DESCRIPTION OF REQUEST:
The petitioner is requesting a special use permit to allow construction of a second accessory structure at 6291
Central Avenue.
SUMMARY OF ISSUES:
Code Section 205.07.01.C.(1) states, "Accessory buildings other than the first accessory building, over 240
square feet [are permitted with a special use permit]"
The petitioner is planning to enlarge his e�dsting home through the construction of a 8' X 24' room extension
on the north side of the e�asting home and building a 2-car garage with a master bedroom above. The
garage/master bedroom combination will be constructed 16' west of the e�dsting home (toward Central Avenue)
and will be connected to tfie home by a 2-story breezeway.
An 18' x 20' garage currentiy e�dsts on the east side of the property. It is the intent of the property owner to
keep that garage and eventually improve it so that it is architecturally compatible with the updated home.
The Appeals Commission approved a side yard setback variance to correct an e�dsting encroachment and
reduce the setback for the proposed garage addition from 10 feet to 7 feet
RECOMMENDED ACTION:
Staff recommends approval of a special use permit, SP #95-09, to allow construction of a second accessory
structure with the following stipulations:
1. The petitioner shall construct a hard-surfaced drive of asphalt or concrete within 12 months of the City
Council's approval of SP #95-09.
2. All grading, drainage and downspout locations shall be designed in a manner will prevent detrimental run-
off impacts to adjacent property.
3. All necessary permits shall be obtained from the City prior to construction.
PLANNING COMMISSION ACTION:
The Planning Commission concurred with the staff recommendation.

A two car garage currently exists on the east side of the property. It is the intent of the property
owner to keep that garage and eventually improve it so that it is architecturally compatible with the
updated home.
Mr. Litwinczuk's home is at the comer of Rice Creek Road and Central Avenue. The home on the
property south of this parcel is located approximately 20' from the property line. At its closest
point, the Litwinczuk home will be approximately 22' from the living portion of the home to tho
south.
A variance request, to construct the garage addition 7' from the southem property line was
approved by the Appeals Commission on September 12, 1995. The existing dwelling is located 3.6'
feet from the property line and would need to be completely relocated if the petitioner were to
correct the existing encroachment.
Description of Parcel & History
Subject parcel is located at the southeast comer of the intersection of Central Avenue and Rice
Creek Road. The parcel measures 67' x 247'. As it is a comer lot, the shortest of the two street
frontages is technically the front yard. Located on the parcel is a single family dwelling unit
measuring 20' x 24'. The City has no record of when this dwelling was constructed, though the
petitioner has indicated that the original construction took place in the 1930's. Also located on the
parcel is an 18' x 20' detached garage, for which a permit was issued in 1973.

Per Section 205.07.O1.C. (1) of the Fridley City Code, to
allow accessory buildings other than the first accessory
building, over 240 square feet, on Lot 17, except the South
55.0 feet thereof, Auditor's Subdivision No. 22, generally
located at 6291 Central Avenue N.E.
MOTION by Ms. Savage, seconded by Ms. Modig, to waive the reading
of the public hearing notice and to open the public hearing.
IIPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON NEWMAN DECLARED
THE MOTION CARRIED AND THE PIIBLIC HEARING OPEN AT 7:33 P.M.
Mr. Hickok stated that the request is for the property located at
6291 Central Avenue N.E. A special use permit is being requested
in conjunction with a variance to allow construction of an
addition to an existing home. The variance was reviewed and
approved by the Appeals Commission on September 12. The variance
allowed the petitioner to construct the addition 7 feet from the
southern property line rather than the 10 feet as required by
code. The special use permit is for a second accessory structure
over 240 square feet.
Mr. Hickok stated there is an existing home and garage on the
site. The addition is out toward Central Avenue. The property

is at the corner of Central Avenue and Rice Creek Road. The
proposed addition is 22 feet x 24 feet. It is a two-car garage
with a master bedroom on the second floor of the addition. A
breezeway connects the new garage/master bedroom to the existing
house. The code requirement for a special use permit is to
protect the open space and to consider elements such as home
occupations, etc. , that a second large accessory building might
encourage.
Mr. Hickok stated staff has determined through their review that
this is living space and additional garage space. The current
garage is detached. Staff recommends approval of the special use
permit with the following stipulations:
1. The petitioner shall construct a hard surface drive of
asphalt or concrete within 12 �onths of the City Council's
approval of SP #95-09.
2. All grading, drainage and downspout locations shall be
designed in a manner which will prevent detrimental run-off
impacts to adjacent properties.
3. All necessary permits shall be obtained from the City prior
to construction.
Mr. Oquist asked if the driveway is on Rice Creek Road or onto
Old Central.
Mr. Hickok stated the driveway is onto Rice Creek Road and the
curb cut for the driveway has already been created.
Mr. Newman asked if the structure the petit�ioner is expanding is
considered an accessory space even if it is connected by a
breezeway.
Mr. Hickok stated yes. The trigger is the garage. Even an
attached garage is considered an accessory structure.
Mr. Newman asked if there had been any comments from the
neighbors.
Mr. Hickok stated the neighbor had provided positive support at
the Appeals Commission meeting.
Mr. Saba asked the petitioner if he had any problem with the
stipulations.
Mr. Litwinczuk stated no.
Mr. Oquist asked if the petitioner would lose any trees.

soon anyway.

