Ms. McPherson stated this property is generally located in the southwest corner of the intersection of O�'borne Road and Central Avenue. She stated the original plat wa�approved in 1961 and is comprised of approximately 11 acres whiclY are predominately vacant. There is a small trucking terminal located on Lot 5 located in the southeasterly corner of the subject rcel. The property is zoned M-1, Light Industrial, as are the�operties to the south. The property to the west is zoned �=2, General Business, and the properties across Central Avenu to the east are zoned C-1, Local Business, and R-1, Single Fami Dwelling. Ms. McPherson stated the pr osed replat would recreate these new lots from the existing fiv lots. Several easements were dedicated along the various lot lin s of the original five lots. Staff needs to verify with the Cou y Surveyor and Recorder to determine if these easements would e vacated through the replat process. If they are not vacat through the replat process, a separate vacation would need o be filed to remove these easements from the record and to dedi ate any new easements which may be necessary. Ms. McPherson s ted the new plat is comprised of three lots, Lots 1 and 2 total .95 acres and 3 .9 acres each. Lot 3 is for the existing truc ing terminal and is approximately 4. 1 acres. Ms. McPher on stated the Fridley Bus Company may purchase the proposed ot 1 in order to relocate its facility from Main Street. Staff i currently awaiting site plans to determine if a special use pe it for exterior storage may be required. Ms. cPherson stated that as far as the original plat, special as ssments for sewer and water laterals were waived for a majority o the plat as the petitioner at that time did not have interested uyers to purchase the remaining vacant lots. A water main is located in Osborne Road; however, the closest sanitary sewer line is located in Central Avenue. A private easement will need to be dedicated along the southern lot line of proposed Lot 2 in order to provide a sanitary sewer lateral from Central Avenue to Lot 1. The City will also require that a maintenance agreement be executed and recorded against both Lot 1 and Lot 2 to require that the owner of Lot 1 maintain the private sanitary sewer line located on proposed Lot 2. Ms. McPherson stated that in 1961, the record was not clear as to whether or not a park dedication fee was paid at the time of the original plat. As Lots 1 and 2 are proposed to remain vacant at this time, staff has calculated park fees for only those two lots. Ms. McPherson stated all the lots meet the minimum lot area and lot width requirements set forth in the M-1 district regulations. Ms. McPherson stated staff is recommending that the Planning Commission recommend approval of the proposed replat with four stipulations: l. Special assessments of $1, 640.25 shall be paid for Lot 1, Block 1, Anderson Development Replat. 2. A park dedication fee of $2,951. 10 for Lot 1 and $3,987. 16 for Lo� 2 shall be paid at the time of the issuance of a bualding permit. � 3 . TO ALLOW THE CONTINUANCE OF A V IANCE GRANTED PRIOR TO NOVEMBER 21 1977 TO ALLOW THE RE ODELING OF A SIGN GENERALLY LOCATED AT 5401 EAST RIVER RO N.E. : Ms. Dacy, Community Development Director, indicat that the property was zoned M-2 and that under the City' ordinances, pre-1977 variances for signs require the approval Council. Ms. Dacy stated that in 1970, Plywood Minne ta was given a variance for a 300 square foot sign located alon I-694. Recently, the petitioner requested that while changing e name from Plywood Minnesota to Home Valu that the company be allowed to keep the 300 square foot sign. Ms. Dacy indicated that when this item came before the Appeals Commission in February, 1993, the peals Commission tabled consideration of this request. Subse ently, a representative of the applicant reduced the size of the roposed sign from 300 square feet to a total square footage o 186.25 square feet. This included 140 square feet for the ome Valu portion of the sign, 32.75 square feet for a time and temperature portion, and 13 .5 square feet for another se ent that would read "Open Tonite. " Ms. Dacy stated that the App ls Commission felt that a hardship did exist. She stated that he Appeals Commission also indicated that even if a special us permit for the time and temperature portion of the sign were t approved, they were willing to support the other two sign segm ts that were being requested. Mr. Brottland, a rep esentative from SignArt, provided a brief rationale for the va iance. Councilman Fitzpa ick pointed out that the sign is a large sign. Mr. Brottland s id that the main sign is less than fifty percent of the size of the existing sign, and that the total sign square footage is on about two-thirds of the size of the original sign. He stated t t the speed of traffic, the existence of trees and shrubs, an the size of the Wickes sign justify a larger sign for Home Valu. Council n Fitzpatrick asked where the sign would be located. Ms. D cy stated that the sign would be located on the subject prope ty just east of the frontage road that is located along the south side of I-694. She said that at that time a single family home building permit was issued. At the time the new home was being constructed, an existing detached garage was in place on the property. She pointed out under the City's codes, the second garage requires a special use permit. The special use permit request was approved by the Planning Commission, subject to the stipulation that the existing garage be painted. Mayor Nee asked if there would be driveway access for the second garage. Ms. Dacy replied said that it would not. She said that the detached garage would be strictly for storage. Councilman Schneider asked Mr. Kedrowski to confirm that there would be no driveway to the detached garage. Mr. Kedrowski confirmed that and indicated that the garage would be used strictly for the storage of motorcycles.
