RE: First Notice of Noncompliance at 1660 Mississippi Street N.E.
Dear Mr. and Mrs. Olson:
The City of Fridley has established a City Code for the purpose of
promoting a pleasant and attractive suburban envirorunent. A recent
inspection of the property at 1660 Mississippi Street N.E. revealed
that not all Code requirements are presently being met. Listed
below are items which do not comply with the City Code:
l. Observed vehicle (LAZ-168) with expired registration parked
on property. Fridley City code requires that all vehicles
must be currently licensed and street operable, or stored in
an enclosed structure.
2 . Discontinue outside storage of tractor and assorted materials
located near tractor on west side of property.
3. Observed several vehicles parked on grass along west side of
property. Fridley City Code requires that all vehicles must
be kept on a hard surface parking area. Please move these
vehicles into your driveway area.
Your prompt attention in correcting this situation would greatly
assist us in helping make Fridley a better place to live. An
inspection will be conducted on or about July 30, 1990, to
determine compliance.

Request
The petitioners request that Lot 1, Auditor's Subdivision No. 22
be split into two parcels. The request is for 1660 and 1668
Mississippi Street N.E.
Site
Located on the parcel are two single family homes built in 1962 and
1963 . The petitioners live at 1660 Mississippi Street, while
renting the house at 1668 Mississippi Street. If the lot split is
approved, the petitioners will sell the house at 1668 Mississippi
Street to the current tenants.
The property is located on the east border of Fridley, north of
Harris Pond and south of Mississippi Street. The property is zoned
R-1, Single Family Dwelling and there is additional R-1 zoning to
the north. Harris Park is located to the west of the subject
parcel.
Analysis
Staff reviewed the address file for the subject parcel to determine
how two houses were constructed on one lot. Contained in the
address file is the original building permit for the house at 1668
Mississippi Street only. Staff researched the utilities and
determined that the property was assessed for one sewer and water
lateral; however, the petitioner has indicated that each property
has its own sewer and water service. The Utility Billing
Department is billing each resident separately for sewer and water.
The proposed lots will meet the minimum requirements for lot area,
structure setbacks, and lot coverage. There will be no adverse
impacts to surrounding areas if the lot split is approved.
Recommendation and Stipulations
Staff recommends that the Planning Commission recommend approval
of the lot split request, L.S. #91-04, to split Lot 1, Auditor's
Subdivision No. 22 into two parcels.
Planning Commission Action
The Planning Commission voted unanimously to recommend approval of
the request to the City Council. •
City Council Recommendation
Staff recommends that the City Council concur with the Planning
Commission action.

Ms. McPherson stated this property is located on the eastern border
of Fridley bordering New Brighton, north of Harris Pond, and east
of Harris Park. The property is zoned R-1, Single Family Dwelling,
and there is R-1 zoning to the north, south, east, and west.
Ms. McPherson stated that currently located on the lot are two
single family homes built in 1962 and 1963. The petitioners live
at the home addressed 1660 Mississippi Street and rent the adjacent
house at 1668 Mississippi Street. If the lot split is approved by
the Council, the petitioners will be selling the house to their
current tenants.
Ms. McPherson stated staff has reviewed the address file for the
- subject parcel to determine how two houses were constructed on the
same lot. There was nothing in the file to tell them how this
occurred. Staff also researched the utilities to determine if each
home was serviced separately for sewer and water. The files in the
Assessing Department indicated that the property was assessed for
one sewer and water lateral; however, the City has been billing the
houses separately for both sewer and water. The real estate agent
has indicated that the property owner believes both homes have
their own sewer and water services.
Ms. McPherson stated the new lots meet the minimum requirements for
lot area, structure setbacks, and lot coverage. There will be no
adverse impacts to surrounding properties if the lot split is
approved.
Ms. McPherson stated staff is recommending that the Planning
Commission recommend approval of the lot split.
Mr. Kondrick asl�ed how they can be assured that both houses have �
sewer and water services.
Ms. McPherson stated they could have the Sewer and Water Department
field verify that each house has its own sewer and water service.
Mark Winson, Assistant Public Works Director, has stated that the
as-builts for this particular stretch of Mississippi Street seem
to indicate that there are two sewer and water services, one for
each dwelling.
Mr. Kondrick stated that if the lot split is approved and they find
out there is only one sewer and water hook-up for both homes, when
there is a problem, who is responsible for the cost of repairs?
Ms. Dacy stated that if the problem is from the property line in,
then it is the property owner's responsibility. If it is in the
right-of-way, then it is the City's responsibility. If both homes

are sharing the same service, then the property owners would have -
to work that out.
Mr. Kondrick stated they need to be assured that both houses have
sewer and water services.
Mr. Clarence Olson, 1660 Mississippi Street, stated there are
definitely two sewer and water hook-ups to both houses. Both lines
come out straight from the center of each house out to the street.
Mr. Olson stated they built the first house at 1668 Mississippi
Street in 1962. In 1963, they decided to build another house (1660
Mississippi Street) , and a building permit was issued by the City.