Mr. Oquist stated he saw no problems with the request. It is a
large lot.

Mr. Hickok, Planning Coordinator, stated that this is a request to
. reduce the front yard setback to allow construction of a garage.
He stated that this is a "double fronted" property and is the best
alternative. Iie stated that one change discussed was that if the
garage was moved five. feet, it would allow additional garage stalls
and open space.
MOTION by Councilman Billings to concur with the unanimous
. recommendation of the Appeals Commission and grant Varia�he

Mr. Flora, Public Works Director, stated that bids were opened for
the Central Avenue bikeway/walkway project, and three bids were
received. He stated that the low bidder was Hardrives, Inc. in the �
amount of $349,352.90. He stated that the City's estimated cost
of the project was $280,000.00.
Mr. Flora said that the State of Minnesota is requiring the C' y
to build a pedestrian bridge to State Highway standards. He st ed
he felt that by revising the present design, the bridge can e a
simpler design. He recommended that the bids be rejected, a this
project be re-bid in early 1996.

MOTION by Councilman Schneider to receive the followir�g bids for
the Central Avenue Bikeway/Walkway Project No. �T. 1994-9:
Hardrives, Inc. in the amount of $349,352.90; ;'Forest Lake
Contracting, Inc. , in the amount of $361,734.50; ar}d H & M Asphalt

18. INFORMAL STATUS REPORTS:
Mr. Burns, City Manager, stated that there are several items to be
discussed in the conference session. He stated that these are:
(1) the Southwest Quadrant condaminium issue; (2) the budget issue
regarding personnel; (3) a Stonybrook Creek update from staff
mediation meeting with the representatives of Spring Lake Park; and
(4) evening hours on Tuesdays from 5:00 p.m. to 7:00 p.m. for City
operations.

mediation meeting with the representatives of Spring Lake Park; and
(4) evening hours on Tuesdays from S:OO p.m. to 7:00 p.m, for City
operations. .

On October 2, 1995, the Fridley City Council officially approved
your request for a special use permit, SP #95-09, to allow
accessory buildings other than the first accessory building, over
240 square feet, generally located at 6291 Central Avenue N.E.
Approval of this special use permit request is contingent upon
the following stipulations:
1. The petitioner shall construct a hard-surfaced drive of
asphalt or concrete within 12 months of the City Council's
approval of SP #95-09.
2. All grading, drainage and downspout locations shall be
designed in a manner will prevent detrimental run-off
impacts to adjacent property.
3. All necessary permits shall be obtained from the City prior
to construction.
You have one year from the date of City Council action to
initiate construction. If you cannot begin construction in time,
you must submit a letter requesting an extension at least three
weeks prior to the expiration date.

but there is a potential that in the future, if the home is so ,

Mr. Hickok, Planning Coordinato,r; stated that this is a request to
reduce the front yard setback' to allow construction of a garage.
He stated that this is a "d�iible fronted" property and is the best
alternative. He stated t�iat one change discussed was that if the
garage was moved five feet, it would allow additional garage stalls
and open space.
MOTION by Cour��ilman Billings to concur with the unanimous
. recommendation�' of the Appeals Commission and grant Variance
Request, VAR #95-26, with the following stipulation: (1) the

Mr. Hickok, Planning Coordinator, stated that this is a request for
a special use permit to allow construction of a second accessory
structure at 6291 Central Avenue N.E. He stated that the peti-
tioner is proposing to construct an 8 foot by 24 foot addition and
construction of a two car garage with a master bedroom above.
Mr. Hickok stated that staff recommended approval of this special
use permit with three stipulations, and the Planning Commission
concurred.
MOTION by Councilman Schneider to concur with the recommendation
of the Planning Commission and grant Special Use Permit, SP #95-09,
with the following stipulations: (1) the petitioner shall con-
struct a hard surfaced drive of asphalt or concrete within twelve
months of this approval of SP #95-09; (2) all grading, drainage

17. RECEIVE BIDS AND AWARD CONTRACT FOR CENTRAL AVENUE BIKEWAY/
WALKWAY PROJECT NO. ST. 1994-9:
Mr. Flora, Public Works Director, stated that bids were o$�ned for
the Central Avenue bikeway/walkway project, and three ,�"iids were
received. He stated that the low bidder was Hardrives, ,,Inc. in the
amount of $349,352.90. He stated that the City's es,timated cost
of the project was $280,000.00. �'`

Mr. Flora said that the State of Minnesota is req�iring the City
to build a pedestrian bridge to State Highway stanclards. He stated
he felt that by revising the present design, the bridge can be a
simpler design. He recommended that the bids be rejected, and this
project be re-bid in early 1996.
MOTION by Councilman Schneider to receive the following bids for
the Central Avenue Bikeway/Walkway Project No. ST. 1994-9:
Hardrives, Inc. in the amount of $349,352.90; Forest Lake
Contracting, Inc. , in the amount of $361,734.50; and H & M Asphalt
Company in the amount of $399,791.95. Seconded by Councilman
Billings. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
