The City of Fridley Planning Commission will be holding an informal
hearing on a request for a lot split, L.S. #91-01, by Charles
Seykora, to split off that part of Lot 6, Block 5, Pearson's
Craigway Estates 2nd Addition, Anoka County, Minnesota, which lies
southeasterly of a line 3.5 feet northwesterly of and parallel with

letter, please f ind 1 ) a cop,v of a survey of Lot 6 and part of
Lot 7 , Block 5 , PEARSON' S CRAIGWAY ESTATES 2nd ADDITION, 2 ) a copy
of a portion of the half-section map showin� these two parcels of
property, 3 ) a copv of a deed from Charles E. LaRue and Pamela M.
LaRue to John T. Meador and Collene D. Meador, and 4 ) a check for
$100 .00 for the lot split application fee.
By a review of the survey, you can see that the sidewalk of the
Meadors encroaches slightly onto the property of the LaRues
( Lot 6 ) . To correct this encroachment problem, the LaRues a�reed
to sell to the Meadors a 3-1/2 foot strip of their lot along the
southeasterly boundary line .
The deed from Charles E. LaRue and Pamela M. LaRue to John T.
Meador and Collene D. Meador is for a 3-1/2 foot strip of Lot 6.
The legal description used in this deed has been approved by the
Anoka County Registrar of Titles as correct , and is a simple
fractional le�al description as required in Minnesota Statutes
Section 508 . 47 , subd. 2 , so that a registered land survey is not
necessary to record this quit claim deed.

To split off that part of Lot 6, Block 5, Pearson's Craigway '
Estates 2nd Addition, Anoka County, Minnesota, which lies
southeasterly of a line 3.5 feet northwesterly of and parallel
with the southeast line of said Lot 6, and combine it with Lot
7, generally located at 7836 and 7830 Alden Way N.E.
Ms. McPherson stated the petitioner is proposing to split 3.5
feet of Lot 6 to combine it with Lot 7, Block 5, Pearson's
Craigway Estates 2nd Addition, the same being 7836 and 7830
Alden Way. Both properties are zoned R-1, Single Family
Dwelling, and abut the Mississippi River bluff line and
overlook Riverview Heights Park and the Mississippi River to
the west.
Ms. McPherson stated the proposed lot split is to correct an
encroachment of a sidewalk from Lot 7 onto Lot 6. The 3 .5
feet will not adversely impact either lot regarding lot width
or lot area.
Ms. McPherson stated staff recommends that the Planning
Commission recommend to City Council approval of the lot split
with one stipulation:
1. The portion to be split shall be combined with Lot
7 and expressed on one tax statement.
Mr. Charles Seykora stated he does not own either property.
He is an attorney retained by Universal Title Insurance
Company, because Mr. John Meador's sidewalk encroached onto
the property next door. He is representing Mr. Meador (7830
Alden Way) to try to correct his encroachment problem. Staff
has made a very good analysis of what is involved.
MOTION by Ms. Sherek, seconded by Mr. Saba, to recommend to
City Council approval of lot split, L.S. #91-01, by Charles
Seykora, to split off that part of Lot 6, Block 5, Pearson's
Craigway Estates 2nd Addition, Anoka County, Minnesota, which

Request
The petitioner is proposing to split 3 .5 feet of Lot 6 to combine
it with Lot 7, Block 5, Pearson's Craigway Estates 2nd Addition,
the same being 7836 and 7830 Alden Way N.E.
Site
Both lots have single family dwelling units located on the parcels.
The lots are located along the Mississippi River bluff line and
overlook the Riverview Heights park and the Mississippi River to
the west. The properties are zoned R-1, Single Family Dwelling as
are the parcels to the north, south and east. Riverview Heights
Park is zoned P, Public.
Analysis
The proposed lot split is relatively minor and will not create nor
eliminate any lots. The purpose of the lot split is to rectify an
encroachment of a sidewalk from Lot 7 onto Lot 6, Block 5,
Pearson's Craigway Estates 2nd Addition. Both lots have a width
of 100 feet and lot areas of approximately 21, 000 square feet. The
proposed lot split will not adversely impact either lot nor will
it impact surrounding lots. The new legal description should be
described on one tax statement.
Recommendation
Staff recommends that the Planning Commission recommend approval
of the proposed lot split, L.S. #91-01, to split 3.5 feet of Lot
6, Block 5, and combine it with Lot 7, Block 5, Pearson's Craigway
Estates 2nd Addition, with the following stipulation:
1. The portion to be split shall be combined with Lot 7 and
expressed on one tax statement.
Planning Commission Action
The Planning Commission voted unanimously to recommend approval of

area is proposed in the back to store vehicles.

