He stated that the three percent deviation may allow the figures to be close to what exists now. Mayor Nee stated that the question is how much flexibility was needed and to determine the percentage of deviation. Mr. Backlund stated that this proposed amendment did not receive a unanimous vote by the Charter Commission but passed significantly. He stated that the negative reaction by the Commission was that this change is being made without really knowing the numbers. He stated it was also felt that there is the one percent guideline now existing in the Charter. Ms. Pat Faner, representing the Leagueiof Women Voters, stated that it was found the State allowed a deviation of two percent. She stated that in reviewing the population figure of 28,335 or an average of 9,445 per ward, a three percent deviation could run as high as 564 persons from one ward to another. She stated that the League felt this was unnecessarily large if the concept of equal representation wanted to be maintained. She stated that the League would recommend a two percent deviation. Mr. Backlund stated th�rt during the Charter Commission's discussion, it was noted that the State law requires a five percent deviation between Legislative districts, and the Charter Commission felt this was too loose. Councilman Billings stated that he attended a conference today regarding redistricting, that many of the rules are not clear at this point, and �he State law apparently has contradictory provisions. He sta'ted that the issue is further complicated by the Governor's veto q� the redistricting bill. Councilman Bil�'ings stated that another issue brought out at the conference was�' that the State is working on new computer software, and this software will work best if all precincts and wards follow the census t�'act blocks. He felt that the Council should probably take this �formation into consideration. Mr. Betz�ld, a member of the Charter Commission, stated that another !�issue facing the City was the requirement that polling places ad to be physically in the district. He stated that there is a w law on the books stating a polling place can be 3,000 feet out the precinct. He stated that the census is not a precise nu r. He stated that these figures will also be several years ol before they are implemented. He stated that he would opt for u erstandable boundaries rather than a mathematical survey. Site Located on the property is a single family dwelling with an attached two car garage. In the back yard, an in-ground pool encroaches into the drainage easement by 10 feet. The property is zoned R-1, Single Family Dwelling, as are the adjacent properties. Analysis The drainage and utility easement was dedicated on the Innsbruck North plat. The contractor originally proposed to locate the pool out of the 40 foot drainage easement (see attached survey) ; however, the pool was constructed encroaching into the easement by 10 feet. The encroachment was discovered when an asbuilt survey was completed at the time the house was sold. The subject parcel is located at an elevation higher than the surrounding properties, resulting in water draining off the subject parcel into lower areas, to collect in a wetland/pond area west of the parcel . The petitioner is requesting that 20 feet of the drainage and utility easement be vacated. In reviewing the request, the Engineering Department indicated that it would be better to vacate as little of the easement as possible (15 feet) to ensure adequate work room within the easement area, should the Engineering Department need to perform any work within the drainage area. Vacating the portion where the pool is located would have a minimal impact on the storage capacity of the drainage area, and as it is at a higher elevation, would have little impact on the flow of water within the drainage area. Recommendation Staff recommends that the Planning Commission recommend to the City Council approval of the vacation, to vacate the south 15 feet of the drainage easement. The smaller portion is based on the Engineering Department' s recommendation. Planning Commission Action The Planning Commission voted unanimously to recommend approval of the request to the City Council. The Planning Commission minutes erroneously indicate vacating the south 20 feet. " Mr. Betzold st ted that at the previous meeting, he did say that he did not know hether the City would incur that kind of cost. He did not want is statement to be implied by anybody that the City ought to be oing it, because later in the June 19th minutes, he stated it is the City's decision. His intent in this statement was to say, at if the alley is not vacated, the City is going to have to d l with it; whether they decide to improve the alley or pave it, it is a decision the City Council will have to make. � � Page 3, paragraph �, 3rd sentence: "He stated he would not like to be placed in e position that by approving one vacation, the other one woul have to be granted. " What he was trying to articulate was he fact that if the City vacated the northern part of the alley nd then the people from the southern half come in petitioning or a vacation, the City has to either grant the vacation, w ich means Mr. Meisner has no access, or the City has to tell t em they cannot have the vacation in order to give Mr. Meisner cess to his property. Ms. McPherson stated the subj ect parcel is located in the Innsbruck neighborhood. The property is zoned R-1, Single Family Dwelling, as are all other surrounding properties. Ms. McPherson stated the proposed request is to vacate the south 20 feet of