Ms. Dacy, Community Development Director, stated that this parcel
is located on the eastern border of Fridley bordering New Brighton,
north of Harris Pond and east of Harris Park. She stated that the
owner wishes to .split this parcel into two lots. She stated that
the parcels do meet the requirements of the zoning district.
Ms. Dacy stated that the Planning Commission has recommended
approval of this lot split; and if it is approved, it is
recommended the resolution be adopted so that the split can be
recorded at the County.
Councilman Schneider stated that he does not have a problem with
the lot split, but he noticed there were a number of vehicles
parked along the side of Mr. Olson's home.
Mr. Olson stated that he has a plumbing business, that he has
several trucks and that the -bobcat on the premises has been used
for clearing snow.
Councilman Schneider asked if these vehicles could be shielded from
public view.
Ms. Dacy stated that it is unusual to find a bobcat parked in a
residential area. She stated that in an R-1 zoning district, if
there is exterior storage, it has to be screened from the public
right-of-way.
Councilman Schneider stated that he would like staff to check into
this further to see if something could be worked out with the
property owner.
MOTION by Councilman Schneider to table this item to the next
meeting, to direct staff to work with the property owner to
determine if there are any violations relating to equipment
storage, and attempt to come up with a plan to eliminate these _
problems. Seconded by Councilman Fitzpatrick. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.

Dear Mr. Olson:
The City Council tabled your request for a lot split, L.S. #91-04, pending
the correction of 2oning code violations at 1660 Mississippi Street N.E.
Steven Barg, Code Enforcement Officer, and I inspected the property on
January 8, 1992, and observed the following violations:
l. Storage of a bobcat on a trailer along the west side of the
dwelling.
2. Storage of three vehicles: dark blue Buick, license #285-DTJ; blue
truck, license #071-DRT; and a white van. We were unable to see
the license plate on the van.
Storage of the three vehicles is permitted, provided they are currently
licensed and street operable. The Buick has expired tabs as of September
1990. Please bring the tabs up to date or remove the car.
Storage of the bobcat and trailer is only permitted if they are screened from
the public right-of-way. Your options for these items are as follows:
remove them, construct a screening fence not to exceed 7 feet in height, or
construct a second accessory building. A special use permit will be required
if the second accessory building is over 240 sq. ft.
Please rectify these zoning code violations prior to January 21, 1992 . An
inspection of the property will occur at that time. Once the zoning code
violations are rectified, I will schedule final approval of your lot split
request. Hopefully, this can be accomplished at the January 27, 1992,
Council meeting.

SUBJECT: Lot Split, L.S. #91-04 , by Clarence and Agnetha
Olson; 1660 and 1668 Mississippi Street N.E.
Per City Council direction from the January 6, 1992 meeting, Steve
Barg, Code Enforcement Officer, and I inspected the above
referenced property on January 8, 1992 . The attached code
enforcement letter requesting removal of several items was sent to
Mr. Olson. We reinspected the property on January 21, 1992 , and
observed that the bobcat had been relocated to the rear of the lot
where it can not be seen from the public right-of-way. The
remaining items include a boat on a trailer, a stack of firewood,
the trailer for the bobcat, a light blue Ford truck, and dark blue
utility truck. All are permitted within the zoning code as they
are currently licensed, street operable, and parked in the side
yard.
As the petitioner has complied with the ordinance, staff recommends
that the City Council approve the attached resolution approving the
lot split.

Councilman Schneider stated that he felt uneas with the way things
happened; however, from the City's standp 'nt, there will be an
occupied building and more jobs in the co unity.
� Mr. Schmidt stated that in attending eetings he hears a phrase
that bothers him and that is the p ase "free" Federal or State
dollars and, in this case, he be ieves someone felt there was
"free" State monies.
Councilman Billings stated th there were a number of jobs to be
created in the first year a more to be created in the second and
third years. He stated th he also shares Mr. Schmidt's concern,
and it is difficult to elieve that the management of McGlynn
Bakeries, possibly not r. Rasmussen per se, but the owners and
stockholders did not ow this was happening. He stated that his
personal opinion is that they perpetrated a fraud. Councilman
Billings stated th if Grand Met's history repeats itself and they
move the jobs out of Eden Prairie and Chanhassen, he felt the seven
county metropol 'tan area will suffer to a greater degree than the
City will ben it.

