The Special Use Permit process begins by filling out a SPECIAL USE PERMIT APPLIC ON. This,
with a site plcm, and other appropriate drawings, must be submitted to the Plcmning st f. A fee is
associated with the application; $100 for second accessory building applications, $40 for all other
applications. Fees c�e non-refur�dablz.
Once the app�ication is received, the crpplication is rev:ewed by staff from the Plcmnin ,
Engineering, Assessing, Fire, cmd Police Depcu�tments. The impacts to adjacent pro rties c�e
discussed, cmd stipulations c�e developed. Simultcmeously, a mcriling list of all prope 'es within a
350 foot radius of the properly is genercrted. Notices of the request cu�e sent to these p operty
owners. There is approximately four weeks between the czpplication due date cmd the Plcmning
Commission meeting. -
Prior to the meeting of the Plcmning Commission, a stc�f-report is written, cmd the peti ' ner calied
regcading the stc�f recommendation.
The Plcmning Commission is made up of seven residents of the community. The mee ' gs cnre held
the first cmd third Wednesdays of the month at 7:30 pm in the Council Chcunbers in th Municipal
� Center. The Pl�ning Commission is cm advisory comrrussion to the City Council. It is the
responsibility of the Plcmning Commission to conduct a public hecu�ing, gather testimo y cmd make
cx recommendation to the City Council regcsding all special use permit rec�:ests.

Mr. Mayor,
We live at 1400 - 64th Ave. NE and are writing to express our concern regarding one of
our neighbors' plans. Jesse Collard, who lives to the east of us at 1426 - 64th, is
requesting permission to build a new structure on his property. As this building would
abut up against our property, we would like to voice our objections for the record.
Our objections are in three areas: size, placement and usage. The structure as planned
is approximately 900 square feet in size. The location of this would be very close to our
property line and in a direct line of site from our 4-season sun porch. This building
would actually be larger than Mr. Collard's house with connecting garage. As he stated
at the recent hearing, his structure would be used as a storage unit for several large
items in his yard, i.e. a boat, three-wheeler, etc. He has also stated that it will NOT be
used as a garage for his cars or even on a day-to-day basis, thus exempting the need
for a paved driveway leading to the unit. Currently, his car and truck do not fit in his
attached garage and so they are always in his existing driveway.
We have lived in Fridley for 30 years and always on our current site. Over the course of
time, we have seen many changes in our neighborhood. Sixty-fourth avenue has grown
in number of houses, and new families continue to come and go, the Collards among
the most recent arrivals. Over half of the neighbors have lived here for as long as we
have. Most of us know each other and say hello on a regular basis. The addition of
new families however, has also seen the addition of more and more vehicles; cars,
trucks, boats, and RV's. We have been told by realtors that because of the way our
street looks with all the vehicles and additional structures, our property values are LESS
than the houses on Arthur St. which is the cross street to the east of 64"' and less than
one block away.

Now, we have yet another buiiding of enormous size being put up next to us. it won't
even be obscured by trees or shrubs. It WILL be in plain sight of us at all times as most
of our windows face that side of the house. This is not acceptable, from our point of
view and the view of other neighbors on this side of the street.
We would like to offer a compromise to this situation. Mr. Collard's structure could be
built on the west side and rear half of his lot. This would place it behind a line of trees
and out of sight of both street and neighbors. Since there is no need for a driveway, or
day-to-day usage, there should be no additional cost or inconvenience. At the least, we
believe that some kind of natural landscaping, such as trees or shrubs, should be done
along the property line to help hide the proposed structure.

Ms. Stromberg stated staff recommends approval of this special use permit with stipulations as
second accessory buildings over 240 square feet are a permitted special use in the R-1 zoning
district. If the special use permit is granted, staff recommends the following stipulations:
1. The petitioner shall install Code-required hard surface driveway extension witf���
12 months of issuance of the building permit.
2. The petitioner shall obtain all necessary building permits prior to construction.
3. The structure shall not be used for a home occupation or living area.
4. All vehicles shall be stored on a hard surface as approved by the City.
5. Total square footage of all accessory structure must not exceed 1,400 square