the 40 foot drainage and utility easement which runs parallel to the rear lot line of the subject parcel. The easement was originally dedicated on the plat. The reason for the vacation request is that the in-ground pool encroaches into the drainage easement by approximately 10 feet. At the time the pool was proposed to be constructed, the contractor did propose that the pool be built outside the easement, but for some reason, the pool was built in the easement. She stated that Mr. Pickering, acting as the agent for the homeowner, has proposed to vacate the south 20 feet. Ms. McPherson stated the drainage for the area flows north of the pool and then west. Staff requested that the Engineering Department to review this request. The Engineering Department has asked that as little of the easement as possible be vacated to ensure that there is adequate room to work if regrading of this drainage area needs to occur within the easement area. Ms. McPherson stated that vacating the portion where the pool is located would have minimal impact on the entire drainage area as the pool area sits much higher than the surrounding drainage area and would have little impact on the storage capability or the flow of water. Ms. McPherson stated staff recommends that the Planning Commission recommend to the City Council approval of the vacation to vacate the south 15 feet instead of the requested 20 feet of the drainage easement. Ms. Sherek stated the pressure on these doors must remain as it is because otherwise the atmospheric pressure will cause them to open and not close and seal /properly. So, the Commission is recommending that automa�c pushplate access be provided on the main entrance door on t e upper level and the Police Department entrance door on the lo�ier level. i� Ms. Sherek stated it i�s the Commission's feeling that if the City is asking people co 'ing in for building permits to make their buildings handicap a cessibility, then the City must take the lead in making its buii ngs handicap accessible. She stated that in addition to the a tomatic door openers, the Commission is also recommending some other items be implemented in the Municipal Center and are re ommending improvements to School District #14 for the Community Ed cation Center. The improvements necessary to meet Code requireme s in the Municipal Center (other than automatic door openers) 's around $600. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 7: 37 p.m. FRIDLEY CITY COUNCIL MEETING OF AIIGOST 12, 1991 PAGE 2 Ms. Dacy, Community Development Director, stated that this is a request to vacate the south 20 feet of a 40 foot drainage and utility easement at 1467 Innsbruck Drive N.E. She stated that in 1980 the homeowner applied for a building permit to construct a swimming pool. She stated that it was indicated the pool would be located outside the 40 foot drainage and utility easement; however, it was constructed with 10 feet encroaching into the easement. She stated that the encroachment was discovered at the time the house was sold. Ms. Dacy stated that the Engineering Department has reviewed this request and determined that vacation of this part of the easement would not have an adverse impact on the function of the easement, and there is adequate property to handle any runoff. She stated, however, that they have recommended only a 15 foot vacation to insure there is adequate space within the easement should any work need to be performed in this area. Ms. Dacy stated that the Planning Commission has recommended approval of the vacation of 15 feet of the drainage easement. Councilman Schneider asked if the City has any record of drainage problems since the pool was constructed. Ms. Dacy stated that staff is not aware of any problems in this area. Councilwoman Jorgenson asked if the pool was inspected by the City's inspectors. Ms. Dacy stated that there was an inspection and, in this case, the setbacks were correct, but the drawing showed that it was not in the easement. Councilman Schneider stated that he felt it was also the obligation of the contractor to make sure the pool is located in the proper place on the site. APPROVE COMPREHENSIVE SIGN PLAN FOR OSBORNE CROSSINGS LOCATED AT 250 OSBORNE ROAD N.E. : Ms. Dacy, Community Development Director, stated the Sign Ordinan�� requires that multi-tenant commercial buildings must sub�i.� a comprehensive sign plan. She stated that the leasing agefit for this property at 250 Osborne Road, Weis Asset Management �nc. , has submitted their plan for the Council 's approval. � � �, Ms. Dacy stated that each tenant will have an ' dividual cabinet sign which will not exceed 5 by 20 feet alo the front of the building. She stated the landlords are so proposing that in addition to the wall signs centered bet en each tenant's lease lines that each tenant be allowed on 37 square foot wall sign placed on the southeast wall of the ilding. She stated that if wall signs are placed on more than ne wall of the building, staff recommends that only the tenan hose space abuts the southeast wall should be allowed to hav wall signage placed on this wall. She stated it was felt that our 37 square foot signs may promote a cluttered appearance; h ever, there is no specific requirement in the sign code preven ng the proposed request. Mr. Bob Grootwassi , representing Weis Asset Management, Inc. , stated that the isting pylon sign will be used by two tenants, Pet Food Wareho e and Stone Fabrics. Mr. Rindsig stated that all those who are current ndholders were given the opportunity to hold on to their bonds. He stated that if