ADOPTION OF PROPOSED CONSENT AGENDA: Councilmember Bolkcom asked for the Planning Commission meeting minutes to be removed and placed on the regular agenda. Paul Hyde, Fridley Land LLC, stated things are moving very fast with the Northern Stacks development and they are starting the sixth building. They are fortunate this is a good leasing market and continue to fill buildings up before they are built. For the broiler room, they are talking to several tap rooms and a photo studio/office space. They hope to have someone in there by the second quarter of 2018. Mayor Lund said the location is great and looks to be highly successful. Mr. Hyde replied that he could not have done it without Council and staff. He was able to capture companies who were moving out of Minneapolis and St. Paul and moving north. There is a diverse group of companies which makes for a stable investment. He has a great partnership with the City which has resulted with one or two companies moving in. Deb Skogen, City Clerk, stated that Gyu Sum (Elizabeth) Hwang, applicant, has applied for an on-sale intoxicating liquor license to operate Kings Restaurant located at 1051 East Moore Lake Drive. The restaurant serving authentic Korean food has been owned and operated by Suki Pak Collopy since 2001. Ms. Collopy is in the process of selling the business to Ms. Hwang who hopes to take ownership December 1, 2017. Ms. Skogen noted that Section 603.07 of the Fridley City Code requires a public hearing to consider the approval of an on-sale intoxicating liquor license. The Notice of Public Hearing was published in the Fridley Sun Focus on October 20, 2017, meeting the ten-day advance notice requirement. After the public hearing, the City Council has the ability to approve the license at the same meeting. Ms. Skogen said Ms. Hwang has been working at Kings Restaurant since 2009. She obtained a Bachelor of Science in Food & Nutrition from Korea National Open University and is a certified Korean Food Craftsman from the Korea Test Institute. Kings Restaurant is known in the Twin Cities as a best Korean restaurant receiving an award in 2009 and 2012. The cuisine serves not only Korean but also Japanese and Chinese food. Ms. Hwang is looking to expand the business and to diversify the customer base. Ms. Skogen said staff received the liquor license application on September 15, 2017. The Police Department conducted the background investigation and credit history of the applicant and found no reason to deny the application. The Fire Marshall found no outstanding issues or reasons to deny the license. Ms. Skogen said staff recommends the following actions: 1. Hold a public hearing for an intoxicating liquor license for Gyu Sum (Elizabeth) Hwang, Applicant, to operate Kings Restaurant located at 1051 E Moore Lake Drive; and 2. Motion to approve liquor license to Gyu Sum Hwang for Kings Restaurant at 1051 E Moore Lake Drive. Ms. Skogen said Jay Hwang is the manager of the restaurant and Elizabeth is the CEO. They have worked there over 9 years and the current owner wants to sell to Elizabeth. The landlord is asking for a personal guarantee for the new lease assignment. They are here today for the liquor license. 3 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 4 Councilmember Saefke asked what the owner had to do with making Elizabeth the owner on the lease. Mr. Hwang stated the landlord said the assets were not enough to pay the lease every month. The existing lease does not end for 4 V2 years. The current owner wants to retire but the landlord is not 100% sure they will be able to pay every month on time for the lease. Mayor Lund asked if they struggle to pay the lease, would the current owner ensure payment would be made. Mr. Hwang said the landlord is asking for 18 months of guaranteed payment. Councilmember Bolkcom asked if they felt comfortable that the current owner will sign on for 18 months. Mr. Hwang replied yes, the current owner agreed to sign and will continue to run the business through December or January if needed. Councilmember Bolkcom asked if Council closed the public hearing to approve this contingent on the signed lease; what would happen if the lease was not signed in February. Ms. Skogen replied the current liquor license is valid until the end of April, so they would continue to operate under the old license. If the lease is not signed the license cannot be issued. Councilmember Bolkcom thought Council should continue the hearing until they have a signed lease. Ms. Skogen suggested closing the public hearing and then when paperwork is ready this can come back to Council under"Licenses." MOTION by Councilmember Varichak to close the public hearing. Consider Transferring Property from the City of Fridley to the Fridley Housing and Redevelopment Authority for Development(Ward 1) (Continued October 9,2017). MOTION by Councilmember Saefke to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilmember Barnette. Scott Hickok, Community Development Director, noted that Item Nos. 7 and 8 will be presented together. A public hearing was opened on August 14, 2017. Council expressed concern over the transfer of property where the park/play structures exist. The hearing was held open for additional public comment. Staff held additional public meetings to gain input. Additional input 4 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13, 2017 PAGE 5 was offered, and the developer prepared a new plan based on input. Anoka County and the general public reviewed the plans and concurred with the concepts. A refined park plan will be produced. Staff recommends the City authorize transfer of the parcels to the HRA. Councilmember Saefke said he was opposed to the transfer the first time this was presented because he felt the neighborhood did not have a chance to provide input. Since then, a few neighborhood meetings were held, and he heard consensus that this plan is satisfactory to the neighborhood. He asked about the patio homes and if there were any reconfigurations. Mr. Hickok replied the developer had a timeline to work under for exclusive negotiations which ended on November 2. There was not enough progress to stay with that developer. By the end of November, a RFP will go out to developers for just the patio homes. The area will have around 29 to 30 units and will stay within the boundaries that are defined. Councilmember Bolkcom said there have been two neighborhood meetings with the entire layout of the patio homes and others. Separate RFPs will be sent out at different times for development. She asked if the senior housing, for example,would change anything related to the park. She wanted to make sure the developer is aware of the area that is going to be reserved for the park. Mr. Hickok replied that a lot of work went into where we are at today and there is not a lot of flexibility within the patio home layout. We will look for a developer and make sure we can build at a price we can afford. MOTION by Councilmember Saefke to move into record the letter of understanding found on pages 69-70 of the agenda. