Scott Hickok, Community Development Director, said at the August 14, 2017, City Council meeting, Council opened the public hearing discussion on this item. After a brief discussion, Council expressed concern over lack of public discussion over potential development concepts offered by the private developer and continued the public hearing. Since that time, staff has continued to work with the developer, has held a neighborhood meeting, and has gathered input from those in attendance at the public meeting. From that input, the developer has prepared a plan that works to address the concerns of those who have spoken on this project. In an early analysis, staff would concur that concerns are being met, but staff has not had an opportunity to present the plan to the Anoka County_Parks staff or to the general public. The plan shows modification to the area east of the patio homes on the Locke Park side of the line of the park boundary. This modification would be for a new park/play area. Coordination with the County Parks staff and further communication with our engaged citizens, would be key to the success of this or other plans that include Locke Park land as part of the solution. Mr. Hickok said staff recommends that Council continue the public hearing until November 13, 2017, to assure that communication with the Anoka County Park staff can occur and feedback can be given. Councilmember Barnette said he received a telephone call questioning how the City could sell property to a developer without going to an election or vote. Mr. Hickok replied what it all comes down to is how the City acquired the property for a park. This property for the park was purchased, and not received through any type of dedication or land that was forfeited where the City would be committed to doing something with it. There has been a lot of thought in development for exchange of the open space and there will be a parklike feature created around the water feature. Councilmember Barnette asked who the City purchased the land from for this park. Mr. Hickok replied that this land was not acquired through means with any strings attached. Usually parks are acquired through dedication or tax forfeiture. This land was available and the City purchased it. Councilmember Barnette said he thought that the property was owned by Ernie Madsen and the City was to develop property like that for a section of parks. Mr. Hickok said this land was not dedicated, and the park existed before the neighborhood came about. MOTION by Councilmember Saefke to continue the public hearing until November 13, 2017. Consider Special Assessments for Street Improvement Project No. ST2017-01. MOTION by Councilmember Bolkcom to open the public hearing. Seconded by Councilmember Saefke. Shelly Peterson, Finance Director, said this special assessment pertains to the rehabilitation of City streets as part of the City's street resurfacing plan. Proposed special assessments for this project are established in conformance with the City's Special Assessment Policy. The 2017 Street Improvement Project includes the North Park Neighborhood, bordered by Matterhorn Drive to the east, Old Central/Highway 65 to the west, Hathaway Lane to the north and I-694 to the south. Ms. Peterson said residents and commercial owners received a mailing prior to the project moving forward. Property owners were invited to a project workshop held on November 1, 2016. A public hearing on this improvement project was held on January 23, 2017. One hundred sixty-one residential (LDR) and commercial (NLDR) properties are subject to this assessment. The proposed special assessments are calculated in accordance with the City's policy, and pay for portions of the street rehabilitation only (curbing and utilities are excluded). Each single family residential (LDR)property is proposed to have an assessment of$1,866.26. Ms. Peterson stated the proposed residential special assessments for the project compare favorably with the projected special assessments. Single family residential projections were $2,150 at the time of the open house, $1,950 at the time of contract award and the proposed assessment is $1,866.25 (-13% lower than initial projections). Ms. Peterson said minor elements of the project are yet to be completed, including reinstalling street signs, spot repair of saw and seal joints, installation of hydrant hardware and future warranty repairs if applicable. There is a 10-year assessment payback period and payments are subject to a 6% interest rate. Written or oral objections will be considered at this public hearing. No appeal may be taken as to the amount of the assessment unless a signed, written objection is filed with the City Clerk prior to the hearing or is presented to the presiding officer at this hearing. Ms. Peterson