Councilwoman Jorgenson asked how long ABRA anticipated vehicle
would be in the storage area.
Mr. Benson stated that ABRA normally schedules and ompletes the
work on the same day. He stated that the delay ay happen when
parts sometimes are not available. He stated at the longest a
vehicle has stayed on the property is for two eeks.
Councilwoman Jorgenson asked if it was nticipated that this
storage area would need to be expanded i several years.
Mr. Benson stated that ABRA's long-r ge business plan is not to
expand the building but to constru other ABRA facilities. He
stated that other facilities have cently been constructed in Coon
Rapids and Maplewood.
MOTION by Councilman Billin to concur with the recommendation of
the Planning Commission a d grant Special Use Permit, SP #91-03,
with the following stip ations: (1) The expanded parking area
shall be paved and ned with curbing; (2) A six foot high
screening fence shal be constructed to enclose the storage area;
(3) Stipulation No 9 from SP #87-i1 to enclose the dumpster shall
be completed; a (4) A performance bond in the amount of 10
percent of the nstruction costs of the outdoor improvements shall
be issued to e City. Seconded by Councilwoman Jorgenson. Upon
a voice vot , all voting aye, Mayor Nee declared the motion carried
unanimous .
Counci oman Jorgenson stated that there is a letter to Steve
Weis berg, Manager of ABRA, dated November 19, 1990 which refers
to he date of July 6, 1990 as when the Council issued SP #87-11

Mr. Hunt Assistant to the City Manager, stated that recently OSHA
require cities and other employers to assess the risk to their
emplo es on the contraction of Hepatitis B. He stated that for

Mr. Hunt stated that last December the City of Bloomingto offered
the services of their Health Department to co uct the
immunizations. He stated that they buy the vaccin from the
Federal government and take care of the immunization at various
clinics throughout the metropolitan area. He stated hat the cost
would be $140 per person. He stated that in ord r for them to
administer the vaccine the City of Bloomington wan�s a contract to
hold them harmless. He stated that he would recopdmend the Council
approve the agreement for these immunizations.
MOTION by Councilwoman Jorgenson to authori the City to enter
into this agreement with the City of Bloomin on for administering
Hepatitis B immunizations. Seconded by Cou ilman Schneider. Upon
a voice vote, all voting aye, Mayor Nee dec ared the motion carried

area is proposed in the back to store vehicles.
Councilwoman Jorgenson asked how long ABRA antic' ated a vehicle
would be in the storage area.
Mr. Benson stated that ABRA normally schedul and completes the
work on the same day. He stated that the elay may happen when
parts sometimes are not available. He st ed that the longest a
vehicle has stayed on the property is fo two weeks.
Councilwoman Jorgenson asked if i was anticipated that this
storage area would need to be expa ed in several years.
Mr. Benson stated that ABRA's ng-range business plan is not to
expand the building but to c struct other ABRA facilities. He
stated that other facilities ave recently been constructed in Coon
Rapids and Maplewood.
MOTION by Councilman Bi ings to concur with the recommendation of
the Planning Commissi and grant Special Use Permit, SP #91-03,
with the following tipulations: (1) The expanded parking area
shall be paved a d lined with curbing; (2) A six foot high
screening fence all be constructed to enclose the storage area;
(3) Stipulation o. 9 from SP #87-11 to enclose the dumpster shall
be completed; and (4) A performance bond in the amount of 10
percent of t construction costs of the outdoor improvements shall
be issued the City. Seconded by Councilwoman Jorgenson. Upon
a voice v e, all voting aye, Mayor Nee declared the motion carried
unanimo ly.
Counc' woman Jorgenson stated that there is a letter to Steve
Wei nberg, Manager of ABRA, dated November 19, 1990 which refers
to the date of July 6, 1990 as when the Council issued SP #87-11

staff's recommendation that the variance for the xisting condition
be approved, but to deny the variance for th proposed addition.
Ms. Dacy stated that the Appeals Commission recommended approval
of both variance requests.