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. Pam Reynolds, 1241 Norton, asked how the land was acquired. Mr. Hickok said it was public land, and the City is ready to convey that area to the HRA for development. Ms. Reynolds asked how the park land could be given to the HRA without a vote. Mr. Hickok replied the park land was bought with no strings attached. The land was not bought solely with park purpose in mind. This piece of land has been analyzed and there is nothing that would prevent us from doing this. Mayor Lund added the Springbrook Nature Center was obtained through an exchange of land and has restrictions. That is not the case with this park land. Mr. Hickok stated this land was purchased and never dedicated as park land. 5 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 6 Ms. Reynolds noted that Lots 2 and 3 were acquired by eminent domain by the County. She asked if that made a difference. Mr. Hickok replied there is no case preventing them from advancing this property into development. Ms. Reynolds asked when the transfer occurred if the yellow area on the map would belong to the City. Mr. Hickok said the plat shows the pond feature, and Outlot A, C, D, and F are subject to this discussion. The City will take on the maintenance of the road. Ms. Reynolds said when this is all said and done, all of the land where taxpayers are building the Civic Center will belong to the City. Mr. Hickok replied this was a mutual decision on how all that will rest. Right now, the item is up for discussion for development purposes. Ms. Reynolds said at their next meeting, the Environmental Quality & Energy Commission will be reviewing the Comprehensive Plan for parks and trails. Their desire is to preserve open space and other desired features, and now we are transferring parks for development. She said she does not agree with all this development. Mr. Hickok replied that preserving open space is on natural features. In this development area, we are preserving the natural areas. Areas that are mowed and maintained are not natural. Mayor Lund added the pond will bring back what was once there--wetland and ponding areas. Councilmember Bolkcom said instead of a field, an enhanced park will be developed to connect the City park to the trail. People are happy about the change and to have a better park. We are still pursuing a field for soccer practice. MOTION by Councilmember Saefke to close the public hearing. Seconded by Councilmember Barnette. Animal Control, by Redefining or Adding Definitions to Section 101.01 Definitions; Creating a New Section 101.04 Allowing for and Regulating Chickens; Creating a New Section 101.05 Allowing for and Regulating Honey Bees; Amending Section 101.14 Changing Kennels to Multiple Pet Locations and Renumbering Sections of this Chapter as Required Deb Skogen, City Clerk, said staff received a directive from the City Council in March to review the city code to allow for the keeping of bees: In addition, staff received numerous requests to keep chickens and apply for a kennel license. These issues were discussed and staff researched and reviewed requirements and regulations from other cities, the state, the animal health board, various animal associations, and the League of Minnesota Cities. Based on this research and review, an ordinance was drafted addressing these three key areas. Information has been provided to the City Council throughout the process. A draft ordinance was presented to the City Council at their work session on October 23, 2017. As a result of the discussion, a few small revisions were made to the draft ordinance. Chickens: This ordinance creates Section 101.04 providing a purpose for the keeping of chickens and for the licensing, conditions and regulations of keeping chickens. Honeybees: This ordinance creates Section 101.05 providing a purpose for the keeping of honeybees and for the licensing, conditions and regulations of keeping honeybees. Multiple Pet Location: This ordinance amends Section 101.01, the definition of a kennel, from residential to a place of business licensed by the Minnesota Board of Animal Health and creates a new definition called "multiple pet location." In addition, Section 101.14 is renumbered to Section 101.16 and amended to use the new definition of multiple pet location for the licensing, conditions and regulation on residential lots having more than three dogs or cats at one location. Ms. Skogen said each of these sections provides for an inspection process for the licensing or complaint of a nuisance. Each section also includes an appeal and hearing process for the applicant if a license is denied, revoked or non-renewed. New fees are also created to address the licensing and inspection fees. As more time is spent on the original inspection and review it is recommended the initial fee be $100 with a renewal fee of$25. 7 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 8 Ms. Skogen said that Staff recommends the City Council hold the first reading of an Ordinance Amending Fridley City Code Chapter 101. Animal Control by Redefining or Adding Definitions to Section 101.01 Definitions; Creating a New Section 101.04 Allowing for a Regulating Chickens; Creating a new Section 101.05 Allowing for and Regulating Honeybees; Amending Section 101.14 Changing Kennels to Multiple Pet Locations and Renumbering Sections of this Chapter as Required. Mayor Lund said to be oted on page 77 to be consistent with the fee structure on page 90. It may be a misprint on the top of page 77; should be $100 not$25 for the original license fee. MOTION by Councilmember Saefke to waive the reading of the ordinance and adopt the ordinance on first reading. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 10. Resolution Providing for Water, Sewer, Storm Water and Recycling Rate Changes. Korrie Johnson, Assistant Finance Director, said in May of 2017, City staff authorized Ehlers Inc. to begin work on a utility rate study designed to shape the rate structures for the water utility and sanitary sewer utility funds for 2018 and beyond. The findings and recommendations were presented to Council on September 25, 2017. The resolution included with this memo reflects those recommendations and, if adopted by Council, would take effect January 1, 2018. The rate study identified a rate structure intended to stabilize rate increases from year-to-year and increase equitability among customer classifications such as single family, multi-family, small and large commercial. Ms. Johnson stated the long-range consumption and expenditure forecasts were applied to the recommended rate structure to enable the utility funds to be self-sustaining without relying • heavily on debt to fund capital and to maintain low to moderate rate increases going forward. A significant portion of the costs in these funds are required regardless of flow through the systems. The Water and Sewer Utilities require major operating and infrastructure costs just to maintain the availability of service. Ms. Johnson reviewed the Water Utility Fund. Since 2012, this fund has averaged just over 8% rate increases year-to-year. Ehlers is proposing a rate structure designed to increase revenue 9.8% in 2018 with only moderate increases needed to stabilize this fund going forward. Water sales have declined in recent years while expenses have continued to increase. Since 2012, per capita residential consumption has declined 22%, while Fridley's population increased only 3%. In order to meet the Water Utility needs, Ehlers is proposing to break the usage tiers into more concise groups and increase the cost per tier for residential. The opposite will hold true for commercial customers with large commercial seeing a higher base fee. Irrigation rates will be billed at the highest tiered amount. These changes will help achieve equitability among our customer classes, and provide greater cost control for customers who wish to conserve water. 