Fridley Minnesota 55432 ATT: Engineering Department Nasim Dear Nasim: April 16, 1973 Subject:`, eadow Run Apartments I paid approximately $20,000.00 in special assessments on this land last year and was of the impression that all special assessments had been paid in full. Now in connection with starting the 4th building, I ordered a Title Policy which disclosed that there was a pending storm sewer project 101, special assessment in the approximate cost of $39,481.84 and a storm sewer project No. 102 special assessment in the amount of $51,729.46. With respect to 102, I wrote a letter to the City Council on August 28, 1972, and I am enclosing a xerox copy of that letter. I believe that in order to assess our land, the City must be prepared to prove that there is a specific and direct benefit to our land resulting from these projects. My engineering studies indicate that in no way whatsoever do either one of these projects benefit our land in any way. I think you can understand, therefore, that I am not going to entertain paying special assessments of some $90,000.00, or more. Our land is draining very adequately to the creek and all surface water running upon our land from adjacent land drains adequately as far as we are concerned and as far as our engineers are concerned, without Project 101 and 102. Other than the notice of the special assessment h--arings which resulted in my written objection of August 28, 1972, I have received no written communi- cation or verbal communication whatsoever to the effect that our land would be subject to any assessment. CITY OF FRIDLEY - 2 - April 16, 1973 Prior to the hearing on 102, I specifically discussed 102 with Councilman Mittlestad. Mr. Mittlestad explained to me that it was his impression that my land would not be assessed for 102. The purpose of this letter, therefore, is to respectfully request that if the City is taking the position that it can charge me over $90,000.00 in special assessments, it would seem reasonable that you provide me with some specific reasoning for this kind of a bill. I am entitled to know the exact cost of Project 101 and 102; the exact and specific description of what these projects entail; an exact and specific description as to the land area which the City claims is benefited; a specific description as to why our land is benefited. When I have received this information, I will correlate it with the engineering data that we have on our project and then hopefully we could have a meeting and discuss the matter further. We have no objection to the proposed installation of this improvement. It should be noted as a matter of record, however, that with respect to assessment therefore, our engineer has advised us that our land No Way would benefit from the installation of this system. Land improvements, (eg, houses etc.) have been fairly stable and complete in this area, we believe, for several years and vie do not note -any surface drainage problems on our land, which vie cannot take care of very adequately without the aid of the 102 proposed project. Therefore, our experience and familiarity with our land and the adjacent land leads us to concur with the recomendations of our engineer.
