Subject: Request by Meridian Corporation for Variances
The undersigned is the attorney for, general partner of and developer of
the Meadow Run Apartments adjoining the premises in question.
Please be advised that Five Sands Development Company does object to the
granting of any of these variances.
I will be at the meeting at 7:30 P. M. on Tuesday, May 13, 1975, to more
clearly express our position in that regard.
The setback requirements in the instant case are not only for asthetic
purpose but for safety purposes. Reducing the setback on 79th or along
East River Road would impair vision and increase the likelihood of auto-
mobile or pedestrian mishaps.
I personally believe that variances are not in order unless the petitioner
can show a high degree of hardship or, in the alternative, a very unusual
sized lot or, in the alternative, a very peculiar purpose suited to pub-
lic needs. I do not believe that the subject fits into any of these
categories. Certainly if the proposed building is being built for "specu-
lation", it would be difficult to imagine the kind of hardship which would
support the granting of any variances whatsoever.

7899 East River Road N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.103, 4, A2 (Paragraphs 1, 2 and 3) requiring an 80 foot
setback from the main structure to any public right of way.
Public purpose served is to provide for adequate parking and open
landscaped areas as well as to congestion and provide adequate site
clearances in commercial areas.
Section 205.103, 4, B, requiring a side yard setback of 15 feet from
a common property line.
Public purpose served is to provide for adequate open areas around
structures and clear access for fire fighting and to reduce the
conflagration of fire.
Section 205.104, 1, E, prohibiting parking in commercial areas within
any portion of the required 20 foot front yard.
Public purpose served is to limit visual encroachment into neighborhing
sight lines and to allow for aesthetically pleasing open areas adjacent
to public right of ways.
Section 205.103, 4, C,2 requiring a rear yard setback of 25 feet.
Public purpose served is to provide adequate access for fire fighting
and again to limit threats from conflagration of fire.
Section 205.103, 6B, requiring a minimum set back of 50 feet from a
common boundary line of neighborhing property which is zoned other
than commercial.
Public purpose served is to provide adequate open "buffer" areas between
zoning districts for aesthetic and development reasons.
B. STATED HARDSHIP:
Due to street setback requirements on three sides, the building area
available is only about 4% (1,825 swuare feet) of the total site area of
about 42,226 square feet. This an extremely low coverage figure. In addition,
the angled geometry of the property makes for an unusual configuation if the site
is to be utilitzed properly or to its even small building maximum. We hereby
apply for a variance to build to the size and configuation show on the enclosed
drawing.
C. ADMINISTRATIVE STAFF REVIEW
The property in question was zoned as R-3 when the original zoning ordinance
was adopted in 1956. In 1960 it was rezoned to C-2S'(general shopping areas).
Several subsequent proposals, including a filling stateion, were submitted and
either denied or withdrawn. A similar request to this one, was approved by the
Administrative Staff Review of 7899 East River Road N.E.

Board of Appeals on May 13, 1975. It was approved by the City Council as well.
Because no further action was taken and no building permit issued, the approved
variances have lapsed.
The unusaly circumstances of this corner property being bounded on three
of four sides by public right of way extremely limits the available building
area. The proposed building of 7,008 square feet (compared to 5,200 square
feet in the Meridian Corporation request in 1975) will apparently house a
7-11 Store with the remainder as office space. (The 1975 request included
a coin operated laundry). The building will cover approximately 17% of
the lot. No plans are on file for the original 1975 request.
A list of the stipulations which Council imposed on the 1975 request
by Meridian Corporation have been included as a reference. Please note
that the request for the petitioner to petition Council for a rezoning
from C -2S (general shopping areas) to C-1 (local shopping areas) would
reduce the setback requirments from 80 feet to 35 feet off 79th Avenue
and East River Road.
A Bond, covering the costs of all stipulated improvements, will be
required. In addition, all necessary and proper right of ways, easements
and letters of encroachment should be submitted and recorded prior to the issuance
of any building permits.

Mr. Walter IC1us, owner of Riverboat Shopping Center, came before the City
Council on March 7, 1988, to appeal the Council's decision on the Center's
Comprehensive Sign Plan. This decision approved the plan with two
stipulations. The first was that the readerboard be deleted from the sign
plan because it is considered a temporary and not a permanent sign. The
second stipulation stated that future sign permit approval be based on the
implementation of the landscape plan. Council decided that the landscape
stipulation should be deleted as a part of the approved plan since it had no
relevance to signage. Council also decided that Mr. Klus must comply with the
Sign Ordinance regulations by removing the permanently installed readerboard.
Staff has worked with Mr. Klus for the past three weeks on completing these
items.

for a comprehensive sign plan for the Riverboat Shopping Center with the

1. The deletion of the words "plus the detached separate reader -board sign"
under Item A-1 of the sign specifications and entirely delete Item A-2 of
the sign specifications.

On March 28, 1988 the Fridley City Council officially approved a
comprehensive sign plan for Riverboat Shopping Center at 7899 East River Road
N.E. with the following stipulation:
L The deletion of the words "plus the detached separate reader -board sign"
under Item A-1 of the sign specifications and entirely delete Item A-2 of
the sign specifications.
If you have any further questions regarding the above action, please call the
Planning Department at 571-3450.