said property owners have until the close of business on November 22 to pay all or at least half of the assessment interest free. After November 22, interest will be charged on the remaining balance. The assessment is due annually to the County in November for collection on 4 FRIDLEY CITY COUNCIL MEETING OF OCTOBER 9,2017 PAGE 5 the next year's real estate taxes. The remaining balance of the principal may be paid to the City by November 15 each calendar year to cancel all future installments. Staff recommends the public hearing be opened for public comment. The resolution adopting the special assessment is under new business. Councilmember Bolkcom asked what attributed to the decrease in the assessment. Jim Kosluchar, Public Works Director, replied his excellent staff. They have not received any objections to the assessment. Councilmember Saefke asked if the work by the contractor was satisfactory. Mr. Kosluchar replied they performed very well, and the punch list of items is very minor. MOTION by Councilmember Saefke to close the public hearing. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7:35 P.M. 7. Consider the Assessments for the 2017 Nuisance Abatement. MOTION by Councilmember Bolkcom to open the public hearing. Seconded by Councilmember Saefke. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT 7:36 P.M. Shelly Peterson, Finance Director, said this is the annual assessment for those properties where continuing code violations existed and the City expended resources to bring the properties into compliance. There are 32 properties involved in this assessment. The total amount of the assessment will be $18,998.13, and the assessment will be for one year at 6 Y2%interest. Written or oral objection will be considered at this public hearing. No appeal may be taken as to the amount of the assessment unless a signed, written objection is filed with the City Clerk prior to the hearing or is presented to the presiding officer at this hearing. Staff has not received any correspondence contesting to the proposed assessment. Ms. Peterson said property owners have until the close of business on November 22 to pay all or at least half of the assessment interest free. After November 22, interest will be charged on the remaining balance. Any remaining principal along with interest from the date of Council adoption of the resolution through December 31, 2018, will be collected with the next year's real-estate taxes. Staff recommends the public hearing be opened for public comment. 5 FRIDLEY CITY COUNCIL MEETING OF OCTOBER 9,2017 PAGE 6 Felecia Jappah, 124 Pilot Avenue NE, said she sent a written objection email to Deb Skogen. She acquired this property in April of 2017 and she did not receive notice of the nuisance. She did not think it was fair. She was not aware the City kept mowing her property, as it is a rental. Amy Kempf, Neighborhood Preservation Specialist, apologized for the miscommunication. She said if rental tenants do not mow the rental property, it is put on a mowing cycle with the City until they are notified to stop. She shared the timeline of experience with the property. She said on July 5, 2017, she was in the neighborhood for an inspection and noticed the long grass. Laura Spencer, Rental License Inspector, also wrote about the long grass in a report. A letter was sent to the property about the long grass and it was returned on July 12. A second inspection happened on July 20 and the property was put on a mowing list to be mowed every two weeks. Invoices were sent by the City mowing contractor on the 21St. During the week of July 28, the rental inspector called Felicia to let her know what was going on. The mailing from the property was returned marked "vacant" with no forwarding address to send the information. On September 4 the contractor was scheduled to mow, and the property was already mowed. Ms. Jappah called on September 7, came in on September 8, and after that, staff emailed the contactor for this property and told them to remove the property from the mowing list. This was the only time the lawn was mowed and there has been no interaction with residents anytime since July 5. Mayor Lund asked why the property was not mowed. Ms. Jappah replied if the property had not been mowed from April to July it would be a forest. It was mowed during that time. Mayor Lund asked why she stopped mowing. Ms. Jappah replied that she did mow the lawn from April to July. After that, she would come to the property for a monthly inspection and did not see the code violation. In July, she made arrangements for someone to mow but because of unforeseen circumstances, they were not able to mow. Since August 1, the tenant has mowed the lawn. She said she was being charged to mow when the lawn was already mowed. Mayor