they did nothing, in effect they sold their onds back to the trustee. He stated that the bonds will be res ctured and resold to a single bondholder, and there has be a new disclosure document prepared. Councilman Billings asked what inter st rate the current bondholders have received. Mr. Rindsig stated that he believed e interest rate was 6-3/8 percent. Councilman Billings asked what a c mpetitive interest rate was in the municipal bond and industrial revenue bond market. Ms. Cleo Rasmussen, representi Miller and Schroder stated that based on a AA-3 rate, an inte est rate of 6-1/4 percent could be expected when the bonds are fered for a three-year period. Councilman Schneider asked if the bondholders received all their money back with interest. Mr. Rindsig stated that all the interest has been paid as it has accrued. He stated that there will be a payment due on September 1, 1991. Councilwoman Jorgen n asked what would happen if Council decided not to proceed. Mr. Rindsig stat that none of the current bondholders will hold the bonds becau e they opted to sell them to the trustee. He stated that if ouncil does not adopt the resolution there may be a default of e bonds, foreclosure of the project, and the bank would become e owner of the property. Mayor Nee s ated there is some indication that the taxes will be paid out o the proceeds. Mr. Rinds 'g stated there is new financing that will be used to pay back tax s so everything will be current as of September 1, 1991 with th new changes to the documents. He stated Mr. Jim O'Meara has ma e it clear that this would happen, and the documents will provi for payment of any back taxes due. FIRST READING OF AN INTERIM ORDINANCE PLACING A MORATORIUM ON THE ISSUANCE OF SPECIAL USE PERMITS FOR EXTERIOR STORAGE OF MATERIALS AND EOUIPMENT AND ROCK CRUSHING ACTIVITIES IN THE M-1, LIGHT INDUSTRIAL, AND M-2 HEAVY INDUSTRIAL ZONING DISTRICTS, AND PROHIBITING THEIR LOCATION WITHIN THE CITY WHILE THE MORATORIUM IS IN EFFECT: Ms. Dacy stated that Council has had a long-term concern for industrial uses that have extensive outdoor activities such as junkyards, trucking terminals, rock crushing operations, construction yards, etc. She stated that the proposed ordinance would establish a moratorium on new development of their uses and the issuance of special use permits for outdoor storage of equipment and material. She; stated that the purpose of a moratorium is so that staff �an conduct a zoning study of the extent and impact of outdoor 'intensive uses that are now located within the City of Fridley.;' She stated that the study is-intended to determine whether th�� City should create a separate zoning district for these types�'of uses. She stated that by creating the zoning district, the Iarroperty owner would have to file a zoning application instead fa'f a special use permit application. % Ms. Dacy stated hat according to the ordinance, the Planning Commission must onsider an ordinance amendment within sixty days of the date of doption of the interim ordinance. She stated that they hope to ave a first draft of an M-3 industrial district at a Planning ommission meeting in November. FRIDLEY CITY COUNCIL MEETING OF SEPTEMBER 9, 1991 PAGE 5 Mr. Lundgren stated that the neighbors have been extremely tolerant of the bus company as it has infringed on the neighborhood�-over the years. He stated that the increased number of buses ha� been tolerated, but now with the destruction of the buffer, the neighborhood is saying: "It must stop. They have been pushed too far. " He stated that the neighborhood would like City, Council to act on four requests: (1. ) To issue an injunction,-%against the Fridley Bus Company which prohibits any further work ,on the outside storage area until the issues regarding the stipulations are resolved; (2. ) To direct the City Manager, staf�, and the City Attorney, to enforce all the 1973 stipulations,,; specifically, the indoor storage of all buses and the restoratiort of the green area buffer with mature 15 to 20 foot evergreens, ,:�.f that is required. If these stipulations are not enforced, �tTiat affect does City Council actions have in the future? How c�an they, as residents, trust that future Councils will uphold ,�he actions the Council takes today? (3. ) There was supposed t�b be a special use permit on the Council agenda which was withdr�wn by Mr. Voigt. He urged each Councilmember to obtain and study the minutes of the August 21, 1991, Planning Commis on meeting, including the petition filed by the neighbors. There are about sixteen to seventeen pages dealing with his item alone. (4. ) The neighborhood would like to be in uded as a regular agenda item at the next City Council meetin to discuss this with a formal dialogue. Mayor Nee stated that he nd the Councilmembers have read the August 21, 1991, Planning ommission minutes. He stated that staff has been doing a lot of ork on this issue. He stated that it was hard for Council to re ond to the neighborhood at this point. He asked if work is st' 1 being done by Mr. Voigt on the outdoor storage area. Mr. Lundgren sta ed that since the Planning Commission meeting, Mr. Voigt has c mpleted the fencing, including the gate, and has added curbing alongside the building. He stated that the neighborhood s concerned that he is going to asphalt the storage area which ould make it more difficult for the City to approach him. He ated that tonight the neighborhood just wanted to gain Council ' attention and make sure they were aware of the situation. Mayor Nee stated that Mr. Lundgren had raised some very good poi s.