8 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 9 Ms. Johnson said since water sales have declined in recent years and prior assumptions,were based on higher consumption estimates, it has been detrimental on cash reserves even with significant rate increases. To put this decreased consumption in a different light, Met Council is encouraging residential consumption at a conservative rate of 75 gallons per person per day, which many cities are well above. Fridley's residential consumption for 2016 is calculated at about 63 %2 gallons per day per person. The study used a conservative approach to consumption forecasts when projecting future rate increases. Ms. Johnson stated staff is recommending a restructure of consumptions tiers, customer classifications and base charges. If consumption meets projections, this rate restructure would provide funding to support operations, scheduled infrastructure rehabilitation and debt obligations for 2018. Ms. Johnson reviewed the Sanitary Sewer Utility Fund. Sanitary sewer charges are dependent on water consumption. With a decline in water usage, the Sewer utility also has seen significant rate increases over the past several years. In 2016 and 2017, rates increased by 9%. Ehlers is proposing a rate structure designed to increase revenue by 4.3% for 2018 with 2019 and beyond increasing at a moderate rate. Ms. Johnson noted the largest portion of our sewer expense comes from the Metropolitan Council Environmental Services (MCES) wastewater transmission and treatment charges which makes up over 70% of total operating costs, and are largely outside of the City's control. While we have edged downward in our share of MCES charges relative to other communities in recent years, MCES costs are projected to continue their increase. Ms. Johnson noted that this utility has major operating and infrastructure costs just to maintain the service no matter how much or how little flow passes through our system. To offset current MCES charges along with future increases, staff is recommending a rate restructuring with higher base charges and usage rates. The most significant of changes would be for residential users where that base charge would include the first 8,000 gallons of usage. We are also adding a class for 2 and 3 unit multi-family, where the base charge would include the first 24,000 gallons of usage. Ms. Johnson reviewed the Storm Water Utility Fund. The storm water fund had a 75% rate increase back in 2015 to support operational expenses and capital projects. With significant projects for a third consecutive year staff is recommending a 3.5% rate increase for storm water for the upcoming year. For the single family residential property, this is an increase of.10 cents per month. The Solid Waste Abatement Fund for 2017 the recycling rates were frozen due to a charter restriction limiting the City's ability to increase rates to support expenditures. Effective November 2, 2017 the Charter was modified allowing the recycling rates to be adjusted to provide the revenue necessary to support anticipated expenditures for 2018. Staff is recommending an 11 cent increase per month for a residential home owner. This rate increase will provide for a balance budget for 2018 and provide the funding necessary to support the increase projected with the recycling hauler contract which makes up over 80% of the Solid Waste Abatement Funds expenditures each year. 9 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 10 Pam Reynolds, 1241 Norton Avenue, noted that the new tier for commercial will pay the same as residential. She asked why commercial will get 250,000 for 2.25 per 1,000 gallons and she gets 8,000 gallons. Also under the sewer residential pays a $50 base fee — she is sure that was incorrect because commercial base fee is only $20. She asked what was included in that fixed charge. She also wondered how the City could do that because the Charter says in Chapter 11 that all charges shall be just and reasonable. The goal in Fridley is to provide safe housing for families and businesses. If rates keep rising, it will force people out of their houses. Young families cannot afford to pay a $50 flat fee. Since restrictions went off in 2007 there have been rate increases every year. Mayor Lund replied that Ehlers is an expert in this field and brought forth critical findings. To compare Fridley to other communities is difficult because there are a lot of differences. Unfortunately, we are getting penalized for being conservative. Because this commodity must be self-sufficient, we have to raise the rates. Shelly Peterson,Finance Director, noted that a study was done and staff time is being charged to each enterprise fund accordingly. Wally Wysopal, City Manager, stated the action item for Council is the rates. There was a 20% reduction in water consumed by customers whether they were residential or commercial. This resulted in a 20% reduction in the City's revenue source. Staff is trying to change the rates to make them fair. We have a good understanding of water and sewer personnel costs and the largest cost is from Met Council which we cannot do anything about but pay it. Improvements have been made to the system to make sure the system doesnot take more flow than what is coming into Fridley. These changes may look drastic, but the customer's bill will compare to what they are paying now. Ms. Peterson noted that even though the base rate went up, the new rate includes consumption that it did not before. The overall bill only increases 2.94%. Mr. Wysopal added that changing the tiers was to make sure in the future we take into account significant consumption users. We needed advice from a consultant to break the bills down. The bottom line is the average customer will see an increase just short of 3%. Mayor Lund noted this is an attempt to stabilize the rate structure. Instead of relying on people to buy more water, the base rate goes up because we still have fixed costs. Ms. Reynolds said the rates are not higher for commercial or industrial. Ms. Johnson replied the commercial and industrial sanitary sewer are calculated based on actual water usage every single month of the year which brings in more revenue for the City. Residential water rates were based on winter water usage only. Councilmember Bolkcom asked how long the study was done and if it was a thorough study. 