Lund said the outside contractor was not lying about the mowing and charging the City for things they did not do. The contractor mowed, and the tenant lied to her. If Ms. Jappah cared about this property, it would have been mowed, and the City would not have been involved. • Ms. Jappah said she was willing to make the July mowing payments but the August charges are not fair charges. The contractor did not mow, as she was constantly there. Ms. Kempf said the September 4 mowing would be removed from the charges and only the trip charge would be billed. Mayor Lund noted that once properties are on the mowing cycle, they continue to mow until it is taken off. Someone was not mowing the property as it should have been. Ms. Jappah has been negligent in taking care of the property. 6 FRIDLEY CITY COUNCIL MEETING OF OCTOBER 9,2017 PAGE 7 Councilmember Bolkcom asked staff to review the timeline again. Scott Hickok, Community Development Director, replied that in this case Laura Spencer, Rental License Inspector, noted tall grass and that was given to the property owner. Councilmember Bolkcom noted that after the conversation about high grass on July 5, the tall grass should have been taken care of in a certain amount of time. The property owner knew about this but it was not taken care of, and the contractor started mowing on July 31. Mr. Hickok said that all it takes is a phone call, but several weeks later the lawn was still not mowed. Councilmember Bolkcom said the lawn was mowed again on the 7th because no one told us to stop mowing. It was mowed again on the 21St and on the 28th the Rental Housing Manager, Pat Wolfe, called to discuss this property and that it was still on the list. Ms. Jappah replied that Laura Spencer said the laundry list of things needed to be done by July 30, which included mowing the lawn. She passed inspection on July 30 because the lawn was mowed by the contractor and she did not get any notification from the City. Councilmember Bolkcom noted that Ms. Jappah knew the City mowed the lawn. She should have called the City to stop. Ms. Jappah replied that she did not know how to stop the mowing and thought the tenant was mowing the lawn. Councilmember Bolkcom said that once the City mows the lawn, they do not wait until it gets 10" long again, they put it on a two-week mowing cycle. The only way to stop is if the owner calls the City. Mayor Lund said the property owner failed to mow the property in a timely manner. It is not up to the taxpayers to foot this bill. He is okay with staff taking off the last charge. MOTION by Councilmember Bolkcom to move into record the letter from Felicia Jappah. Seconded by Councilmember Barnette. Motion to Approve the Release of the Request for Proposal for Residential Organic Material Collection Service. Rachel Workin, Environmental Planner, said organic material includes fruit and vegetable scraps, meat and bones, paper towels, and compostable paper products and flatware. Produce compost has economical and ecological benefits. It saves landfill space and disposal cost. The statewide goal is to have 75% diversion of recycling and organics by 2030. This was formally adopted in the 2016-2036 Solid Waste Management Policy Plan and will necessitate new programs. Ms. Workin said organics recycling is currently being done at the SNC and the schools. Backyard composting allows for limited materials but takes time, requires a good location and there are physical requirements. Neighboring city and county drop-offs are available. Ten residents have signed up for the Spring Lake Park drop-off, thirty-three residents for the Columbia Heights drop-off, and one hundred nine residents for the Bunker Hills drop-off. Sixty- nine percent of the ninety respondents are interested in the curbside organics recycling program. Ms. Workin said Chapter 113 of the City Code was updated in 2016 to have one contract, one hauler and one license. Dwelling units would be 1-4 and participation would be voluntary. Funds from the Anoka County SCORE were received in 2017. The RFP for collection service would be administered by one hauler. The service would last through April 30, 2019, with an opportunity to renew two times. Ms. Workin reviewed the next steps of having a signed contract by year-end with the approval to release the RFP October 9, have it due November 6, and present it at the Council conference meeting on November 27. 