The Special Use Permit process begins by filling out a SPECIAL USE PERMIT APPLICATION. This, with a site plcm, cmd other appropriate drawings, must be submitted to the Plcmning staff. A fee is associated with the application; $100 for second accessoiy building applications, $400 for all other appliccrtions. Fees cQe non-refundable. Once the application is received, the application is reviewed by staff from the Plcmning, Engineering, Assessing, Fire, cmd Police Depcstments. The impacts to adjacent properties cme discussed, cmd stipulations cire developed. Simultcmeously, a mcriling list of all properties within a 350 foot rad.ius of the property is generated. Notices of the request cu�e sent to these property owners. There is approximately four weeks between the application due date and the Plcmning ! Commission meeting. Prior to the meeting of the Plcuuiing Commission, a stc�f report is written, cmd the petitioner called regcffding the stcdf recommendation. The Plcmning Commission is made up of seven residents of the community. The meetings are held the first cmd third Wednesdays of the month at 7:30 pm in the Council Chcunbers in the Municipal Center. The Plcmn;ng Commission is cm advisory commission to the City Council. It is the responsibility of the Plcmning Commission to conduct a public hecsing, gather testimony cmd make a recommendation to the City Council regcncding all special use permit requests. The existing shed would be taken down and the building will go in its place. Staff recommends approval with stipulations. Bob and Frankie Fetrow, petitioners, stated that they had no problems with the stipulations. Mr. Dwayne Myrvold, petitioner, stated that the stipulat' ns are fine but instead of having a 20 feet setback, he would like a 24 foot setback. This would i n the ara e doors, and he would be able to see the garage from his back deck. Last night he ad a bicycle stolen out of his yard, so he would like to see what is going on there. r Ms. Bulthuis stated that would not be a problem a�long as he can make the required rear yard setbacks. Mr. Myrvold stated that there is a driveway on e east side of the property, and they intend to use that for a horseshoe driveway and no addition I curb cuts would be necessary. Ms. Johns asked if the driveway would be s ared with the neighbor. Mr. Myrvold stated that it would not. Mr. Kondrick stated that the horseshoe ould go in front of the new garage and come back out with the other curb cut. Mr. Kuechle stated that it does not tak care of the requirement for the single curb cut. Ms. Johns stated that he is not addin one; it is already there. Ms. Bulthuis stated that the petition is requesting a special use permit to construct a 780 square foot accessory building. It will be use for vehicle parking and storage. Section 205 requires a special use permit to allow an accesso building other than the first accessory building of over 240 square feet. The total square footage o ccessory structures is not to exceed 1400 square feet. The total square footage of the existing ga age and the proposed accessory structures on this site is 1,354 square feet. A 96 square foot shed i located next to the house that will need to be removed upon completion of the proposed accessory ructure in order to comply with the 1400 square foot maximum for accessory structures. The petiti er has asked to keep the shed intact until the proposed structure is constructed to eliminate a outdoor storage issues, that may be a problem if the structure is removed. Staff recommends app val with stipulations. Mr. Oquist stated that the stipulation regarding that t garage be architecturally compatible could include requiring the same 4-12 pitch as the house. The pitch he submitted in the plan has do with going steeper than the house because he has to shovel off the roof in the winter. He also w uld like to build the garage as close to 826 square feet as possible to get as close to the 1400 squa foot maximum allowed. What is the maximum height to the top of the garage allowed? Ms. Bulthuis tated that 14 feet is the maximum to the center line of the garage. Mr. Hatchett a ked if there was a 3 foot setback required from the side property line to the overhang of the garage. Ms. Bulthuis stat that it does not apply to the overhang. Mr. Kondrick stated there are ways to make this garage able to handle any type of snow load without maximizing the heig t of the garage. He thinks the pitch should look exactly the same as the house. Mr. Kuechle stated tha there should be no reason why anyone needs to shovel snow off the roof. Mr. Kondrick stated that 'nce there will not be heat inside the garage, there should not be a problem with the snow. Mr. Hatchett stated there wo Id be heat in the garage. Mr. Kondrick stated there are ys to not have to add to the pitch very easily. Mr. Hatchett stated that for some eason, he always has to shovel off his garage. Mr. Kuechle stated that he could ma e the garage a little bit bigger because he is within 46 feet of the allowed square footage. The resolution will then g to Anoka County and we will ask the courts for authorization to make the necessary repairs.�,,That will allow us to assess and redeem our funds through the assessment process. `'��, �. Mr. Hickok stated that in May an June of this year, warrants were issued because of an animal complaint. Inspection revealed the ome was unsafe and unfit for human habitation. The home at that time was boarded and posted� nd the owner was given time to develop a solution. On July 3 of this year staff initiated the Stat tory Abatement Process for unsafe buildings. No action occurred on the property at that point d staff stepped it up to the Abatement process which allows the homeowner one of the follo ing three options: 1. Bring the home into compliance within twenty days; 2. Bring in a sched le for correction and compliance which needs to be submitted and approved by the City within 0 days; or 3. Request a hearing with a Court Hearing Examiner or Officer within twenty days. � Mr. Hickok stated that the homeowner has req�ested the third option and there will be a hearing to deliberate any issues of contention on this��case. The owner has met with staff and has indicated that she would like to have the home �o through the proper permit processes and all corrections made by October 15 of this year. �here is a very aggressive approach. Staff recommends that Council hold the hearing with puBlic comment but not close the hearing until after there has been a decision from the hearing officek� Councilmember Bolkcom asked how soon after the l�aring before a hearing officer will a � recommendation be made. ` Mr. Hickok stated that the item could be back on the agenda�or the September 11 meeting. Mr. Ray Sopcinski, 5808 Tennison Drive, stated that he lives a�ijacent to the home and this has been going on for many years. It will cost the City thousands bf dollars. There was a petition signed by the neighbors and it did not do any good. Only one affidavit has been sent out but it was quite obvious that if this property has been let go, there has been no cooperation whatsoever from the owner. The City should follow the trend of trying to keep the City in well repair and healthy.