10 FRIDLEY CITY COUNCIL MEETING OF NOVEMBER 13,2017 PAGE 11 Ms. Johnson replied that Ehlers worked with staff for two months. They are well known for utility rate studies. The study was done through 2024 and we are looking at moderate increases going forward. Councilmember Bolkcom noted this is not something Council or staff took lightly. This was well thought out and needs to happen. Compared to other communities, Fridley is sitting in mid- range for rates. Ms. Peterson said commercial usage was subsidizing residential and now it will be fairer. Mayor Lund stated that even though commercial is using a lot of water, they are also paying more revenues. That is not the case with residential. A letter of understanding between the City and the Fridley HRA has also been attached that will require Council's signature, once the second reading of the Ordinance has been approved. Elements Simply put, the purpose of the transfer is to allow the City's development partner, the Fridley HRA the opportunity to negotiate the best layout possible for additional housing units for the City and this development. A platted pump house parcel and a platted passive park area will be part of the overall layout. Attached, Council will also find a letter of understanding from the HRA. In that letter of understanding, it is clear that the City's Development partner, the HRA has asked for the authority to use four parcels to negotiate the private residential land deal for Locke Park Pointe. In that letter of understanding; note the HRA is requesting the opportunity to use the defined parcels including, "Outlot E" (park/pump house parcel) to provide maximum flexibility for the future patio home layout. The HRA will then plat and provide back both a pump house and park parcel to the City. Skogen, City Clerk' Date: November 17,2017 Re: Second Reading of an Ordinance Amending Chapter 101 Animal Control Pertaining to Chickens, Bees and Multiple Pet Location City staff received a directive from the City Council in March to allow for the keeping of bees. In addition, staff received numerous requests for livestock (for chickens) and kennel licenses. These issues were discussed by the Design Review Committee after researching the requirements and regulations from other cities, the state, animal health board, various animal associations, and the League of Minnesota Cities. Based on this research and review, an ordinance was drafted addressing these three key areas. Information was provided to the City Council throughout the process, and discussed during a session on October 23, 2017. A first reading of the ordinance was held on November 13. Chickens and Honeybees This ordinance creates Sections 101.04 and 101.05 providing for the purpose of the keeping of and for the licensing, conditions and regulations of keeping chickens and honeybees Multiple Pet Location The ordinance amends Section 101.01, changing the definition of a kennel and creating definition of multiple pet location. In addition, Section 101.14 is renumbered to Section 101.16 and amended to use the new definition of multiple pet location for the licensing, conditions and regulation on residential lots having more than three dogs or cats at one location. New fees are also created to address the licensing and inspection fees. As more time is spent on the original inspection and review it is recommended the initial fee be$100 with a renewal fee of$25. Staff recommends the following actions: 1. City Council waive the second reading and adopt an Ordinance Amending Fridley City Code Chapter 101. Animal Control pertaining to chickens, honeybees and multiple pet locations, as shown in Attachment 1. 2. SECTION II: That Section 101.04 be hereby amended by creating new language allowing for the keeping and regulating of chickens as follows: 101.04. Chickens 1. Purpose: A. The purpose of this ordinance is to allow for the keeping of chickens on a small-scale basis and to address the negative impacts such as noise and odors that may result and that are not typical in urban areas. B. The keeping of chickens, sometimes referred to as "urban chickens" or"city chickens" is a movement spreading across the state and country. The urban chicken movement allows for the keeping of chickens on a small-scale for the purpose and desire of people to be closer to their food sources. This movement allows people to raise chickens in an urban environment to have access to fresh eggs on a regular basis for their own individual use and consumption. 2. Defmitions A. Chicken. A chicken (Gallus gallus domesticus) is a domesticated type of fowl that serves as an egg or meat source. B. Clucking. The sound uttered by a hen when laying eggs,brooding, or in calling her chicks. C. Coop. The structure for the housing of chickens permitted by this chapter. D. Crowing. The sound uttered by a rooster is the `singing' of the rooster. Roosters crow for many reasons including: reacting to a disturbance, reacting to almost any kind of sound (cars, people, other roosters, other animals, etc.), guarding their territory, feeling threatened, a predator `trespassing' on their territory, or just communicating with other chickens E. Hen. A hen is a female chicken. F. Rooster. A rooster is a male chicken. G. Run. A fully enclosed and covered area attached to a coop where the chickens can roam unsupervised. 20 Ordinance No. Page 3 3. License Required A. No person shall keep, harbor, maintain or allow the keeping of chickens on any property in the City without an approved license. If the applicant is a tenant, they must also provide proof of approval of owner permitting the keeping of chickens. B. Education and training on how to raise chickens is required for the individual prior to the issuance of the initial license by the City. At the time of application for licensing, the individual must submit proof of completion of an educational course on the care and keeping of chickens. C. The application for licensing must be upon a form provided by the City. All required information must be complete, including the number and breed of chickens, a diagram or photograph of the proposed coop and run, description of sanitation control and a description on how chicken feed will be maintained or stored. D. A site plan of the property showing the location, size, and setback requirements of the proposed chicken coop and run shall be required. E. The property must be in compliance with all other applicable City regulations in order to receive approval and renewal. F. If the licensee fails to maintain the standards of practice subsequent to issuance of the license, the Community Development Director or designee license may revoke the license. G. Within six months of the effective date of this section, individuals who have been keeping chickens in the City must either apply for and receive a license or remove the chickens and structures from property. H. The license shall be valid until April 30th of each calendar year following initial issuance and must be renewed prior to annual expiration by submitting a renewal form provided by the City and the required renewal fee. I. The fees for the license are set in Chapter 11 of the Fridley City Code. 4. Location and Size of Coop and Run A. Residents on properties zoned R-1, Single Family Residential may be permitted to keep and raise chickens as a hobby with a license and shall be limited to a maximum of six chickens per property. B. Coop and run area must be located in the backyard and must be located a minimum of thirty(30) feet from all adjacent property lines. 