8 FRIDLEY CITY COUNCIL MEETING OF OCTOBER 9,2017 PAGE 9 Councilmember Bolkcom asked who the hauler was for the schools' organics. Ms. Workin replied that the schools contract with their own haulers. There are a few different transfer stations in the Twin Cities and two final processing sites in the south metro. Councilmember Bolkcom asked how big the organic recycle container would be. Ms. Workin replied the hauler would be able to specify the size of the container. They recommend a 32 gallon cart, half the size of the standard recycling container. Organics would be collected in the home in a pail kept in the kitchen lined with a compostable bag from a retailer. The City can do an evaluation of the distribution of bags depending on funding. The resident would bring the bag to the curbside cart provided by the hauler and it would be collected on a weekly basis. Scott Hickok, Community Development Director, recognized Rachel Workin for her success in organizing the recycling event this weekend. He thanked all who participated. It was a good day in spite of the weather. He said they counted 423 cars. Councilmember Bolkcom announced the Pumpkin in the Park event coming on October 21 from 6-10 p.m. at the Nature Center. Tickets can be bought online or by calling the Nature Center. They are $10 at the door and $8 in advance. Jim Kosluchar,Public Works Director, said staff is working on better parking for this event and providing a shuttle bus to make it easier at the end of the event. CenterPoint Energy is requesting a 15 foot wide easement in Commons Park for the purpose of installing a new gas service to the Fridley Middle School. The location of this easement is shown on the attached figure, and the easement documents have been submitted by CenterPoint for execution by the City. The location of the proposed easement has been reviewed by Parks and Utilities staff,and this service does not create any problems for the Park.The Easement documents have been submitted to the City Attorney for comments. Staff recommends that the City Council move to approve the CenterPoint Gas Facilities Easement and execute the easement documents. Attachment 19 2017-014 EASEMENT Torrens/Abstract THIS EASEMENT made , 201 , by and between City of Fridley, a Minnesota Municipal Corporation, situated in he County of Anoka, • State of Minnesota, ("Grantor"), and CenterPoint Energy Resources Corp., a Delaware corporation, doing business in Minnesota as CenterPoint Energy Minnesota Gas, its successors and assigns("Grantee"). 1. Grantor warrants are the owner of that certain real property in Fridley, Anoka County, Minnesota described below and in Document No. T488158.009 Torrens, filed of record in the office of Registrar of Titles and Document No. 1703880 Abstract filed of record in Recorders office, Anoka County, Minnesota, and has the right, without title restriction, to execute and deliver this instrument: Lots 7A and 7B, Block 1 VINEWOOD PARK, according to the recorded plate at Anoka County Recorder office. ("Grantor's Property"). 2. Grantee desires an easement in, under and upon Grantor's Property. Additionally, Grantor agrees not to encroach upon Grantee's Easement by filling, excavating, or erecting buildings or permanent enclosures unless same are pre-approved by Grantee, which approval shall not be unreasonably delayed or withheld. Grantor understands and agrees that Grantee may remove any unapproved encroachments or obstructions Grantor places on Grantee's Easement, at Grantor's expense. 6. Grantor agrees that future utilities of other entities will not be located within Grantee's Easement without Grantee's advance written consent, which consent shall not be unreasonably delayed or withheld. 7. Grantee will exercise due care and diligence to avoid injury or damage to Grantor's non-encroaching buildings, permitted personal property, and permitted landscaping. Grantee indemnifies Grantor from any such damage or loss arising or occurring to such property solely by reason of the operation, maintenance, relocation, replacement, substitution or removal of Grantee's gas facilities. 8. If Grantee discontinues use of its gas facilities, Grantee has the right, but not the duty, to enter upon Grantee's Easement and remove all or any portion of its gas facilities. 9. Grantee may exercise the rights conveyed herein from time to time as may be necessary and convenient, and Grantee's failure to exercise said rights will not limit or extinguish said rights. Grantee's rights can only be extinguished or modified by a written instrument executed by Grantee and filed of record in the county and state aforesaid. 