by Monte and Michelle Maher, 7965 Riverview Terrace NE
The Planning Commission reviewed the Special Use Permit request
to allow construction of an addition to a dwelling located in the
flood fringe district at its September 21, 1994 meeting. The
Commission voted unanimously to recommend approval of the request
to the City Council with the following stipulations:
1. The Petitioner shall submit an elevation certificate
prior to the foundation being capped which shall verify
that the minimum first floor elevation is 824 . 00.
2 . The Petitioner shall submit a grading and drainage plan
prior to the issuance of a building permit.
3 . The Petitioner shall dedicate a 15 foot flood control
and street easement along the Riverview Terrace
property line.
The City typically requires a hold harmless agreement be executed
and recorded against the property in addition to the Special Use
Permit. Staff recommends that the City Council approve the
request with the above stipulations as well as:
4 . The Petitioner shall execute and record against the
property a hold harmless agreement indemnifying the
City from liability as a result of flood damage.

Ms. McPherson stated the petitio r is Mr. Dolan of Parson's
Electric and the owners are L en and Gertrude Simer who owned
what was previously known a Simer Pump, which is now Parson's
Electric. The property i located generally at 60th Avenue on
the west side of Main S eet. The property is zoned M-2 , Heavy
Industrial .
This request is ique in the fact that the lot split as
requested will ot create a buildable parcel . The purpose of the
lot split is o split a piece of property approximately 13 feet x
200 feet a ng the common property line where the existing
driveway nd concrete curbing of Parson's Electric property
encroa es onto the vacant property to the west. It encroaches
by a roximately 8 feet. To resolve the matter, the two parties
ha e entered into an agreement by which Parson's Electric would

Mr. Nelson stated he is not necessarily suggesting he disagrees
in concept or in actuality. He would prefer the opportunity to
review this in more detail . He first heard about this when he
saw the draft planning report. There will likely be a green
strip in front anyway, and this would have no impact on the e
of the property. Unless it is required as part of this
application for the two parcels to the north, he would pr fer not
to include them.
Ms. Dacy stated what they need to determine is what s the
resulting description from the lot split. She th ght there were
three PIN numbers and this is more of a detail i sue that staff
will have to work out.
Mr. Nelson stated they support the request or the lot split.

Ms. Dacy stated this is a decision to be made by the and the
City Council. The Planning Commission should try focus on the
exterior designs and look at a site plan. Also conduct a
neighborhood meeting.
Mr. Oquist stated the timetable is tight
Ms. Dacy stated the HRA would be se cting the short list of
developers in October. Staff wo have the rest of October to
work with this short list to s if one developer will work. The
schedule is aggressive. She opes in two weeks to have someone
at the meeting to present me comments.
Mr. Newman recommende aving two meetings. One of the key
events is the Parad of Homes. If this could be done by next
fall, this event uld help. The City does not want to force a
bad product and ill take the time needed.
Ms. Dacy st ed the architect will look at the exterior of the
building Staff have asked for three alternatives just to start
laying ut some concepts and asked members to try to visualize
how ey want this to look. This will be included as part of the
n meeting's agenda.

REQUEST•
The petitioner requests that a special use permit be issued to
allow construction of an addition to a single family dwelling
unit in the flood fringe district. The subject dwelling is
located at the northeast corner of the intersection of Riverview
Terrace and Cheryl Street.
BACRGROUND
The petitioner is proposing to construct a 26' x 40' addition to
the rear of the dwelling unit. The proposed addition will be 30
feet from the rear lot line. The petitioner applied for a
variance to reduce the rear yard setback from 40 feet to 30 feet.
The Appeals Commission at its August 23, 1994 meeting reviewed
the variance request and unanimously approved it.
ANALYSIS
The proposed addition will contain three bedrooms and a bath, and
will be one story in height. The existing dwelling unit is 1-1/2
stories. Section 205. 024 . 05.A of the O-1 district regulations
require that the first floor elevation of all habitable living
spaces is to be a minimum of one foot above the 100 year flood
elevation. The 100 year flood elevation for the subject parcel
is 823 . 00. Therefore, the first floor elevation must be 824. 00.
An elevation certificate will be required to be submitted prior
to the foundation of the addition being capped. Basements are
not permitted in the flood fringe district, however, a crawl
space may be constructed.

Staff reviewed the elevation certificate for 7995 Riverview
Terrace, which included the first floor elevation of the
petitioner's dwelling; 821.8 feet. The petitioner's addition
will need to be 2 . 2 feet above the existing first floor.
**Stipulation** The petitioner shall submit an elevation
certificate prior to the foundation beinq
capped, which shall verify that the minimum
first floor elevation is 824.00.
The O-1 district regulations also require that any fill needed to
elevate the addition to meet the 100 year flood elevation
requirement extend a minimum of 15 feet from the proposed
addition. The addition of any fill needed will change the
existing grading and drainage patterns. The petitioner will be
required to submit a proposed grading plan prior to the issuance
of a building permit for staff review to insure that the altered
topography will not adversely affect the surrounding parcels, and
to insure that erosion is controlled.
**Stipulation** The petitioner shall submit a grading/
drainage and erosion control plan prior to
the issuance of a building permit.
Riverview Terrace is proposed to be upgraded in the future, and
is also used for flood control measures. The Engineering
Department has requested a 15 foot flood control and street
easement along the east side of Riverview Terrace.
**Stipulation** The petitioner shall dedicate a 15 foot flood
control and street easement alonq the
Riverview Terrace property line.
RECOMMENDATION�STIPULATIONS
Staff recommends the Planning Commission recommend approval of
the request to the City Council with the following stipulations:
1. The petitioner shall submit an elevation certificate prior

variance was also granted by the City to allow a reduced rear yard

variance was within previously granted parameters and the Appeals
Commission unanimously approved the request. Consequently, the
City Council was not required to act on that request. The
petitioners have submitted a letter requesting a one year extension
to their variance [special use permit] from the City Council.