21 Ordinance No. Page 4 C. Coop and covered run area shall be limited to no more than sixty(60) square feet. D. Coop size shall be not less than three (3) square feet per bird, be weather proof and fully enclosed. E. The coop shall comply with current zoning and building codes. The coop shall be constructed with architecturally appropriate building materials including exterior grade siding and either a metal, composite or shingled roof In the alternative, coop may be purchased from a commercial source that constructs structures specifically to be used as coops for chickens. F. The run shall have a fence around the enclosure and shall be securely constructed with mesh type material. G. The run shall have protective overhead netting or fencing to prevent the chickens from roaming freely and to protect them from other animals. H. If the keeping of chickens has been discontinued for more than 12 months, the licensee must remove the coop and run and restore the site within 90 days. 5. Conditions A. There shall be a maximum of six chickens kept on site at any one time. B. There shall be no roosters or loud clucking hens permitted on site. C. There shall be no chickens allowed or kept inside of any residential garage or dwelling unit. D. Chickens shall be secured inside of a shelter from sunset to sunrise each day to prevent nuisance noise and attraction of predators. E. Chickens shall be confined to the chicken coop and run area and may not roam free on the property. F. Housing facilities and grounds shall be maintained in a clean and sanitary condition, and kept in good repair. Flies, rodents and noxious odors shall be controlled. Facilities shall be kept free of fecal matter and collected fecal matter shall be properly stored and disposed of weekly. G. If chickens are to be maintained during the winter months, the chicken coop shall be winterized to protect the chickens in cold weather. H. Chickens shall be fed within the confines of the chicken coop or run area. Feed shall be stored in leak-proof containers with a tight-fitting cover to prevent attracting vermin. 22 Ordinance No. Page 5 I. The raising of chickens for breeding purposes is prohibited on residentially used or zoned properties. J. There shall be no slaughtering or butchering of any chickens on residential properties within the City of Fridley. 6. Inspection As a part of the initial license application or annual renewal each resident must allow an inspection of the coop and run area. The Community Development Director or designee shall have the right to inspect any coop and run for the purpose of ensuring compliance with this section between 8 a.m. and 5 p.m. Monday through Friday upon providing prior notice to the owner of the property. In the case of a complaint regarding the coop and run, the site may be inspected without prior notice. In the event the licensee moves to a new residential lot within the City of Fridley, the licensee is required to complete a new application for the new location. 7. Appeal and Hearing Procedure A. Licenses issued under this section may be denied, revoked or non-renewed due to any of the following: 1) The keeping of chickens in a manner which constitutes a nuisance to the health, safety or general welfare of the public; 2) A chicken may be impounded by the city pursuant to City Code Section 101.11 if it is found to be at large in violation of this section. After being impounded for five (5) business days without being reclaimed by the owner, it may be humanely euthanized or sold. A person reclaiming any impounded chickens shall pay the cost of impounding and boarding of the chicken(s). 3) Fraud, misrepresentation, or a false statement contained in the registration application or during the course of the registered activity; or 4) Any violation of the applicable provisions in this Chapter. B. Notice of approval, denial revocation or non-renewal must be made in writing to the applicant. The applicant may request a hearing by submitting a written request to the city clerk within fourteen(14)business days of the date of the notification letter. C. The Appeals Commission shall hold a hearing on a contested approval, denial, revocation, or non-renewal. The appeal process to be used shall be the same process described in Section 128.06 of the Fridley City Code. At the hearing, the applicant may speak and may present witnesses and other evidence. Upon the conclusion of the hearing, the Appeals Commission shall issue a written decision that includes findings of fact. The City shall provide the applicant with a copy of the Appeals Commission decision. The applicant may appeal the Commission's decision to the city council by 23 Ordinance No. Page 6 submitting a written request to the city clerk within fourteen (14) business days of the date of the Appeals Commission decision. SECTION III: That Section 101.05 be hereby amended by creating new language allowing for the keeping and regulating honeybees as follows: 101.05. Beekeeping 1. Purpose Honeybees are an asset to the community and important in the pollination of plants and production of honey and other products. The purpose of this ordinance is to allow for the hobby of keeping honeybees and to establish certain requirements for beekeeping within the City, to avoid issues which might otherwise be associated with beekeeping in populated areas. 2. Definitions As used in this section of the Code, the following words and terms shall have the meanings ascribed in this section unless the context of their usage indicates another usage. A. Accredited Institution. An educational institution holding accredited status which has been licensed or registered by the Minnesota Office of Higher Education at the time the registrant obtained his or certificate. B. Apiary. The assembly of one or more colonies of bees on a single lot. C. Apiary Site. The lot upon which an apiary is located. D. Beekeeper. A person who owns or has charge of one or more colonies of honeybees or a person who owns or controls a lot on which a colony is located whether or not the person is intentionally keeping honeybees. E. Beekeeping Equipment. Anything used in the operation of an apiary, such as hive bodies, supers, frames, top and bottom board and extractors. F. Colony. An aggregate of honeybees consisting principally of workers, but having, when perfect, one queen and at times drones,brook, combs and honey. G. Hive. The receptacle inhabited by a colony. H. Honeybee. All life stages of the common domestic honeybee, apis mellifera. This definition does not include wasps, hornets, African subspecies or Africanized hybrids. I. Licensee. Any beekeeper or person who has applied and received approval of a beekeeping license. 