10. Skogen, City Clerk Date: October 10,2017 Re: Acknowledgement of Receipt of Twin Cities Gateway 2018 Fiscal Year Annual Budget Chapter 608 of the Fridley City Code imposes a lodging tax on local lodging properties. The purpose of the tax is to fund a convention and tourism bureau to promote the City as a tourist destination. The City is a member of the Minnesota Metro North Tourism dba Twin Cities Gateway (TCG), a tourism bureau consisting of 9 cities. The Agreement between the City and TCG requires the annual budget be provided to the City on or before October 1st of the year preceding the effective date of the budget. Such budget shall detail the uses to which monies received shall be spent to provide services. The 2018 Fiscal Year(FY) Budget for TCG was approved by the TCG Board of Directors on September 19,2017 and received by Staff on October 4,2017. TCG's projected revenue for FY 2018 is$933,000 which represents growth over the organization's founding five years ago (for comparison, the FY12 revenue was $728,824). The TCG Board of Directors' goal is to maximize marketing and promotional opportunities,while continuing to minimize administrative and overhead expenses. The approved budget for FY 2018 is$1,056,000. In addition to the lodging tax and Explore MN Tourism Grant, the Board will be utilizing$123,000 from the fund reserve. The organization remains strong financially with a projected 2018 year end fund reserve of$486,372. The Board manages the fund reserve to stay within the$500,000 maximum FDIC insurance coverage available. The FY 2018 budget allocates 75%to marketing and promotion and 25%to administrative and overhead expenses. The ratio of marketing expenses is significantly higher than other comparable metropolitan organisations. For 2018,the administrative expenses increased by four percent reflecting the Board approved addition of the Sports Marketing Director to help increase the number of sports-related events to be held in TCG member cities. Attachment 1 is an Executive Summary and approved fiscal year 2018 Budget for Twin Cities Gateway. Staff recommends a motion receiving the Twin Cities Gateway Fiscal Year 2018 Budget. 23 TWIN CITIES GATEWAY Twin Cffies Gateway FY18 Budget Overview Background: This will provide an overview of the FY18 Twin Cities Gateway (TCG) line item budget allocations, as recommended by the TCG Finance Committee and as approved by the Board of Directors at the September 18,2017 board meeting. Twin Cities Gateway operates on a January 1 -December 31 fiscal year. The organization remains in a very strong financial position with a projected 12/31/18, (year-end),fund reserve of$486,372.The TCG Board manages the fund reserve to stay within the$500,000 maximum FDIC insurance coverage available. In accordance with the Board of Directors' goals of not exceeding 25%of the budget for administrative and overhead expenses,the FY18 administrative and overhead expenses for the organization represent 25%of the overall budget and marketing programming is 75%. Note:the organization generates an additional$250,000 in value that is not reported as revenue, but is generated via added-value media, marketing partnerships and co-op programs.This incremental value reduces the allocation ratio to 20%for administration and overhead costs and 80%marketing/promotional programs. Revenue • Lodging Taxes $925,000 Represents the total 3%local option lodging tax receipts, collected from (22) lodging properties located in TCG's member cities of Anoka, Blaine, Coon Rapids, Fridley, Ham Lake, Lino Lakes, Mounds View, New Brighton &Shoreview. Note:lodging tax receipts are projected conservatively, due largely to approximately 10%more new hotel rooms available via new hotel development (2,000+new hotel rooms) that has recently taken place across the metro area • Explore MN Tourism Grant& Investment Income $8,000 Operating Expenditures • Management Contracts $190,000 The Twin Cities Gateway organization does not have paid staff and therefore does not provide actual salaries or benefits, but rather er r etains the services of two 1 24 independent contractors, functioning as the organization's executive director and sports marketing director. This line item covers the contractors'monthly compensation and all day-to-day operating expenditures for the organization, including:office equipment, computer hardware &software, office telephones, office supplies, postage and handling, TCG liability insurance coverage, metro area mileage and vehicle expenses, etc. • Other Administrative Costs $25,000 This line item includes out of metro-area travel expenses to represent TCG by attending sports marketing tradeshows, and tourism industry conferences, as well as TCG Board meeting expenses, preparation of annual Form 990 and federal tax returns, audit expenses, and any performance bonus compensation, if awarded, to the two independent contractors retained by the organization. • Blaine(Fiscal Agent) $15,000 Twin Cities Gateway contracts with the City of Blaine Finance Department to provide all organizational fiscal services. This includes processing and depositing all member city monthly lodging tax receipts;payment of all TCG related invoices;bank account reconciliation and preparation of financial reports. • Organizational Insurance $1,500 Provides Officers