Councilman Billings stated that with the e ctment of the

beneficial to have a report from staff on how he City conforms to

Ms. Dacy, Community Development Dir ctor, stated that staff is
currently working on these issu s and could supply further
information to Council.
Councilman Billings stated at when he attended the National
League of Cities meeting brought back a tape for staff to
review, and he also state that there is a book published by the
National League of Citi covering this issue.
Ms. Dacy stated th the American Institute of Architects is
holding a seminar and staff will be attending and purchasing a
guide book on th National Disabilities Act.

PARCELS
WHEREAS, the City Council approved a lot split at the January 27,
1992 meeting; and
WHEREAS, such approval was to split a lot into two separate
parcels, as follows:
Parcel A
The west 170.06 feet of the north 250 feet of Lot 1, Auditor's
Subdivision No. 22, Anoka County, Minnesota. Subject to roads and
easements of record.
Parcel B
Except the west 170.06 feet of the north 250 feet of Lot 1,
Auditor's Subdivision No. 22, Anoka County, Minnesota. Subject to
roads and easements of record.
This property is generally located at 1660 and 1668 Mississippi
Street N.E.
WHEREAS, the City has received the required Certificate of Survey
from the owner; and
WHEREAS, such approval will split a lot into two separate parcels.
NOW, THEREFORE, BE IT RESOLVED, that the City Council directs the
petitioner to record this lot split at Anoka County within six
months of this approval or else such approval shall be null and
void.

Councilman Schneider stated that he felt uneasy with -l4e way things
happened; however, from the City's standpoint,. t re will be an
occupied building and more jobs in the communit�.
' Mr. Schmidt stated that in attending meetiryc�s he hears a phrase
that bothers him and that is the phrase " ree" Federal or State
dollars and, in this case, he believes someone felt there was
"free" State monies. %

. Councilman Billings stated that th��e were a number of jobs to be
created in the first year and mor to be created in the second and
third years. He stated that he lso shares Mr. Schmidt's concern,
and it is difficult to beli e that the management of McGlynn
Bakeries, possibly not Mr. asmussen per se, but the owners and
stockholders did not know his was happening. He stated that his
personal opinion is tha they perpetrated a fraud. Councilnian
Billings stated that if rand Met's history repeats itself and they
move the j obs out of en Prairie and Chanhassen, he felt the seven
county metropolitan area will suffer to a greater degree than the
City will benefit

Mr. B ns, City Manager, stated the main change is that this
ordi nce would reduce the waiting period for disability benefits.
MO ION by Councilman Schneider to waive the reading and adopt
dinance No. 9S5 on the second reading and order publication.

Seconded by Councilman Billings. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
Ms. Dacy, Community Development Director, stated that Council
tabled this item on January 6, as they had concerns regarding the
amount and type of outdoor storage on this parcel. She stated that
staff has been working with Mr. and Mrs. Olson to resolve the code

violations. She stated that a boat and firewood are being stored �
in the side yard, and the bobcat is stored in the garage.
Ms. Dacy st�ted that staff is recommending approval of this lot
split and adoption of the resolution.
MOTION by Councilman Schneider to adopt Resolution No. 12-1992.
Seconded by Counci�man Billings. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
NEW BUSINESS-
3 . APPOINT CITY REPRESENTATIVE TO THE NATIONAL ORGANIZATION ON
DISABILITY•
MOTION by Councilman Schneider to re-appoint Roger Blohm to th�'
National Organization on Disability. Seconded by Council 'an
Billings. Upon a voice vote, all voting aye, Mayor Nee de ared
the motion carried unanimously. � ,�
Councilman Billings stated that with the enactm�rit of the
: Disabilities Act taking effect today it, probabiy would be
beneficial to have a report from staff on how the City conforms to
these requirements. He suggested that this re�ort be presented
under Informal Status Reports at a Council me��ing.

Ms. Dacy, Community Development Director stated that staff is
currently working on these issues a could supply further
information to Council. ;'
Councilman Billings stated that �0hen he attended the National
League of Cities meeting he b ought back a tape for staff to
review, and he also stated th there is a book published by the
National League of Cities co ering this issue.
Ms. Dacy stated that t e American Institute of Architects is
holding a seminar, and staff will be attending and purchasing a
guide book on the Nat�onal Disabilities Act.