24 Ordinance No. Page 7 J. Nucleus Colony. A small quantity of honeybees with a queen housed in a smaller than usual hive box designed for a particular purpose, and containing no supers. K. Queen. An adult mated female that lives in a honeybee colony or hive that is usually the mother of most, if not all, of the bees in the beehive. A queen is developed from larvae selected by workers bees and specifically fed in order to become sexually mature. L. Super. A box that holds the frames where bees will store the honey. M. Swarming. The process where a queen bee leaves a colony with a large group of worker bees in order to form a new honeybee colony. N. Unusual Aggressive Behavior. Any instance in which unusual aggressive characteristics such as stinging or attacking without provocation occurs. Provocation is an act that an adult could reasonably expect may cause a bee to sting or attack. 3. Beekeeping License Required. A. No person shall keep, harbor, maintain or allow to be kept any hive or other facility for the housing of honeybees on or in any property in the City without an approved license. B. Beekeeping training and education is required for the beekeeper prior to the issuance of the initial beekeeping license by the City. At the time of application for licensing, the beekeeper must submit a certificate of completion of a honeybee keeping course from an accredited Minnesota institution. C. The application of licensing must be upon a form provided by the City. All required information must be complete. D. Each apiary site must apply for a license and receive approval prior to bringing any honeybees into the City. E. The beekeeping license shall be valid until April 30th of each calendar year following initial issuance and must be renewed prior to annual expiration by submitting a renewal form provided by the City and paying the required renewal fee. F. Upon receipt of an application for initial license, the City will send written notice to all owners of properties located within 200 feet of the property line of the apiary site identified on the application. Any objections must be made in writing and received within fourteen(14)business days of mailing the notice. G. The license may be denied if the City receives a written objection from a resident living within the designated notification area who provides reasonable evidence that he or she or a member of his or her household has an allergy to honeybee venom. H. The fees for the license are set in Chapter 11 of the Fridley City Code. 25 Ordinance No. Page 8 I. The property must be in compliance with all other applicable City regulations in order to receive approval and renewal. J. If the licensee fails to maintain the standards of practice subsequent to issuance of a beekeeping license, the community development director or designee may revoke the license. K. Beekeepers operating in the City prior to the effective date of this section must either apply for and receive a license or remove the bees and structure within six months of the effective date. 4. Colony Location A. Residents on properties zoned R-1, Single Family Residential may be permitted to keep and raise honeybees as a hobby and shall be limited to two colonies per property. B. Hives must be located in the backyard and must be located a minimum of thirty(30) feet from all property lines. C. If any licensed beekeeper serves the community by removing a swarm or swarms of honeybees from locations where they are not desired, that person shall not be considered in violation of the colony density restrictions in this section if the following conditions are met: 1) The person temporarily houses the honeybees at an apiary site of a beekeeper licensed by the City; 2) The bees are not kept for more than thirty(30) days; and 3) The site remains in compliance with the other provisions of this section. 5. Required Conditions A. No more than two colonies may be kept on the property at one time. B. For each colony permitted to be maintained in this section, there may also be maintained upon the same apiary lot, one nucleus colony in a hive structure not to exceed one standard nine and five-eighths (9 5/8) inch depth box, ten frame hive body with a maximum of 5 supers. C. Honeybee colonies shall be kept in hives with removable frames which shall be kept in sound and usable condition. D. Each colony on the apiary site shall be provided with a convenient source of water which must be located within ten feet of each active colony. 26 Ordinance No. Page 9 E. Materials from a hive such as wax combs or other materials that might encourage robbing by other bees shall be promptly disposed of in a sealed container or placed within a building or other bee and vermin proof enclosure. F. Beekeeping equipment must be maintained in good condition, including keeping the hives free of chipped and peeling paint if painted, and any unused equipment must be stored in an enclosed structure. G. Hives shall be continuously managed to provide adequate living space for their respective honeybees in order to prevent swarming. H. In any instance in which a colony exhibits unusual aggressive behavior, it shall be the duty of the beekeeper to promptly re-queen the colony. I. Honey may not be sold from any residential property. 6. Inspection. As part of the initial application or annual renewal, each beekeeper must allow an inspection of the apiary site. The community development director or designee shall have the right to inspect any apiary for the purpose of ensuring compliance with this section between 8 a.m. and 5 p.m. Monday through Friday upon providing prior notice to the owner of the apiary property. Facilities shall be kept free of fecal matter and collected fecal matter shall be properly disposed of weekly so as not to create a public nuisance as defined in Chapter 110 of this Code. B. The premises for keeping of dogs and/or cats shall be fenced. The fencing must be of such quality and design so that it will contain the dogs and/or cats. C. If dogs and cats are to be maintained outside during the winter months, the housing or shelter°shall be winterized to protect the dogs or cats from the harsh elements of the cold. 29 Ordinance No. Page 12 D. Animal feed shall be stored in leak-proof containers with tight-fitting covers to prevent attracting vermin so as not to create a public nuisance as defined in Chapter 110 of this code. E. The animals are maintained in a manner that they do not become a public nuisance as defined in Section 101.06 of this Code. 45. Fennel Multiple Pet Location License Fee. The annual license fee and expiration date shall be as provided in Chapter 11.1 of this Code. 6. Inspection As a part of the initial license application or annual renewal, each resident must allow an inspection of the housing facilities and grounds. The community development director or designee shall have the right to inspect the property for the purpose of ensuring compliance with this section between 8 a.m. and 5 p.m. Monday through Friday upon providing prior notice to the owner of the property. In the case of a complaint regarding the multiple pet location, the site may be inspected without prior notice. In the event the licensee moves to a new residential lot within the City of Fridley, the licensee is required to complete a new application for the new location. 