Dear Sir:
On the 13th day of November, 1970, Fridley issued its Building Permit
No. 10894 to Five Sands Development for the 59 unit structure which we
are building at 7875 East River Road.
One of the stipulations contained in this building permit is as follows:
"Exit and entry for Phase II on 79th at Lincoln Street only".
Therefore, this building permit is forbidding us to use over 500 feet
of frontage road adjoining this property for ingress and egress.
You will find absolutely nothing of an official action in any of the
Minutes of any of the Municipal Boards concerning this matter.

It is my contention that the City of Fridley is completely without any
legal right whatsoever to restrict our use of this public road. This
is, of course, why I appeared at the recent Council Meeting and objected
to the improvement of 79th. It would indeed be paradoxical if Five Sands
would have to pay to improve 79th, with such language in the building
permits.
I was unaware of the language in the permit until recently when it was
pointed out to me by the FHA lawyers from Chicago, when we were closing
the mortgage on this building.
I am sure you can realize the inconvenience, confusion, and legal red
tape which has resulted from a situation where we are trying to build
apartment buildings under Federal Housing Authority financing and we
have to show the FHA officials stipulations in building permits forbidding
us to use public roads. Indeed, this matter was difficult to explain.
At any rate, I would appreciate it very much if you would review this
situation and then either issue an amended building permit eliminating
this stipulation from the building permit or, in the alternative, send
me written correspondence specifically referring to this building permit
and specifically eliminating this language.

Initially, and from a practical point of view, we will probably be using
Lincoln Street as the only ingress and egress, for an undetermined length
of time.
We, however, recognize that 79th is a state aid road and in the future,
79th will be cut through to University. We, therefore, obviously do not
want to preclude our ability to use 79th at other areas than Lincoln Street.

the restricted use of 79th Way N.E.
On March 19 1971, the City Council of Fridley considered your request
for removal of Stipulation #1 (Exit & entry for Phase II on 79th Way at
Lincoln Street only.) which restricted the use of 79th Way I1.E. for Phase II
building of Five Sands Development except at Lincoln Street. They authorized
the deletion of this stipulation from the Building Permit #10,894 for Phase II
building of Five Sands Development.
A copy of the amended Building Permit is attached herewith for your files.
I hope you will find this satisfactory. If you need any additional

This correspondence will confirm the meeting held this day between the
undersigned; yourself; Nasim and Bob Aldridge.
1. That we will proceed to complete all items of a safety or
health nature in the subject property by no later than
12 o'clock noon on Friday, September 3, 1971.
2. We request an inspector of this building to determine com-
pliance with Item No. l the afternoon of Friday, September
3, 1971.
3. The "no occupancy" signs posted on the building the morning
of August 31, 1971, shall remain posted until we obtain a
temporary occupancy permit.
4. That we anticipate moving no more than 11 families into the
property on or about September 1, 1971.
5. That the City of Fridley does not consent to any occupancy
prior to the issuance of a temporary occupancy permit.
Notwithstanding, the City will not hold the undersigned
in violation thereof assuming a temporary occupancy permit
issues the afternoon of Friday, September 3, 1971.
6. That there shall be no more than 11 families moving in the
premises for the month of September.
7. Complete plumbing and heat tests shall be completed no
later than September 25, 1971.

8. That upon completion by the undersigned of health and safety
features and construction, a temporary occupancy permit shall
issue.

I am enclosing a table showing several method's of reducing
the clearance from the 36" required. Please note the foot-
notes to the table.
As to allowing the flue to pass thru the floor -ceiling to
help heat the second floor, it would not be permissable
to use a single wall pipe as a vent -connector (from wood -
burning device to the chimney) to pass thru any floor or
ceiling. A Class "A" metal chimney may do so, but then
you would not be gaining much heat from the chimney.
If you have further questions we would suggest you contact
your local city Building Inspector, or local Fire Marshall.
They should be in a position to advise you of proper methods
and materials.