Mr. Kondrick asked how much time does the City normally allow for somebody to make a
garage or house compatible with each other?
Ms. Stromberg stated it all depends on the situation and how comparabie the new garag� is
going to be with the existing home. The petitioner had stated in his letter to the City that e
wants to re-side the house and put in new windows when funds allow him to do that. Sh
guessed she could check with the petitioner as to the color of the proposed garage and s e how
comparable it is and then come up with a timeline. '
Mr. Kuechle stated his concern is, and he believed the City's as well, that these additiona
accessory buildings don't downgrade the house.
Ms. Savage asked Ms. Stromberg whether she had received any phone calls from neigh ors or
anyone nearby. �
Ms. Stromberg replied, no.
Mr. Jesse Collard, 1426 —64�h Avenue NE, stated as far as the siding goes he guessed e
would just have to go with whatever timeline the City gives him. He needs a garage, bec use of
all the clutter in his yard.
Mr. Collard stated the ainted the house last ear, and the were oin to o with a col�r that

was compatible with that color— probably a tan — if it's too far off, he would be willing to aint it
again as he doesn't want to live with an eyesore either. He would appreciate a little bit o time
for new windows and siding. He wouldn't like to get a big debt; he likes to pay for things s he
does them.
Ms. Savage asked the petitioner whether he had any problems with the stipulations.
Mr. Collard stated the only stipulation he has a problem with is #1 regarding the drivewa . He
wasn't planning on parking any vehicles in the new garage right now, and his neighbor ju t built
a garage across the street and he doesn't have a driveway to his. Right now, he would se the
garage for lawnmowers, boats, and storing things, instead of parking his vehicle in it eve day.
Eventually he would probably like to put vehicles in there and at that time he would put i a
driveway. He believed his neighbors had a stipulation for their garage addition that they id not
need to put in a driveway until there is any sign of the grass being worn. '
Ms. Stromberg stated that in the past, staff has put a specific stipulation on special use ermits,
where the petitioner is requesting not to do the driveway at this time, stating that staff wil
inspect the property and, if they notice that it appears that a trail is going to the proposed garage
and they are using it as a driveway, staff will require them to install a hard surface drive ay
within 90 days. That is something they have done in the past two years. If the Commis�ioners
would like to change stipulation #1 to say that, that would be fine. �
Ms. Savage stated the petitioner cannot park any vehicles on the grass.

Ms. Stromberg stated that is correct. He can park vehicies in the proposed accessory structure
but not on a regular basis.
Mr. Collard stated if he did park a vehicle in that garage, he wouid not be taking it in and out ali
the time. It would be to get the vehicle off the slab he has in his backyard.
Ms. Johns asked if the main purpose for this accessory structure right now is for storage.
Mr. Collard stated that is right.
Ms. Savage asked the petitioner that he unCerstands of course if the situation changes, and he
is using it as a driveway or he is parking vehicles on the grass, then he needs to have the hard
surface.
Mr. Collard stated he understand.
Mr. Kondrick stated he wants to make sure that the petitioner coordinates the color of the
garage with the house.

INTRODUCTION
Jesse Collard is seeking a special use permit to allow the construction of a 994 square

PLANNING COMMISSION RECOMMENDATION
At the July 16, 2003, Planning Commission meeting, a public hearing was held for SP#03-
12. During the public hearing, the petitioner requested to have stipulation#1 changed
regarding requiring a hard surface driveway because he strictly plans to use the proposed
structure for storage. The Planning Commission recommended approval of special use
permit, SP#03-12, with a change to stipulations#1 to read, "Staff shall conduct regular
inspections of the site. If, at any time, a trail simulating a driveway is present, a hard

to the variance request, which should alleviate he nei�hbors' concerns. I

this in 2002, the survey did not show a street behind. Lat inspection revealed that ther� was a
double frontaQe, and by then they had the slab poured d the structure basically up.� Staff
recommended approval with five stipulations.

�Ir. Hickok stated one difference �vas based on the size. On a sin`lz-familv residential site y�ou
cannot eYceed the tirst floor area of the home �tiith a first accessory structure. They are very
careh.il to note that. In this particular case, the principal structure was 1,007 square feet. The
attached �araQe was relatively small. The second accessory structure w-as going to be 994 square
feet. In this case. no accessory structure was exceedinQ the first floor area of the home. The
combination of the t��-o cannot esceed 1.=�00 square feet and they are belo�v that. Re�ardina the
term "accessory structure." all of the thinas mentioned are under the umbrella of the accessory
structure in the Code. Thev are not treated anv different. An accessorv structure mav not have
an overhead aara�,e door or Qate doors. Even an attached garaae w�as an accessory to the
principal use of that lot, which was the sinale-family home. �
Councilmember Bolkcom asked �vhat ���ould happen if a;aza��e was turned into living space.
Mr. Hickok said that happened quite often. If the detached �ara�e became livinQ space that
�vould be a problem. Only one principal structure �vas allo�ved on a single-family residential
site.
Councilmember Bolkcom asked if her attached garaje became her livin� space and her
accessory structure became her garage, would it change where it was placed?
Mr. Hickok stated if that happened, it �vould allow more living space to compare against the
garage. In no case can a sinale garaae erceed 1,000 square feet. It could free up what was
considered an accessory structure, make it a principal structure, and instead of 994 square feet,
they could take that up to 1,400 square feet.