57. Appeal and Hearing Procedure T i„ense D eveeatio . A. Stacy Stromberg,Planner, stated the petitioner, Paul Hyde of Fridley Land LLC, is requesting the fourth preliminary plat to allow for the redevelopment of the northern edge of what was 4800 East River Road. Ms. Stromberg stated the portion of the property to be replatted for Phase IV will create(2)new building lots to allow for further redevelopment of this site and will be addressed as 40- 51St Way NE and 60-51St Way NE. Ms. Stromberg stated the Commission and Council will recall that this property was rezoned from M-2, Heavy Industrial to S-2,Redevelopment District in 2013 to allow redevelopment of what has been known as the BAE/FMCINavy site, now being called Northern Stacks. The S-2 zoning designation allows flexibility with the redevelopment of the property. A master plan was approved with the rezoning that establishes guidelines that dictate what type of development can occur on the site. Ms. Stromberg stated the petitioner has planned to redevelop this large parcel in four phases, and this request will be the last phase. This request will replat the parcel north of 4800 East River Road and create 2 new lots that will be addressed as 40 - 51St Way and 60 - 51St Way NE. The lots will be legally described as Lot 1 and 2, Block 1,Northern Stacks 4th Addition. Lot 1 is proposed to be 514,732 square feet (11.82 acres); and Lot 2 is proposed to be 466,274 square feet (10.70 acres). Each lot and their prospective use meet the intent of the master plan that was approved with the S-2 rezoning for this property. Construction for the building to the east has already begun and construction on the final building to the west is expected to begin in the spring of 2018. There is tenant interest for both buildings. 34 Planning Commission Meeting October 18, 2017 Page 2 of 5 Ms. Stromberg stated the first plat was approved in 2015 to allow for Phase I of the redevelopment, which created two separate parcels on the south side of the property. As a result, two buildings were constructed and are currently 100 percent occupied. That plat also dedicated 1.49 acres of land for right- of-way purposes, which includes the construction of a cul-de-sac off of East River Road, to allow access to the Phase I parcels. Ms. Stromberg stated the second plat was approved in 2016 to allow Phase II of the redevelopment, which consolidated BAE Systems within the northern 561,000 of the original building. This space remains as office and technology space for BAE. The exterior of the building has been completely renovated to meet the development standards that the petitioner has set for this development.Construction and remediation of the original building are substantially complete. The petitioner has received a certificate of completion from the Minnesota Pollution Control Agency (MPCA) and BAE's Northern Lights Café is now open to the public. Ms. Stromberg stated the third plat was approved in 2016 to allow for Phase III of the redevelopment, which created three new lots and gave 41 Northern Stacks Drive a new legal description. The building located to the southeast of BAE is 74 percent leased with interest in the remaining space. The shell building to the west is almost complete and already 82 percent leased, and there is also interest in the remaining space. The western most building should be completed by the end of the year, and a lease for 47 percent of the building is expected to be signed soon.There is also interest in the remaining space. Ms. Stromberg stated the boiler building has plans to be upgraded with a new floor, windows and landscaping to help attract prospective tenants. The petitioner has been working with several potential tenants to have a tap room/beer production use out of this building. Ms. Stromberg stated the City staff recommends approval of the preliminary plat request as the plat complies with the master plan approved for the rezoning of this property. Commissioner Sielaff asked for an environmental update. Paul Hyde, Fridley Land LLC, stated last year they platted Phase III and in April of 2017 they completed their Northern Stacks III building. There is 100,000 of 133,000 feet occupied. They have several folks looking at the last 35,000 feet there. They then started Northern Stacks IV early this spring. Their largest tenant is occupying 105,000 feet for consolidation of different offices and production facilities around Minneapolis and St. Paul. They just finished that phase and received the Certificate of Occupancy on October 13. Just north of them they have signed an agreement with a warehouse business to occupy 33,000 feet. On the north side of the building there is a company from Fridley which moved in last week. Mr. Hyde stated they started Northern Stacks V late this summer and this afternoon they have signed with a business to occupy 55,000 of 118,000 feet. Because of this activity and filling up the stuff that they have,they have decided to start Stacks VI. That building will be done in March 2018, and they have three proposals out for that building currently. Mr. Hyde stated that is the reason for this application to carve that larger piece to plat the two parcels so they can start the final building of the project, Stacks VII, next year. The last development piece is the boiler room which is where the smoke stacks are. Coming this fall they will be applying for an environmental cleanup grant for a vapor barrier for that boiler room building and, if successful, then will start building out that building next spring. 35 Planning Commission Meeting October 18, 2017 Page 3 of 5 Mr.Hyde stated in terms of the environmental update, what they have done is each phase of the project has had a cleanup plan approved by the State of Minnesota Pollution Control Agency and funded a combination of grants from DEED, Metropolitan Council, and TIF from the City of Fridley. They then did that cleanup by phase and, as they completed the cleanup, were issued a Certificate of Completion stating they have completed the cleanup and there is no further work at the time. Mr. Hyde stated the first phase of cleanup was Stacks I, and they have a Certificate of Completion for both of those buildings stating that they have done their environmental work. They have received their Certificate of Completion this summer for the BAE building which is Stacks II, Phase II. As to Plat 3, Phase III, they just submitted their completion report for Stacks III and N buildings and expect the Certificate to be issued in the first quarter of 2018. Mr. Hyde stated when Stacks V is done in March they will submit. They will get the Certificate of Completion probably by summer of 2018, and they are just completing their cleanup for Stacks VI by mid-November, the Stacks VII building will be completed, and those reports will be submitted next year with the Certificates closing out that cleanup next year. Commissioner Sielaff asked Mr.Hyde whether he has to do the monitoring? Mr. Hyde replied there continues to be groundwater monitoring done by the United States Navy. They have moved a few of their wells for them. They continue monitoring the groundwater and there remains seven groundwater extraction wells on the west side of the property that the Navy will operate for the foreseeable future. Commissioner Sielaff asked Mr.Hyde whether they are not