and Directors insurance and errors and omissions insurance coverage for the TCG Board of Directors. NOTE:in addition to this coverage, the two independent contractors are required to carry$2 million liability insurance and errors and omissions coverage identifying TCG as an additional insured. • Organizational Memberships $3,000 Memberships in five area chambers of commerce and tourism organizations. • Other $1,000 • Amortization expense of the TCG logo and other miscellaneous expenses. Marketing Expenditures • Website Development/Social Media $55,000 On-going website design enhancements and updating, website analytics, content development and execution,calendar of events maintenance, and all multi-platform and channel social media development and management. 2 25 • Destination Marketing $400,000 All marketing and promotional activities, including print, online, video, and promotional activities to market the Twin Cities Gateway and its nine-member cities as a destination for leisure visitors and travelers. • Promotions/Collateral Materials $25,000 Includes production of the annual TCG regional map of attractions, hotels, parks, golf courses, city halls and other area points of interest and promotional "welcome"banners produced for sporting events/meetings/conferences. • New Venue/Public Facilities Promotion $10,000 Funds made available by Twin Cities Gateway to for marketingand promotion of new visitor-related venues and facilities in which significant investment is made. • Member City Grants $100,000 Funding provided to each member city to market and promote public facilities and venues, as well as festivals and events to attract visitors to the community. • Meeting&Conference Marketing $80,000 Print and online marketing and promotional activities to increase awareness and utilization of(12) venues and facilities located throughout the Twin Cities Gateway area with the capacity to host events, functions, and meetings. • Sports Marketing $140,000 Funding for sales'and marketing efforts, including participation at major sports marketing tradeshows to solicit, bid and host sports-related events and competitions at the National Sports Center, as well as at facilities/venues located in TCG's member cities. • Regional Grant Program $30,000 Grant funding for marketing and promotional purposes for new event development or in support of new activities at existing events. As you are aware, the Nelson's and Keenan's homes are on the bank of the Mississippi River and over the past year their properties have experienced significant and serious bank failure. The property owners together with Coon Creek Watershed District (CCWD) have been monitoring the progression of this failure, and have engaged geotechnical engineers to review the situation and make a recommendation for action. Staff will need more time to fully analyze the effects of the request to the City. There are concerns with the financial match and disposition cost of the property. We want to pursue a FEMA Mitigation Grant that could provide funding to help us,and ultimately prevent uncontrolled erosion into the Mississippi River. Specifically,we are asking the City of Fridley to: 1. Act as the Mitigation Grant sponsor. 2. Use the needed resources to prepare the Mitigation Grant application and related documents. 3. Wysopal, City Manager DATE: October 19, 2017 SUBJECT: Prosecution Services INTRODUCTION Consider entering into an agreement with the City of Coon Rapids to provide criminal prosecution services. DISCUSSION The City of Fridley recently approached the City of Coon Rapids staff about providing criminal prosecution services. At its September 25, 2017, Council meeting,the Fridley City Council directed staff to negotiate an agreement with Coon Rapids. This has been accomplished and within the parameters discussed previously. Under the agreement, the Coon Rapids City Attorney's Office would act as the City Prosecutor for Fridley and provide representation for all petty, misdemeanor, and gross misdemeanor criminal proceedings and cases beginning on January 1, 2018. In addition,the City of Coon Rapids would handle DWI forfeitures for Fridley. The proposed agreement is for five years with an option for an additional five years upon agreement of the parties. The cities have agreed to review the agreement after six months and yearly after that to ensure it meets the needs of both cities. The cost is within the proposed 2018 budget and will result in a cost savings of approximately$40,000. This services agreement will replace the current provider Carl Newquist. It is anticipated that the City of Coon Rapids will hire one additional assistant city attorney and one legal assistant to meet the needs of the agreement. The City and Coon Rapids also recently received a grant to cover the costs of a Victim Services Coordinator. Fridley will share in the benefits of that position and pay any costs above the grant. The Coon Rapids City Council approved the agreement as proposed on October 17. RECOMMENDATION Approve agreement for criminal prosecution services between the City of Fridley and the City of Coon Rapids and authorize the Mayor and City Manager to execute the agreement. 