3 . RECEIVE THE MINUTES OF THE PLANNING COMMISSION MEETING OF
SEPTEMBER 21, 1994:
A. SPECIAL USE PERMIT REQUEST, SP #94-12 , BY MONTE AND MICHELLE
MAHER, TO ALLOW CONSTRUCTION IN THE FLOOD FRINGE DISTRICT
GENERALLY LOCATED AT 7965 RIVERVIEW TERRACE N.E. (WARD 3) :
Mr. Hickok, Planning Coordinator, stated that this is a request for
a special use permit to allow construction in the flood fringe
district. He stated that the petitioner wishes to construct a
26 foot by 40 foot addition in the rear of the dwelling unit. He
stated that the Planning Commission reviewed this request and
recommended approval with three stipulations. He stated that staff
has added an additional stipulation for the petitioner to execute
a hold harmless agreement.
Mr. Hickok stated that the petitioner also applied for a variance
to zeduce the rear yard setback from 40 feet to 30 feet, and this
was unanimously approved by the Appeals Commission at their
August 23 , 1994 meeting.
MOTION by Councilwoman Bolkcom to grant Special Use Permit,
SP #94-12, with the following stipulations: (1) the petitioner
shall submit an elevation certificate prior to the foundation being
capped which shall verify that the minimum first floor elevation
is 824 . 00; (2) the petitioner shall submit a grading and drainage
plan prior to the issuarice of a building permit; (3) the petitioner
shall dedicate a 15 foot flood control and street easement along
the Riverview Terrace property line; and (4) the petitioner shall
execute and record against the property a hold harmless agreement
indemnifying the City from liability as a result of flood damage.
Seconded by Councilman Schneider. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
B. SPECIAL USE PERMIT RE UEST 5P 94-13 OHN RICE JR. TO
ALLOW CONSTRUCTION OF A SECOND ACC ORY STRUCTURE IN THE
FLOOD FRINGE DISTRICT GENERALL OCATED AT 8041 RIVERVIEW
TERRACE N.E. (WARD 3) :
Mr. Hickok, Planning Coordi or, stated that this is a two-part
request for a special use ermit to allow construction of a second

the time of the next meeting, vote on the application at the
October 17 Council meeting. He stated that he would be willing to
approve the liquor license, and allow teen nights and all age
nights with certain conditions. He stated that if these condi-
tions were not met, the liquor license would still be in effect,
but the teen nights would be eliminated.
Councilman Schneider stated his concern is that past history as
shown that teen clubs do not work. He stated that he wou d be
willing to go along with Councilman Billings' suggestion, ut he
would not want liquor served anywhere on the premises n teen
nights.
Councilwoman Bolkcom stated that she is inclined t agree with
Councilman Schneider's remarks.
Mayor Nee asked if it would be legal for Counci representatives
to be appointed to work with staff on the prepa tion of a docu-
ment covering these issues.
Mr. Herrick stated that he does not have ny problem with this
suggestion.
MOTION by Councilwoman Bolkcom to con inue this public hearing
until the next Council meeting on Oct er 17, 1994 and that Mayor
Nee appoint a committee of two repre ntatives from the Council to
work with staff and the applicant n stipulations. Seconded by
Councilman Schneider. Upon a voic vote, all voting aye, Mayor Nee
declared the motion carried una 'mously.
Mayor Nee stated that he wo d appoint Councilwoman Bolkcom and
Councilman Billings as the ouncil representatives to work with
staff and the applicant o this issue.
OLD BUSINESS•
2 . APPROVE JOINT OWERS AGREEMENT FOR THE RECONSTRUCTION OF
COUNTY ROAD O. 102 MAIN STREET FROM 44TH AVENUE AND
INTERSTATE 6 4 BETWEEN THE CITY OF FRIDLEY AND THE COUNTY OF
ANOKA TAB D SEPTEMBER 19 1994 WARD 3 :
Mr. Flora st ed that the public hearing for this project was held
on Septembe 6, 1994, and it is recommended that Council authorize
the Mayor nd City Manager to execute this joint powers agreement
for the construction of Main Street.
Counci woman Bolkcom stated that on Page 4, Item IX, Maintenance,
there is reference to the bikeway, and this should be eliminated.
MOTION by Councilwoman Bolkcom to authorize the Mayor and City
Manger to enter into the Joint Powers Agreement with Anoka County
for the reconstruction of County Road No. 102 (Main Street) from

address the gap between revenues and expenditures. He ated
that most funds are less than. last year, but capita project
funds are greater.

3 . RESOLUTION NO. 52-1995 CERTIFYING PROPOS TAX LEVY RE UIRE-
MENTS FOR 1996 TO THE COUNTY OF ANOKA:
Mr. Burns, City Manager, stated t t this 1996 proposed tax
levy of $3,897, 629 represents a .2 percent increase over the
1995 certified levy. He stat that this is a result of a
four percent increase in t property tax levy and a four
percent decrease in the Ho stead and Agricultural Credit Aid.

MAIN REPAIR PROJECT NO. 272 :
Mr. Burns, City Manager, stated that bids wer received to
replace 400 feet of eight inch water main or Washington
Street. He stated that the existing pipe is orn by elements
in the soil and has been the subject of nu rous water main
breaks.
Mr. Burns stated that the bids were high than anticipated,
and the low bidder was Penn Contractin , Inc. in the amount
of $39,765. He stated that there a savings from other
projects to cover this overage.