second storaQe building. In the future, he �r�ould like to utilize the aara�e he had and convert it

On Monday, July 28, 2003, the Fridley City Council afficially approved your request for a
Special Use Permit, SP #03-12, to allow for the construction of a second accessory
structure (garage), legally described as Lot 7, Block 2, Springvalley, generally located at
1426-64"'Avenue NE.
Approval of this special use permit is contingent upon the following stipulations:
1. Staff shall conduct regular inspections of the site. If, at any time, a trail
simulating a driveway is present, a hard surface driveway as approved by the
City will need to be installed within 90 days.
2. Petitioner shall obtain all necessary permits prior to constructior�.
3. The structure shall not be used for a home occupation or iiving area.
4. All vehicles shalf be stored on a hard surFace as approved by the City.

construction of a 994-square foot accessory structure in the side yard of the residence at 1426 —

i�1r. Hickok stated the City Code required a special use permit to allow accessory building , other
than the first accessory buildin� over 240 square feet. The total square footage of the ac essory
structures shall not exceed 1,�00 square feet. The total square footage of the existing g abe is
?4� square feet. The total square footage of the proposed accessory structure is 994 squ e feet.
The total of the two structures would be 1,239 square feet, which w�as 161 square feet le s than
the Code allowed. Petitioner has a small storaae shed in the rear yard of his property which
�vould be removed upon completion of the proposed accessorv structure. The proposed arage
location meets all setback and lot coverage requirements. Petitioner has asked if they c move
the structure back rouahly 10 feet. He said they could move it back as close as three fee to the
rear lot line according to the City Code. Ttivo neighborin� property owners had concern about
the placement, size, and use of the structure. It was suggested that �1r. Collard mo' e the
proposed structure further back in his rear yard to provide landscaping between the pr posed
structure and the property line. The petitioner stated he planned to move the struct re an
additional 10 feet to the south. Staff visited the site and saw no problems with tlze st cture
being moved back an additional 10 feet.
Mr. Hickok said the Planning Commission recommended approval of the special use perm t with
seven stipulations. Second accessory buildin�s over 200 square feet are permitted special ses in
the R-1 District. Staff recommended Council's approval with seven stipulations.

one dated July 22, 2003, from Pat Mulroy at 1384 — 64`" Avenue N.E., and the other dat d July

Councilmember Wolfe asked if this was meant to be storage for recreational vehicles.

Councilmember Wolfe stated he found out it was going to be a garage with no hard s rface
going to it.
Mr. Hickok said the building �vas intended for accessory uses, boats on trailers not in use iawn
mowers, that type of thing. The representation was made that a driveway would not be nec ssary
because they would not be utilizing the course back and forth between the garage d the
roadway enough to �vear any sort of path. In similar situations in the past, the Pl nning
Commission and staff have recommended in some circumstances that a driveway not be pl ced.
Councilmember Wolfe asked if he knew it was going to be a garage would the decisio have