64 RESOLUTION NO. 2017- A RESOLUTION APPROVING A JOINT POWERS AGREEMENT FOR CRIMINAL PROSECUTION SERVICES BETWEEN THE CITY OF FRIDLEY AND THE CITY OF COON RAPIDS AND AUTHORIZING EXECUTION OF SAID AGREEMENT WHEREAS,the City of Fridley's current criminal prosecutor has announced his retirement requiring the City to seek criminal prosecution legal services; and WHEREAS, The City of Coon Rapids, through its in-house City Attorney's office,has the ability and expertise to provide criminal prosecution services; and WHEREAS, on September 25, 017,the Fridley City Council directed staff to negotiate an agreement with Coon Rapids for criminal prosecution services; and WHEREAS, the cities of Fridley and Coon Rapids see a benefit of sharing resources between the two municipalities to create more efficient and cost saving governmental operations for citizens of both cities; and WHEREAS,pursuant to Minnesota Statute 471.59 the cities wish to enter into a joint powers agreement to allow Coon Rapids to provide criminal prosecution services to Fridley pursuant to this agreement. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Fridley hereby approves the Joint Powers Agreement for Criminal Prosecution Services between the City of Fridley and the City of Coon Rapids, as shown in Attachment 1, and authorize said agreement by the mayor and city manager. Skogen, City Clerk 65 ATTACHMENT 1 JOINT POWERS AGREEMENT CRIMINAL PROSECUTION SERVICES BETWEEN THE CITY OF FRIDLEY AND THE CITY OF COON RAPIDS THIS AGREEMENT,made on this day of , 2017 by and between the CITY OF FRIDLEY, a municipal corporation under the laws of Minnesota ("Fridley"), and CITY OF COON RAPIDS, a municipal corporation under the laws of Minnesota ("Coon Rapids"). WHEREAS, Fridley is seeking criminal prosecution legal services; WHEREAS, Coon Rapids and its in-house City Attorney's Office have the ability and expertise to provide criminal prosecution legal services; WHEREAS, Fridley and Coon Rapids see the benefit of sharing resources between the two municipalities that will create a more efficient and cost saving government operations for citizens of both cities; WHEREAS, pursuant to Minnesota Statute 471.59 the parties wish to enter into a joint powers agreement in order for Coon Rapids to provide criminal prosecution legal services to Fridley pursuant to the terms of this agreement; NOW THEREFORE, IT IS HEREBY AGREED that this document by and between Fridley and Coon Rapids shall be a binding obligation on behalf of all parties named. I. CITY PROSECUTOR APPOINTMENT. Coon Rapids, through the Coon Rapids City Attorney's Office, is appointed City Prosecutor for Fridley. H. TERM. The term of this agreement will be from January 1, 2018 to December 31, 2022, with an option for 5 year extension per mutual agreement of the parties. III. SCOPE OF PROSECUTION SERVICES. The following services shall be provided to Fridley by Coon Rapids as a matter of right under the terms of this agreement: A. Represent Fridley in all criminal proceedings and cases where Fridley is a party and /or has an identifiable interest, except those cases arising under the Fridley's zoning, housing, rental housing, and building codes. B. As required, prepare and appear at arraignments, pre-trial hearings, probation revocation hearings, omnibus hearings, Rasmussen hearings, Florence hearings, court trials, jury trials, in-custody arraignments, expungement hearings, motion hearings, and sentencings as required. Prepare files for court as necessary including the opening of files, preparing gross misdemeanor and misdemeanor complaints, preparing subpoenas, obtaining drivers' records, motor vehicle records, prior convictions, orders for protection, domestic abuse no contact orders, bank records, transcripts from prior hearings, plea petitions from prior hearings, and other information for prosecution as required. D. Comply with all discovery requests from defendants including documents, photographs, digital evidence and other discoverable items as requested or required. Coon Rapids may charge the requesting party a fee for discovery as permitted by law. E. Maintain communication with involved agencies including law enforcement agencies, courts, Minnesota correctional facilities, victim/witnesses, defendants/defense attorneys, social workers, mental health personnel, victim advocate representatives including Alexandra