunas, game room, etc. , for adults and children.
Access to Employm :nt: Eriployrnent opportunities are located in Brookdale
and Apache Plaza; the site is about six miles from the employment
cone :ntration at the int„rsection of Highway 10 and 35W; it is about
eight miles from downtown Minneapolis.

E. Status of Project
Project plans are in final stages. They have been approved by the
Fridley City Council. A building permit has been granted.
Ii. SUMMARY
The subject application proposes the final phase. of a three hundred unit
multi -family development located in northwestern Fridley. While the project
will not offer new opportunities for lower income persons in this suburban
community, it will contribute to further diversifying Fridley's existing housing
stock which is primarily single-family. The Council reviewed an earlier
phase of the total development in August of 1971 (see Comments and Recom-
mendations of the Council, HUD Housing Referral, Council File No. 852)
and found it to be generally in conformance with area -wide policies, As
in the case of the earlier phase, the Council was satisfied that this proposed
addition is well -located with respect to most services and facilities normally
desired or required by a residential development of this type. As such, the
project is consistent with Council policies calling for coordination of resi-
dential development with the provision of those services.
Site plans for the project were not submitted. We would, therefore, request
review of these plans by the insuring office in order to guarantee the sound-
ness of both site and architectural planning of this phase. The project
appears to involve no environmental problems.
III. RECOMMENDATION
The project appears to involve no major conflicts with area -wide development
plans and goals.

Dear Sir:
I have discussed your question regarding kitchen vent hoods with
Mr. Clark and Mr. Belish as to whether or not we could make a definite
statement as to the merits of the two types.
There are of course advantages to each as well as disadvantages.
The direct venting types does of course provide changing air whereas
the self filtering type doesn't.
Maintenance on either type presents a problem to the tenant.
As a fireman I see a definite disadvantage in the direct venting type
unit in that it is often necessary to breach fire rated walls, ceil-
ings, etc., to provide outside exhaust, thereby allowing for easier
communication of fire. It has also been my experience to note build up
of grease in some of the longer runs. This further complicates the
fire picture.
My own preference in a multiple type occupancy would be to the non -
vented type, but this of course is only my opinion. With proper
installation and maintenace both types perform equally well, improperly
installed and maintained they both present problems.

I am in receipt of your letter of October 14, 1981 asking for
clarification of the City's intentions regarding Meadow Run
Apartments.
The City Council has directed staff to survey all commercial,
industrial, and multiple -family residential properties in Fridley to
assess the extent of compliance to the Zoning Code and to ensure
adequate compliance to this code. Pursuant to this directive, an
inspection was made of the Meadow Run Apartments on June 30, 1981.
It was noted that Section 205.076.1 - landscaping, sections 205.078.2
and 205.078.5 - screenings were deficient (see endorsed copy of
Code). A letter was sent on July 14, 1981 notifying the owners of
the deficiency and our intentions (see enclosed letter).
From consequent discussions with Sally Schoch, a landscape/screening
plan was devised which would satisfy our requirements of screening
and landscaping. This land is Zoned R-3 and falls under all the
stipulations and requirements of that district classification.
Many properties along East River Road specifically and throughout
Fridley have been contacted regarding zoning code deficiencies and I
have been working closely with them to bring them into adequate
compliance of the code within a reasonable period of time.