Mr. Hickok said it the intent was to use the building as a garave, a driveway �vould be required.
He said it �vas a public nuisance not to have a hard surface driveway, and petitioner was aware of
that. It�the intent changed and thev decided to use the buildin� as a principal jarage, then the
original stipulation should stand that a hard surface drive must be installed within 12 months of
the approval.
Councilmember ��'olfe stated if it �vas Qoin� to be used for storave. it could be put h.irther back
on the property. �
Mr. Hickok stated the City Code �vould not mandate where it needed to go.
Councilmember Bolkcom asked about the difference between an accessory� storage building and
detached garaQe. She asked what would have happened if it was attached.
Mr. Hickok stated one difference �vas based on the size. On a single-family residential site you
cannot exceed the first floor area of the home with a first accessory structure. They are very
careful to note that. In this particular case, the principal structure was 1,007 square feet. The
attached gara�e was relatively small. The second accessory structure was going to be 994 square
feet. In this case, no accessory structure was e�cceeding the first floor area of the home. The
combination of the t�vo cannot eYceed 1,400 square feet and they are below that. Re�arding the
term "accessory structure," all of the things mentioned are tmder the umbrella of the accessory
structure in the Code. They are not treated any different. An accessory structure may not have
an overhead garage door or gate doors. Even an attached gara�e was an accessory to the
principal use of that lot, which was the single-family home.
Councilmember Bolkcom asked what would happen if a garage was turned into living space.
Mr. Hickok said that happened quite often. If the detached garage became living space that
would be a problem. Only one principal structure was allowed on a single-family residential
site.
Councilmember Bolkcom asked if her attached garage became her living space and her
accessory structure became her garage, would it change where it was placed?
Mr. Hickok stated if that happened, it would allow more living space to compare against the
garage. In no case can a single garage exceed 1,000 square feet. It could free up what was
considered an accessory structure, make it a principal structure, and instead of 994 square feet,
they could take that up to 1,400 square feet.
Mr. Jesse Collard, 1426 — 64�h Avenue N.E., said the garage would primarily be used for a
second storage building. In the future, he would like to utilize the garage he had and convert it
into living space at which time he would reroute the driveway to the new garage.
Mr. Mike Zerby, 1400 — 64`�' Avenue N.E., said there was a lot of building there already and if
there was a driveway that went back they were looking at a lot of square footage of wood. It
would have a hu�e impact. Petitioner suggested to him that he put up a fence. He said he was

N1r. Hickok, Community D velopment Director, stated the recognition of this non-conf rmity
�vould allo�v an existinQ shed in the rear yard to remain at its location. He staid the propert �vas
zoned R-1, Sinale-Family r sidential, as were the surrounding properties. The home faced
Madison Street, and Jefferso Wav bordered the property on the west side. Therefor , the
property was considered to h ve double frontage. The City Code required that propertie with
frontaQes on both sides of t eir lot meet front yard setback requirements for garage and
accessory structures located i the rear yard. The petitioners are applying for a vari ce to
recognize the location of the xistin� shed located in their rear yard. The location f the
structure was 7 feet from the st property line instead of the required 34 feet determin d by
setback avera�ina requirements. Setback averabina app(ies when the setback of the neigh ring
home was greater than the minim 1 front setback.y In that case, the setback of the new st cture
can be 6 feet more or less of the a �eraQe depth of the adjacent structures. The minimum se back
was 2� feet by Code. The subjec property �vas �0 feet, and the adjacent garage on the orth
itself was also =�0 feet back. In o er words all three were currently positioned 40 feet ack.
W�hen you added or subtracted 6 fee the setback options were to go to 34 feet from the rib t-of-
way or to stay back 46 from the right of-way. Based on the City Code requir�ments, the 3 foot
minimum setback �vas determined. T petitioner was seeking a variance to reduce the re yard
from 34 feet to 7 feet.
Mr. Hickok stated City staff has heard mments from neighboring property owners who have
had concerns about parking on the gra in the rear yard and the lack of screening long
Jefferson. Staff has also heard from tho neighboring property owners that the petitio er is
running a home occupation from his reside ce and shed. They stated there are electrical t cks
pulling up to the shed and load/unload mater als at all times of the day. Staff added stipul ions
to the variance request, which should alleviate he neighbors' concerns.
N1r. Hickok stated the Appeals Commission rec mmended denial of this variance request d e to
neighboring concerns and lack of hardship. The ppeals Commission recommended that 'f the
variance was �ranted, Stipulation No. 2, the scre ing fence, be changed from 12 months to 6
months.
Mr. Hickok stated the petitioner's fence had an openi near the southern garage wall, an that
was where the neighbors saw trucks pulling in and park g where there was no hard surface. He
said this was a fairly recent structure. When the petition r received the building permit to uild
this in 2002, the survey did not show a street behind. Lat inspection revealed that there as a
double frontage, and by then they had the slab poured d the structure basically up. taff
recommended approval with five stipulations.
Councilmember Bolkcom asked how come they did not know th street was there.
Mr. Hickok said a number of different building permits come i and they have to us the
information provided on the survey. Most of the time it was correct. this case it was not.
Councilmember Bolkcom stated she drove by petitioner's home and s w two vehicles p ked
neYt to the gara�e. It was totally packed with stuff and there was more 'n the backyard. Her
concern was that it looked like a warehouse and that there was a home occu tion going on.