House, hospitals, banks, insurance companies, probation officers. F. Notify crime victims as required by law or otherwise request. Coon Rapids will provide Victim Coordinator services to provide information/referrals, assistance and advocacy for Fridley crime victims. Fridley acknowledges that this Coordinator is a state funded grant position and will not require Coon Rapids to maintain the position in the event that grant funds are no longer available. G. Handle and prepare criminal appellate work including correspondence, preparation of briefs and attendance at any necessary appearance and/or oral arguments. H. Prepare reports of prosecution activities as requested by Fridley City Manager or Public Safety Director. I. Maintain records including court calendars, formal complaint requests, and court assignment schedules for prosecutors. J. Comply with all requirements to maintain access to necessary systems such as eCharging, DVS, and Minnesota Government Access (MGA) K. Provide and attend education and training programs for Fridley Police Department officers and staff as requested by the Director of Public Safety. Be available for communications by email, telephone or in person with Fridley officers, detectives, and record staff. • L. Coon Rapids will prepare complaints, notices, orders, settlement agreements, and other pleadings related to vehicle forfeitures and attend all necessary court appearances regarding the same unless documents are completed and managed by the Fridley Police Department, M. Comply with the Minnesota Data Practice Act and Fridley Police Department data access requirements. 2 67 IV. FEES. Fridley shall compensate Coon Rapids subject to the following terms: A. Coon Rapids shall be compensated for prosecution services and vehicle forfeiture services which includes travel, photocopying, printing, faxes, legal research, expenses and costs of overhead, on an annual basis, payable in 12 equal monthly installments throughout the terms of this agreement as follow: a. 2018: $285,000 b. 2019: $285,000 c. 2020: $302,100 d. 2021: $320,226 e. 2022: $339,440 B. Fridley shall be responsible for all costs, if any, incurred by Coon Rapids, for outside copying/binding of appellate briefs and for serving/filing of appellate briefs. C. Coon Rapids will submit billing statements for each monthly installment. Fridley will pay the monthly installment according to its internal procedures to Coon Rapids. D. The parties agree to mutually evaluate the usage of legal services after the first six months and at the end of each year of the agreement thereafter to evaluate usage/costs and identify areas were modification in the parties' relationship may be mutually beneficial. VI. ASSIGNMENT OF SERVICES AND AGREEMENT. Coon Rapids shall not assign any interest or obligation of this Agreement without the prior written consent of the Fridley. VII. AFFIRMATIVE ACTION. Both Fridley and Coon Rapids require and follow Affirmative Action Policies and will not tolerate discriminatory acts. Coon Rapids shall not discriminate under the agreement against any person in accordance with federal, state, or local laws or regulations. VIII. WORK PRODUCT. All ordinances, resolutions, correspondence, and other documents or materials drafted for the Fridley by Coon Rapids' attorneys on behalf of Fridley shall, upon their completion, become the property of Fridley. 3 68 IX. INSURANCE. Coon Rapids agrees to maintain a valid policy of General Liability Insurance to cover professional liability claims for the duration of this agreement. The value of the policy shall not be less than the cap for municipal tort liability as established by Minnesota Statutes. X. INDEMNIFICATION. To the fullest extent permitted by law, Coon Rapids agrees to defend and indemnify Fridley, its agents and employees from and against all claims, damages, losses, and expenses, including attorney fees, arising out of or resulting from the performance of work under this Agreement; but only to the extent caused in whole or in part by the negligent acts, errors or omissions of Coon Rapids. Coon Rapids agrees this indemnity obligation shall survive the completion or termination of this Agreement. XI. SEVERABILITY. Fridley or Coon Rapids may sever the terms of this agreement upon 120 days written notice. Failure by the Fridley or Coon Rapids to comply with any of the terms of this agreement shall be grounds for terminating this agreement. Upon termination of this agreement, the City shall only be responsible for the monthly fee and any additional billings accrued as of the date of termination. XII. ENTIRE AGREEMENT. This agreement supersedes any prior or contemporaneous representations or agreements, whether written or oral, between the parties and contains the entire agreement. XIII. AMENDMENTS.