responsible for sampling of the wells,etc.? Mr.Hyde replied,that is not their responsibility. They are working with the Navy cooperatively. Chairperson Kondrick stated and have they been easy to work with. Mr.Hyde replied,they have been. He has been gratified to see that when they told them there would be a short window in the Phase 3, Plat 3, between tearing downa building and putting up a new building, it was an opportunity for them to do some additional cleanup; and they did that work last summer and it went very well. They are meeting with the Navy again in a few weeks just to update them on their progress and talk about possible work on other projects. Chairperson Kondrick asked Mr. Hyde he has not run into any construction snags because of their reluctance to do some things? Mr.Hyde replied,we have all worked very well together. Commissioner Schwankl asked whether they have the ability to add parking as needed as it appears they have 1 parking stall per 1,000 square feet. Mr. Hyde replied that is the ratio that is typical for this kind of building. What typically happens if you get a higher finish building you have less trucks so then they would stripe the truck parking to get the higher parking count they would need. That is the backup plan. This project is essential to maintain the current sanitary sewer service for the City, and to address existing inflow and infiltration issues with these systems. Pipe lining is a cost effective method of preserving the structural integrity and flow characteristics of sanitary sewer and storm sewer without replacing the entire pipe and structures. This project includes six separate areas across the City with the shortest section being less than 200 feet in length and the largest being slightly more than a mile in length.The work is expected to start early in 2018 and will be complete in early 2019 or sooner. The low base bid was received from Lametti & Sons, Hugo, MN in the amount of $956,682.00. The high bid received was$1,318,617.00. Staff is satisfied that the low bid is responsive, and therefore recommends moving forward with the necessary work. Please refer to the attached summary sheet for a more specific breakdown of bids received. Funding for this project includes allocations from the 2017 and 2019 CIP budgets from the Sanitary Sewer Utility Fund. The project will be eligible fora partial reimbursement under the MCES Inflow/Infiltration grant program. This will be the only change order request for this project. This project provides a diversion for storm water from Main Street to Horizon Drive, with an 18" RCP storm sewer installed down 53rd Ave. The project is being performed under contract with Lametti & Sons, Inc. of Hugo, MN. The amount of this change order is -$4,305.20. There is no change to the contract completion date for the project as a result of this change order. Total work included in Change Order No. 1 for this project would decrease the original contract by -2.3%. The design for the project was changed after bidding, therefore, at the completion of the project there were savings for certain project items that lowered the total project cost.Those items included elimination of a drainage structure(C1-1: -$6,050)and less concrete curb&gutter (C1-2: -$4,410). Other cost savings for the project included no repair for sanitary sewer service (C1-3: -$3,000) and only lowered one water service (C1-4: -$3,200). Major work activities directed under this change order include additional Traffic Control (C1-5: $6,592.40) and additional Mill and Overlay (C1-6: $5,762.40). Part of the project included a closure for the work at the Main Street/53rd Ave intersection. Anoka County required an extensive detour with more signs for Traffic Control when Lametti & Sons, Inc. applied for the Anoka County Right-of-Way Permit. During construction in the intersection, there were issues with traffic not following detour signs and trucks ending up going through the adjacent neighborhoods to get around the closure. Staff advised the contractor to install more signs on Main Street and University Ave to help some of the Traffic Control issues. Additional Mill and Overlay was added to the project for a small portion on the south side of 53rd Ave. Staff recognized that there was an issue with the roadway and requested to get the issue fixed while the contractor was onsite paving the northbound side of 53rd Ave.The road portion had settled in the area and to fix the issue the contractor built up the roadway by adding 2 1/2" of bituminous pavement. This work was necessary to match pavement in the eastbound lanes with the new westbound pavement, which was the reason it was required to do the eastbound lanes now. 41 City staff directed all changes above as necessary to fulfill our project goals and meeting our standards. All project fund sources remain within the project budget. This project and change order is fully funded through the Mississippi Watershed Management Organization (MWMO) Capital Project Grant Agreement of $248,230.00 for the project. This change order has been reviewed and was determined acceptable by the MWMO. Staff is recommending that the City Council move to approve Change Order No. 1 for the Main Street Drainage Improvements Project No. 17-486 to Lametti&Sons,Inc. in the amount of -$4,305.20. If approved, the contract amount shall be decreased from $183,950.00 to $179,644.80. It has been in existence for six months and is actively identifying opportunities to engage the community in ways that speak of the good things happening in Fridley. I have prepared a presentation prior to opening that public meeting. This will be an opportunity for the public to comment on the proposed budget. Below are some updates to the budget document since it was presented to Council at the November 13th council meeting. In addition to minor changes such as additions to a few key measures and budget comments, below are the adjustments made to budgeted figures: 1. Police, page 23 (new book page#24) 2017 Revised Budget— adjusted Personnel services on the Police summary page to correctly tie to the memo presented to council. This increase of$99,800 was an inadvertent omission. This increase is still below the original 2017 budget for Police and as it related to total personnel services in the General Fund. 2018 Proposed Budget— reduced Other Services & Charges by$9,000 with the savings identified for the Public Safety Data System annual fees billed by Anoka County Central Communications. 2. Fire, page 25 (new book page#26) 2018 Proposed Budget— increased Other Services & Charges by $9,000 to support the increase projected for the Public Safety Data System annual fees billed by Anoka County Central Communication. 3. Springbrook Nature Center, page 24 (new book page#45) 2017 Revised Budget— increased personnel services by$9,400 due to the mid-year personnel restructure of hiring of 2 part time employees to replace one full time employee. This fund is projected to see a deficiency in fund balance of$15,600 at the end of 2017. As explained during the budget conference meeting, this deficit is the result of a one-time capital purchase to be reimbursed in full over the next two years.
